I AM SOOOOOOOOO VERY PROUD TO FIND PEOPLE WILLING TO STAND UP TO DO SOMETHING NOW.

1.) Media attention is the BEST idea......but, I wrote to CBS and Oprah and a few other outfits, but no response. Maybe my one letter didn't do the trick. Let's compile a list of reputable news people to contact.
2.) Postal letters and e-mail and faxes all at once is what I propose-->to USCIS, DHS and our Senators.

Here is a draft of the letter I started; don't know where "Mrs." is......but, I appreciate any and all feedback, constructive feedback. We should finalize something soon though. Thanks, W

Vermont Service Center

Saint Albans, Vermont 05479
Attn: Dr. Emilio T. Gonzalez, Director

Dear Dr. Gonzalez:

I am one of many United States Citizens perplexed by the extensive delays in processing of K-1 and K-3 visas at USCIS’ Vermont Service center.

When I began this process I was pleased to find that my application would be processed through the Vermont Service center as I had heard that this particular center processes petitions quickly and efficiently. Lately, this had not been the case.

I am a member of an on-line community whose members share information and experiences related to immigration. We have been closely following the changes that USCIS has undergone, including a substantial rate increase in the fees associated with processing of applications and petitions. While I understand the need for fee increases and some restructuring at USCIS (training prioritizing the processing of applications and not others, etc.) to create a more efficient and customer friendly organization/agency, there are several issues of concern shared by many of us that we would like addressed. It is obvious to us that since June 2007, things at USCIS appear to have gotten worse instead of better. My concerns include:

1.) Significant delays in the processing of petitions. Many of us who filed in June (to this present date) are noticing that a VERY small number of petitions have been approved. Many of us are close to the 90 day mark in waiting for a decision on our petition. Some of us are receiving RFE’s long after NOA 1, thereby re-starting the clock. According to data compiled over the past few years, VSC processes K-1’s in an average of ____ days and K-3’s in an average of ___ days.
2.) Many of us have not received a notice of receipt (NOA 1), even though the On-line Case Status confirms the receipt of our applications.
3.) Information provided by your out-sourced call center employees is often misleading, incorrect or incomplete.
4.) Prioritizing WORK visa applications over Family-Based, Non-Immigrant Petitions

Dr. Gonzalez, I understand that Immigration Benefits are a privilege and not a right, but as a United States citizen, I deserve accurate information AND the opportunity to have my concerns addressed by an knowledgable official who can give me the FACTS (not in-accurate time estimates and scripted misinformation designed to appease nervous callers). Only the truth and some swift action on the part of USCIS can alleviate some of the stress associated with this process. My life is on hold at the moment as I am separated from my loved one and I have no idea when this first part of the immigration process will conclude. The strain of this process (financial and emotional) is taking a heavy toll on my well-being. My frustration level with USCIS' inability or unwillingness to ease this process is reaching a critical point.

?something here about our expectations re: an answer and some sort of formal response.
We can tailor this letter for Senators, etc. and do a mass mailing/fax and e-mail campaign.

What do you think? Too emotional, not personal enough?

It's been awful quiet in here today so I thought I'd jump-start this thread.

When I first filed, the timeline estimated that my case would be adjudicated by September 1st.....
Now the date is November 2.

I was in Albania for about a month with my SO and, although I knew better, I hoped I'd see an approval or at least a touch upon my return. NOTHING.

I'm certainly fed up; have been for a while now.

Are you all ready to organize something or do you want to keep waiting for USCIS to do the right thing?

I sent a sample form letter to another member to proof. I hope some of you will come on-board to wake USCIS and our Senators up before the 6-month mark arrives and we are all still sitting around waiting for an approved petition.

Stay tuned.

Well....I think we need to all do something. Its not just about the individual petition. Its about standing up to say we are humans, with emotions..and to me this is a bit more weighted then what my individual petition status is. Plus once we get our foot in the door and VCS Director starts getting emails, phone calls from Senators offices alll over the usa....they know we are watching, waiting and ready to take the next step...they know we stood up for our simple right to knowledge. Also, I DO understand that the individual petition is processed in its own time. If everyone wants nothing but their individual petition to go through faster then we won't gain the attention of politicians. Its MUCH more reasonable to want information...lets face it...for all we they may have a legitimate reason for the lagging. It wasnt THAT long ago they were processing in less than a month...so SOMETHING happened to stop this fast work...and we, the petitioners, who paid for a service.....have a right to know why the change... Its our right. I think we can get more on board by making others understand as an individual petition we aren't noticed....as a large group of voters demanding their RIGHTS to information on the PROCESS we will get noticed. Just my opinion. Law of large numbers. We'd never get action if they thought we ALL wanted individual petitions rushed. They just need to know we are here and not afraid to demand our rights. Any ideas on how to start and collect the information we need? Im thinking...a listing of state senators, with phone numbers, fax numbers, email addresses. A form letter for everyone to send with a space to say how the lack of knowledge and information is affecting them on a personal level. I say we CC: the white house to. Another date, another campaign.

