Some of you might already know my story... I met my fiancee in Morocco while I was studying abroad last fall, we first met in October and we got engaged a couple weeks right before I left in mid December right before Christmas... so it was about 2 months of knowing each other before i proposed to her. we technically kind of had to get engaged quickly because in their culture parents shouldnt know of casual relationships, only when he proposes and it is serious enough for marriage. and of course there is no way her parents would have accepted if they hadnt met me first before my leaving. we both graduated college just this past semester and now im starting a full-time job. so obviously i havent been able to save the money to go back there again for another visit. its hard saving money for that especially in my situation.

might that be a problem though? im gonna front-load the petition a lot and im writing a little extra for the "how we met" question. what does everyone think?


The short engagement may not be all that much of a problem. The money situation may present to be a problem. The USCIS will want to see that you can afford to care for your fiancee. The petitioner is responsible financially for the fiancee. Just coming out of school you must be broke. You may need someone to co-sign so you can reach the minimum financial requirement. Hey, give it try, it is a journey. God bless the two on your visa journey.

I'm new to this forum, but I couldn't find this question posted yet. Sorry if it's been asked before.

My girlfriend and I want to apply for a visa (possibly a K1) for her to come to America in July 2010. We currently have no plans to get married....maybe, maybe not. But it's certain that she will join me for 1 month in the US and we'll return to Vietnam (where we both currently live) afterward.

Should we apply for the K1 since the processing takes so long and we may decide to get married during that processing time?

Are there any repercussions if we apply for the K1 and return from the US after a short time? I'm afraid that the travel visa will be more difficult than the K1 since Vietnam is very strict with handing them out.....but it may be equally difficult to get any visa for a Vietnamese national.

Are any other visas better for this than the K1?

The K1 visa is for couples who intend to marry. It is a one entry visa for your fiancee to come to the USA and marry within 90 days. She can't leave again in one month, and return to Vietnam to live. She has to remain in the US and adjust status.

I understand that travel visas are hard to come by, but I don't think applying for a fiancee visa when you have no clear intent to marry is a way around that.


This is absolutely incorrect. The United States does not compel foreign nationals to immigrate, nor does it jail people to prevent them from leaving, nor does it force people to accept green cards they don't want. If you want to have your fiancee come to the United States, get married with your family here, and then leave to go back to Vietnam, the federal government is definately not going to force you to "remain in the US and adjust status." The US does sometimes force people to leave, but it doesn't force people to stay.


Of course they don't force people to do anything of the sort. But if he wants a K1 visa those are the terms.


The terms of the K-1 visa are that you get married within 90 days of your entrance. That's it. If you want to immigrate, it's a different process. If not you go home. There's no law or regulation that demands you get a green card or citizenship.


The OP asked if this was the visa for him. The answer would be no. The terms of a K1 are usually you have an intent to marry and remain. He doesn't.


I'm sorry, but I just don't think that this is correct. You do have to have intent to marry, but I do not think that you have to show an intent on staying in the US for any set amount of time.

Poorly, but that's not what I was commenting on. You said that with a K-1 visa the fiancee "has to remain in the US and adjust status." That is 100% factually incorrect. If someone for whatever reason (and I can think of many reasons) wants to get married in the United States but leave the very next day for some other country and never bother adjusting status, that's fine.



If the American is not residing in the USA, I wish he would apply for a different visa. With the K1 visa there is more to it than just coming to the US and marrying. If the K1 is used for other purposes it is just clogging the system. We are all waiting what we believe to be extremely long times to get our fiance(e)'s here in the USA, that is those of us that live here and have met the love of our lives and want to continue to reside here in the USA.

You might want to give this a little time. I see here that you started a relationship before your fiance was divorced. Now he is living with his ex. In the eyes of the consul that waves red flags, because how are you going to fit in with this. If this goes not work well are you going to become ejected from the situation upon which you may become a subject of the USA welfare system. Another consideration is your finace's sincerity.

Hi Tom,
I am not sure about if they are trying to slow down the number of petitions. It is possible there are more obstacles in the background checks with China than with other countries or it takes more effort with getting background checks in the more remote areas. From the stats 2 to 4 months is very common in getting the NOA2. It is so hard to say because there were others that have a similar timeline as mine and some got their NOA2 before me, some after me. Then I see there are still some waiting. Vermont does seem to be taking longer than California. It sure looks like the USCIS is processing at a fast rate now. My NOA2 came only after 76 days from the NOA1, I think according to the stats it is 121 days for the average. My petition did not get a touch until when it was approved. Maybe a background check was initiated when the NOA1 came through and then it was only a matter looking over the petition and bam it was done.

