 I want to say thank you for posting these stats. I actually enjoyed looking over them and KUDOS to you for researching and putting them together and then also sharing them with the crowd. Atleast I now know that I am not being singled out and picked on!

I think you would make a great statistician...both because of your natural curiosity and your ability to be good with numbers.

K-1 Fiance(e) Visa Process & ProceduresI-129F Processing in Vermont
I applied in May and recieved and RFE almost exactly 5 months to the day. I responded promptly to the RFE and it has now been 5 weeks since that happened. Everyone else that filed at that time have already recieved their NOA2s and are well on their way to interview and Visa in hand.

I contacted my Congressman which resulted in absolutely NO HELP whatsoever. I called USCIS today and because in their response to having recieved my RFE they state that it can take up to 60 days for them to process my case which will put me at over 7 months processing time.

Like everyone else here, I am hoping to hear something every day....but I have this sinking feeling that they will take the entire 60 days just because they bought themself some time.

I am very upset about this whole ordeal that sometimes I can't even breathe.

K-1 Fiance(e) Visa Process & ProceduresCase forwarded to Consulate
Good Evening VJers!

So I have been reading and researching and gathing all the needed information so that I would be good and ready to move quickly after receiving my NOA2. BUT then I got the hard copy of my NOA2 in the mail and it says that my case has been approved and was forwarded to the listed Consulate. I was expecting it to say forwarded to the NVC. So any idea why it reads like that? It might be nothing and this is normal but I wasn't sure so I wanted to ask to see if it is in fact normal. I also want to know who I need to follow up with in the event that too much time passes and I don't hear from anything. So any details about what comes next would be great too. I THINK my fiance should recieve an e-mail with instructions but I just want to be sure.

Just wondering where I am because I am a bit disoriented at the moment!!

Thanks! :)

Have they recieved the photos that they requested? It took them 6 weeks to process my RFE and that was AFTER I submitted a Service Request with them. I suggest calling them on Monday and asking for them to submit one for you. That is really all you can do.

K-1 Fiance(e) Visa Process & ProceduresText Message History
I have been gathering information to prove my relationship with my fiance for his interview. I wanted to pass on some critical information for anyone who uses Verizon Wireless. Actually I am not sure if this pertains to other US Wireless carrirers but just in case it does, you might want be aware of this also. I just found this out today.

I thought that the past 6 months of text messages would be stored and I would be able to pull this information and easily print it out for the interview. Much to my dismay I have learned that they only keep the past 3 months record of these. This is what they sent me an in response to my e-mail inquiry, "Verizon Wireless offers the ability to view a detailed report of your text, picture and video messages online. You will be able to view the date, time, and destination of sent/received messages for the last three billing statements as well as the details on your unbilled messages." They did say that they could pull data from earlier dates but they will need a search warrent for them!? :wow:

My finace and I do ALOT of text messaging. It really is our primary form of conversation. Soooo I might have 4 months of texting records to show at the interview out of the 8 months that have passed. I do have my call history and also other forms of ID but this was a bit surprising for me to learn so I thought to share it here to alert anyone who is counting on printing these all at once to maybe do a better job than I did and print them as you go. :crying:

K-1 Fiance(e) Visa Process & ProceduresOriginal documents
What you really want to do is anything you can do to not get a Request For Evidence (RFE) which can cost you a lot of time. So by taking the extra step in having her mail you her original signature on this form you have atleast removed that as a case for an RFE.

The extra week or so it will take for her to mail those to you will be a good time for you to double check your petiton! :) HAHAH just trying to look on the bright side! LOL

Good Luck! :)

K-1 Fiance(e) Visa Process & ProceduresOriginal documents
When I sent in my I-129F petition, I had to get my fiance to write a letter from him stating that he was legally free and willing to marry me and it had to have his original signature. I don't know if a scanned copy will work, I errored on the safe side and got the snail mail version with the ink on the paper. The G-325A form will also need the ink to paper signature.

K-1 Fiance(e) Visa Process & ProceduresMedical exam.. stupid move, dont repeat, heads up to others!
I did a lot of research on this a few weeks ago because my finace doesn't have a shot record so he will have to get all of them. I was going to have him get started while we are waiting BUT then I came across this question on the USCIS website and found it very useful. I hope it helps set your mind at ease.

Q: Does USCIS require that all shots in each vaccine series be completed before applying for adjustment of status?