I got the number of applicatants on file by clicking on immigration timelines...Then K1. I selected last 6 months option and it tells number of files on VJ...or did I read it wrong??? Or is that number wrong? And if it is...how does THAT affect the numbers???

Ok...I guess we need a committee to make letters, help gather information and make a plan on how to recruit petitioners to send this and call. Also, its not just VSC...we can include ALL centers....this isn't just VSC issues....no one can get ANY information for many reasons. Plus the more....the merrier. Anyone interested in helping....message me and lets get rolling. I will look for volunteers to help organize this till next wednesday...then we can make a meeting in chat to discuss the details...look for more details to come..I will start a new thread for this tomorrow. Keep an eye out for it...

Well thought out plan of action. Thank you. I'll start working on a form letter and get back to you. With all the posting on here asking "why......" ...those questions need to be directed to the appropriate officials.
What REALLY works is something to capture media attention-->like the H1-B visa folks, but what can we do without stealing their idea exactly?
Probably need a new thread once we get this organized to post in the other appropriate forums to get everyone's attention on here.

My mind is working double time....

What do others think of a "CALL IN DAY"? A SPECIFIC DAT OR TWO...where we ALL call in to senators offices, flood them with emails, with a plea for simple information???? May not work...but.....what if it DID? whistling.gif (ohhh theres that optimistic positive PMS combination working.... blush.gif blink.gif innocent.gif ) And instead of sending chocolates or flowers to VCS....send the to our politicians with letters....hmmm......

FINALLY...............someone is ready to take some real action. I can't believe it!!!! Really, I was losing hope here.

If you can get people to buy into something like that, I'd definitely support you.

I don't know if you will find many motivated beyond their own individual concerns. I often find when I talk of 'revolt' on here and other forums, the 'sheep' run for the hills for fear that some USCIS official is secretly cruising the site....looking to retaliate against anyone saying or doing anything to make the organization look bad.

A little anarchy is a healthy thing. Complacency is deadly, IMHO.

Good luck and PM me if you need any help or want to brainstorm.

Go here:
http://www.dhs.gov/x...3751418157.shtm

You will also have an opportunity to call in and voice your concerns, sometime in mid-August. I'll be out of the country, but I would highly recommend that MOST of you on here with concerns:
-inaccurate information
-no hard copies
-over 90 days, no NOA2
-not being able to access a knowledgeable immigration officer for answers
-inaccurate timeline data published on the website
-the list goes on and on and on

ACT NOW!!!

K-1 Fiance(e) Visa Case Filing and Progress ReportsWaiting for a NOA2 from VSC for your I-129F?
Has anyone had time to 'really' read the Ombudman's report on USCIS? It's lengthy and I just skimmed through it, but I think I remember reading something about a recommendation that more checks (perhaps security) are done up front while the petition is still at USCIS......before they go to the consulates.....
Now, don't you all start jumping up and down, but I could swear I read that.
It's just one more bit of speculation re: this process slowing down so much.....in addition to the H1-B visa mess and other anomalies. If this is true, it's gonna be 90 days, or more, for everyone from here on out (except Cuban fiances).

My first petition through USCIS was approved in 12 days-->October/November 2006. I think those days are over.

If anyone has the time or patience, it might be worth looking into........and the rest of you can either hope for a miracle and speedier processing or just come to terms with the fact that this is the way it's going to be from here on out.