I think the interviewer looks for how genuine you seem to be. If it looks like meeting on the internet then meeting in person and applying for a visa; that sounds like a fling to me. If the couple have built a relationship over time then met in person and applied for a visa and does not stumble looking for answers at the interview I think the interview will go through fine. If the interviewer detects not really knowing the person or seems uneasy, they may throw out some probing questions to trip up the interviewee. This is only what I think. It looks like to two have known each other for quite awhile. I think you should be fine.

I have seen many posts here at this site that they were only asked a few questions and that is it. Then others were treated quite differently.

They do not put anything about what they did. It was a week ago Friday July17th that I noticed the date changed on my status at the USCIS site. I did not receive an e-mail or anything. One Monday the 20th I received my NOA2 which was effective on the 16th. So apparently the touch on the 17th was when the petition was sent to the NVC. I saw no other touches at all.

I do not think there is any rule, because that would be discrimination, so do not pay any attention to hear say. If there are security reasons or background check problems the USCIS might request more information on employment and where someone has lived. I would include only information on the G-325A that is requested; maybe use the examples as a guide found at this site. If you get an RFE for more information, just supply what they ask for.

Where do I find the Packet info at?


Packet 3 is now called the Informational Packet. It is just some information about what forms and you need to send it to where they say to send it so you can qualify for an interview. The US Embassy in Manila has a site where Packet 4 is downloaded, so it may be different for your finace(e). If you got an e-mail indicating that you petition has been accepted you should see your case being touched at the USCIS site, then yopu should be getting your NOA2 in the mail a a few days. I never got an e-mail, I just noticed one day my case was touched, which was a Friday, thne the following Monday I received the notice by snail mail.

Now just wait 2 to 4 weeks for the petition to get to the NVC and a case number will be assigned and forwarded to the embassy or consulate. What you can do now is download the forms for packet 4 and start making out the I-134 and start collecting the supporting documents.

Then how come some couples in 2008 are left unapproved even if they aren’t subjected to RFE?


Is it any helpful that my fiancé lives in California? Does CA welcome new immigrants at this period?


My fiancé had typed “Californa” instead of “California” on the I-129F form that he sent. Would that affect the process? I hope not. That was the only error there. He sent me the whole first package scanned after mailing them to the USCIS. He must have been too excited to send the forms so he did not proofread every single letter.


Does the USCIS already check tax matters before releasing the NOA2 or tax-related stuff arise during the NOA2 compliance? I haven’t asked my fiancé if he already submitted there in April the necessary tax forms. He was working on those four months ago before his visit here.


And oh, to all members here who replied to my very first post yesterday, thank you very much. You are indeed helpful. I need more guidance and I’ll be grateful to your assistance.

I think the documents are the same no matter what country the fiance(e) is coming from. I think you should be just fine. I submitted the petition for Pat and I to California and it was put into the system May 1st. I got the NOA2 on July 16th. From Igor's list I found that many of the other early May petitioners are have also been processed. It was 76 days from my NOA1. Everything will be fine, and if not the USCIS will send an RFE. Everything will turn out just fine.

My petition was approved on July 16th so I am waiting to hear the petition has a case number and it has been forwarded to Manila. The US Embassy in Manila does not send out packet 4 anymore. You dowload the packet 4 from the embassy site. The link is in Sheriff Uling's post; the Philippines Guide. Now the petitioner can start rounding up or at least figuring what supporting documents will need to be submitted to the beneficiary with the I-134 form.

Right now it is just a wait until you get your case number. Once you get the case number You should be elgible for scheduling of the interview. As evidence of an ongoing relationship I used screen shots of the log of my Yahoo IMs with Pat. I also set Yahoo IM to archive the messages. Then I also make screen shots of some messages; two or three messages per month just for examples. I choose the screen shots verses the text version because the screen shots shows what the exact messages looked like. I was afraid the straight text messages may not have been as believable. I didn't get an RFE so it must have been fine. Now I am going to take another log and examples to send to Pat for her interview to show a continual ongoing relationship.

I just sent in my I-129F package on April 17, 2009. I made two copies of the package plus I scanned the original and saved it as a PDF so I could reconstruct everything as it was originally. Then I have backup copies of the documents that need an original signature.

I sent a personal check and insured the package for the amount of the check and sent it USPS. When insuring the package then you automatically have access to the tracking and confirmation feature. It has been 6 days and so far USCIS has not picked up the package.

If you go searching in the USCIS website they do give recommendation to use a two hole Acco fastener at the top of your sheets. This is what I found and used the recommendation: http://www.uscis.gov...00045f3d6a1RCRD Then use tabs instead of dividers. If you do use tabs put them on the bottom. The reasoning is the USCIS has to do something with it if it is in a binder and it the tabs are on the side it may not fit well in a folder. I used tabs to divide the petition according to my table of contents. My petition went through just fine.

