Removing Conditions on Residency General DiscussionHow Many Photos??

We sent about 30 photos - in hindsight might've been overkill

Ahaha you want to talk overkill? I sent like 100 photos. In an album. Totally overkill but the first time around, with my I-485, the interviewing officer gave me ####### for not having enough photos and not enough of the 'right kind' of photos. Take that, USCIS.

I did an infopass a week ago (Baltimore) regarding inquiry on my expired GC since I will be travelling out of the country this April. I have my extension letter with me. The immigration officer told me that I DON'T need a stamp on my passport because the extension letter is enough.

Awesome! I'm in Baltimore too smile.gif I will bring my extension letter, GC, passport, marriage cert, etc. to be safe!

The OP never suggested that didn't have a valid passport. They were concerned with the expired GC which is extended and will permit reentry with the extension letter. If your passport is not expired there is no issue.

Too bad you cancelled your cruise due to a misinterpretation

Yup, my Canadian passport is most definitely valid until 2011. Also, I do have the letter explaining that my GC is extended for 1 year. I thought maybe some other form of documentation for the extension would come at a later date. Thanks for all the help. I guess I'm all set then!

For some reason I can't edit my original post. Anyways, I understand that my current conditional green card will be extended for a year, but what documentation do I have to prove that? The NOA? Biometrics appointment letter? What exactly will I be able to show as proof?

Hi all,

I'm traveling to Ireland in May but my conditional GC expires April 27th. Will I need to get a stamp in my passport in order to travel with the expired GC? Any info would be greatly appreciated.

Removing Conditions on Residency General DiscussionAbout to file for removal of conditions
hey there.
1st, with reference to the affadavit. I did not addthe financial as my salary is quite a bit above the poverty acale. I am including my past 3 years tax returns just in case. The statement you will want to have a Notary sign it and and stamp it.Most banks have a notary or access to one.
I have found that too much information is not a bad thing. If you look at the example forms on this site, the financial details are not filled out.
I hope that helps, '
good luck

Hi again,

I have another question (I am suddenly remembering all sorts of questions as the days draw closer to the big file date)

My question is: What did you do about your personal information showing on your documents like for example: bank statements, did you leave your bank account number visible or did you darken out the number(s).

As for the affidavits, I had a friend who I have known for over 7 years who agreed to do the one of the affidavits for me. She knew about this for 2 years and it was her who continuously asked me when does she need to complete this. Well I gave her the information she needed to include in the letter now at the last minute she has bailed on me, saying she was having reservations about doing the letter and couldnt do it. When I informed her that the letter was optional she suddenly had a change of heart and said "Oh okay then since its optional I can do it then". I just told her don't worry about it, it was as if as long as she thought I desperately needed the affidavit she had reservations but once I didnt need them her reservations suddenly disappeared. Please tell me am I overreacting by being upset about what she did. I am just very disappointed that she waited to close to the last moment to bail out on me, I mean she could have told me "No" when I asked her on several different occassions if she understand what was needed and whether or not she still wanted to do this she always replied yes. I could have very easily gotten another friend to do it, now most of them that could do it if given enough time can't now but the timing is so short.

Please answer my question about the personal information on the evidence and give your opinion about my situation.

Thanks

I did CR1 but I just wrote my name on the back and didn't have an issue.

We did not write anything on the photo, front or back. Ours was simply attached to the application. Evidentally this was fine, we did not receive any negative feedback as a result. Best of luck

Removing Conditions on Residency General DiscussionFinancial records
I have a similar problem, I do not have any joint bills or lease agreement for 07-08 only 09 after we bought our house. We lived in a family house and did not have a lease agreement or any bills for 07-08.

I have joint tax returns for 07 and 08 and will go to the bank to try to get old bank statements from 07 and 08 (I was thinking maybe 3 or 4). What else can I show for this time period? what other proof is required?

Removing Conditions on Residency General DiscussionDoes the 90 day count include weekends or only weekdays?
I am preparing to file to remove conditions but I want to be sure that I have the date calculated correctly. Should I include weekends in calculating my 90 days?

Based on my calculation, my green card was approved 8/6/07 so I am eligible to file to remove the conditions starting 5/8/09, is that correct?

Thanks for your assistance.

