K-1 Fiance(e) Visa Process & ProceduresCheck List from Embassy & getting Police check before getting it (Pakistan)
Thanks everyone for the replies and the informaiton! I always find this group very helpful. :)

I read somewhere that the police report could take 2-3 months for them to process and get it back to him. From what I have read here, it only takes a few days. I'll wait for him to file for it until after we get our NOA2. I was going to do that anyway but I wanted to try to beat the checklist there so when he got it he could immediately send it back to them marked complete and request an interview! :)

Thanks again,
Feeling a litte better today - Kim

K-1 Fiance(e) Visa Process & ProceduresCheck List from Embassy & getting Police check before getting it (Pakistan)
Good Evening Everyone-

I am always trying to think ahead and try to save some time. I was wondering if anyone who is going throught the K-1 Visa process, in Pakistan, or anywere else could share the thngs that were on the check list from the Embassy?

Also, specific to Islamabad, Pakistan, is there a way to request the Police certificate before getting this cheklist requiring it? If so how and where.

Thanks in advance for any infromation. Like everyone else, the wait is killing me and since it is inevitable that we will go through some time on AP I was thinking of how to save time elsewhere.

Best,
Kinda Sad Today Kim

K-1 Fiance(e) Visa Process & Proceduresquestion about Photo, & miscellaneous
After reading this thread I have a few comments:

1- I made my own photos by cropping pics that were taken of myself and my finance. I then sized them and printed them out at Kinko's and used their paper cutter to make them the 2X2 size. I made myself the amount I needed for the petition and I am mailing him the ones he needs for the Visa application when I send him the supporting documents and a copy of the petition. (we are still waiting on our NOA2)

2- As far as the wedding confusion. As long as the Wedding Certificate is signed here in the US before 90 days is over then you should be fine wherever you choose to have the ceremony. You CANNOT have a Wedding Certificate done in a foreign country on the K-1 Visa because then it is void and you will have to start all over to apply for a K-3 Visa because your fiance is now considered your spouse. So the trick is, that if you have to have a wedding in Colombia go for it but be sure that you skip the part where you sign any documents and just enjoy the day. Then go to the Justice of the Peace here in the US and get that Wedding Certificate.

Just my 2 cents based on my own understanding.

Hello Havehope,

From the Embassy Reviews that I have read, it sounds like this fee is collected on the day they go for their interview at the Embassy.

Hope that helps!

K-1 Fiance(e) Visa Process & ProceduresIs DS-160 Required?
Hello Again Havehope!

From what I can read on this page on this site: http://www.visajourn...n&cty=Islamabad

It seems that the DS-160 is filled out online by your fiance after they recieve the Packet 3. I haven't gotten to that point yet, but that is what is appears to say.

Hope that helps!

Question for you Havehope,

Did the USCIS website where you check your petition's status ever update your status from Acceptance to any of the other status? I am obsessed with that site and checking my status but nothing ever seems to change!!!

Thanks,

K-1 Fiance(e) Visa Process & ProceduresI-134 vs Form I-864
Hi Havehope! :)

Here is what this site suggests:

Packet 3 Contains: Specifying the documents needed and actions that must be taken by the beneficiary and the petitioner prior to issuance of a visa.

Packet 3.5 for K1 Visas (for Afghans) Requests These Documents:
Cover Letter
Passport Photos 2"x2" (2 in addition to the ones attached to DS-156s)
Copy of National ID Translation
DS-156 (2 copies, EVAF, w/ original passport photo attached)
DS-156K (1 copy)
DS-230 part I & II (1 copy)
Parental Information Form
I-134 Affidavit of Support w/ Supporting Financial Docs from Petitioner> optional .
Dont need to fill all forms for k1 just fill out DS- 160 online and need to email the comformation to the embassy .
**Note: Police Cert for Afghans is NOT required unless they lived in another country after age 16 for more than 6 months.

Includes These for Benefit of Applicant:
Medical contact information
Vaccination requirements
Picture requirements
All forms included with exception of DS-156 which must be completed and printed offline. Web address given in packet.