When I sent my evidence I just printed my name on the back along with the date that the picture was taken. The instructions did not say that date had to be printed on front with photograph, just that it had to be written on the back of each picture. I hope they do nt do this to me, because I cant make a date magically appear on the front. It haas to be set up with the camera. I did set mine up that way, but, it didnt print that way. However.... if you put the sd card in your computer, look up that file on the computer, right click on the picture file, and it will show you the dates that the pictures were taken (in some instances). If your creative and have an idea on how to do this, you may be able to print those dates out to show as proof.


You are right, that is what I had and it went through fine. It is like an adjudicator is asking for something the requirements do not ask for. Yes, that is an idea to do a properties of each one with a thumbnail of each and doing a screen print then a paste to a word processor and printing. Here is another idea. A print screen could be made of each thumbnail and then printed by pasting east to a Word document. I hope something works for them.

The photos I first sent them, I just wrote our names on the back, where it was taken and the date. But obviously they didnt like that.

They really are being sticklers. I send my petition to the California service center as well and only had the date the pictures were taken, where we were, and our names. If you had that then my two cents worth is you are right they must want the date on the front printed. I believe my camera will do it, but I have to set it up; I have never done it. For it to work I need the correct date and time set. I guess look in your manual and see, hopefully yours will be easier to set up than mine is.

It will depend a little on the consulate, but if the packet 3 has been received by your fiance and if he had to send anything back. It also depends on the packet 4. Does the consulate send out packet 4 or is it downloaded from the consulate website? However the consulate does this your fiance will still need an I-134 from you with supporting documents. Then there will be several other forms your fiance will have to make out. That information should be coming from the consulate. The consulate may or may not set an interview time. Here again it depends on the consulate. Your fiance may be the one to call the consulate to set up a time, but he will need all the documents and so forth needed. To now for sure what is next visit the Mumbia consulate. I just followed what they had only in addition to what they showed, I saw at the USCIS site to use ACCO fasteners to bind everything together, the two hole ones at the top. Then at the bottom use tabs to divide things so it is well organized and easy to find with your table of contents. here is an a portion of an old post...I hope it helps...

he guard asked me if its my first day, I said yes and then he gave me some forms which is the evaluation form, application form and the instruction. He asked my passport and appointment letter and he told me to fill up the form inside and once finished, give it to the receptionist. He stamped my right hand.

STEP 1
After I fill up the form, I gave it to the Reception Area (Ground floor) and she told me to go to the room (this is
in the reception area also) because I need to take a digital picture and encoding of date through my
index finger. I just need put my index finger on the red button then tap it slowly (four times) and you can see it
in the computer anyways. After that, the lady told me to go to 5th Flr. for payment.


STEP 2
I went to the Cashier's Area (once the elevator is already in the 5th Flr. you just have to turn left and that's where the cashier is). I paid the medical fee which costsP10,241.00. then the cashier told me to go to 4th Flr. for blood and urine test. In every floor, there's a reception area where you need to give your papers and you just have to wait for your name to be called.

STEP 3
On the 5th floor, I gave my papers to the receptionist and after 2-3 minutes, the lady called my name and told me to go to the Extraction Area(same floor). So, I went there and a guy assisted me and I took a blood test for HIV then after that he told me to go to the Urine test area(same floor). A lady assisted me and she told me to put my things on the chair then she gave me a
small cup for my urine. It was a good timing bcoz I want to pee also! lol Then after that, I gave the cup to the lady and she told me to wait again. After 2 minutes, she gave me my umbrella and asked if its mine and I said yes and thanks! hehe..

Ok, then after that she told me to go to 3rd Flr to take an Xray Exam... So i went down on the said floor and I got the chance to meet some Filipina who is also taking their medical exam.. The process is kinda fast thats why we weren't able to talk for that long so I went inside the changing room, changed my tshirt and wear the xray gown. Then i proceed to the Xray Room and the lady told me to put my things on the chair and she gave me a heavy square bag while im having the xray exam - its really odd and i think this is to test more of your lungs thats why they want us to carry this heavy bag. While taking the xray, the lady told me to inhale then exhale. On this part, I didn't inhale that much hehehe..(My friend told me not to inhale that much) but it just bothered me coz i was carrying this heavy square bag and I asked the lady, What's this?! and she said, there's a magic in there..lol I was like hmm.. ok. So after that she told me to go to 5th floor for an Eye test and Physical Examination.