Removing Conditions on Residency General DiscussionRecent evidence only - no early evidence
We are contacting our HR department to get copies of our insurance plans for the last 2 years showing each other as the beneficiary, hope they will come through to us. We are not on each other’s insurance plans.
We have our driver’s licenses with the old address and change of address card with the new address.
We went to the bank and got old statements, June and Dec 07, June and Dec 08, March 09 for the joint account

Our joint credit cards are all newer and so are our various memberships, they are from mid 08 - 09. I hope that I have listed above along with the joint tax return will be sufficient for 2007 proof.

Thank you!

If it raise suspicions then they will call you in for interview and all you have to do is explain the situation. get a letter from family home ower stating that u lived with them in 2007. if you received any mail at that address then put that in your package.

I was hoping to avoid that if possible. I will have the 2007 and 2008 tax returns and will try to get old statements from the bank and pray that is enough.

I am also hoping that I am not filing too early, does anyone know?

Removing Conditions on Residency General DiscussionRecent evidence only - no early evidence
I actually have 2 questions regarding filing to remove status:

1. My green card expires 8/6/09 (approved 8/6/07) and by my calculations I am eligible to file to remove the conditions starting May 8, 2009. Is that correct or am I too early?

2. I am putting my paperwork together but I now realize that I only have evidence of marriage and living together starting mid 2008. For 2007 we lived in a family home hence no lease information. All our banking is done online and I am not able to retrieve older bank statements from 2007. I have the tax return transcripts from 2007 and 2008 (filed jointly) and bank statements for 2008-now. We started proceedings to buy our house in July 2008 but the final sale did not come through until Jan 09 so all the paperwork related to the house (deed, mortgage, bills) is dated Jan 2009 - now.

The question is this:
What other evidence can I show for 2007?
If I am not able to show proof from 2007 and early 2008, will that raise suspicions?

Removing Conditions on Residency General DiscussionGetting I-765 Affidavits Notarized
I agree with 'Sandra/Ahmed' the correct process is to sign the letter in front of the Notary however if the Notary is personally aquainted with you they might make an exception.

A simple way to do this is to go a bank where the person writing the affidavit has an account. The Notary on staff at the bank will notarize the letter for the person who wrote it. Note, it has to be their bank, not yours.

Hope that helps.

I do not have bank statements dating back to the beginning of the marriage and I am curious what else can cover that need.

Removing Conditions on Residency General DiscussionReady to file but problem with IRS tax forms
Thanks guys, I called back and spoke to yet another person requesting the "Tax Return Transcript" for 2008 so now they are to fax that to me. They said it can take up to 48 hours for me to get the fax and it's already been 17 hours and the fax has not come through yet. Leave it to them to need 48 hours to send a fax!

Hopefully I will have the transcript for both 2007 and 2008 and will send that with my paperwork. I hope to get my package in the mail by this weekend.

ELW: I was not clear on what they meant but I asked for "Tax Return Transcript" both times but it seems that I got the ‘Account Summary’ the 1st time I called then the ‘Tax Return Transcript’ the 2nd time; I was not sure what the difference was but the 3rd time was the charm and I have what I need now.

CanAmCharlotte: Since you used a CPA I think it’s different from those who file electronically without any professional services; just trying to cover all my bases just in case.

Removing Conditions on Residency General DiscussionReady to file but problem with IRS tax forms
I am finally ready to file to remove conditions but my delay is the IRS transcript information. I called to get a copy of the transcript from 2007 and 2007 showing that we filed jointly for those 2 years since marriage.

1st call – they sent a 3 page ‘summary’ but for 2008 only
2nd call – the sent a 7 page ‘copy’ but for 2007 only

I do not want to file with 2 different types of documents from the IRS but I do not know which is correct, should I call back to ask for the 3 page ‘summary’ for 2007 or the 7 page ‘copy’ for 2008? Which one is the transcript?

Also, if I send a copy of the 1040 from turbo tax and copies of our W2s for the 2 years, do I still need the information from the IRS?