For me, I am also filing for a K-1 and I plan to include everything that they are recommending on this list. Even though it says this: "

K-1 Fiance(e) Visa Process & ProceduresNVC'S TIME FRAME IS LONG
After doing some additional research about vaccines that are required for Immigration Visas and those that will seek Adjustment of Status (K-1 specificlaly for me) I found this on the USCIS website as part of their Questions and Answers part of the site: (http://www.uscis.gov...0004718190aRCRD)

"Q. Certain vaccine series can only be completed with multiple visits to the civil surgeon. Am I required to complete the entire series before the civil surgeon can sign the Form I-693?
A. You are only required to receive a single dose of each vaccine when you visit the civil surgeon. You are encouraged to follow up with your private health care provider to complete the series. Once you have received the single dose appropriate at the time, the civil surgeon can sign and certify the Form I-693."

I also found this reference that basicaly tells you what will you can expect as far as Vaccinations go at the Medical: http://www.cdc.gov/i...structions.html

However if the woman is at all older than the man you are much more apt to have issues. All is not fair.

I hope not! My fiancée (Thai) is 5 months older than me. What can I say? I like older women.

The I-129F petition is valid for four months from the date of approval from USCIS. Consular officers can extend the validity of the petition (revalidate the petition) if it expires before the processing of the visa application is completed.

K-1 Fiance(e) Visa Process & ProceduresHow long we need wait for NOA2?
To contribute to what Karin und Otto pointed toward, these trends may and do change. They are a helpful guidepost but they are statistical averages. Some people are adjudicated in weeks i.e. Many VJ members from Cuba, while most others wait several months. Sometimes the pace picks up and then there are delays at other steps. Patience, understanding, and love make the ride smoother.

It's strange how people are saying things like that to you. Everyone in US originate from immigrants (except the indians of course) so ask these people where their parents / grandparents came from!

Even the American Indians, or Native Americans, were immigrants. The latest theories state that they came from Asia in two waves spanning back several thousands years; There is the ice bridge theory as well as sea faring theory.

Cynthia, welcome to Visa Journey. I am glad you found us and wish you the best on the journey. There shall always be naysayers, and they shall affect you as much as you allow them. My preferred attitudes are of acceptance, understanding, compassion, and especially humor!

K-1 Fiance(e) Visa Process & ProceduresPresentation of Petitiion
Anything you use to assemble the packet e.g. paperclips, folder, should be easily disassembled.
Do not staple anything, as they shall have to pull it all apart, which might make a grumpy officer.

You can use ACCO (two holes at the middle of the top of the pages) fasteners, but they are not required.

We paper clipped the different forms and sections together as well as placed Post-It notes at the bottoms of the pages.

K-1 Fiance(e) Visa Process & Proceduresrecieved notice of action
timeline.gif

You have received your first Notice of Action (NOA1), which confirms receipt of the petition.
You are awaiting your second Notice of Action (NOA2), which confirms that the petition has been approved. Usually it can take anywhere from two to six months. By filling in your timeline, you can get an estimate of when you'll be approved.

In the meantime you should be collecting evidence of your relationship, such as emails, photographs, regular mail, phone bills, etc. Make sure all this evidence is two-way; that is it should show contact from both of you, not just one always contacting the other.

It is probably a bit too soon now, but once you get NOA2, you should begin to gather information such as a letter from your employer (US citizen) and the past three years of tax returns (2006-2009). Your fiancée can find out more about the US embassy in Korea's requirements, including medical exam and vaccinations.

NVC usually sends a letter, though we've never received one.

Safe and speedy journey!

K-1 Fiance(e) Visa Process & ProceduresHelp! Does everybody sends snail mails for proof of relationship?
I believe most of what posters above have said covers it.

1) Snail mail is not necessary, as the Consulate Officer is looking at the whole picture. It would best to have phone records, emails, chat logs, etc. going both ways, not just from you to him or from him to you.

2) Snail mail can never hurt, even if you present 3 to 5 pieces each and it can be quite romantic. He can do it if for no other reason, then for the visa. If he still refuses it says a lot about how much care he is willing to put into the relationship.

