Hey... I need something to do smile.gif

75 pages

I know I don't have the most. Do you?

I have right at about 100 pages. I could have almost come up with a whole ream of paper with the e-mails for over 3 years and IMs since archiving them in November. Instead of using the phone we use Yahoo IM. What I ended up doing was to print off a copy of the list of e-mails and IMs then print off a few samples. That totalled to be just a few pages over 100.

I find it quite unusual that nothing has happened there regarding K-1's for about a week now. I know we only have a small portion of the applications that come in but my fiancee is actually having a nervous breakdown about the uncertainty about it all. We submitted our's on the 13th and haven't heard yet and its becoming increasingly frustrating that couples (I Know its not there fault and I'm happy they've heard something) almost a month after ours have heard. Has anyone any information and idea on why it has suddenly seemed to of stopped after a lot being done at the end of last and start of this month? wacko.gif

Good luck to anyone facing the same problems as ours....

In addition to the H-B1 visas I noticed there was a new office opended to for processing foreign immigration from I believe Mexico. Maybe that will help take the load so the K1s will start flowing again. My K1 petition was was received by the CSC on May 1st and updated on May 4th, but no more action yet. I wonder how far after 90 days it will be before we start seeing the NOA2s. Good luck.

I even said to her that cases were being accepted that were in January and febuary and all she said was "theres nothing I can do". I swear to god this better be BS! or else I'm calling off the K-1 and were moving to England and doing a K-3 because there is no freakin way that its right we should have to wait 7 months when some get theres in 3-4 and when I call them on it they just say "what do you want us to do about it". Absolute BS!!!!

I can understand your frustration. You are so close to the end now. I see the USCIS according to VJ the VSC is processing February filers. I think the average is 6 months. So hang on you are getting close. You are coming up on 6 months, so it should be soon. According to the VJ estimate you should have had you adjudication in the 2nd or 3rd week of May. If it hits the 6 month mark maybe you should call the USCIS again and tell them it is past the 6 months. I think that the adjudicators work on a case and let it sit for background checks then work on another one. I think sometimes when it sits for background checks. It may take time to get back to it. Good luck to you.

hi just curious about how much money you spend on your wedding?

My fiancee have had some talks on this. She tells me any price I quote here for a wedding, that we can do it for less. She tells me that the money is better spent on other things. She is very practical, so I will spend as little as possible. My guess will be $1500.00 to $2000.00. What I am figuring on doing is to have a very simple wedding, which will probably be in the winter then have an open house/reception more toward spring.

Can I get advice on what I can do. I have filed a k-1 visa in April, 2009 and I now feel like I am not in love with my fiancee as I thought. The reasson is that I have asked my fiancee for help with half of the filing fee for the application k-1. He said that is all that I will have to pay, but he has also said that he does not have any money saved for the costs that he will need to pay for the fees for his permanent residence fees once he is in the USA. I am concerned that he will come here and have nothing to contribute to those cost. I am a single mother of three. I really want to say to him that he needs to prove to me that he has the money for these cost. I cannot incure any debt as I have small children that depend upon me. He says that he will borrow money from family. I am thinking that maybe at this point that he may have been interested in me for entry into the US only. I am so confused. I have a dear friend from his country that I talk with, who has concerns that once he is here and after we meet the requirements for his citizenship that he will leave me. My friend has been more support than my fiancee has. I have known him for 2 years longer than my fiancee. I am thinking that I made a huge mistake in accepting his proposal. I am wondering if I am really in love with my other friend, but I do not know what to do.?

Any advise??? wacko.gif unsure.gif

I understand your situation. When you petition the USA Government to bring someone here, you are the source of their finanaces. I think if I were in your situation this is what I would do. First decide if you really love this person, then if the answer is yes can this person come up with money up front? If he is willing, but does not have the money then wait until you have the money and have some talks on the financial end of all this. It will be awhile for him to find work.

There is nothing wrong with waiting to sort things out.

God bless and good luck.

K-1 Fiance(e) Visa Case Filing and Progress ReportsK1 NOA2 Approved

I received my K1 NOA2 today 7-20-2009. On Friday 7-17-2009 I noticed the K1 petition was touched and today I received the I-797 Notice of Action by snail mail. The USCIS must have really accelerated the background checks and so forth. This is more than a month sooner than I expected.

There is a light at the end of the tunnel. I want to offer encouragement to everyone still waiting. Hang in there.

