Losing Permanent Residence Because of Travel

There are many myths about how long a permanent resident (green card holder) may remain outside of the United States before losing his or her green card status. This article will address some of those myths and provide the information necessary to try and avoid getting into trouble due to staying outside of the U.S. longer than the immigration law permits.
Myth 1 - Now that I have my green card I can move back to my country.

If you remain outside of the U.S. for more than one year continuously, you may lose your green card automatically. The Immigration Service takes the position that if you stay out this long, you have abandoned your green card status.
Myth 2 - If I visit the U.S. once a year I’ll be okay.

This is wrong. The law and the Immigration Service look to your intent or the purpose of your travel, not just whether you have returned to the U.S. once in a while. In fact, even if you travel to the U.S. frequently but you are living abroad, the Immigration Service may find that you have abandoned your residence and revoke your green card. The test is whether you intended to be abroad temporarily or whether you plan to live abroad permanently, not simply the time you spend outside of the U.S.

For example, if a person stays outside of the U.S. continuously and returns every few months but has no roots in the U.S., such as a job, bank accounts, a home, yearly tax returns, etc., the Immigration Service may find abandonment. On the other hand, if a person has strong ties to the U.S. but only returns once a year because he or she is abroad taking care of an ill or elderly family member, a finding of abandonment would not be appropriate if all other aspects of the person’s life establish that he or she has no intent of abandoning his or her residence (e.g., maintains a home, pays taxes, owns a business, etc.).

In determining whether a person has abandoned his residence, the courts have generally looked at the following factors: a. Purpose of departure; b. Existence of fixed termination date for visit abroad; and c. Objective intention to return to U.S. as place of permanent employment or actual home.
How will the Immigration Service know how long I’ve been gone?

This typically occurs either at the time you return to the U.S. and come through customs or when you apply for citizenship and the Immigration Service inquires about your travels.

It is important to note that you have the right to contest the Immigration Service's allegation that you have abandoned your residence.

In order to prevail on a finding that someone has abandoned her green card status, the Immigration Service must prove by clear, unequivocal and convincing evidence that residence has been abandoned.

If it was not your intent to abandon your residence and you maintained strong ties to the U.S., do not be intimidated by the Immigration Service merely because an immigration officer makes allegations of abandonment – make them prove it!
Myth 3 - I am automatically eligible for citizenship after five years.

One last point about traveling abroad is that it may effect your eligibility for U.S. citizenship. In addition to maintaining your ties to the U.S., you must also be physically present in the U.S. for certain periods of time in order to be eligible for citizenship. Generally, you must be physically present in the U.S. for at least half of the previous five years.

For most travelers, abandonment of residence will not be an issue, but for those who stay outside the U.S. for extended periods of time, the above tips should be kept in mind.

Due to 9/11 everything under the uniform DL act expires when the immigration stuff expires. Keep renewing and keep paying.



In Maryland my wife received a 5 year drivers licenses and her conditional greencard expired in September. So every state does not tie expiration dates of DL to GC.

If he actually lives here then no he does not get an exemption only if he lives in the foreign country while working. Do not worry it is not your job to prove the money is legit. The government does not care and if they do audit you (which is very unlikely) you can just explain where the money came from. It is their job to prove it was not legit. I think you are wise to hire a professional. If nothing else than for piece of mind and then you will know the proper way to do it next year.

It is certainly true that self-employed people have the ability to avoid paying taxes. But, they are also more likely to be audited. If you are claiming a mortgage interest deduction for a 500,000 house and then claiming only a 20,000 income expect the IRS computers to flag you for an audit (Just like you will be flagged by the USCIS for things that don't make sense).

The problem is that no one really knows how the IRS determines who gets audited. But if you are audited it will be almost impossible to hide 30,000 in cash (Unless you don't spend it and keep it under your bed). People get away with a lot because the IRS doesn't bother much with auditing people with lower incomes, but i am sure they notice a lot of things.

I don't think there is a 80,000 exemption for foreign earnings. The whole tax system regarding foreign income is complicated, but permanent residents and citizens are a class were they are expected to declare all their income. People are confusing this class of people with people using tax treaties, working abroad and some non-resident alien visas. As someone above says, go to a CPA.


I was wrong the foreign earned income exemption is $95,100.00 for 2012. I am not sure where you got tax evasion from my post as I was merely stating that w2 or 1099 is not necessary to file income taxes. And if you do not know what you are suggesting perhaps you should do some research before giving advise.

From the IRS website:

If you are a U.S. citizen or a resident alien of the United States and you live abroad, you are taxed on your worldwide income. However, you may qualify to exclude from income up to an amount of your foreign earnings that is now adjusted for inflation ($91,400 for 2009, $91,500 for 2010, $92,900 for 2011, $95,100 for 2012). In addition, you can exclude or deduct certain foreign housing amounts.

See a little research is a wonderful thing.

Self-employed persons in the USA file tax returns with no documents every year. Lets say you bake and sell cupcakes for a living. At the end of the year you have sold $30,000 worth of cupcakes for cash. You have no w-2 or 1099 just your cash. You fill out your tax forms put in your income minus deductions and send it in. In my scenario you would most likely owe taxes to the USA but in your case foreign income up to a certain amount ($80,000) I believe, is exempt.