3) Begin gathering the evidence today and continue until the interview. My fiancée and I have an abudance of evidence that spans nearly five years.

Wish the two of you all the very best!

K-1 Fiance(e) Visa Process & ProceduresShould I marry my girl before trying to come to USA?
I believe many shall agree that no single way is easier than the others, though all of them have advantages and disadvantages. I would recommend a IR-1/CR-1 visa for you. This is for those who are already married. It takes approximately the same amount of time as a K-3 marriage visa but the moment she enters America she is a permenant resident as well as able to work immediately. If you decide to pursue a K-1 fiancée visa or a K-3 spousal visa, you'll need to file more paperwork after she arrives in order to get a Green Card (permanent residency) as well as work authorization.

K-1 Fiance(e) Visa Process & Procedurespast history with ICE & Homeland security
I honestly do not know how the lawsuit nor how your ex-husband's deportation shall affect your filing. I do wish to offer words of encouragement, since the biggest issue appears to be your apprehension about what may happen, not what has happened. You've submitted everything, so now it's time to wait. In the meantime you can continue to gather evidence of ongoing relationship, visit your fiancé is you are able to, and continue your life.

12 Step groups have a common saying that "There is no such thing as a justified resentment": You are free to resent something or someone, but it's never valid to do so. I would add that there is no such thing as a justified fear. Sometimes folks believe it was fear that helped them through a situation, when in reality they made it through in spite of the fear. Fear does not have much energy and therefore does not afford one with the maximum range of choices. Another option would be acceptance, which you've already alluded to in your post when you said that you might just end up moving to Morocco to be with him. At this point it might be helpful to just accept that you have to wait to discover the outcome; and whatever that may be to accept that. Such an attitude affords you with far more opportunity and serenity than fear.

All the best on your journey.

You must bring with you at the time of interview sufficient evidence that you have a legitimate relationship with the person who has petitioned for you, such as photographs, letters, detailed phone records from telephone

I mentioned using the lease as evidence due to this passage above from Bangkok embassy's Packet 3. As Gary stated, I wouldn't be using it as a primary piece of evidence, but it certainly could be included.

K-1 Fiance(e) Visa Process & ProceduresAnother odd question from me
I think this would serve as evidence of ongoing relationship that would be useful to present at the interview. Then again, I would check into the rules of VWP. Is someone who comes in on VWP allowed to 'co-lease' an apartment in America? For example, if someone coming in on VWP is forbidden from taking up residence then this would be a no-no.

As far as making her stay "legit for the complex's sake," I see no reason whatsoever why you have to put her on your lease. It's your apartment and you're free to have anyone stay with you.

Is this going to be an issue come Consulate Interview? Generally the US Petitioner has to have an income of over $18,500 to support a household of two. You may want to seek a second job in order to fulfill this requirement for the I-134 and I-864 Affidavits of Support.

the answer should be NO...

36. Has anyone ever filed an immigrant visa petition on your behalf?

this is a past tense question, see the bolded word, its asking you, in your past, did anyone help you file for an immigrant VISA.

That is not past, but rather present perfect tense. Past tense indicates a completed action, whereas present perfect tense indicates an action that was initiated in the past, but may still be occuring.

Conny you are correct. It is a non-immigrant visa and therefore you can truthfully answer 'no' to it.

Unless you plan to wed in Mexico, it's going to be nearly impossible to get married by October. K-1 visas are taking about 200 days from sending in the paperwork to getting the visa. Another thing to consider is once you get to America, if your fiancé arrives on a K-1 visa, he will not be able to work until after you file for Adjustment of Status (AOS), which could take 3 months or more to processed. You mentioned going to law school full-time, but it might pose an even greater challenge if you have a husband to support as well.

You may wish to review the Customs Declaration form as well: My fiancée was a bit perplexed when I told her to list the gifts she was bringing and their value.

Also it doesn't hurt to ask an immigration officer "I am a K-1 visa holder. Which line should I go to?" because sometimes they wish you to go to a particular lane and other times they don't care.

Occasionally there is a second inspection that takes place in a separate area or room while other times it's all done right there at the booth.