K-1 Fiance(e) Visa Case Filing and Progress ReportsCommon trends in K-1 approvals
QUOTE (Starlight95 @ Jul 20 2009, 10:37 PM) <{POST_SNAPBACK}>
Hello everyone,

First of all I want to wish all the March, April, and May filers congrats on their approval. I am just happy that they are approving faster than before. I don't know about everybody else, but I noticed a common trend in approvals. It seems like they usually get through the mid month, and than move on to the next month. For instance, if your on the last dates of the month for some reason you are stuck there for some time. I think USCIS follows the FIFO method smile.gif. It sucks to have filed on the last days of the month, means you may be waiting for some time. This is just my take on this, as I noticed a pattern. I know VJ is not completely accurate, but it gives us an idea at least.

Maybe you have something. I sent my K1petition in on April 17, but the NOA1 was May1. Then 76 days later I have my NOA2. I noticed others close to my NOA1 are also being processed and the NOA2s are really showing up. I thought it odd how the NOA1s in May are being processed and what looks like many of the NOA1s in April are just sitting there. Can it be also that they are picking the low hanging fruit first; the simpler or easier petitions first?

I would think you would be coming up on your approval very soon. Good luck and God bless.

K-1 Fiance(e) Visa Case Filing and Progress ReportsPhilippines Credit Card for Fiancee'
QUOTE (Scott St. Hillier @ Jul 22 2009, 09:47 AM) <{POST_SNAPBACK}>
Hello,

My fiancee' is in the Philippines and we filed for her K-1 Visa and just received NOA1 07/14/09. She lives in Tacloban and the interview and medical exam will be in Manila. She will need to fly from Tacloban to Manila and back twice and stay in hotel's etc. to complete the K-1 process. I currently send her cash through moneygram.com but I would like to get her a prepaid credit card so she can go online and book flights, pay for hotel rooms, etc. I would like for her to have a prepaid credit card that originates from the Philippines so there are no issues where when she uses the card, it is a US based card and beleive there is a security issue because the charge is taking place outside the US. I would also like to "load" the card from the US for her use. I have investigated the Moneygram prepaid credit card and they do not allow what I am trying to accomplish. Does anyone have any ideas on how I can accomplish this.

Thanks!

A card would be safer than cash. I wonder if it would be best to send her money though Western Union, or I guess you used moneygram.com, but send her the money and have her get the card in her name. If the bank is an international bank it might be better. Just a thought.

One thing that I have come across because soon my fiancee will be getting her medical exam, but I believe the exam is paid for in advance once the NOA2 comes through and you know the number for the beneficiary.

Good luck,
Dale

Okay, so as much as i try being patient, seeing march and April approved cases did not help. so i called the USCIS. what did they have to tell me?

she literally reiterated a shpeel, saying person handling our case is is either too busy or too lazy and told me to call in 2 months. I really don't want to believe in that i have along wait ahead of me bs because clearly people who filed after us are being approved already.

I am so ANGRY! We are really on a strict time line here, and no touches, no RFE's, NOTHING what so ever. the whole process is suppose to be taking 6 months.

I am sorry to hear you are having a long wait. I have noticed there are many being processed and approved right now. It seemed like April and May were dry months where nothing was being approved. It is about 4 moths from your NOA1, so looking at the stats you should see a touch and bam there will be the NOA2 very soon. I wish I had a magic wand and could grant you your wish.

The best on your visa journey,
Dale

I-601 from Jamaica!!!!!!!!

--------------------------------------------------------------------------------

Hi Everyone,

Can someone please help me out here, I would greatly appreciate it.
Here's my story:

I came here almost 9 and a half years ago in someone else's passport from Jamaica. The problem is I have absolutely no evidence to proove this and no way of getting any. I guess I will be filing as EWI. I've been married for a year now and I have two kids that are not my husband's. Lawyers advised us that I have to go back to Jamaica for my interview after everything's been filed. Can someone help me get started with this lon process, what information to get to prepare to file the I-130. Has anyone ever filed a case like this without using a lawyer? I know we'll have to prepare a waiver packet but what's the first step, thanks.

Let me get this straight. You came here to the USA on someone else's passport. The US Immigration may view that as fraud and if that is the case you are not here legally. Then a relative could use the I-130 to bring you here legally. If you go back to Jamaica or even try Customs and Immigration my notice something. If they do, I am not sure what will happen. It just maybe that you will not need to worry about the I-130 petition.