No. The applicant must have received all the required age-appropriate vaccines that could be given at the time of the medical exam. If the applicant has started the vaccination series, but is not able to complete all the required shots because, at the time of the medical exam, the minimum time interval between shots has not passed, the applicant may still apply for adjustment of status. A waiver is available in cases where, due to required time intervals, it was impossible for the applicant to receive all shots in the series before submitting the application for adjustment of status.

For example, the Hepatitis A vaccine requires that applicant receive two doses of vaccine, six months apart. If the applicant receives the first dose in January, he or she does not have to wait until July, when the second dose would be given, to submit the adjustment of status application. However, the applicant must have received at least the first dose of the vaccine, if appropriate, before applying for adjustment of status.

So as long as he has his shots documented then there shouldn't be an issue.

So in an attempt to help the OP's need. How would she go about annotating this in her I-129F petition? I didn't see anywhere specific to do that when I filled mine out (although I wasn't looking for this specifically) but it seems she is passionate about including it. Any thoughts, ideas or recommendations to her to incorporate it?

K-1 Fiance(e) Visa Process & ProceduresLost in the sauce

I'm not sure about the strange phone call either. But I wanted to let you know that it took around 3-4 weeks for the embassy to acknowledge having received Packet 3.5 in my case. Rather than contacting the embassy about it or AEG, I called DOS each week until they acknowledged that Packet 3.5 was now in the system & that an interview date was assigned. I think his interview was approximately 6 weeks after we submitted 3.5.

I was also worried that we had gotten the courier wrong. I was able to find a website for AEG that has a visa tracking page: http://www.aegusvisa....aspx?PageID=17 . I haven't seen anyone mention this page before on the Pakistan portal. Anyhow, when I entered my fiance's passport number, his information came up....So I stopped feeling nervous that we hadn't turned it in correctly.

I suppose the AEG website was set up to model the system in other countries and allow for tracking. At some point months ago, my fiance's status changed to "Delivered" (It was around the time he got his interview letter). Since then, the status has remained the same. After my fiance got his visa, I checked to see if AEG had made any changes to the status -- nope! AEG hasn't quite figured out how to do these status things then :)

Hey Thanks soo much for this information! Actually my fiance found this site referenced on his reciept from the American Express Office where he sent his documetns from. We check it everyday and as of today it still says No file is found. :( Perhaps we just need a little more patience.....after all it has only been 8 months since we started this process...why want to rush it now!! LOL :)

Hopefully we hear something from them next week - InshAllah.

I can say for sure that it didn't have anything to do with him getting his police certificate because he did that about 2 weeks prior to the phone call and already had it in his hands.

Ok now I am getting a bit more worried about it. Hopefully no harm will come because of it. He was completely honest with the Officer, if it was an Officer.

My finace and I received our Packet 3.5 at the beginning of December. He returned it to the Embassy using American Express Office in Islamabad on December 22nd as instructed in the packet. As of today, the Embassy shows that they haven't received the documents and American Express is telling him not to worry that he will recieve a call from the Embassy soon. Any advice on how in the world we track down our documents and secure an interview date?

On a separate note, he recieved a phone call on December 19th from a Police Officer stating that he had a background check request for my finace and wanted my finace to tell him about himself (i.e. where he worked, where he lived, what he did in his spare time, where he went to school, etc.) is this part of AP or what?

Any comments, thoughts, advice are more than welcome!
Thanks!

OK so one last question that has me completely paranoid. Usman and I didn't have the traditional "engagement party" that is usually thrown in Pakistan. We just simply exchanged rings, agreed to be committed to each other and then filed for the K-1 Visa. Is this going to cause us problems?

K-1 Fiance(e) Visa Process & ProceduresPreparing for K1 Interview
Thanks so much for your responses! I think it is a great point to have the 2011 tax returns available if needed. As Winning23 stated I am waiting for many documents in the mail before I can actually file. I have more than just the W2 that has to come to me. I have some forms from my schooling and some other investments. I will do my best to file BEFORE Feb 23rd (Usually I have been able to do this at the beginning of February in past years). I can always email the .pdf version of my tax return to Usman to print out. I actually make well over the poverty line and have done so for the past 5 years so I am not much too worried about that.. So since they are asking Mohsin for 2011 I will do my best to make sure Usman has it too. I had intended on being there for his interview but since I made the trip over the holidays to see him he is going to have to go to it without me. So, I just want to make sure Usman is prepared for any question they can throw at him.