Sorry guys. For some reason, I didn't receive email notifications about your replies. I received 2 card production emails. I got the the first email on Friday, the 26th of June and got another card production email today. They were both the exact same email. I did not get any other emails saying my case was approved.

Should I have received another email saying the case was approved?

We are sending in our information for my husbands 10 yr green card. Just got the babys birth certificate in the mail this morning and noticed that my husband's middle name was spelled incorrectly with one letter.

My question is is this a big deal. I plan to still send it in but in the meantime get it corrected with vital statistics.

Hoping that the rest of our documentation will be sufficient enough. So tedious..

I am waiting patiently (well, I am trying to blush.gif ) for this final step to be over so I can focus on the next step; citizenship.

I was starting to get worried but today I finally got a letter saying that I am approved. The decision is dated 10/1 so all together that was 4 months … all things considered I guess that wasn’t too bad!

So, now I wait for the card and start preparing for citizenship. I am sure I will see you all in that forum too and I will keep praying for those who are still waiting for a reply.

By the way, my online status still has not been updated yet; I was last touched on 7/6. headbonk.gif

Any tips on how to best organize and present photos sent with the ROC paperwork?

We're planning on including 10-15 with our documentation - a good assortment over the last two years, including trips we've taken and times out with friends, family, etc.


We purchased photo albums, but also brought a photo album for photos to give them. we wanted to put an extra step forward. we took about 500 pictures..lol , but in the end we gave them 30.

Hi,
Thank you visa journeyers for all your advice in the past it helped us get through some nail biting timeframes.. :).
I am married to a u.s. Citizen, and have a green card. I have just applied for a uk visitors visa. But I had an offense for driving without car insurance and tag, and they gave me supervised probation, which i was not locked up, just seeing a probation officer once a month .during the probation time, which was for one year, I have traveled to Ghana 3 times and went on cruises with my wife and kids twice with permission of the court to travel. I have had red light tickets and a couple of parking tickets in the past for expired meter. (that is all it was...nothing strange found illegal in the car, nor any other prior run ins with the law) so, now the probation is ended, and it was completed .
I am now waiting for info if my visa will be approved, I will be going with my wife who is a u.s. Citizen .has anyone else had a traffic offense and tried for a British visa? Any info would help..thanks!

F.y.I. My green card has just been approved for an extra year while I am waiting to go on my interview to change status to a permanent green card.

Thank you for all of your help.

I think I am going to send it in as is, and see how it goes. I do feel like if someone looked at the packet, they wouldn't question at all whether we're a legitimate family living together. I read a post saying that they really like seeing evidence that both parents are involved in the children's education. I am including proof that I've been home schooling my husband's son, and I don't think a stepmom can get any more involved than that. :)

Regarding the question about the marriage cert, my passport, and our daughter's passport...I just thought it couldn't hurt. The marriage cert helps to prove we're married, in case they don't have it on hand. I did remove the copy of my passport, on second thought (I'm just used to sending it with every. single. packet. :) ). But with our daughter's passport, I thought it would just help connect her name with her photo, so that there would be no doubt the baby we're holding in almost every photo is our daughter. :) Unnecessary, but it's just an extra paper - can't hurt, I thought.

Anyway, thanks again for all the opinions and suggestions.

One last question. On the receipt that they'll send me once they receive the packet is a notice that my stay is extended one year and that I can travel in the meantime - is that correct? We are hoping to take a trip to visit my family in Canada in July, but I want to make sure I have the paper saying I can travel before we buy the tickets.

Hi everyone,

I'm about to file my I-751, and am a little nervous that I don't have enough paperwork to send. My husband already owned our home before we were married, and my name is not on it, nor any of our bills at this time. We do have a joint bank account, however, and I am on his health insurance.

Another concern I have is that I am including our personal copy of our 2009 tax return, instead of the tax transcript. Do you think that will make a huge difference? I would order the transcript, but I don't want to wait another two weeks for them to arrive because I've already waited long enough to send this in (my green card expires in mid-July). I hadn't realized the transcript was preferable until now.

Btw, I am a Canadian citizen and moved here on a K-1 Visa. I had no issues getting my green card, and actually received it without an interview. I'll be filing through the Vermont Service Center.

This is the "evidence" I have compiled:

- Cover letter stating:

- we're happily married
- I am home schooling his son (who lives with us 10 months out of the year)
- we have one daughter together
- we are expecting another child
- a list of what's in the packet

- Copy of my permanent resident card (front and back)
- Copy of our marriage certificate
- Copy of my Canadian passport (not necessary, I know, but I feel like I might as well)
- Copy of our daughter's American passport
- Copy of our daughter's birth certificate
- Copy of our tax return for 2009 (everything inclusive - I wasn't sure how much they need, so I included all of it)
- Copies of our debit/credit cards from our joint bank account
- Copy of most recent full statement from our joint bank account
- Copies of our health insurance cards
- Copy of a recent health insurance statement (with our names and our children's names on it)
- Copy of a recent health insurance statement of coverage on an ultrasound I just had for my current pregnancy, with both mine and my husband's names on it
- Copies of approved applications to home school his stepson for years 2008 and 2009
- Many family photos from throughout our marriage, taken both at our home and on vacation together

Does this sound like enough evidence?
