I called USCIS again today, finally got someone that is familiar with 319(b) and she has put a request in to have my case expedited, she can't understand why they haven't done anything with my case. She gave me a new case number and said I could call about it any time I liked, she was a really nice lady, finally one of them that actually knows whats going on :)

I actually did it online yesterday to use double prong attack..if i do get 2 cards, I will send back one back



My interview was done on 08/9/2012 and I go the Oath date of 08/18/2012.

Maybe thats what is gonna happen to me, two voting cards that is.

Funny thing is I read online yesterday that it takes 6 to 8 weeks to process it but today it says 3 weeks online! :) :)

You should get something in the mail letting you know you have been accepted. I wish this wasn't done per state, it would be a lot easier! How long ago did you send it in? It will probably take them a few weeks.


I sent the form on Friday.

Yeah we will see.

They have to process the paperwork. How long that will take, well... your guess is as good as mine. ;)


Like Presley, I was thinking it will be right away but judging from the time it takes USCIS to update the system, it might be few weeks as well but oh well.

As long as we registered, thats all that matters.

The rules were different and stricter.
 

A person born on or after November 14, 1986, is a U.S. citizen if all of the following are true (different rules apply if child was born out-of-wedlock):[8]

  1. The person's parents were married at time of birth
  2. One of the person's parents was a U.S. citizen when the person in question was born
  3. The citizen parent lived at least five years in the United States before the child's birth
  4. A minimum of two of these five years in the United States were after the citizen parent's 14th birthday.

INA 301(g) makes additional provisions to satisfy the physical-presence requirements for periods citizens spent abroad in "honorable service in the Armed Forces of the United States, or periods of employment with the United States Government or with an international organization." Additionally citizens, who spent time living abroad as the "dependent unmarried son or daughter and a member of the household of a person" in any of the previously mentioned organizations can also be counted.

A person's record of birth abroad, if registered with a U.S. consulate or embassy, is proof of citizenship. Such a person may also apply for a passport or a Certificate of Citizenship to have a record of citizenship. Such documentation is often useful to prove citizenship in lieu of the availability of an American birth certificate.

Different rules apply for persons born abroad to one U.S. citizen before November 14, 1986. United States law on this subject changed multiple times throughout the twentieth century, and the law is applicable as it existed at the time of the individual's birth.

For persons born between December 24, 1952 and November 14, 1986, a person is a U.S. citizen if all of the following are true (except if born out-of-wedlock):[8]

  1. The person's parents were married at the time of birth
  2. One of the person's parents was a U.S. citizen when the person was born
  3. The citizen parent lived at least ten years in the United States before the child's birth;
  4. A minimum of 5 of these 10 years in the United States were after the citizen parent's 14th birthday.

For persons born out-of-wedlock (mother) if all the following apply:

  1. the mother was a U.S. citizen at the time of the person's birth and
  2. the mother was physically present in the United States or one of its outlying possessions for a continuous period of one year prior to the person's birth.
Birth Abroad Out-of-Wedlock to a U.S. Citizen Father ? ?New? Section 309(a)

A person born abroad out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under Section 301(g) of the INA, as made applicable by the ?new? Section 309(a) of the INA provided:

  1. A blood relationship between the person and the father is established by clear and convincing evidence;
  2. The father had the nationality of the United States at the time of the person?s birth;
  3. The father was physically present in the United States or its outlying possessions prior to the child?s birth for five years, at least two of which were after reaching the age of 14.
  4. The father (unless deceased) has agreed in writing to provide financial support for the person until the person reaches the age of 18 years, and
  5. While the person is under the age of 18 years --
    • the person is legitimated under the law of his/her residence or domicile,
    • the father acknowledges paternity of the person in writing under oath, or
    • the paternity of the person is established by adjudication of a competent court.

Birth Abroad Out-of-Wedlock to a U.S. Citizen Father ? ?Old? Section 309(a) of the INA- A child born out-of-wedlock to a U.S. citizen father may acquire U.S. citizenship under the former Section 301(a)(7) of the INA as made applicable by the ?old? Section 309(a) of the INA if the U.S. citizen father, prior to the child?s birth, had been physically present in the United States or one of its outlying possessions for ten years, five of which were after the age of 14, and if the paternity of the child had been established by legitimation prior to the child reaching the age of 21. The ?old? Section 309(a) of the INA is applicable to individuals who were 18 on November 14, 1986 and to individuals whose paternity had been established by legitimation prior to that date. Individuals who were at least 15 on November 14, 1986, but under the age of 18, could opt to have their claim determined in accordance with the provisions of either the ?old? or the ?new? Section 309(a).

I don't even think the mother can. It seems the grandfather would not meet the requirements for time spent in the U.S. to pass on citizenship. This is assuming the mother's mother is not a U.S. citizen.
 

The rules were different before 1986 and back before the 50's so the grandfather may meet the requirements to pass on to the mother but the mother would not be able to pass on to the daughter because she did not meet the time requirements.

At our AOS, when done, asked a simple question, what's next?  IO said you have to fill out that I-751 for removal of condtions, then for citizenship, the N-400.  Wrote those down, next day, downloaded those forms and the instructions and read them.  Wow, we have a lot of record keeping to do.

 

So what would happen if I didn't ask?  Think the USCIS would give you a piece of paper and tell us what you are in for.  2-3-5 years later is to late.