What about other evidences for our relationship proof. I feel like we are a little light on that end. Or am I worrying for nothing?

K-1 Fiance(e) Visa Process & ProceduresPreparing for K1 Interview
I am the petitioner (the USC) my fiance is the beneficiary (25 y/o male) so I am very nervous about our interview in Islamabad on Feb 23rd. When I went to visit him in Islamabad over the holidays I took the opportunity to deliver most of the paperwork that he would need to take with him to the interview. However, now it will be 2 months additional that I need to send him proof for, soooo since I have to send him a package, I thought to post what I have here and get your thoughts and views on if you think it will be enough:

What I gave him:
1- Full copy of the I-129F Petition with all correspondence between me and USCIS (NOA1, NOA2, RFE and shipping receipts)
2- Chat logs
3- Phone logs
4- Text Message logs
5- Receipts for packages I mailed to him for holidays and his Birthday
6- ezetop receipt for when I would top off his cel phone to add additional minutes
7- I-134 Affidavit of Support
8- Last 6 months of pay statements
9- Last 3 years of tax transcripts
10- Letter from employer

What he will add to the paperwork:
1- Birth Certificate
2- Police Certificate
3- Passport
4- Greeting Cards I sent to him in holiday packages
6- Medical Examination

What I am going to send to him:
1- A picture book I made from Shutterfly of all of our pictures that we took together this past year on my two trips to visit him
2- My itinerary from my 2nd trip I took in December
3- Copies of my Passport to show Pakistan Visa and entry exit stamps from my trip in December
4- Copies of the Boarding passes from my trip in December
5- my January pay statments
6- my January cell phone logs and text message logs

Soo my question is, am I missing anything or are there any other things I/We should include?

Many thanks to all responses and guideance provided.

K-1 Fiance(e) Visa Process & Proceduresimmunizations
I actually did a lot of research on this topic a few months back. Here is what I discovered: http://www.cdc.gov/v...lt-schedule.pdf that gives you a breakdown of the immunizations needed for adults.

I also had a question about the immunizations that are a series of 2 or 3 shots. I found this to be very helpful from USCIS Q&A section: (http://www.uscis.gov...0004718190aRCRD)

"Q. Certain vaccine series can only be completed with multiple visits to the civil surgeon. Am I required to complete the entire series before the civil surgeon can sign the Form I-693?
A. You are only required to receive a single dose of each vaccine when you visit the civil surgeon. You are encouraged to follow up with your private health care provider to complete the series. Once you have received the single dose appropriate at the time, the civil surgeon can sign and certify the Form I-693."

Hope this helps!

K-1 Fiance(e) Visa Process & Procedurespacket 3...W2's vs tax transcripts.
I wish this process was more streamlined so that one person's experience could really benefit others who follow. Having said that, I am not sure what is contained in Packet 3 from Austrailia, but with my fiance in Pakistan he only sent the Forms that they requested he fill out and send back to them. All supporting documents, to include the affidavit of support and tax forms he will carry with him to the interview to give to them personally. So, having said that, I had time to get the tax transcripts for the past 3 years (2010, 2009 & 2008) as far as 2011 goes. I am playing this by ear. HIs interview date has been scheduled for Feb 23rd. So I am hoping to be able to file before his interview and then he can just take a copy of my taxes with him (Tax for 1040). If I don't get to file beforehand, then my W4 and past 3 month of pay statements should suffice. (fingers crossed) So that's my plan.

Others have actually gone to their IRS office and somehow were able to get thier W4 and filed early so their significant other could have 2011 tax documents. So I guess that is also possible for you to do.

I hope this somehow helps answer your questions even thought it is not an obvious solution for you to take atleast it could give you some ideas.

K-1 Fiance(e) Visa Process & ProceduresAnother UNCLEAR issue on the NOA2
I can tell you my personal experience.

worth_the_waitFemalePakistan2012-01-18 13:00:00
K-1 Fiance(e) Visa Process & ProceduresAnother UNCLEAR issue on the NOA2
Mine said that same thing, that it had been sent to the Consulate. However, it actually makes it way to the NVC first who then they mail it to the Consulate. Once the Consulate/Embassy receives it then they will notify you with the Packet 3.5 via e-mail. You can, if you are worried about it, call the NVC in about a week or two and see if they received it and or sent it on to the Consulate/Embassy. They can also give you the CASE # which is very beneficial when you then call to inquire the Consulate/Embassy about your case. Once the NVC assigns the CASE # that is what you should use from there on out when referencing your case.

