K-1 Fiance(e) Visa Process & ProceduresK-1 doubts
QUOTE (Carolina+James @ Jul 1 2009, 03:21 PM) <{POST_SNAPBACK}>
-------------------------------------------------
Specific I-129F doubt:

Part B, question 20: "Your fiancé(e) will apply for a visa abroad at the American embassy or consulate at" and then it asks for city and country. I can't remember this one, but I once read somewhere that for Brazil, it would always be default on Rio de Janeiro for fiance and marriage visas. Can someone confirm me that please?

-------------------------------------------------
Affidavit of Support: It is not for this first part, but... we are still a little confused on this part, so just to confirm (in short): my fiance must have an income on the past 5 years of 125% higher then the poverty level of the current year? And if not, have a co-sponsor? Is it interesting to have a co-sponsor just in case the numbers seem to close to the limit?

Unless James lives in Brazil, he won't be filing the I-129F petition at the American embassy, rather at the nearest USCIS service center in America, either California or Vermont.

Generally they only request 3 years of tax transcripts (free from IRS) or returns. Also they are most interested in present job and whether it meets the minimum. I have only been at my current job for two years, but was accepted with no problems.

All the best

K-1 Fiance(e) Visa Process & ProceduresComing up on our NOA2...
It's best to post your question as separate topic, otherwise it might go unanswered.

One does not need to disclose savings/assets whatsoever so long as one meets the 125% of poverty line requirement.
If one does not meet that, one must have 3 times the amount that is lacking.

For example, if a household of two needs $18,500 (approximation) to meet 125% of the poverty line and one's income is $18,000 a year one would need $1,500 ($500x3) in savings to cover the difference.

K-1 Fiance(e) Visa Process & ProceduresMaking copies of I-129F
I do not believe the two copies are in case USCIS loses the first, as they may be inadmissible, since they are copies of signatures and not original signatures. One copy is usually sent to the beneficiary, so that he or she can become familiar with the information therein. The other is retained by the petitioner. It's best practice to make copies of most things that are submitted to anyone e.g. Pep Boys suggested I copy the receipt and rebate form before sending in the originals.

Bangkok consulate does not accept cosponsors for K-1 visa petitions. As things are you do not have much of a chance of your fiancée receiving the visa. You could get a new job that would meet the requirements. My wife also recommends getting married and petitioning for CR-1 visa which can have a co-sponsor.

A couple of years back, a friend had to pay a boatload on a care package sent from America. It contained things like his favorite cereal, maple syrup, etc. (his parents didn't know what he could and couldn't get in Bangkok, and just included things they thought he'd been missing). Though I can't recall the precise amount, UPS was asking for something like 4,000 Baht in duty. His argument was that it was more than the value of the things when he ruefully paid it.

Then again another friend had a laptop sent and paid nothing.

My mother had sent me a pair of shoes (size 12's are near impossible to find), and they never arrived at my townhouse. About 14 months later they arrived back on her doorstep with all sorts of stamps all over the package. My guess is that they did want me to pay a duty, but either didn't give me a notice or it got lost; perhaps after several months they just returned to sender.

It may help not to send it in the original Apple packaging as that might be misconstrued as an item for sale.

Good day Herk Driver,

Answers to your questions may be found at the US Embassy in Bangkok's website.

Here is a list of post offices

...just scroll down to page 9 to see those in Isaan. Looks like most provinces in Isaan have a single post office in the capital town where one can pay. Do you know in which province she lives?

Here is Packet 3 Document
. . . in which it states

Original documents below must be presented at interview. No need to mail them to us at this
stage.

EVIDENCE OF RELATIONSHIP:. . .
MEDICAL EXAMINATION:

If you go here for Packet 4 Document
. . . you will see a link to the requisite medical forms. There is no need to wait for Packet 3.

Medical examination forms (DS2053, DS3024, DS3025 and DS3026) downloadable from

Hopefully that takes care of your questions. If you have any more, feel free to post or PM me.

My wife has been in America for nearly a year now and it's been the best in my life. I've said before that if I could bottle up and sell patience, I'd make a fortune just from this site. If you are still waiting to be together, wish you all the very best. In the meantime, there is much you can do to prepare. One thing Thai's appreciate is access to Thai ingredients. We had to search for a few weeks to find the Asian markets that carry what she was looking for, but now we have a routine to go to this one for chilies, that one for Thai eggplant, etc. If any of you are in or near Maryland I can recommend several excellent shops. One in Frederick Maryland is owned by a pleasant Burmese family and over 80% of what they carry is imported from Thailand. I was joyful to find the khao soi (Northern curry noodle soup) mix there.

May you be reunited with your loved one soon.

My wife was a teacher in Thailand and previously had come to America on an F-1 student visa. During her interview in Bangkok the officer asked, "I see that you had visited America on an F-1. How come you only stayed for three weeks?" My wife explained that her stay was paid for by the Thai government on a scholarship she had received. She didn't have any problems.

My wife is going for her driver's license exam this weekend. She's been studying for over a week now and she's been driving us around as well. She's already taken the required drug and alcohol education course and passed the test with flying colors; I'm grateful that she's an English teacher.

We've mailed off the AOS paperwork and her biometrics appointment is on Oct. 1st, so we're hoping for work authorization sometime in the next six weeks. She's agreeable to working anywhere she can find work in the short term and hopefully a position at a local college or university later.

