K-1 Fiance(e) Visa Process & ProceduresJust Got NOA2 & what is the next step?
QUOTE (S.IS.Hwang @ Apr 27 2009, 12:32 PM) <{POST_SNAPBACK}>
Hey Korameri:

My case was never updated on the USCIS website so no worries.

You should call the national visa center to see if your case has been received, you will be issued a Seoul Embassy case number starting w/ SEO2009 ... something...

Your case will stay at the National Visa Center (fingers crossed) for a few days... and then the National Visa Center will send it off to the Seoul Embassy.

Takes 5-6 working days for Seoul Embassy to receive your case.. Packet 3 will be sent out via email after that... basically you can schedule an interview once you receive your packet # 3 ... but my fiance and i are waiting until we have all of our paper works prepared.

Let me know if you have any questions!

Wow, did you file expediated or anything? How did your whole process go through so insanely fast? The average is still around 210 days according to visajourney.

So if i don't plan on using my condo as an asset, i just fill out the amount i paid, my mortgage and what its worth on the I134 form in the corrrect places...and i don't need to show a lot of proof? Or do i need notarized statements for all of those documents?

K-1 Fiance(e) Visa Process & ProceduresNOA2 getting close, some questions about the next step and I134
From the guide:

"Send all originals of the documentary proof that you submitted for the I-129F to your fiance(e) for their interview at the embassy."

Does this include my original birth certificate?

Regarding I134:

1. I have taken off about 6 months to stay with my fiance's family (to gain their trust, etc) so as of now i may not be able to get a job prior to her interview (my dad IS willing to co-sponsor) but how much assets would be required to not need a cosponsor with no current job?

2. What kind of documentation is needed when you list your house/condo on the I134? It's specific about personal bank account information you need to collect, but i'm a bit confused about the others.

3. How about accounts in the stock market?

Thanks everyone. I've checked around but there apparently aren't a whole heck of a lot of people from Indonesia. What i have read makes it seem pretty relaxed, but we're not taking chances. I've found every possible question on here and typed of the answers so we make sure there isn't anything common that we are surprised by.

I live with her family, i have nothing stating the fact that i live here with mine and her name on it (like a lease or anything), thanks for the constructive responses from other members, a family letter is a good idea.

K-1 Fiance(e) Visa Process & ProceduresNOA2 valid dates
I just got the NOA2 form in the mail and it says it is valid from 6/30 to 10/30. I just wanted to confirm this has nothing to do with how the dates of the actual visa (assuming we get that) and when she has to enter the US by, correct? From what i've read that is supposed to be 6 months from the date the visa is issued??

My fiance's sister is getting married now later in the year (it was supposed to be soon) and may wait until then to enter the US.

K-1 Fiance(e) Visa Process & ProceduresDifference between I129F ans I130???

No, neither the I-129F or I-130 are applications for anything. They are petitions, which when approved, allow the foreigner to apply for a visa. To have success doing it yourself for an immigration process, you'll need to be able to carefully read forms and instructions, then interpret them literally and respond accurately. If you are not capable of easily comprehending the difference between a relative and a fiancee, you MIGHT want to re-think your do it yourself ideas. It's not for everybody.

Ok first of all dont speak down to me like I'm some ignorant uneducated person ,ok. For your imformation I submitted my petition back in September and did it all my lonely self and I have yet to receive and RFE. I was simply asking asking on USCIS.GOV it says "I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN". That is why I asked because it says Fiance in there.

So please don't come on my posting being rude and trying to treat me like I'm an idiot.

No, they are not both for alien fiance. The I-130 is for an alien relative. A fiance is not yet a relative.

Oh ok. So then that would be the application for couples that are already married then.

Pictures are the BEST evidence. However, its still possible to obtain the visa without photo evidence. Do you have other types of proof from your "in person visits?" Did you save plane tickets/itineraries, receipts from your stay in the foreign country?

I am using a U.S.-based immigration attorney (who happens to be a personal friend). She advised me that 1.5 pages was good -- long enough to say something, but not so long as to overwhelm the USCIS officers looking over the case. The attorney encouraged me to make it personal (first person), a "love story", because that spoke to the sincerity of our relationship.

She's handled hundreds of K-1s with success, so I hope she's right!

We have been checking the electronic case stautus update online and we have had another 2 touches/updates. One on the 30th Oct and another on the 31st Oct. To add to this we have this too.....another approval notice dated 30th Oct 2008.