These two items on my signature:
NVC Received from USCIS 11/21/11
NVC Sent to Embassy 11/25/11

Were obtained by calling the NVC. :)

Good Luck! Even though things seem to move a little bit quicker, I find that I still need a lot of patience! :)

K-1 Fiance(e) Visa Process & Proceduresa little help with I-129F
Question #18: how long these explanations need to be? My fiancé and I met only once, will this be a problem? I think mine was all of two sentences. I said that I had gone and spent 10 days with my fiance in April and during that visit is when we proposed which led me to file the K-1 Visa.
Question #19: We meet thru a personals ads website not thru a marriage broker, what should I answer in this question? Is meeting thru personals consider a marriage broker? I met my fiance on Facebook, same thing pretty much, and I didn't list it as a marriage broker. Just say that you met online and leave it at that.
Question #20: My fiancé is from Belarus and the embassy there doesn’t process visas, any ideas? Anyone from Belarus? What should I answer here? People from Belarus should be processed for Visa's somewhere, sorry I can't help more than that.

Regarding the fiancé Letter of Intent, do we need to notarize? I wrote one and he wrote one. We did sign with our own signature and we did not have it notarized and didn't have any issues with it.

My rule of thumb was to keep it clear, conscise and to the point without too many filler words inbetween.
Good Luck!

I will also be presenting secondary evidence such as photos, airline ticket confirmations, boarding passes, passport stamps, and so forth to verify that I was there on other occasions, but these will of course not prove that we definitely saw each other at those exact times.

On the backs of the photos besure to write in pen who is in them and what date they were taken.

K-1 Fiance(e) Visa Process & ProceduresHow to start process for my fiance and how long?

You don't have enough time to get married on a K-1 visa this sumer anyway. If you haven't seen him in two years, you must do that first as well.

You can get married this summer in Afganistan and file a spousal petition.

I share Harpa Timsah's opinion. Go to Afghanistan, get married, then file as soon as you get home!

Congrats and Best of Luck!

K-1 Fiance(e) Visa Process & ProceduresThinking past the Visa

Wow! You ask an interesting question. It might not be a bad idea to have a certified, translated copy of his college transcript to bolster his Diploma Certificate and add credibility.

Good luck.

Yes, I want to be sure that while he is still in Pakistan that he gets any documents that he can and will need because when he comes here it will be more difficult to get them until he is able to travel back to Paksitan after AOS. The certifide copies of his transcipts are a good idea. He has both a Bachelor's and a Master's and already has the Degree certificate but I am not sure what the US requires for emplyment purposes.

Don't know about your state but here in NC they don't accept international drivers license... but since i work for an international company i asked a gentleman who just opened an account with us about his license.. he said he is using his country license for 90 days and then he has to update to the NC license. They will add him to an insurance policy etc using that one and when he gets his new license he will update his policy reflecting the new one.

LOL i too have been searching this so when Adil comes all we have to do is add him to the insurance policy using his karachi license and he can study and take the test for his new one within 90 days.

Oh wow! So you have the inside scoop! :) You make a good point though, I forgot how different rules and regulations can be between the different states. Although, I live in Maryland which isn't too far away from NC so maybe it's similar. I guess I'll have to look at our Dept of Motor Vehicles site to see if I can find anything out on there.

Thank you both for your responses!

K-1 Fiance(e) Visa Process & ProceduresThinking past the Visa
In an attempt to get my mind off of the Visa interview (which is a month away) I was thinking about what my fiance will need when he finally comes here.

So I am wondering if anyone here might know what he needs to prove his degrees when applying for jobs. He has a Master's degree in Information Technology which was obtained at a University in Islamabad. Is the Diploma Certificate enough?

Also, is there any benefit to him getting an International Driver's License?

Thanks!

