Hey guys,
In a month it is time for me to send in my application to remove the conditions for my residency. So I looked at the guide and I got 2 questions.

For the birth certificate of any children born into this marriage: do I need a notarized copy?

And what kind of cover letter should I use? The one that is used as an example seems kinda long and weird??!

Thanks in Advance Isabel good.gif

cover letters are not required..... just make one up that you think is needed to let them know what is in the packet

Removing Conditions on Residency General DiscussionI751 no apt yet.....
Hey guys,
I filed for removing my conditions last June and I have yet to receive a biometrics appointment. The only thing I have is the NOA
I read in the forum that VSC is kind of slow with that lately. In fact the processing date hasn't moved a day forward since I filed. So I am wondering if I even have a chance of approval before my 1 year extension expires.
Do they send out an extension automatically if they go over the time or do I have to request one?
Ah and in August I am technically eligable to file for citizenship. Can I do that without having my conditions removed or do I have to wait till that goes through?

Isabel

Removing Conditions on Residency General DiscussionTough situation - removing and moving all at the same time
It looks like I could file Form I-407 to abandon my LPR status, if that was what I wanted. That would leave me in good standing and I could apply for it again if need be. Also, I'm in my 2nd year here. I remove conditions next January. I'd need to wait a total of 2 years from now in order to get citizenship but quite honestly, I don't want US cititzenship. I'd be happy enough being an LPR.

I also found this:

You are correct in thinking that you must satisfy the officials at our Case Processing Centre in Mississauga that you will actually move as a couple to live in Canada when your spouse receives a visa. (Only Canadian Citizens may sponsor from abroad; a “permanent resident” must be physically resident in Canada to be eligible.) In order to satisfy the officer reviewing the file that you intend to return to Canada, you should include with your application information on your plan for return to Canada and sufficient documentation to substantiate it, including any or all of the following:

- A written submission explaining the reasons why you have been abroad and why you are now returning to Canada (employment, family obligations, studies, etc...)
- letters from relatives or friends in Canada offering initial accommodation and assistance
- Proof of registration in a University or College
- Proof of a job offer
- Proof of family obligations
- Proof of purchase of home in Canada (or sale of property in your current country of residence)

I also found this: Six to eight weeks after landing in Canada, your Permanent Resident card should be mailed to you at your address in Canada. If you do leave Canada after landing without first obtaining a Permanent Resident card, you must apply at a Canadian Embassy or High Commission for a “Travel Document for Permanent Residents” prior to returning to Canada.

This leads me to believe the process should be quick enough. I dunno. I'm so overwhelmed.

Removing Conditions on Residency General DiscussionTough situation - removing and moving all at the same time
My first question is about the processing times.. after looking through the different service center timelines, it looks like Vermont takes at least 6 months to approve a removal of conditions whereas the other service centers are averaging 2-4 months. Any idea why Vermont is so slow?

Also, I'm in a rather strange situation. My husband and I are both 25 and want to start a family in a couple of years but we aren't sure where we want to raise our family. He's never lived in a city whereas I've lived in 3 different countries. He loves Montreal (I was born and raised there) so we want to go live there for a year and see how he likes living there.

We were planning on moving in the summer of 2009, after I remove conditions. I will start removing conditions on January 27, 2009. I figure if it takes 6 months, we'll be done by July 2009, which is when we want to move anyways.

I'm going to have to start immigration proceedings for my husband in order to get him permanent residency status in Canada so that we can live in Canada legally and he can work. If we decide we want to raise our family in Canada and ultimately stay there, it will be best if all the proper immigration stuff is in place. At the same time, if I have a 10 year green card, I assume I can spend 1 year outside the USA in Canada and still be able to come back and live in the USA if we decide to have a family in the USA.

The problem is that I probably will have to start filing for Canadian immigration stuff at the same time as I'm removing my conditions. Is this going to cause a problem with USCIS? Are they going to know that my husband is trying to get permanent residency in Canada? Will they even care? Is this legal?? Ugh. So overwhelming! Anyone else ever been in this situation?

QUOTE (Keigwyn @ Jan 27 2009, 11:49 AM) <{POST_SNAPBACK}>
That is a lot of evidence. Personally, I am not a believer in photos. To reference your photo they have biometrics, but do they know what your other-half looks like? no.
You don't need your passport or birth certificate.

The rest looks good!

I did not include photos or affidavits and got approved in 62 days (CSC)

Well, I want to include the photos because the immigration officer who interviewed us for my I-485 was disappointed that I didn't have any 'wedding' photos the first time around. I had photos of us getting married at the court house, but there was no reception, wedding dress, tux, cake, etc. Seemed like he was expecting photos of a huge fancy church wedding with a huge reception afterwards huh.gif

I figured I'd send them lots of photos this time around in case I got another person who was looking for more 'valid proof' in the form of photos.

For some reason I can't edit my post. Anyways..

How did you guys package everything? When I filed for my I-485, I used addecco (sp?) clips to separate everything and put it in an envelope. Should I do the same? Also, for the pictures, I have them in a photo album at the moment. Is that too bulky? Should I put them in an envelope as well? We were going to package everything (including the photo album) in a fed ex box (small one).