I have never heard of 2 approvals myself and wonder what is going on over there. blink.gif

We had an e-mail saying we had been approved the first time - 23rd Sept, but nothing this time. Maybe it's coming out of the dust and will be on it's way now to NVC?

Yes, same thing happened to me. I was touched (VSC) three days in a row, but the NOA2 was dated for the first touch. Not sure what the other two were about. I neither got an email nor did the USCIS site reflect an approval -- I was simply mailed the NOA2.

There is never anything worth worrying about. I am careful and concerned about most areas of my life; health, social responsbilities, friendships, etc. Worrying is wasted energy from my point of view. Whether one gets an RFE or denial, it never truly helps to worry. Worrying that is chronic can become paralyzing, whereas care, caution, concern, and preparedness all allow one to better navigate any challenges that may arise.

A K-1 visa (fiancee - i.e., not married yet, but planning to) is easier/faster to get than a K-3 visa (already married). I know that doesn't make a lot of sense, but it's a fact. So, it may make sense for you to hold off on the marriage and go for the K-1 visa.

How many wedding dates do you intend to have?! There is no reason to rush to a court house to get married, because 90 days is plenty of time to plan and get married, especially if you've already done some ground work, like finding a wedding planner, or someone like that.
Robert

Well in my case, the rush is saving 1000s of dollars if we have the wedding by December 31. The difference in income taxes between filing "single" and "married filing jointly" is pretty big. I know it's not romantic, but we discussed it and she thought it was a good idea... and after all, we had the unofficial Buddhist ceremony in Thailand back in August.

So we are doing the same thing. Courthouse wedding in December... family wedding later.

Well that's one good reason for getting married by Dec 31st!

Yeah, in our case, not sure it would have made up the difference for the more expensive flight though! Oh well.

Does anyone know a good Website (free or otherwise) to download contemporary Isan music? I kind of like it (in small doses) and was hoping to surprise my SO by having some MP3s for her to make her feel at home.

Thanks!

What a GREAT IDEA!
My Tilac said she didn't want to talk to any Thai people here once she comes because she "heard" (geez, they put SO MUCH WEIGHT on gossip and what they "hear") that the women are catty and think they're richer than so and so and the catty competition is just as bad here as it is there (I do know it's ruthless and nasty there).

I think it would be great to find some Thais locally but she told me yesterday "everybody say not do...everybody say lady not nice once they move to farang country". I tried to tell her everyone's different but that's what I get for finding a small town girl. They rely heavily on what they hear and gossip.

I guess all I can do is try and show her there are plenty of others just like her over here.

That's interesting. My fiancee and I had the exact same conversation -- me trying to hook her up with the local Thai community and she saying she's not interested. I wonder if that will change though.

Does anyone know what the have been asking at the visa interviews lately in BKK?

Noi just had her visa interview today and got approved!

Questions

the usual ...
where/when did you meet?
also ...
where did you live together? (we lived together in BKK for 2 years)
can you spell your fiance's name (she misspelled my first name out of nervousness, but immediately corrected)

Noi says interviewer (a man) was very nice, complimented her English and said she had a great personality. Then said "Merry Christmas, your visa is approved"

Congratulations!!!

I need to tell my Tilac to email me more!

Any other questions you can think of? THere's an interview update page link on your timeline, I think

I'm sweating and waiting for NOA2 and as soon as that comes, I'll have a better idea when to buy my ticket and stay there for a month to 6 weeks then bring her back....

Meanwhile we'll do the Isaan wedding (ceremony only) so her family can do their sendoff (and get a little cash and gold, jingjing)! LOL!

It's nice to hear what exactly they ask.

I met her in April but went back stayed a long time twice, gonna see her a 3rd time...hope we won't have ANY problems at all!!! I'm worried...everything is good then it's up to one person to decide....

Just be sure to keep the wedding ceremony completely hush hush. My attorney (a friend who just happens to be an immigration attorney who helped with paperwork) said they are very touchy about that -- even if it's unofficial. Make sure she gets her "single paper" from the district (I think). It's a paper that proves her marital status -- the consulate will want to see it.

I guess I'm worried over nothing. I lived in BKK for 3 years. 1.5 of them with her. I have a Hutch bill with her name, and a UBC bill with my name at the same address. I hope that is good enough. I have 10 photos of her with me and my sister at Doi Suthep in Chiang Mai, plus some boarding passes from my last trip in March. I sent phone bills as well.
