Isabel, I believe Germany is one of the few countries that doesn't allow their citizens to hold dual citizenship. Children can hold it, but adults cannot. I.E. if your children are born in US, you can still go back to Germany and declare them as German citizens, you just can't hold dual yourself. Check out wikipedia @ http://en.wikipedia....man_citizenship

Loss of German citizenship
German citizenship is automatically lost when a German citizen voluntarily acquires the citizenship of another country.
The exception is when permission to obtain a foreign citizenship has been applied for and granted in advance of foreign naturalisation. The relevant form is called a Beibehaltungsgenehmigung Details (in German)

Other cases where German citizenship can be lost include:

Persons acquiring German citizenship on the basis of birth in Germany (without a German parent) lose German citizenship automatically at age 23 if they have not successfully applied to retain German citizenship. If it is desired to maintain a foreign citizenship, application must be made by age 21.
A German citizen who voluntarily serves in a foreign army (over and above compulsory military service) from 1 January 2000 may lose German citizenship unless permission is obtained from the German government.
A German child adopted by foreign parents, where the child automatically acquires the nationality of the adoptive parents under the law of the adoptive parents' country. (For example, a German child adopted by Americans prior to February 27, 2001 [the effective date of the Child Citizenship Act of 2000] would not have automatically lost his/her German citizenship, because the child did not automatically acquire United States citizenship by virtue of having been adopted by U.S. citizens.) An exception applies where legal ties to the German parent are maintained.

[edit] Dual citizenship
Although dual citizenship is restricted under German law, it can be held in limited circumstances:

where a child born to German parents acquires another citizenship at birth (e.g based on place of birth, or descent from one parent)
where a German citizen acquires a foreign nationality with the permission of the German government
where a naturalized German citizen, or a child born to non-German parents in Germany, obtains permission to keep their foreign nationality
A senior Social Democratic member Ralf Stegner, who is the interior minister in the regional state of Schleswig-Holstein, has asked the German chancellor to change dual-nationality law to allow dual-nationality to all citizens of Germany. He feels that Germany should allow multi-nationality to integrate many of the Gastarbeiter who live in Germany. [2]

Good Luck! good.gif

great that just sucks. Then I have no clue what I am gonna do.
uff thanks tho smile.gif

Yes he has bee living with me all these 3 years.

As I read this, it does not apply to my case. This seems to pertain IR-3 entrants. Alex.

Is your child in your custody, living in the United States?

If so, then when you become a citizen, your child becomes a citizen automatically, without filing any paperwork, without being inspected by immigration officers, without taking an oath.

Your child isn't eligible to file for citizenship on his own, because he's not old enough. Among other things, he's not considered old enough to sign a contract or take an oath.

See the child citizenship act.

So the child stays as a resident and you become a citizen and in two years... who petitions for him/her? As they cannot petition for themselves before age 18?

I have been a permanent resident for 3 years and I got residency through marriage to a U.S. citizen. My child (now 15) has been here all along. I can now apply for citizenship but he cannot? I do not understand. So I become a US citizen and he does not?

On the citizenship form N400 they want me to list all of my trips outside of the US in the last 5 years. How am I supposed to remember, above all, these dates?

US Citizenship General DiscussionInterview experience, Sacramento office
I passed my interview on Jun 17, in Sacramento. I arrived about 20 min early and was invited in ten minutes before my appointment. The place was relatively empty. The officer, a very nice, older lady, made me raise my right hand and swear I was going to speak the truth; then she read the details of my application back to me, to make sure I had everything written right on my forms. Of all the documents I was asked to bring with me, she only looked at my green card and my drivers’ license. She asked casual questions during the process like “how did you meet your husband?” and “what does your husband do?” and things like that. She also asked me some of the questions on the form, such as “are you a terrorist”, “have you been a member of the communist party”, “have you ever been arrested?” Any “political arrests” in Brazil?” I felt like explaining that there is no such thing in my country but decided to just answer “no”. Then she asked me if I wanted to become a citizen. After I said “yes”, she told me that she was going to let the computer choose “very easy questions”. They were: “who is the commander in chief of the military?”; “name three of the 13 original colonies”; “what party does the president belong to?”; “what are the two political parties in the US?” “Who wrote the constitution?” Then she showed me a piece of paper where it was written “Who elects congress?” and asked me to read it back to her. On another piece of paper, she made me write “the people elect congress”. Then she said that I had passed the test and that she was going to recommend my application for acceptance. She handed me a piece of paper with the details on the oath ceremony. Then she congratulated me for passing the test and invited me out. The whole process did not take 20 minutes.