By time my co-worker translated it and converted it to English grammer the closest he can come to is the operation is an IT project. He seemed to think it was almost nonesense.

I am getting ready to submit the application for the K-1 to bring my fiancee here. I have held off because I have not worked for over a year. Last year I went to the Philippines twice and once this year. I understand adequate income is mandatory so I'm waiting till I have secured a job before I submit application. I will begin receiving social security benefits for me and my son beginning in July. I am hoping between that and a Job will be enough to qualify. My question is, does the USCIS look at social security as being better because its more of a guaranteed income? Also, does your year to date income have to equal the 125% of poverty level (there are me,my son,my fiancee and her son = $27,563 minimum)or just how do they figure it? I'm trying to determine how much I need to make between now and 6-7 months from now.

MikeA,
Good luke to you on job hunting. This is just a thought, but the USCIS may see getting a job recently as a bit of a wisk and if you were drawing on Social Security recently as another red flag. The reason I say this is the USICS wants to make sure your fiancee will not also have to draw on social security or any form of money from the Government to live. It is sure worth a try. If the request is rejected submit a request again after you have had a job awhile.

I do not think it matters if your fiance owns a house. It seems like the USCIS is more interested in income than assets. They may be interested in only dollars as far as income than total compensation. Like the compnay I work for, puts 75 cents into my 401k for every dollar I out into the account. This may count more toward an asset. My net income passes the 125 percent above the federal income level. So yours may also. http://aspe.hhs.gov/...09poverty.shtml Here is the latest poverty guidelines. Hope this answers some of you questions.

I will have to supply the I134 to my fiancee too with proof of my employment and income. Many people seem to pass, so you should be ok.

Maybe the US Consulate in Canada may be different, but the packet 4 which is to be downloaded from your consulate, but the US Embassy in Manila packet 4 gives some definitions. http://manila.usemba...ov/wwwfk1en.pdf This document tells the evidence of engagement is showing an ongoing relationship. The requirements for the US Embassy in Canada may be different.

US Embassy and Consulate DiscussionI-134 Affidavitt of Support supporting Docs Question
Maybe someone is familiar with this. On the I-134 Affidavitt of Support instruction sheet under General Instructions it says: You must submit in duplicate evidence of income and resources, as appropriate:

http://www.uscis.gov.../i-134instr.pdf

Does this mean two copies of each category or two sources of for each category?

I have last years income tax return, W2, letter from my bank, income and work history from The Work Number, pay check stubs, total benefits statement from my employer, 401k statement, life insurance statement, and some other information printed from my employers intranet site. Some of this is really duplicated information. Is that the duplicates the instruction sheet is asking for?

I downloaded the I-134 form here on VJ and I have it filled already in preparation for the next step. I just want to check on some things.

1. Is the version of the document available for download here on VJ the version that does not need to be notarized?
2. I'm way over the poverty line for my corresponding household. Do I need to include a letter from the bank summarizing my deposits and also put the value of any property that I have, etc? Do these documents are required depending on the embassy?

Thanks a lot for your help.

PEACE.............

It may depend on the embassy. I am several times over the poverty line. I still listed my house as real estate and I am supplying a retirement account statement, a 401k statement, a letter from my bank with the deposites, verification of employment. The US Embassy in Manila did state some of these, so it may be different for the embassy you are providing info for. They did call out the federal 1040 and pay stubs. These do perform double duty. They help verify employment and how much you make. Good luck.

I went to the RP 5 times in a year and a half (felt good to get that free flight from Philippines Airline... finally!). I went to the interview, but I didn't go into the interview with my fiancee. It is her interview so they often don't want the USC in there to interrupt the flow of it all. The COs are just normal employees trying to get through a day of work so to some of the COs, the USC is considered a pain in the back side. I think visiting your fiancee 3 times helps you, but I don't think attending the interview helps anyone especially when trip number 2 is for the interview (my opinion).

I have been wondering about the USC attending the interview. I believe you are right if the petitioner is there they might be in the way. Something that I wondered also is if the petitioner is there the interviewer may perceive this to be a possible coercion. A possible case for forcing the Filipina. This would be a chance for the Filipina to think over if she really wants to do this. Just a thought.

QUOTE (Bob-KhaHan @ Jul 23 2009, 09:16 PM) <{POST_SNAPBACK}>
I went to my HR department to get my employment / income verification letter for my I-134, but they told me that they could not sign one for me and that the HCMC Consulate (or whomever needs this) would have to go to a website (www.theworknumber.com) to get that information. I told them my situation and they didn't budge. This is not the main HR for my company, but the one in my city so I haven't tried calling the main HR number yet. The main HR department would probably not do anything, either.

