K-1 Fiance(e) Visa Process & Proceduresquestion 18
Here is mine:

I, one luck guy, and the sweetest lady first met on Blank, 2004 in Disney. I was a traveling salesman and she was a siren. Sweetie was visiting her brother in Epcott Center when we first became acquainted. We maintained a relationship over the next two years while I lived in Disney and during the subsequent two years I have been in America.

On Blank, 2007, I returned to Disney to spend time Sweetie until Blank, 2007.

During the month of Blank 2007, Sweetie came to America to try clam chowder. I went to visit her in the Magic Kingdom over the weekend of Blank 7 to 9. Sweetie visited me in Neverland during the weekend of Blank 14 through 16.

I returned to Disney from Blank, 2008 until Blank, 2008 to ask for Sweetie's hand in marriage. She accepted and our intention is to wed once she is able to come to America.

Obviously I replaced details with substitutes. I tried to establish the original meeting, as well as having fulfilled the requirement of having met within the past two years. Some folks talk of presenting a timeline for the interview, would something like this suffice, I wonder?

Your time may be better spent accumulating additional evidence of ongoing relationship, such as emails, chat logs, phone bills, packages/envelopes sent with accompanying cards/letters, etc. Your fiancée can do the same from her end.

There may be a good chance that the second notice of action (NOA2) arrives while you're there, but from that point it could be at least 4 to 6 more weeks until she has the interview. That largely depends on when you send in the required forms (varies by Consulate) that are sent by the Consulate to your fiancée in Packet 3.

K-1 Fiance(e) Visa Process & ProceduresVISA JOURNEY TIMELINES RELIABLE ?
Our timeframe changed several times, often being pushed back further. In the end we were adjudicated BEFORE the original timeframe. I would say it is relatively accurate, but by no means a way to determine exactly when your case will be adjudicated. Even when USCIS reaches your month's petitions, there can be a great delay between the first and last cases being adjudicated.

K-1 Fiance(e) Visa Process & ProceduresI-129F Question No. 10
I would recommend that you do have her sign a G-325a (four copies of the same form). Technically there is a memo stating that an RFE (Request for evidence) should not be issued someone does not sign the G-325a, but I would play it safe and have her print, sign and send you the form.

K-1 Fiance(e) Visa Process & ProceduresWrong mothers b-day. Now what?
Since you have already received NOA2, I doubt it shall be an issue either. You could bring proof to the interview of your mother's actual birthday i.e. birth certificate or passport, and if asked about it, explain and show the proof.

Have no fear!

K-1 Fiance(e) Visa Process & ProceduresRFE - Is it Good or Bad
I am unaware of having to submit copies of all pages of the passport if one intends to use it as evidence of having met in the past two years. I am aware that one is to submit copies of all pages of the passport if one intends to use it as evidence of US Citizenship (Pettitioner). I did not submit all pages, rather just the photo and bio pages along with pages that contained the appropriate stamps.

K-1 Fiance(e) Visa Process & ProceduresSufficient evidence of having met my fiancée in the past two years?
Several VJer's have encouraged sending evidence that is beyond just having met in the past two years, such as copies of greeting cards, emails, etc. Their rationale is that all that information shall be forwarded to the Consulate and can then be examined by the CO during the interview. Whereas, anything submitted at the interview can be refused; that is, the CO can say "I am not going to take that." They can't say that if it is already with the petition.

A Thai poster recently said that his fiancée submitted the emails and other correspondence to the pre-screener, yet when the CO asked for this, the pre-screener continually said "No have. No have." Although it was right there in her hands.

I encourage you to submit some sample emails along with copies of phones bills, etc. from within the past two years of filling. You don't need to make it 300 pages of evidence, but I ended up submitting about 70 pages, including the forms. We have gathered even more evidence from the time we filed until now for the interview.

K-1 Fiance(e) Visa Process & ProceduresLetter from bank for I134?
I agree with you, Danny and John, that it cannot hurt to be overprepared, and since this is a relatively simple procedure for most people, why not do it?

However, it does not state in the new I-134's instructions that a bank letter is necessary. It does state:

QUOTE
As the sponsor, you must show that you have sufficient income or (emphasis added) financial resourse to assure that the alien you are sponsoring will not become a public charge while in the United States.

Someone who makes over $50,000 a year and provides a letter from employer, pay slips, and three years of tax transcripts/returns shall not be required to supply the bank letter.

It goes on to state:

QUOTE
Evidence should consist of copies of any of the documents listed below that applies to your situation.

It does not state everyone must supply everything below. If I am just making enough to be 125% of the poverty line, I would likely want to include the bank letter. If I am making double it, there simply is no need.

That is precisely how come other VJer's, like Gary, say "There is no need if your income is sufficient." That is what the instructions state.

Again, I am in agreement that it's no big deal and could do no harm in having. At the same time, it is unnecessary for some.