US Citizenship General DiscussionQuestion on N-600
I got naturalized today and have spent some of the afternoon trying to figure the N-600 form out. On part 3, item 5, they ask when the child entered the US. The instructions are not clear. Does this refer to the the first time the child entered, or the last time?

My son first entered the US in 1996 as a dependent on my F1 visa. Since then, his passport has been renewed several times and the passport numbers have changed. When writing down the passport number, which number I use, the current passport, or the expired passport?

US Citizenship General Discussionevidence of legal custody?
I called both the passport center and the USCIS today to elaborate on this. Customer representatives in both offices I spoke with told me that they are not "allowed to elaborate" on what kinds of evidence are accepted for custody or anything, beyond what is written on the form. The USCIS officer told me that to have my question answered, I should contact "an attorney, a community-based organization or a professional forms preparer"

For those who think they will be treated with more dignity once they become naturalized, I got news for you. :bonk:

I tried to obtain a passport for my son who is now 16 and has lived with me here in the US since 2000, and I got a letter saying that I have to prove that I have "legal custody" of his. His father and I run our divorce in Brazil and it was mutually agreed that I was to have legal custody. Even though I have a copy of the divorce agreement, it is about 8 pages long and somewhere in there it says that I have custody. Would something else suffice? Has anyone there run into the same problem?

Foreign nationals in any country should just follow the damn law. Follow the law and you don't have problems. I am glad this persons' naturalization was denied. I hope he is deported. I don't want to drive on the road thinking he may be there, speaking on his stupid cell phone and speeding. And it sounds like the kind of person who will hit you and run and never appear for a court hearing. Give me a break.

US Citizenship General DiscussionQuestion about N-600 and passport
I posted this question a while ago and no one answered. So I went on and requested a passport for my son together with a request for mine. Mine came within 10 days or so but his came with a request for more info. They wanted proof that I am divorced from his father and proof that I have legal custody of him. Both documents were listed on the N-600 instructions but not on the passport instructions form. I then called their 1-800 number to find out what documents would be acceptable as evidence of custody and I was told "whatever you feel like will do it". Then I called the USCIS asking the same question as pertaining the N-600 and was told that they are not "allowed to tell" anything beyond what is written on the forms' instructions!

I got my 5-page divorce agreement translated (it cost me 150 U$ but one translator in particular wanted 850 U$ so do your research when looking for translators, it pays off!) and sent that as well as a few of my son's report cards with my address on them. Last weekend they called asking for "more evidence" as for example my tax returns with my son listed as a dependent. My husband, who took the call, told them the perils we've been trough with lack of information and they apparently approved the passport on the spot.

I am telling all this for those who have children from a previous marriage and become naturalized, the documentation requested for the N-600 is similar to that required for the passport if you ask the latter first. No shourtcuts. And the need for these documents is apparently not listed on the passport form instructions.

US Citizenship General DiscussionQuestion about N-600 and passport
A child living in the US with a parent becomes a US citizen when the parent does.

If you do and USCIS finds out that the child is not a USC yet(?) then you might cause future problems since the form is for USC only and applying for a passport means you declare you are a US citizen.

I guess my question was, how difficult is to obtain a US passport for a minor child of a naturalized citizen (both living in the US) before a certificate of citizenship is obtained for the child through a N-600?

I have read the instructions on how to obtain a US passport using indirect evidence of citizenship (parent's naturalization certificate included). It is possible and not against the law but I would like to hear about people's success in doing this and whether it was complicated.

now for the oath on the same day as the appointment... i did a lot of reading on other people who had their interview in baltimore, and i would say that at least 90% had the interview and oath on the same day in baltimore. i also googled it, and it said that if your appointment is before 12 then you have the oath the same day. so i was pretty sure i would be sworn in the same day because my appointment was at 10. i also asked my IO when i was there and she said they do same day oath in baltimore unless you have a name change. hope this helped you a little.