Has anyone else run into this situation that you just printed out a website address and a "secret code" for them to use?

Another question is that I don't get pay stubs, but I can print them from a website. Do you think they might ask for "original copies"?

I ran into the same thing about The Work Number. You are entitled to a yearly free report. I sent in for mine and got some information, but not all. So I am submitting what I have. You can also get the code you mentioned from The Work Number, which is then printed off and can be submitted, but they do not say what the charge is up front. From my company's website I also have a benefits summary plus an earnings report that is current, but there is not any company letterhead, but there is the secure URL prints at the bottom of the paper, which has some of the same information with a 401k savings plan. The paychecks are e-pay electronic so there are no hardcopies of the paycheck stubs, but from the company's website I can print the pay stubs, so I am submitting these as well. I am also submitting last year's copy of the federal income tax return, plus a copy of the W2. I am not sure if it will be enough or not. I wonder what others have experienced with this.

US Embassy and Consulate DiscussionBank Statements/PAystubs
QUOTE (masteryfic @ Aug 27 2009, 09:08 PM) <{POST_SNAPBACK}>
Hi anybody experience giving bank statements to the embassy during the interview. Is it ok to cross out SSN and bank account numbers? will they keep those?

I went to my bank for a tally of deposites for the past year with the teller's letter on letterhead and indicating the total of the deposites and signature with date. I tried to eradicate the bank account numbers on the printed out deposites, but there were so many and even using a Sharpie if you wanted to see the number you could hold it up to a light and still make it out.

PhilippinesI-134 Affidavitt of Support supporting Docs Question
QUOTE (Kurt y Dora @ Aug 16 2009, 01:13 PM) <{POST_SNAPBACK}>
You need two copies of everything (just as your fiancee needs two copies of passport size photos) for the interview. I would guess that, as in all things bureaucratic, they send your information everywhere in the "system".

Thanks. I have made 2 copies of everything I prepared for the I-134, plus I ran off 8 or so 2 x 2 pictures of Pat plus pictures of Pat and I. I am also sending Pat a copy of the petition with pictures. I think I have it now.

Thanks and God Bless,
Dale

Thanks for any help,
Dale

It means 2 copies. I sent her 3 copies of everything including the I-134. As for the list, I sent A,B and C.

Thanks, I think 3 copies is a good idea because some of the material will be used for the change of status.

Thanks,
Dale

Dale,
I have made duplicate copies...that is all
but I cant tell if I am correct or not because she has not been thru the Interview yet...right now is set for SEPT 23
Best wishes

Thanks, I will just make copies of mainly anything financially support Pat. I see the DS-156K asks for the financial support and evidence of engagement. I see to change status some of this is also required.

Thanks,
Dale

PhilippinesQuestion on Income/Affidavit of Support
QUOTE (hara/eric @ Aug 23 2009, 10:20 AM) <{POST_SNAPBACK}>
hey guys, i'm fairly new here and this is my first post.. From what I understand, including the past THREE tax returns is a requirement for the Affidavit of Support. Anybody know if this is absolutely a requirement?? Here's my situation: I received NOA1 on 7/14/09. I recently graduated medical school this past May, and am currently a doctor in residency training (started working on 7/1/09). I am 29yo, and have never filed taxes, as I've been a student practically my whole life. I figure, with the way the timelines are heading, my SO will have her interview some time in January. By then, I will have about 6 or 7 months of pay stubs to show..... but that's about it. Does anybody know if this will satisfy the requirement? I'm just trying to plan ahead. I'm not sure whether or not I should just get one of my parents to agree to be a co-sponsor. If anyone else was in a similiar situation, and have advise, I would be grateful. Thanks!

Just a thought, but in your situation I am guessing; a hospital, if they have an e-pay site or if your paychecks are electronic then perhaps you can go to the website and print the paycheck stubs of what you have, then if they provide it print off a report of your total income so far this year.

Arch and Cel,
Where are you getting the information about a notorized I-134 form and 3 years tax returns and W2s. On the instruction sheet for the I-134 it states a notorized I-134 is not needed and only stipulates 3 years tax returns if self employed. I sent my fiancee only last year's tax return and W2 and just a signed I-134. I followed the instructions. Did I overlook something?