K-1 Fiance(e) Visa Process & ProceduresNo NVC hard Copies?!?!?

ThaitoUSAMaleThailand2009-03-18 20:45:00
K-1 Fiance(e) Visa Process & ProceduresQuestion about evidence...
I am a supporter of front-loading in light of stories of additional evidence being provided by the beneficiary at the interview but not being accepted by the interviewing officer. Phone records, photos, emails, etc. were all brought to the interview as required but would not be looked at.

If the petitioner front-loads the I-129F petition with at least a sampling of photos, emails, phone records, etc. and the petition is approved, the interviewing officer must accept those pieces of evidence.

As pushbrk has stated, this is not necessary in all cases, but it certainly could do no harm to include.

K-1 Fiance(e) Visa Process & ProceduresI-129F to complete processing time?
Paperwork shall become your forte. The paperwork continues for at least the next 3 years. You have to file innumerable forms, fees, and facts about your present and past locations, employment and education.

If you wish to pay me to do it for you. I would do it for a small fee. One day I want to be a USCIS adjudicator to help speed along the process for those in love.

ThaitoUSAMaleThailand2009-03-07 13:02:00
K-1 Fiance(e) Visa Process & ProceduresHey guys I am new here and I have a few questions.
A touch indicates that the petition has been handled. Usually touches appear shortly after the petition has arrived at the service center, and in our case, on the day we received the second notice of action (NOA2) indicating the petition had been approved.

Once you have received NOA1, you can use your case number to register on USCIS's website. Touches are found under the update column on your profile. We had a total of four touches. Some folks go through the entire process without receiving a single touch; other folks are never able to access their case online.

I would highly recommend that you see your fiancée again, at least one more time, between now and her interview (which could be anywhere from 5 to 8 months from now). Having only met in person once ever may cause a bit of suspicion on the interviewing officer's part.
ThaitoUSAMaleThailand2009-03-22 08:25:00
K-1 Fiance(e) Visa Process & ProceduresDouble sided or Fronts?
I am not certain if it is allowed to copy documents on front and back of one sheet or to print forms on front and back. I just printed and copied all as one sided, which is perfectly acceptable.

The G-325 is four separate sheets that have unique markings in the bottom corner i.e. this copy goes to blank, this copy to blank, etc. All four contain the same information from you.

The beneficiary's (person getting the visa) birth certificate does not need to be included in the I-129F petition, but will be required at the interview. The beneficiary's passport may be included if it provides evidence i.e. entry stamps, visas, etc. of having met within the last two years or proof of ongoing relationship. For example, my fiancée had traveled to America, so we included a copy of her passport with the US visa.

K-1 Fiance(e) Visa Process & ProceduresNVC when to call
This is a bit off-topic, but in your signature line, Cereza, you state that you were engaged on Feb. 15th, 2009. Technically you were to have been engaged at the time you filed the I-129F petition. I would not tell an consular officer during the visa interview that you were engaged after sending in the I-129F petition.

QUOTE
Dont you WANT the choice not to have to fulfill this role of always having to be the strong one? Relied upon one? The one that everything rests upon? I want to be a team with my future husband...

I see my fiancée and myself as a team, a partnership. Each of us has strengths and weaknesses and in understanding each other's, we can effectively work together to accomplish mutual goals e.g. her earning her PhD, me buying the farm (really want about 10 acres of land), etc. Most relationships throughout the world are involved with each other. This type of relationship comes from the solar plexus, pride, and involves being right at any cost, one-upping the other one, etc. The relationship that my fiancée and I strive toward is one of alignment, where our common principles, values, and goals bind us together. The former is a vertical relationship, that expends energy going back and forth, while the latter is a horizontal relationship that gains energy due to its alignment to principles (such as honesty, being helpful, understanding, caring, etc.).

My fiancée comes from a culture, Thai, that still predominantly adheres to the older view of relationships. I am not referring to involvement vs. alignment, rather the social roles of males being the bread-winners and females being the child-rearers and house keepers. My fiancée is about 30 years old and though she is far more open minded (she has already earned her Master's degree, which is rare for Thai women), she is still influenced by her culture. She does perceive me as a strong protector, who will ensure the safety of our nest.

In closing, I would propose that this issue is not an either/or rather chocolate and vanilla. Though I certainly prefer chocolate and can hardly understand how anyone could choose otherwise, I do not need to vilify vanilla. So each is free to choose his or her preference without demonizing the other. Cause I have a feeling that both views shall continue for a long while, it seems unreasable to attack the other.

All the best

K-1 Fiance(e) Visa Process & ProceduresAlmost approved K1 - can get married outside US?
I do not know of any flights to Saint Thomas USVI that stop in other islands, besides Puerto Rico. Our normal flights from Baltimore-Washington International or Dulles usually lay over in NC. As far as the doomsday prophets who ask "What if you were forced to land on another island?" e.g. Dominican Republic, it would still not be an issue as we would not be entering port, rather just landing.