K-1 Fiance(e) Visa Process & ProceduresK1 Visa questions
The requiremetns of a K-1 Visa are pretty simple and straight forward:

  • The petitioner must be a United States citizen. Legal Permanent Resident "Green Card" holders of the U.S. are not allowed to obtain a K1 Visa for their foreign fiancee.
  • Both the petitioner (U.S. citizen) and the beneficiary (foreign fiancee) must be free to marry. This means that if either has been previously married he or she must be either divorced or widowed, or else the marriage must be legally annulled.
  • The petitioner and foreign fiancee must have the intent to marry within 90 days of the foreign fiancee's arrival in the U.S.
  • The petitioner and foreign fiancee must have met in person within two years prior to filing the fiancee visa petition with the U.S. Citizenship and Immigration Services (the USCIS and formerly the "INS" - Immigration and Naturalization Service ). You will have to prove this by boarding passes, Visa and or Passport stamps of trip, receipts, pictures taken of each other and dated, etc.
  • The U.S. citizen petitioner must meet a minimum income requirement that is the poverty level set by Congress every February.
  • The foreign fiancee must pass a medical exam at a clinic approved by the U.S. Consulate that is processing the fiancee visa application. The fiancee must not have any type of communicable disease or serious mental illness.
  • The foreign fiancee must also not have a criminal record. Some arrests and/or convictions are exempt from this requirement.
Given these requirements, I think you qualify, but you will need to be able to prove your ongoing relationship so keep your chatlogs and phone logs handy.

I don't know about the overstay, so I'll defer to someone else to answer about that one!

Good Luck!

P.S. I filed by myself just pay close attention to the forms when you fill them out, the directions they give you for the forms and any supporting evidence they are asking for.

K-1 Fiance(e) Visa Process & Proceduresto plan or not to plan wedding date?
I have to be honest here. I am not suggesting to go and buy a plane ticket or put a deposit down on anything for a specific date BUT my fiance is going to be buying a new suit for our wedding day and is going to wear it to the interview. :) Also, we have already picked out our wedding rings and my dresss. He is going to take pictures of those with him to the interview just in case they ask about what we have done to prepare for the wedding. :) Again though, we haven't set a firm date or any plans past what I described above. It just feels good to think about something other than the interview date and plan something together. Once we are able to set a firm date most of the prep will have already been done! That is the best part.

I personally didn't want to risk not following the intstructions so I actually gave my finace a copy of my entire I-129f petition, the originals of all the NOAs and such that I received from USCIS as well as the original signed Affidavit of support. I sent him copies of my Earnings statements and tax transcripts for the past 3 years and a copy of my letter from HR stating my position, my hire date, how much I make a year. I also went ahead and made a book on Shutterfly of all of the pictures we have taken together on the two trips that I made to see him. Plus copies of my passport, Visas to his country and the entry and exit stamps, boarding passes and hotel receipt. I also gave him pages and pages of cell phone call history, text message history, chat logs, and letters from my family stating that they are aware of our relationship and have no issue with it since he has never met them. I also use a service called ezetop that I use to top off his cell phone so he can call and text me. He is going to take receipts from the post office on packages that I have mailed to him, greeting cards from myself and my kids for holidays that have passed. He plans to take his original birth certificate with him, but made a copy for them to keep so they can see it is an exact copy of it.

Althought I must say that the Embassy in Pakistan is much more difficult to Interview at then it sounds like the Embassy in Paris is, I just would recommend that if you think you should have it.....take it. Just in case. :) You definately have the time to get things done now! :)

Good Luck!

The divorce decree that is signed by the judge is called an "Exemplified copy". Send it in with your I-129f or you will get an RFE.

I received an RFE because I didn't pay close attention to this specific advise. So be 100% sure that what you send is the FINAL and Signed copy of it. This is important and will save you time and worry in the long run.

I am divorced and filed no problem. Just be sure to include a certified copy of the final divorce decree and you'll be all set.

K-1 Fiance(e) Visa Process & Procedurescalling uscis
The lack of communication is a constant source of frustration for many many people who are going through the Visa process. Personally I had to wait 60 days for my case to even show up on their site. I signed up for email and text messages and did get those as soon as my status changed on their website. It will do you no good to call them before the 5-6 months is completed. They will not tell you anything about your case. Just one day, you'll wake up and get a text/email giving you a notification that something has happened to your case. Until then, I recommend to stop checking their website, stop calling them and just find a way to kill your time while you are waiting.

My suggestion would be to look forward at the rest of the journey and focus on the things that you can have control over like getting your documents in order, how to document your ongoing relationship, order your tax transcripts for your affidavit of support (mine took about a month to get to me and now that it is tax season they might take longer after you request them) letter from your employer etc. anything to get you ready for the next steps AFTER USCIS.

I can remember many days hanging up the phone in tears from frustration and realizing all I could do is wait. Just remember, each day that passes is one day closer to getting news on your case.

Oh and by the way, my case never showed that it was touched.

Chin up and Good Luck!