 

The USCIS sent my wife a letter reminding her to remove conditions about 6 months prior to the expiration of her 2 year greencard.

I have always heard that they require you to have filed taxes regardless of income or not... This demonstrates that you are a "tax paying" participant in the system and will probably continue to be as a citizen. They asked for our proof of filing as a condition of approval, I would be astonished if they. Accepted. Yours without this... IMO

 

You are correct.  People are confusing the fact that US Citizens need not file a tax return if they have no income but a requirement of your greencard is that "File all income tax return"  there is no * stating only if you have income.  It is a good idea for anyone to file federal and state even if it is all 0.00.  If you do not file the governemnt can file on your behalf and estimate taxes owed and who wants to be on the back side of that fighting.  If you file 0.00 you are covered for the price of a first class stamp.

Update my interview and result today.

Had my interview at the LA field office. Arrived at 10-ish and waited for about 20 minutes, talk about fast.

Funny story about my name being called... some old lady with her lawyer thought it was calling her and went in with the IO, few minutes later they were asked to return to the waiting room and called my name again. IO apologized for the mix up and I told him oh it's allllllll groovy.

Whet through my app, asked some questions that's already asked on the N-400 application. Then went through the civil test, I can't recall what he asked but he asked me 6 oral questions, read one and write down something.

Asked me to give him the copy of the Selective Service registration, which I already provided with my initial N-400 package. Didn't bother to see the originals at all.

Then asked about my marriage briefly. Showed him some recent bills and he asked for some financial records from the past 3 years. I said I didn't see that on the document list, and he said oh there is an IRS office down at the lobby, you can go grab your tax return transcripts. In which I replied that I already submitted my past 4 years of tax transcripts with the N-400 application. He was like "oh you did? Let me check... ahh yeah there it is. Sorry about that."

Finally have me sign a few paper, gave me the N-462 with Recommended for Approval and told me everything looks good and upon another IO checks his work, I should receive the oath letter in a month or two.

Honestly it was easy breezy, oh and the IO is very nice guy, we joked a bit and had small talks, the entire procedure is easy. However I can see he is somewhat rushing as he didn't even check my folder with the documents I already submitted with.

Anyway hopefully I'll get my oath letter soon, it's almost over.

Oh and my ROC is STILL PENDING. What a joke.

Selective service record? Like status letter? Can you send me an email with your experience? I have gotten gr8 reviews from different folks...I just wanna make sure I am on right track you know....I am filing based on 5 years, not married

Yeah :lol: just in case my IO hang out here too, then IO might change her mind.
I brought 3 full folders, 2 lbs each. The IO told me at the end of the interview that I don't need those because I applied base on 10 yrs. I guess you'd better bring everything.
Oh, she took a copy of my selective service record.

When you said cited, are you talking traffic tickets and stuff ?

Didn't you put your trips on the form initially?

I know you are so excited to be done with USCIS...

You IO must have been having a bad day but at least you saying hello is a good thing and you weren't nervous!

P.s was yours based on 5 years? Did u take a whole bunch of stuff with you?

Sure, My interview was scheduled for 7:45 am, I arrived at 7:00, was called in at 7:30, out of interview at 7:42.
I started by wishing "good morning" to which I, received no reply. Followed the officer to her room, where she asked me to raise my right hand and swear to speak the truth.
This followed by going through my application, just to verify what I had written corresponded to my answers. Two changes:

1. Where you charged? I said No, but because I was cited she changed it to Yes (i assumed charged means when one goes to jail:))
2. She added the days I was out of the country since I filled N-400.

Written Test:
The capital of United States is Washington.

Oral Test:
What is the capital of United States?

Civic Test:
1. What is the declaration of Independence signify?
2. Who is in line next after President & Vice President if they are no longer capable?
3. How long is the term of a senator?
4. Name one branch of the government?
5. Who makes the federal laws?
6. How many justices are in Supreme Court?

Then she told me she was going to recommend me for approval (she stamped the application "Approved") and that I, should receive my letter in 2~6 weeks.

I mailed 2 letters to my U.S Rep and a Senator last week asking for help. Just called the Senator office yesterday, they will look into my case but I have not received any update yet.
Today, boring at work, so I start to call USCIS as usual and speak to Tier 2. To my surprise, the officer told me they scheduled my oath today for July 25 oath ceremony. :)

Nothing give me more joy than this. Now I can see what's happening at the oath ceremony in my naked eyes.

Hard work is the exact word to describe these who citizenship!
Hard in the sense you have make sure you behave yourself during the 10 year probationary period ..thank God I did!!!! And you have a memory of an elephant because I don't! No wonder they give you 30 days to gather your sh!t together before the interview!

Such a nice experience and wonderful way to remember the day you became US citizen. These ceremonies are always so emotional because it's at that moment the thoughts of everyone's hard work, hardship, etc comes to mind. Who knows what people have to go through to become a US citizen. It almost feels like justice and reward for all the hard work. Congrats!!

Secondary proof like what pay stubs and/ or w2 forms?

I have tax transcripts spanning from 2008 to 2011. 2007 is not available on IRS.gov

I also have selective service system status letter dated 2011, is that sufficient enough?

Umuc...yes it is safer to do so. Because uscis uses tax return not just for checking marriage status but to make sure you don't owe any tax, you didn't claim to be a non resident and sometimes a secondary proof of your employment. You can go to local IRS office they will print it out there and give it to you. Even if you got only a few days left before your interview