Perhaps it would be prudent to mention that once in US Virgin Islands, the beneficiary should not travel off island e.g. British Virgin Islands.

As an aside, my parents live on St. John and ICE now regularly checks the papers of people traveling between there and St. Thomas on the ferry. An acquaintance got picked up with expired papers and the last I heard he was in a federal penitentiary in Puerto Rico. With the large number of Chinese illegal immigrants coming through the USVI, I am going to be sure my fiancée has her passport at all times!

K-1 Fiance(e) Visa Process & ProceduresLength of visiting each other?
Paying her bills would not count, nor would buying her parents gifts, as I have done both already. The dowry is called 'sin-sot' in Thai. The parents want cash and gold at the very least. The amount depends on the girl's socio-economic class, as well as the 'farang' (foreigner) factor: Generally Thai view westerners as very wealthy, so they expect more from them.

A typical asking price might be 10 Baht in gold (currently around $1,400 worth of gold), as well as 100,000-200,000 Baht ($2,800-5,600) in cash. Among the social elite in Thailand, gifts of BMW's, townhouses, etc. is not uncommon. Generally if a girl has already been married or has children, the man is not expected to pay anything, though as cdrrck24 mentioned, the family usually returns some if not all of it anyway.

Edit: sin-sot is generally negotiated by the parents or close relatives of the to-be groom with the bride's parents. This is another reason why foreigners pay more, as they may find it difficult to negotiate, and often leave it up to their fiancée's to help.

K-1 Fiance(e) Visa Process & ProceduresLength of visiting each other?
I second the suggestion to avoid showing your financial support; it could be misunderstood. I certainly encourage at least one more visit prior to your fiancée coming to America. Be sure the evidence is not just one-sided: it should show communication from both directions. Having phone bills from your fiancée showing that she calls you too, as well as having her send you emails and regular cards/letters in the mail is supporting evdience of a bona fide relationship. The more evidence you can collect, the better.
ThaitoUSAMaleThailand2009-04-20 18:14:00
K-1 Fiance(e) Visa Process & ProceduresProof of Engagement?
What you will want to gather for the interview is proof of ongoing relationship. This would include boarding passes, passport stamps, photographs together, and receipts from any trips made after filing for the I-129F. It would also include phone bills, emails, chat logs, and letters through regular mail. The Consulate Officer must be convinced that it is a real relationship. These pieces of evidence shall assist, but it also includes the non-tangibles, such as the sincerity of your fiancé and the bias of the officer. Wish you all the best.

We sent the paperwork in October 17th. We are now approaching the final step of the interview, at which point she could receive the visa. We've had no delays, barring an additional week wait for the police certificate. We're coming up on six months now. Looks like it will take about seven months total. With the current processing times being what they are at VSC, it seems like this could be your minimal wait time. So anticipate anywhere from seven to ten months.

K-1 Fiance(e) Visa Process & ProceduresIn between NOA1 and NOA2
Bangkok is specific about what they want for the I-134. If you search "Thailand Packet 3" you should be able to find a scanned copy I uploaded or a .pdf another member uploaded. These are of the most current Packet 3 checklist (unlike the embasssy's website which still has the old one up).

You will need:

1) completed I-134 (new form does NOT need to be notorized)
2) a letter from your current employer stating your position (full or part-time), and current salary (Wait till NOA2 to get this)
3) a copy of your (Petitioner) Passport
4) Tax return and/or transcript from the most recent year (as of now, 2008)

You must earn at least 125% of the poverty line, which would be about $18,000 for a household of two. That is the minimum, if you earned $20,000+, you should probably be fine. There is no need to disclose bank account info, property, life insurance, etc. if you earn at least 125%. However, if you are still close to that threshold, you may wish to add bank account information. All that is required though is what I listed above. Check out the Packet 3 checklist and see for yourself.

It is consulate-specific since in Bangkok you may present any document in Thai or English. However, if it is another language, say Burmese, it would need to be translated into English.

Since you are suggesting you shall submit these letters with the original I-129F petition, you would probably want to have accompanying English translations. Certainly the adjudicating officer may read the entire contents of each email you submit, so be certain you do not mind sharing that.

The better solution is simply to refrain from submitting emails with the petition. They are not required. Use them as evidence of an ongoing relationship at the interview, not with the petition filing. If you do submit them with the petition, yes follow the USCIS translation guidelines.

Wouldn't this return us to the axiom of whether to front load the petition i.e. provide some documentation of ongoing relationship prior to the interview to ensure admissibility at the interview or not? Generally I wish to suggest doing it, as it appears to do no harm and could benefit, as experience has shown. The advice to refrain seems to support the null hypothesis of this principle i.e. not front loading is the preferable advice. I am uncertain of which is more advisable.