STEP 4
I went up to the 5th floor and I gave my papers to the USA counter area.. Remember, there's two counter/receptionist on the 5th floor . On the left side you can see a counter for the coutries of Australia/New Zealand and Canada and on the right side, there's the counter for USA.

So, I gave my papers to the counter area then she told me to wait for my name to be called. After 5 minutes, a guy called my name and he told me to take off my socks to check my weight.. He said to face the audience (I was lil shy coz there's lot of people waiting and you know looking at me haha) and I was smiling and then I said I'm underweight and he replied, your just slim. hehehe..He said to wait again for my name to be called.

After 2 minutes, a lady called my name to check my blood pressure and I told her, do i still have blood? hahaha she said, lets see lol.. My blood pressure was 110/70 and I asked her if its normal, she replied yes it is. Yehey! I thought i'm anemic.. So again, she told me to wait for my name to be called.. Then, after 2 - 3 minutes one of the medical staff (guy) told me to go to the Eye Test Room. As i entered, a doctor asked me if im wearing contact lens or eyeglasses - obviously i'm wearing eyeglasses and he checked it. He started to ask me about the alphabet letters in front of me which i really can't read especially the small ones..He also asked me if i have period, i said no... Then after that, he told me to give the paper to the receptionist again..

STEP 5
The waiting time is kinda long because I've waited like 20 minutes for the physical examination. I got my number (24) and while waiting I got the chance again to talk to some fellow Filipina about their visas, how & where did they met their husbands and their interview dates... It was a cool talk (we forgot to ask each others name lol) until each one of us has to go inside the room for physical test.. And then it was my turn, I went inside the room and a lady doctor asked me a few questions about my health.

These are the folliowing questions:

What is your name
How old are you
When was your last period
Did you take any illegal drugs
Are you pregnant / have you been pregnant before
Are you sexually active
Are you allergic to any medicine or foods
Do you have TB or is there anyone in your house who has TB
Do you smoke
Do you have cancer or diabetes
Did you any operation before

After I answer all those questions, she told me to sign the paper stating that i am telling the truth.. Then after that, she told me to read the instructions posted at the wall and it says please take off your clothes and your socks. I take off my clothes and socks and I asked her if i need to wear the robe - she said yes.

She told me to lay down at the bed and she put her fingers on my chest checking my heartbeat, then she told me to put
my hands up in my head then after that she told me to bend my legs and open it then she checked my precious one lol. She also check my wrist. And after that, then she told me to stand up and she checked my ear and she asked If I had an operation on my ear before.. I said no. Then she told me to wear my clothes.. While im taking my clothes on, she also asked me if my I have false teeth... After that, she told me to give the paper to the receptionist..

I gave the papers to the receptionist and the lady told me to go down to 2nd Floor at the vaccination room.. The doctor
called my name and she asked me if I had my previous chickenpox (bulutong). I said yes, and she said tell me where you scar is? I told her, I cant since i got my chicken pox when i was elementary.. She also asked about my last period and then she told me that I will take my vaccinations for Anti Cervix Cancer, Anti Tetano, Anti Measles and Anti chicken pox . I thought I'm going to take my shots on that day but it wasn't.. So after that she just told me to give the papers to the Checkout Counter.

I gave my papers to checkout counter including the Evaluation form and the guy returned my passport and reciept. He told me to go back again tomorrow for the vaccinations and for the results..


MEDICAL DAY 2 - VACCINATIONS AND RELEASING OF RESULTS

I woke up at 12:30noon even though the checkout counter told me to go back at 10am...So, I went to SLEC again past 2pm afternoon then i gave my passport and receipt to the guard and he check my data from the computer. He told me, did you take your digitial photo yesterday? I guess you didn't coz your picture is not here in the computer.. I replied, I did! He stamped my hand and then he told me to go to 2nd Flr for vaccination..

STEP 1
I gave my passport and receipt to the guard since there's no medical staff. He then gave my passport and receipt to the medical staff inside the room and I've waited like 20 - 30 minutes. There's a few people who are also waiting for their vaccination. While waiting, I was talking to my husband over the phone using YM hehe just to clear off the boredom lol..

After the long wait, a guy called my name over the mic and i went inside the vaccination room. I sit down and the medical staff asked me some questions like, When is the first day of your last period, are you allergic to any medicine or food? He gave me 2 papers - Evaluation form I told him I already filled up the evaluation form yesterday and he said its a different one. He also gave me the lists of the symptoms to observe after I take my vaccination.