BabyBlue, thank you very much for your support. I am at my wits end. Every waking moment I spend researching and appealing to every agency, person, entity anyone who will hear our pleas. I am soooooo burned out, depressed and stressed I need to take a leave of absence to go to Albania to relieve the pain of the separation from my fiance. I've exhausted my savings on travel and attorney fees. My last resort is to sell off all my belongings, pay off most of my debt and move to Albania. It's crazy and I don't want to do that. I can't work there, heck, there are sooooo many Albanians who can't find work. I don't even want to get into the personal and physical toll this has taken on my fiance (out of respect) who sits there in Albania with nothing to do but wait for this infuriating system and repeatedly ask me to come there. It's heartbreaking!!!! When I think about it, yes, I'll leave everything I have behind in the U.S. to be with the one I love (my elderly parents, my job, excellent medical care and political freedom-->or so I thought). What are 'things' if you can't share your life with the person you love, you know? I wouldn't wish this on my worst enemy, seriously!!!! I so hope you don't have any problems with your petition and from what I'm reading-->you are on top of your game so, "bless you".
Virgillionare,
I have contacted 2 senators and 1 representative. They say they will help and they make inquiries on your behalf, but they were not successful in keeping our 1st petition from being returned and they can not speed up the review of that case, which now languishes on the desk of some adjudicator who might get to it in one year or so. I so hoped this second petition would be approved quite quickly with all of the evidence I provided this time around....our first one was approved by USCIS in 12 days!!!!! With this H1B visa business, we are all in for a lot longer wait than I every expected. I'm trudging on but I'm afraid the writing is on the wall, for me at least. Life is so short, you know? I could get hit by a bus or my plane go down and this precious little time we have is wasted....... and we all know once today is gone, you can NEVER get it back. :crying:
Thanks again for your support!!!!

Bzoom,
Please add me to the list.

This process is some serious Bulls***!!!! :crying: Really, I am soooooooooooo disgusted with USCIS and their cohorts--> these embassies under DOS. They really couldn't care less about us; we are nothing but nameless, faceless numbers to these people.

I really don't understand why we don't organize and protest or something. If the H1-B visa people can get action, why can't we? More and more delays, lies and needless red tape. You need a friggin' degree to navigate the immigration maze....dot your 'i's and cross your 't's and still you may get tripped up....and by 'tripping' us up, do they realize they forever alter the course of our lives? No humanity and no compassion....just the facts, the rules, policy and regulation. Okay, now they are charging more money for substandard services and we have no choice but to pay them and wait?

I am so ready to leave the U.S. and make a life elsewhere. Yes, I know, I know-->"the grass is always greener.......". Someone please talk some sense into me. :help:

 I don't blame you for being burned out on the process, once through it is bad enough! It seems unfair to me that apparently they dropped everything (our petitions) for these H1B visas. Should be first come, first served, but businesses come first nowadays ($$$).
FYI, not sure who your senator is, but I wrote an email to Senator Cardin (i live near baltimore) about my first come, first served idea and he wrote a nice letter offering to look into my petition. Maybe you could try that as it sounds like you have run into some serious red tape.
Virgil

Hi Wendy! Thanks alot. We're tickled like 2 children before Christmas. Haven't see you in a while. And reading your signature timeline is a little confusing to me. I'm not sure where exactly you are in your process. But I hope you're doing well and maintaining your optimism. You sure do get mentioned alot on these forums though. You're like our local VJ celebrity. cool.gif

(time to run off and investigate your current status...)

KimandRuss....I'm just watching the clock ClockWatch2.gif

Well.....my timeline confuses me too!!! Basically, I had to put the events on my signature....because we are in 'review status' and there aren't a lot of options for that in the timeline format we are given. Basically, we are still waiting for our first petition to be reaffirmed. The 'official' timeline reflects our 2nd petition.....which I filed in case the first was either refused or expired....USCIS in Vermont and California have different procedures for petitions returned/refused by the embassies. Hope that makes things a little more clear.
OMG-->more talking about me here? I can only imagine.......still, it's nice to be considered a bit of a celebrity...although I wish my 15 minutes of fame would be over already. Anyway, I'm hanging in there...back in the states because it just got a bit scary over there in Albania....it's a long story, but it's amazing how foreign countries view Americans.....many think we are all filthy rich and that can invite unwanted attention. There is a lot of corruption in some of these countries and really, the police can't protect you....particularly if THEY are corrupt also. Besides, I am broke and I need a job if I do want to get my fiance over here. I had planned to make a life there, but I'd have to sell everything and after I realized it wasn't going to be a safe place for me, I really had no option but to return home....and that was REALLY hard for me because you KNOW i'm a fighter headbonk.gif , but common sense FINALLY won over.
So, here I am. smile.gif
Congratulations again.
FYI-Maybe you all already know but Gonzales resigned from USCIS and....
unfortunately so did the Ombudsman (leave DHS)
I'm happy about the first, but not the second. The Ombudsman really worked hard to try and effect change at USCIS, but after July 2007, USCIS just stopped responding to his recommendations......heck, I'd resign too. What's the point....like rolling a boulder up a hill, only to watch it keep falling down. wacko.gif

Hello Everyone....No, I didn't forget about you all.
I hope everyone here has gotten some progress, if not an approval, in their cases.