Do you have life insurance or health insurance showing the spouse as beneficiary of benefit? Yours looks a lot like ours except for the insurance but you might want to black out some of the CC number - probably just leave the last 4 for security?

Nope. I used to be on his health insurance but it ended up costing us way too much so now I have my own health insurance through my employer and he has his through his employer. As for life insurance, we were going to but never ended up getting any. Is that going to be an issue? And thanks for the advice about the CC's. Will do.

Removing Conditions on Residency General DiscussionAnother one of those "do I have enough evidence" posts!
Hi all,

Haven't posted here in a while. It's time to file my I-751 and I'm wondering if I have enough (or too much!) evidence. This is what we are sending:

-Copy of my passport, green card, birth certificate
-Copies of my license and husband's license (he's the US citizen) showing same address
-Copies of debit cards, CitiBank and Target cards showing joint accounts for all 3
-Bank statements, CitiBank statements, Target statements
-ING Direct savings account statements showing joint account
-Car titles & registrations showing joint ownership of both cars
-Car insurance notices, invoices showing both our names at same address
-Volkswagen Credit statements for both cars to same address
-Confirmation of change of address from US Postal Service showing previous and current address
-Utility bills from previous address
-Notarized Letter from my mother in law stating that we live with her, how much rent we pay, what utilities she pays (as an explanation as to why we have no utility bills in our names for our current address)
-Mail addressed to both of us at our previous and current address
-AT&T phone bills showing both names at previous and current address
-Joint tax returns for 2006, 2007 & 2008
-Flight itineraries, hotel confirmations, etc. for travel between 2007-2008 showing both names
-Approx. 100 photos of us over the last 2 years (including our renewal of vows ceremony that took place on our first wedding anniversary, it was pretty much like a wedding reception - 60 people there, food, drinks, 1st dance, cake cutting - I had a wedding dress and all!)
-Copy of the lease from our previous address
-Two original letters (sworn affidavits) written by U.S. citizen friends, attesting to our relationship and marriage

That's what I can think of off the top of my head. There might be more.. is that enough? Too much?

Removing Conditions on Residency General DiscussionHow should we package our I-751?
QUOTE (jasminelily @ Jan 30 2009, 04:41 PM) <{POST_SNAPBACK}>
It's my observation during my I-130 interview about 2 years ago. USCIS uses ACCO fasterner with two holes on top and brown color folders. So if you want to save them some time punching holes, then ACCO fasterner is your way to go. I think some of the staff that work at USCIS documentation might actually say thank you from the bottom of their heart if you do this for them. Just my 2 cents.

Ok so I guess we should use the stuff my husband got. Thanks for the info!

Removing Conditions on Residency General DiscussionHow should we package our I-751?
My husband and I cannot agree on how to mail our package. He went out and bought a folder with acco fasteners, I believe. In any case, this is what he bought:

I think that we should use something like this instead, so that our copies don't end up with holes going right through important information:

What would be best? Any suggestions?

ive been stressing about this and trying to look for information here and the USCIS site but cant find the answers i need..

can anyone please help me ......

Finances and employment don't come into play removing conditions. Main thing is you have a valid marriage and you are living together!

thanks for your quick response smile.gif

Also, you guys have bee together since 1998??? I'm sure you'll have more than enough information showing a valid marriage when the time comes smile.gif

No one sends you a reminder for removing conditions - must be your lawyer or someone or something like that. Take another look at the reminder. As far as I know there is no such thing as a reminder from Immigration people - I haven't heard of anything like this yet. Good Luck

I most certainly got a reminder from USCIS about my I-751. It was just one single paper letting me know that my card expired on 4/27/09 and that I would need to file to remove my conditions before then.

I am in the same position as you ~ passport still in maiden name ~ and I never thought about it! mellow.gif My GC is in my married name and when I travel I just take my passport and GC with (and my driver's license for additional identification). My tickets are in my married name because my US credit card is in my married name. I don't travel with a copy of my marriage certificate although that does seem wise in hindsight. I have clocked quite a few domestic flights and in November came back from Jamaica without any incident.

Any time I've traveled domestically, I've used my married name and just used my Driver's License as ID. This time, I'm traveling to Ireland and so a license won't cut it. I changed my tickets so that my maiden name is on them. This way, it matches my passport. Hopefully, I won't have any issues. I'll be bringing my marriage certificate along just in case.

I had my name changed to my maiden name on the tickets. The airline said people travel in their married name all the time, who have passports that don't match, and that it would be fine.... but I didn't feel comfortable with that. So now my ticket matches my passport and I will have my marriage certificate with me just in case. The only way to change my passport would be to apply for an entirely new passport. Turns out you can't add a page to a Canadian passport with the name change anymore. Argh!

Ahaha you want to talk overkill? I sent like 100 photos. In an album. Totally overkill but the first time around, with my I-485, the interviewing officer gave me ####### for not having enough photos and not enough of the 'right kind' of photos. Take that, USCIS.
