Has anyone out there going through a divorce from your wife or husband and they filed a I751 to get conditions removed? My attorneys contacted INS enforcement who informed them that most marriages that end before conditions are removed, that the recipient will, a lot of times file an I751 claiming abuse, it's what the agent called the "Abuse Excuse" (their words not mine). I am in no way stating that some cases are very legitimate and the respondent did not come to this country with good intentions because some do. But what the INS enforcemnt will do is pull everything that you and your respondent has filed and go through it with a fine tooth comb and that includes going to the respondant's country of orgin and do another extensive records check to see if something was either missed or something new has materialized. i filed i-130 for my spouse in vermont early jan 2006

i got NOA 1 within 2 weeks

but i haven't received NOA 2 and its now close to 3 months.

Is this normal processing time?



I filed my I-130 on Jan 25th and I received my approval noa2 on Apr 7 (72 days later) But I still have not gotten approval on my damned I-129F and the I129F is the one I need

:help: My wife sent her Packet 3 to the Embassy which was signed for on May 5th But when she calls to check on it they say it's not on the system as of yet. Does anyone know how long it usually takes from the time the packet it received until it is put in the system?? :mellow:

You should really consider cultural differences.
I am sure that she has some language problems. She has no friends in the States.
She wants to be secure. She needs job. She wants to have her own place to live where both of you can live as a family. It is not always easy to live with a mother in law (even if you are from the same country). You need time to adjust to each other and to the fact that you are married.
Give her a chance. Talk to her.
You can divorce at any time. Sure you can get a legal advise but do not rush.
There are always two sides of a medal.

Artegal - can you send me some of that stuff you are smokin cause today I can really use something to releive my pain and help me forget just a little......the liitle princess does speak broken English, has a SS card and I do encourage her to get a job (but does not want to - working in a restaurant is beneath her, she's here to take Corporate America by storm and make millions because that is how they do it on our American TV programs she watched back home), oh and no I don't keep my trophy looked in the closet all day either, she can come and go as she pleases - I prefer her to go out in the sunshine and fresh air anyway. Well here is my story - I am a USC, got married 3 months ago overseas. The wife came here a month ago and has a CR1 visa and has her 2 year GC. She has totally changed since she has arrived, far different from the gal I knew and fell in love with. Her constant nagging is driving me up the wall. She became extremley upset when I refused to start paperwork to sponser her younger brother to visit us (I have a feeling that he would overstay and never leave). I'm a regular working guy and really can't afford any more financial responsibility. I have done everything I can to make her happy - put in a satellite TV so she can watch her programs from back home, got a good long distance company so she can call home more often, we go out to nice places, this summer she will be starting English language classes, gave her a generous allowance so she can buy what she wants, I encourage her to find a job if she desires, I told her I would buy her a nice home next year (still saving), we currently live at my moms. She wants to know what my life savings is - how much and where? if I don't tell her then I don't trust her and it will never work. I continue to refuse to say. She has told me 2x already that if I wanted to divorce "her" that would be fine with her. Everyday I bang my head against the wall trying to figure out what i am doing wrong? and why I can't please her? My fear is that if I try to divorce her, she will lie and cry "abuse" and how do I get her out of my moms place?
Is there someone I can talk to? someone I can report this to?

The interview lasted all of 5 minutes and the interviewer knew that she was nervous so they went out of their way to be friendly and cordial. :thumbs:

My wife received her Visa via DHL this morning.The whole process from start to finish only took us 123 days. That includes when we first sent off the I-130 right up to the courrier handing her the Visa this morning. Thank You for all the support, and for those who has not yet received their visa or whose paperwork is still in some sort of legal limbo all I can say is "Better you than me Dude" :lol: NO Just teasing! please hang in there and don't be shy of calling and or emailing the USCIS people. Yes it has been a while since my last post but I have not forgotten all who has given me and my British Sweetie Pie. She and my daughter finally arrived at Hartsfield airport in Atlanta Monday. And after all the waiting and agonizing on Visa Journey her flight, due to weather was delayed for 2 1/2 hours.

If not you may "slip" through but you will have some major questions about the relationship in 2 years at ROC. DO you have proof of a valid marriage ?

my understanding of this is: Once the petitioner has made a contract of Affidavit of Support, it stays in effect even in the case of divorce. The green card has no bearing on the matter. The petitioner is obligated to support the beneficiary until U.S. Citizenship is aquired or the beneficiary has worked under the SS system for 40 quarters.
If I am wrong about this, someone please correct me.


What if the beneficiary makes more than the petitioner and has been working for the past 2 1/2 years?

I was informed on Friday that my K-3 packet was sent from the NVC enroute to the consulate. My wife called the Consulate today and was told that they have not received the packet as of yet.

Me and my bride filed the I130 last month, she is in London and will be relocating here with me to Atlanta GA. The advice I can give you especially onthe 325a's is to make sure that all your "I"'s are dotted and your "T"'s are crossed. Also the moment you send off your I-130 start working on your papers for the I-129F that way when you receive your first NOA (notice of action) from the I-130 which should be in about a week from the filing have your I-129F ready to go. PS when sending all your papers off make sure you have delivery confirmation....Good Luck....Wayne

I fully understand the trauma of the I-130 and the checking and rechecking to make sure all is done properly. I am in Atlanta and my wife is in London. We are now awaiting our 2nd NOA from the I-129 so I am working on the I-134 (affidavit of support) The trick is to stay one step ahead of the process that way you can check, recheck and triple check your papers....Wayne


I finally found time to finish the I-130 package this morning after a week of going so slowly it nearly killed me. I didn't want to make mistakes. So, I headed to Kinko's to get copies. The first copier got jammed. The assistant came to help, but it still wouldn't work. The second copier wouldn't copy. The assistant tried to help but no luck. Finally, he takes my paperwork and makes a copy himself and gives them to me on the house for all of the trouble. I headed downtown to the post office. Closed. I drove back to Kinko's to try and FedEx. They can't deliver to PO Boxes. But, the helpful assistant tells me about a post office across town that is open later on Saturdays. I drive miles on a strange snowy day in NC to the other post office. Finally...it's on it's way with Airmail and delivery confirmation. I feel great to be over that first heart attack, but I'm also a little pensive. Oh well...begin the begin.

Never send your original copies with any of your forms just copies. My wife is in the UK as well and what I am planning to do with all the originals is to send them to her (By DHL so i can track them too important to send any other way) as soon as I get my NOA2 from the I-129F so when she has her interview she can take them with her....Wayne