I'm still waiting, but my case is very different and very complicated. Still waiting to see if USCIS will reaffirm our first petition......and if not, will they go ahead and approve our second petition. Anyhoo, I'm happy to see that most of you are through the thickest part of the fog.

P.S.-I'm back in the U.S. Had a few 'close calls' in Albania and figured I'd better go home to finish fighting this battle. Besides, thanks to this lengthly and cumbersome immigration process, I am OFFICIALLY 'broke'.
Cheers, Wendy

I was just thinking...it saddens me greatly that obviously VSC is much faster than all the rest. I don't really understand why, to be honest..but I guess it's one more of those reality checks we as adults get all to often, that life just isn't fair. I do feel lucky and blessed..don't get me wrong, I just wish it was somewhat more uniformed. It's so hard to gadge where you are at in the process with such huge timing gaps. I don't really get the process, I'm just taking this all one doc. at a time. I can only hope I fill things out correctly and so on. Anyway...all this post is really is to just say, yeah it sucks. I am saddened by the delays that any of you feel. I've waited to be with Craig for such a very long time already, I had to "wait" through the whole process of my divorce which started with a one year mandatory seperation before I could file even a bit of paperwork.........oh well you don't need to hear those problems. I just read on the NVC site to give it 3 weeks before calling them to see if they have your I-129F or not. So I guess I get to still just wait. I don't know if it's in the mail or anything :(

I'm thankful yes that I got my Visa approved, but I still haven't gotten the hard copy that is supposed to have guidelines on what to do next. I got the email saying it was approved on Mar 1st, so I'm not sure if there's a lapse between the approval and them actually mailing it out or what.

Has anyone who is at the NVC stage actually get contacted when your petition reached there? What about when they mailed it to the appropriate embassy?

Is it necessary to call/email them to be sure all of this is on track? If so, what is an appropriate amount of time to wait before calling/emailing them?

The only thing I'm worried about is the AOS and the Ghanaian Embassy. I'm a student and currently unemployed so I'm wondering how that's going to work out.

Any ideas??? Any ideas to ease my anxiety???

Ghana love, welcome to the Club!!!!!!!!! yay for Vermont feb filers!
first, be sure to fill in your timeline, go up to My Assistant. You have filled in your signature but not your timeline and so your info is not being included in the immigration timelines that help us all out.

As for the ghana embassy, there may be delays. I hear that you have to wait months to schedule an interview. in terms of being unemployed, you'll need a co-sponsor. also check out the sub-saharan africa forum, theres lots of ghana folks there who can anser specifc questions about the idiosyncrasies (sp?) of the embassy in accra!

btw, i studied abroad at legon...did u as well?

GOOD LUCK!!!!!!

Thanks for the quick reply! I didn't realize my timeline wasn't showing up, I thought I had filled it out.

I studied abroad in Cape Coast actually. I used the School for International Training, www.sit.edu, and had the best time of my life... especially since I found my future husband! How did you find yourself in Tanzania??

I'm joining the February Filers Team. Let's stick together and hope for speedy results. Mailed mine on the 5th and got my NOA1 on the 12th.

The only thing I'm worried about is the AOS and the Ghanaian Embassy. I'm a student and currently unemployed so I'm wondering how that's going to work out.

Any ideas??? Any ideas to ease my anxiety???

K-1 Fiance(e) Visa Case Filing and Progress ReportsPassed Manila USE Interview!!!
QUOTE (Ann-Drew @ Mar 11 2008, 06:05 PM) <{POST_SNAPBACK}>
She did it!!! My Fiancee passed her interview at the US Embassy in Manila yesterday! It's been a little over 6 months since our NOA 1 and Im overwhelmed that she will be with me here in the US in just a matter of days. She had every form required by the USE as well as more than enough evidence of our relationship (though the Consular only asked to see photos of us together). She said he was very surprised that I visited her twice in the Philippines and overall it was a fairly painless experience.....(except for her first experience with the ####### of a needle at St Lukes). I am actually VERY surprised at how easy this process has been for us - I had seriously considered using the aid of an attorney but in retrospect, that was obviously unecessary with the abundance of help available on this site. (Special thanks to Sheriff Uling!) I wish the best of luck to those still on their "visa journey", with a little time and patience, it CAN BE DONE! Thanks too, to my Mother for all her countless hours researching this site and helping prevent any of the numerous delays so many others here have experienced, by learning from their mistakes posted here. I cant find the words to express my excitement about picking up my Sweetie at the airport here in my city later this month, a moment Im sure I will remember forever!

Congrats!
