K-1 Fiance(e) Visa Case Filing and Progress Reports	NOA 1--Wooo hoooo Vermont!!	what is IMBRA waiver? Did you have to do an IMBRA waiver? If so what did you have to write? how complicated is it? You should do a search here and read the guides for more details on IMBRA and IMBRA waivers, but the short answer is you need the waiver if you file two or more petitions within a 2-year period. There are other reasons to request the waiver, but this is my reason. I am petitioning for the same individual, so technically, I shouldn't have to make the request, but better safe than sorry because it really depends on who is adjudicating our petition. I don't need and RFE after everything I've been through. My attorney wrote it and he used lots of legal terminology so I'm sure to get the waiver. [/quote] I used the congress person to try and get the 1st visa refusal reversed. That didn't work so.................I haven't been in contact with them for this new petition. I am working with my attorney for now. If I need the politicians later, I will not hesitate to contact them, but I don't think they can do anything about the first petition once it had been returned to the US. My petition was returned to Vermont in a little over two months, officially. But it made it back to NVC in about 5 weeks, I think. Can't be sure exactly, but the embassy said they sent our petition back around April 24th, so either someone is lying or it got caught up in embassy rotation and NVC held onto it for a while. K-1 Fiance(e) Visa Case Filing and Progress Reports	Fiance Visa sent back to NVC	The same attorney who wrote the above referenced article is advising me to refile my K-1 as well. It's a ####### shoot. No one is being advised to ignore the NOID or NOIR and go ahead with a new petition....but there are cases where the embassy has simply either ignored or forgotten about the first petition (pending) and went ahead with the second interview and issued the visa. This is rare, but happens. The Embassy is obligated to process EVERY petition, they can hold off on this, but not forever. The problem is that CSC is not readjudicating the most recently returned petitions. I don't know why, other than work overload and the fact that these petitions do not take priority. They will simply 'expire' them and make no ruling (at CSC). You can wait 6-8 months or more for them to simply tell you that the petition is expired. Then they will tell you that you are welcome to reapply. I don't know if VSC is doing the same thing, but we'll see. It's $170.00 chance that I, for one, am willing to take if it means my fiance can be here sooner and the government can't steal anymore precious time from my fiance and I. I think as long as you deal with a NOID or NOIR, IF you get one, you can't be charged with misrepresentation. By re-filing and requesting and IMBRA waiver, USCIS can't forget about you.............while we wait in vain for some answer that may never come. The second petition should address any and all issues in the forfront of the CO's mind, even if they didn't put all their speculation and prejudice all in writing on the return petition memo. Philippines	W-8BEN form	Hello. My fiance' asked me to fill-up this form so he can get me a debit card account in one of the US' banks.. This account will be applied jointly(me and him). I don't really understand what is the form for if it's JUST for debit card application or for other things also... Does anybody here knows this form? If he wants to add you to his account and get you a debit card, this form will be accessible through his bank. He should be able to obtain a pdf of the form and email it to you. He can also just request another card and give this card to you. Most banks will require either a Social Security number or a passport number/residents card when adding you to the account. I put all my folders and envelopes in one big bag so it wouldn't be such a hassle to have to bring 3 or more bags with me. I also brought some office supplies just in case...extra paper clips, ballpens...Like you said, better to be over prepared than under prepared. Before the interview, I made sure I knew by heart all the important dates and facts. I also had someone (pretended to be a consul) give me a mock interview to help me get the feel of it so that I could be more confident and relaxed. Removing Conditions on Residency General Discussion	REMOVAL OF CONDITIONS QUESTION	ladies and gents, just looking for some confirmation on the widow of time to file the I-751 , my packing is ready to be sent out for my wife ( conditional card holder ) and I the USA citizen . From what I have  the 1-751 should be sent within  the 90 days prior to the expiration of the 2 year green card  is this still correct ?.. reason i ask is I received  a notice in the mail from USCIS kind of a reminder of sorts to do file this however  her card expires January 20th 2014 so i was going to mail it out October 20th 2013 90 days out .. should I stick to that plan or send it off now ?.. any and all insight is appreciated	Ty & Nanda	Male	0	2013-09-25 20:28:00

I recieved the I-797 NOA saying that her Green card is extened for 1 year , not sure about her passport being stamped  with a I-551 ( will have to check )  is she good to travel on just the letter saying her GC was extened ? Vj peoples , Just curious if this is  the normal process ?  here is what happened for removing conditions for my wife   Paid my fees for removal of conditions sent in our package and only got a letter saying her existing  green card was extended for 1 year and to go to our Baltimore Maryland ASC center for another round of biometrics and photo?s we did that all on January 3rd 2014  . Since that date now 02/27/2014  we have not received anything ?.. seems to be taking a lot longer than her  1st green card that we got a week after her  initial biometrics and photos .