He started to give me 2 shots on the right arm and then the 2 shots on the left. The last shot is the anti cervix cancer which is kinda pain but before that the guy asked me if im left handed or right handed.. I am right handed so he shot the anti cervix cancer on my left arm. Ouch! So, after all those tiny needles entered into my veins... The guy told me to go to the Ground floor and wait for my name to be called for the releasing of results..

It took almost 40 minutes and many of us are also waiting for their results.. So while waiting - I bought some snacks because i started to feel the hunger.. It was already 6 in the evening too!

After the long wait....... a guy called my name while I was talking to some fellow Filipina then i go to Counter B and the guy started to ask my name and the first day of my last period. He asked me if I got pregnant before and i said never been preggy.

He gave me the cd (xray result - he never told me not to open it), vaccination document worksheet and my receipt.
He told me, your passport will be forwarded to USEM including the vaccination document worksheet. He also said that my interview date is on June 16, 2009.

On the vaccination document worksheet, he told me that I need to follow up the 2 shots that was given to me which is Varicella and Human Papillomavirus to a private clinic. I asked him, can i do that here in St. Lukes - he replied its too expensive here.. Better go to a private clinic for another shots.. He also told me that I need to take another shot in USA which is the Td or Tdap - he encircle it and put USA on the paper..

Whew! Finally the day is over and I can go home but gosh it was rainy outside.. I really want to go home since my left arm is in pain also..

I took an 8.5 x 11 paper and used double sided tape to attach a sandwich sized zip-lock bag to the paper and put the photo in it. Then I labeled a tab according to my table of contents. It went behind the G-325. Then I put everything together with ACCO fasteners with the two holes at the top and labeled tabs to divide the petition into sections according to the table of contents.

All the Pat is bringing are a couple suitcases of mostly cloths and personal items. Has anyone run into if there are any import duties when going through customs at the POE when entering on the K1 visa?

My fiance is in Manila at a hotel on the 3rd floor. I just got a text message. She said the electricity has been a total blackout for 2 days. That message was at a out 8:20 am this morning (Sunday morning). It may be awhile for the power and phone service to be restored. I could not even reach Pat's cell phone, so either her phone battery ran down or the towers serving cell phone service were blacked out. Pat toldme there are still some areas in the area flooded.

If she have negative smear, then you will be fine for sputum culture. Though it is 2 months delay for your process. No need to re-schedule for an interview, SLEC will take care of it. Then, if she is negative with sputum culture, she will have her vaccination and she could even choose her date on interview at SLEC. Sometimes, SLEC gives kinda later date for interview.

Yes, the interview was scheduled for the 28th. Pat will start the sputum test on Tuesday, so we have a bit of a wait for the results. Pat was vaccinated for TB years ago, so I am sure the test will come back negative.

That is a good question, I am waiting to hear from my Fiancee. She is in a hotel near the embassy and SLEC on the third floor. I last talked to Pat at about 2:00am CST or about 3:00pm Saturday Manila time. At that time it was raining hard and the first level of the hotel was flooded, but power was still on. If I can get in touch with Pat I will post what I find out. I just checked the US Embassey's site and nothing about flooding there.

All you have to do is get a box and fill it and take it to one of the warehouses.

Michigan is a large place so it you live in a more remote area you may have a distance to take you box.

I do not live in Michigan, but I live in Iowa. I get the boxes from JoJo's Oriental Foods. They use Alpha Cargo. What I am not sure of is if Alpha Cargo picks them up in Cedar Rapids or if someone takes them to a supplier or distributor in Chicago and then ships to Alpha Cargo. When I was in San Fransisco, Ca at the airport I notices some Filipinos with Alpha Cargo boxes, so Alpha Cargo is probably in any large city in America that exports to Asia or boxes are collected and sent to Alpha Cargo in California. I see from the website Alpha Cargo must ship from California. If there are oriental foods restaurants in your area you could ask them if they sent boxes to the Philippines. I will ask how that is done at JoJo's.

I don't have an interview date yet but I'm hoping for the 19th of the month if I can have it. I called yesterday at USEM, the agent said I'm not eligible to schedule an interview date yet. I'll try to call again tomorrow.

That is good that you got the medical exam out of the way now. My fiancee Pat went to Manila to get her medical and visa interview one week apart. The problem was there was a scar on a lung. So the interview had to be canceled to wait on the 8 week sputum test. They do a three day check to find the TB bacteria so treatment can be started, but if it is negative like Pat's she still has to wait until the 8 weeks is up to make sure.

It looks like you have some real good advise. I thought my fiancee would be here by now, but she had a scar on a lung, so everything is being delayed by 8 weeks. I would wait until after the interview. Maybe see if Air21 will notify you when the visa and passport are being delivered. Maybe they will even let you pick up the parcel at some location that serves your province.
