I'd like to have my fiance visit here, but I've read it's difficult to get a tourist visa, especially for women. She has a job, but it's a new job, most likely visitting me would mean losing that job, especially if it's for any significant amount of time (and of course I'd want to allow as much time here as possible while the k1 processing is going on). She lives with her family, so no rent or financial responsibilities, at least not the kind that may count. She doesn't have children or a husband (obviously) waiting in the philippines for her return. Also, she doesn't have a passport yet. I have a few questions about this.

How long does a passport take to get? I know she'll need this for the k1 anyway, but if it takes 3 or 4 months to get a passport, then likely the NOA2 will arrive first, and there won't really be a lot of time for her to fly here (at that point the cost etc, will make more sense to wait until she can fly here and stay).

How long does the tourist visa take?

Are you most likely to get denied the visa, or to get refused entry at PoE?

What counts as strong ties, I think I've already ruled out the strongest ties, with the exception of the return trip ticket which of course she'd have?

Money is an issue here, it's absolutely worth the cost if successful, but at the same time, the plane tickets alone will put me back about a month financially... I can't really afford that if the odds are against her being allowed entry. I'd really like to be together with her during the wait, but I just don't think it's possible. If the denial typically happens before plane tickets are bought, it's a whole different deal than if you spend 28 hours in the air and a pile of money on tickets to be stuck in a small room in the airport for however long it takes to find another 28 hour flight to cram you into. Those kinda flights (especially alone) are hardly what I'd call fun, making two of them in a row... ow. Anyway, can anyone answer the questions I have on this?


I have tried twice under circumstances similar to yours. So, it actually cost me $260 to find out. The odds are stacked heavily against getting one.

Thai Jasmine rice is hands down the best in the world! It's about $5 per kilo in most Asian food stores and a bit more in many grocery stores. Don't get "glutinous" rice unless you want thai-syle sticky rice or Basmati, which is specific to Indian dishes.

Correct, but if he does not work 40 quarters in the USA he will not qualify SS or medicare.

But we have absolutely no way to prove he's getting a salary. It just looks like somebody deposits money every month. I wouldn't know how to prove to them it's from a job. I'll still look into it.


You can simply state his income you are not required to submit a W2 or other documents. His income up to $80,000 should be exempt anyways but I would still report it.

You will see that for American's it says the same thing on the IRS website "you are required to file a US tax return no matter where you live on worldwide income".

It is common sense that if you have no income, you have not paid tax and have no income to file taxes on...



Well it is a requirement and if you are a US citizen nothing will happen to you but you can have trouble removing conditions, renewing a greencard or obtaining citizenship if you cannot prove you filed US tax returns for all the years you were a LPR. It is harder to prove a negative(I had no income) than to simply fill out a tax form with all 0.00, sign it and mail it in. And common since would dictate that you follow the rules and not do anything that will jeopardize your legal status. I have never been stopped by a police officer for drive 56mph in a 55mph zone but that does not mean it is legal it just means it is rarely enforced but it could be.

US Citizens do not have to file tax returns if they have no income but I was told one of the duties of a LPR was to file a US tax return each year even if it says 0.00 From the USCIS website:

As a permanent resident (green card holder), you have the right to:

Live permanently in the United States provided you do not commit any actions that would make you removable under immigration law
Work in the United States at any legal work of your qualification and choosing. (Please note that some jobs will be limited to U.S. citizens for security reasons)
Be protected by all laws of the United States, your state of residence and local jurisdictions

Your Responsibilities as a Permanent Resident

As a permanent resident, you are:

Required to obey all laws of the United States the states, and localities
Required to file your income tax returns and report your income to the U.S. Internal Revenue Service and state taxing authorities (see IRS link to the right)
Expected to support the democratic form of government and not to change the government through illegal means
Required, if you are a male age 18 through 25, to register with the Selective Service

I don't see an option to file only if you have income.

I would simply fill out the last two or three years tax forms and put 0.00 for income and send them in. That way you have fulfilled the requirement to file US taxes. Joint taxes is one of the items that can show an bonafide marriage but there are many others as well.

I thought you had to actually LIVE in the US to be a permanent resident unless you or your spouse are in the Military. You can live in another country the majority of the time and maintain a Green Card?

We sent Our application on June 14, 2012, received June 18, 2012 Check cashed June 29, 2012 so I would say I am a June filer but if it would make you happier I can move to July.

I am more interested in the people claiming they mailed there application 1 day and received a NOA1 dated the next day. How does that happen?

Well my fiance has not yet receieved the package, but upon checking the Moscow web-site, I saw that we have an interview date.
It is all very exciting. Any words of advice to prepare for the interview? I am heading to Moscow next week. It will be good to see her.

I hope the journey and the cases are going well for all you other VJ'ers.

I sent my 129F on the 8th of may. And I noticed that most people get their first NOA within 10 days. I called USCIS and they said I should call back the 5 of June if I havent heard of anything. Should I be concerned? Should I call them again? Is this unusual?

I'm just freaking out because it seems like everything I do turns astray, and I want to make sure they recieved it so I can send another if they didnt get it or whatnot.



As mentioned the Fed Ex could track it if you registered it. How did you pay? If with a check, has it been cashed yet?
Which office did you go through? west coast is a bit slower in there response times.

What happen to Vermont being the fastest in K-1's. I have Been waiting 2 months and not even a touch. I am getting so worried its hard working and sleeping, all I ever think about is jennifer. Im sure I am 1 or many guys going thu this now and have already been thu it. Its just so hard just waiting.

what is IMBRA waiver?



Did you have to do an IMBRA waiver? If so what did you have to write? how complicated is it?


You should do a search here and read the guides for more details on IMBRA and IMBRA waivers, but the short answer is you need the waiver if you file two or more petitions within a 2-year period. There are other reasons to request the waiver, but this is my reason. I am petitioning for the same individual, so technically, I shouldn't have to make the request, but better safe than sorry because it really depends on who is adjudicating our petition. I don't need and RFE after everything I've been through.

My attorney wrote it and he used lots of legal terminology so I'm sure to get the waiver. You can write your own, but after a visa refusal, I would advice against that.