Otherwise, I have the following in my package. My package is much smaller than those mentioned in other posts that I have read. Do I need anything else:
1. $545 check for I-751 Petition fee and biometrics fee
2. Completed and signed Form I-751
3. Attachment to I-751 for Part 3, item 9 listing additional residences since obtaining conditional resident status
4. Copy Homeland Security/USCIS I-751 reminder letter
5. Copy of Permanent Resident Card, front and back
6. Copy of Marriage Certificate
7. Copy of driver’s license and change of address card issues by Maryland Department of Motor Vehicles for permanent resident and spouse
8. Proof change of address filed with USCIS:
a. AR-11 Confirmation for PR
b. Form I-865 for USC
9. Three original copies of sworn affidavits by U.S Citizen friends
a. friend and former landlord attesting to marriage and that we lived in his condo rent free
b. coworker
c. friend
10. Employer Benefits summary information listing spouse as life insurance beneficiary
a. PR
b. USC spouse
11. Copy of statements from Federal Credit Union showing joint account ownership
a. June and December 2007
b. June and December 2008
c. April 2009
12. Proof of joint home ownership
a. Copy of deed
b. Copy of mortgage statements from Countrywide
c. Copy of County property tax bill
d. Copy of water bill
e. Copy of insurance policy(car and homeowner insurance are with the same company, the letter submitted shows information fro both car and home coverage)
13. Proof of joint car ownership
a. Copy of joint car loan approval letter showing car loan filed together
b. Copy of insurance policy (car and homeowner insurance are with the same company, the letter submitted shows information fro both car and home coverage)
14. Copies of 2 actual credit cards with same account number but different name for self and spouse; cards issued by Capital One and Credit Union
15. Boarding passes from one of the vacations taken together
16. Pictures of us since marriage

Already updated my timeline and the status list, but my husband's removal of conditions was approved on 05/28/2009. There haven't been any status updates online, but we got a snail-mail message yesterday saying that he was approved and will get his card in 60 days.

What a relief to have that over.

Congrats! 2 months, is that some kind of new record?

CanadaSo we're married now....verifying next steps
So we got married on July 1 and of course I am back here trying to make sure I complete the next steps right. This site helped us tremendously with the K1 process...My plan at this time is to go tomorrow to do the SSN. I already received 3 certified copies of the marriage certificate in preparation for the steps to come. The certificate has my name and her maiden name, but I am assuming that since there was no place to put her "married name" that we can just use the SS card as the beginning of the new name. We did pretty well on the K1 part and I want it to go as smoothly for the AOS.

So after we apply for the SSN, should we wait til we get it to file AOS papers or just go ahead and file those this week as well? We have until August 6th for her I-94 to expire. Also, from what I read, I need to pay the EAD application fee but not the AP application and biometrics fee since I am paying the "new" fee on the 485? I've read the guides and the instructions for each form several times and I keep questioning my understanding on it.

Any other comments and questions are welcome...in case I am missing something.

CanadaSocial Security Card Problems
Background. My wife's POE date was 5/7. We got married on 7/1. Applied for SS Card on July 13th. Applied for AOS on 7/23. We applied for the SS card under the married name. It was denied August 23rd due to the fact that her I94 expired before they could issue us a card. Interesting...since A: We applied PRIOR to it expiring and B: It was delayed due to the fact they ignored all the supporting documents (ie wedding certificate) about the name change.

So, we're going to complain and appeal...but I am guessing there's nothing we can do except wait until her EAD arrives. The Biometrics is on the 7th of September...and the only real pressing issue is a job interview tomorrow...which in itself isn't a huge deal because I think she'll offer to intern if she's not ready to work because of the immigration stuff yet.

But for the appeal, do we have any hope? It specifically states on the USCIS website an expired I94 is not a problem IF you're already in process for AOS. We have the evidence that we have applied for AOS and it's in progress...but honestly, I don't know how much trouble I want to go through.

Had our interview back on the 26th of October...approved (AOS). Letter came on the 1st of Nov saying Green Card being printed. Hoping we get it this coming week. All in all, from K1 to now wasn't an awful experience. No RFEs throughout the whole process. No real issues at all that I can think of. Guess we were lucky as well as prepared.

If you didn't sign up for email updates then yes, you'll have to wait for the first NOA from them, which will have your receipt # on it. It shouldn't take too long, maybe this week or next. If they have only had it for a week I'm not surprised you haven't heard yet. Don't worry. :)

We got the email notifications today. BUT, I put the receipt number in to try and add it and says it's not found. So no idea. At least I know they have it and are moving things around.

CanadaDivorce and Custody of American Child?
I have a friend that married a Canadian man (she's a US citizen) and they had a child together who is a US citizen. Unfortunately, there were some problems in the marriage and they are getting a divorce. He only has a greencard at this point (before the 2 year period is up) and he wants to move back to Canada with the child. How would any of this work? Does the Canadian have much of a chance in getting the child? I have tried looking this up on various sites and can't find an answer.