We've been to three different Asian markets and she's been able to find nearly everything from home. I've never eated better!

All's well and wish the best to everyone else.

Until recently the police report has been free. My fiancée received it for free some time around April 10th this year. Since then couples have been reporting a 200 Baht 'fee' that is asked for by the police. Likely a quick buck for the cops doing it, but certainly far from 9500.

Just a quick update before we head up to Philly to visit family.

Nern got in just before noon on Friday, July 3rd. Immigration only took about 5 minutes; they asked her about 4 questions such as "How did you meet?" "When did you last see him?" "When do you plan to get married?" She says they did not fingerprint her. Customs was more interested in the dog food she brought than her dog and didn't even remove the dog from the carrier for an inspection.

We went to a friend's party that evening and got to see the town's fireworks display. The next evening of the 4th we saw the big show from a friend's house that overlooks the Antietam battlefield. And on Sunday we went to another friend's for a wiffleball tournament / band jam. I was up playing, trying to show off a bit but she was too busy having fun playing wiffleball for the first time. All in all it's been a great transition and she's almost over jetlag already.

Just as a side note, we tried to get a Social Security number yesterday, four days after entry, only to be told that she is not yet been entered into that system that ICE uses. The lady offered to do the manual check, which could take six weeks +, but we declined and agreed it would be faster to return a couple of weeks later instead. I believe Gary of Gary and Alla has been telling the entire community that people's names should be entered the day they arrive at midnight and if not that night, then within a day or so. Clearly this is not the case as others have reported the same story.

Take care all.

nusder05, that might be because Kim Jong Il intends to launch a rocket on the 4th, though not the kind most Americans are used to. Just got off the phone with her and as I had said she confirmed "I didn't want to wake you honey." Bah!

She said there were about 50 or so people total, perhaps 10 to 12 there for K-1. The first lady did not receive the visa and told Nern that she was lacking evidence. She said it was nice meeting Kat and Ray, and that the look on Kat's face was priceless when she got accepted.

She also commented how the interviewing lady didn't look at her and instead spent most of the time typing into the computer, presumably some of Nern's responses to her questions. Her Thai was pretty good, but with a strong American accent.

We're looking for an arrival date in about 2 weeks, which I can go with considering that it's been nearly a year since we were last together and 240 days since NOA1.

One last thing, which probably won't apply to most of the Thai spouses on here, but be sure your fiancée dresses appropriately. Nern commented about one Thai lady who was dressed quite inappropriately i.e. like she was on Pattaya's walking street, and the folks at the embassy seemed to have been giving her a harder time. She was attempting to hand in her evidence and the lady behind the counter was saying something like "No, that won't do. I need. . . . " Yet when Kat and Nern went to present their evidence, which I believe was similar to what that first lady was attempting to give, no problems at all.

All the best to all those with upcoming interviews. I believe we can safely say that the glabrous gentleman is presently not conducting interviews and so long as you have all your ducks in order, you shall be just fine.

I actually do. I make the gesture of extended index finger pointing down at the table circling around as I say it. It will be good to have my fiancée here to practice Thai. As we all know, if you don't use it you lose it. I wish to increase my ability in Thai. We've already discussed when we have children, during the first few years she'll speak entirely in Thai to them and I shall speak entirely in English. As they get older, I wish to communicate with them in Thai as well, as I would wish for her to speak with them in English. With both parents being teachers, these kids aren't going to have a chance: we've already worked with every type of child imaginable and we got their number.

Sincerely The Wire is a dramatized, sanitized version of Baltimore city. To say the public schools are off the hook is an understatement. We have a new superintendent who was born in Cuba and cut his teeth in NYC schools. We shall see what a few years under his guidance will produce: he's reshuffled personnel, surplussing many, and paid students who improved their high school state exam grades to passing.

Phone cards are a no-no according to the embassy's instructions. Either Packet 3 or 4, both available on the site, states that there must be detailed phone records i.e. phone cards not acceptable. I recommend something like www.voipdiscount.com You get 30 hours per week for four months at only about $4 a month. That is enough for me, but if you happen to speak more frequently, you can always purchase more credits on this service. You use your computer to place a call; you receive a call from a local number on your home/cellpone; it uses Skype-like technology; your Thai fiancée receives a local call. Another option that doesn't require a computer to place the call is www.mobivox.com/ Costs a bit more but probably cheaper than most phone cards.

It's funny that after more than a week, the embassy has just emailed me back saying "We've scheduled your fiancée's interview for June 18th." They had already sent us each an email saying they'd scheduled the interview. In this email it also states that they sent her Packet 4 by regular mail on June 2nd, though she has yet to see it arrive. Of course she's already gone online and downloaded Packet 4, so it's not an issue.

I am a public school teacher and I am telling you that USCIS as well as the State Deparment have it together compared to Baltimore's school system. From the top down there are all sorts of craziness and it was a bigger culture shock returning here than living in Thailand for four years.

This is quite encouraging! With the shift toward receiving most of the paperwork with Packet 3 submission, I wonder if they're doing most of the work up front now, so that the interview is just a formal step that is relatively stress-free: Present evidence, answer a few questions and get rubber stamped.
