So the answer to the question is NO on the application?

.....and yes you came on a nonimmigrant visa. Nonimmigrant basically means you did not move here with the INTENT to stay here and make this your permanent home. So, yes, lawful (because you were paroled at a POE) nonimmigrant visa it was.

Okay here is the situation

I am a 33 year old permanent resident who is filling out the N 400 form.

I have filled out the questions on N400 until I got to question 33.

I came into the country 1995 on a visitor's visa(is this lawful NONimmigrant?) but I overstayed.

My mother petitioned for me in 2004 and had to pay 1000 fine for overstaying and also it was based on i-485 requirement as well.

I became a permanent resident in 2007 at age 28.

I applied to grad school and boom, SSS came up as a requirement. I tried to register with them but I was told, on my status letter, that i couldnt anymore since I was flagrantly over 26. I clearly also explained that I unknowingly didnt register because I didnt have any knowledge of it at all untill I applied for school and my situation as well.

My question, given these details, is how do I answer QUESTION 33.

Do I answer YES or NO?

NOA - notice of action. if you've been through other immigration processes it is the notice from USCIS indicating they have received your application (for whatever you've applied for) and they are starting to process it.

The Yellow letter refers to a letter (literally the paper is yellow)some people who applied for citizenship receive (not all...and it's random and doesn't mean anything if you do or don't receive it)

I saw your comment on my topic and I am here to write this; I have been using Money Order with the Immigration since I came here to America with NO problems. Even if there is something wrong with your N-400 you will still get your Notice Of Action, you just need to relax and let them do their job.

If it was received on the 15th (5 days) ago, then YES you are worrying for nothing. Relax, no everyone get the NOA receipt 5 days after USCIS receives the package. I got my receipt almost 15 days after they received my application. You are fine, give it a few more days, you will get it soon. Also once you get your receipt you might want to sign up on the USCIS site to get text/email updates of your case. This the link:

I might be worrying too much or something but please hear me out.


I mailed out my form on the 13th and it was received on 15th..WAIT A MINUTE before answering

I sent Money Order instead of check(not able to track it except wait 60 days per USPS representative!)


I have seen folks on here get NOA in 5 days.

Could i be worrying too much as I am doing this all by myself.

Usually you'll receive NOA with in 2 weeks. Some times could take longer. Did you send the form for the txt message along the application? If now you have to wait until you receive your NOA and register online to receive text messages.

I sent my about a week ago and nothing has been back yet to me via email/txt/mail.

How long did it take for u to receive your NOA?

I saw "snail's mail"(LOL) in ur journey..should I just lay back and hope and pray that I get it in another wee or two?

You will get a letter, soon after your fingerprint appointment "the so called Yellow Letter" and it says bring ALL PASSPORTS, current and expired along with any other travel documents you may have.


Got it.

When I renewed my passport, the expired one was taken from me by the Nigerian embassy last year.

Will that be a problem?

In my case yes; I had an expired Swiss passport (was still current when I immigrated to the USA), and a current Irish passport, they asked for both.

Hi folks,

I'm currently applying for USC through N-400 process. My interview letter states that proof of SSS registration should be brought to the interview. I know that I was not required to register as I entered US first time being 25 years old on a non-immigrant VISA which was valid till I was almost 27. I Left the US and reentered the US on K1 at age 28 therefore answering the "Have you registered with SSS" question on the N-400 with NO. It looks to me that the evidence of registration doesn't apply to me as I was not required and have not registered for SSS.

I found that there is a letter on SSS.gov which you can use for naturalization confirming registration or non registration with the SSS. Is this letter required for interview if not registered?

Because my fingerprints are not readable. Never work. So I have to get Police Clearance after doing 2 biometrics.

When I was waiting for AOS I had to do it 3 times (now they only can do 2) and it took over a year to get my GC. It always goes well with the petition, thank God, but with fingerprints messed up it always takes longer. Last year I could have called them and maybe it would have gone faster but I had problems (our kitty got sick, treatment and ended up dying and he was our baby and I got really depressed :( ). By the end of the year I got sick myself, so I just let it go. Got an appointment letter for January 2012 and could not go, so I sent it back and they rescheduled it (it was fast), so it was done in February and then interview on March 20. On my interview the Officer said she could not recommend for approval at that time because of my fingerprints, so I had to go get Police Clearance and sent it last week. Now, just wait (something I learned how to be used to LOL).

They are just generally slow. Nobody know why but in my case? My ROC (751) is STILL FREAKING PENDING since June of last year! That's 9+ months. I'm qualified for N400 so I filed it today and I am not sure how long my naturalization process is going to be.

Sometimes it's amusing to see how they operate at such a slow pace.


You know what..seeing all these replies going back and forth about how people waited for more than 2 weeks and such for replies from USCIS has actually calmed down. I guess I should stop whining and just hope and pray for the best!. Hope everything goes well for you too man.

How early have you arrived previously for other biomtreics for other stages of immigration? You need to arrive prior to the appt time...you may have a sheet to fill out usually so perhaps 15 minutes before.


I have always arrived 10 mins before but I dont know if this time, it might be different hence the question.

Judging from your answer, I guess a good 20 mins will suffice.

I think they do it because they want to make sure the name and fingerprints match what they have on file. There are plenty of cases of fraud and we all pay the price for that.

90 day window opened Christmas Eve. We filed New Year's Eve, so about a week into the 90 days. Biometrics pretty quick, then nothing for 2 months. If these monthly lists had an eligible date (for citizenship) column, you could get a better idea.


Well at least you have an interview date now so thats a good thing(4-26-2012). Most likely, I hope and pray, you will have interview and oath ceremony :-) :thumbs:

It depends on when your eligibility date is. If you applied 90 days in advance of when you are eligible, then your interview letter may come near the time of eligibility. If you've been eligible for a long time, but are just now applying to be a citizen, then you may hear something in a week or two.

Updates are ussualy received within a few weeks from when you have your biometrics taken. However, nothing is written in stone if it comes to the timeframe.

Most commonly you'll receive an update "placed in line for interview scheduling" followed by another one saying "scheduled for an interview". The first one means it's up to your local office to schedule your appointment. The latter means they have scheduled it. The time between them could be as short as a few hours or as long as weeks.

Make sureu write your GC number on the back of the check and photos as well...
