K-1 Fiance(e) Visa Case Filing and Progress ReportsCan i pay 165$ fee online for K-1 fiance visa.

I get the K-1 fiance VISA last week..So anyone tell me can i pay 165$ fee online before departure to U.S.A...??

Hi & congrats on your visa, as for the $165 immigration fee you don't pay this as it is only for people who have got a CR-1/IR-1 spouses visa. It's for the progressing fee for there Green Card.

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal Doc or Certified Copy?
For things like birth, marriage certificates, passports, US natrilazation certificate, & any translations of these documents you only need to send photocopys as you can then show them the originals at the interview. If you do send the originals of any of these you may very well never get them back.

IR-1 / CR-1 Spouse Visa Process & ProceduresShould K-1 petition be addressed in I-130 Packet as a statement.
I may be wrong but I would have thought that you will have to cancel the I-129f first before submitting the I-130. Also congrats on getting married.

Yes they do as it's his evidence of residency until he gets his Green Card in the post. Have you paid the $165 USCIS Immigration fee yet?.

IR-1 / CR-1 Spouse Visa Process & ProceduresApproved

My husband visa was finally approved dancin5hr.gif .
Thank you so much to all the members for all the help.
We start our process Nov 2012 and it was approved Feb 2014 (Montreal CA Consulate) .

Quick question. We would love to take a vacation in the Caribbean, can my husband travel outside of the USA before he gets his residency??

Hi has your husband received his passport back from the embassy & entered the US yet? If he has did the CBP Officer who prossesed his paper work stamp his passport with an I-551 it's a temporary Green Card.

IR-1 / CR-1 Spouse Visa Process & ProceduresReplace a page on I-864... slightly odd question

Actually never mind, since it was literally just a box she forgot to tick (whether she's on active military service) and not a change/amendment I just did it by hand with the same colour pen she used on the form. I don't see how they could object to that.

Thanks Brian, I came to the same conclusion.

That's ok as long as all the info is on the form & they can understand it, then everything's ok. ?
Good luck to you both.

Brian

IR-1 / CR-1 Spouse Visa Process & ProceduresReplace a page on I-864... slightly odd question

Hi all

My wife has finished her I-864 for my application and yesterday we printed everything off and she signed on the dotted line. I was going to post it express today but noticed that she forgot to tick one box on the form, so I thought I'd just print that page again from my work once she ticked the relevant box and insert it into the signed package.

The (very minor) issue is that we used an inkjet printer at home but at work I have a laser. So if I replace a page it will look ever so slightly different from the other pages.

Question: has anyone done this and got through without issues? In my excessive cautiousness I'm imagining a situation where they see the printing is different and suspect some kind of fraud.

(the reason I would prefer to send today is simply an extra day's delay if I wait until I get home and have her resign a new version).

Hi, it won't be a problem, on some of the forms that we did on the computer, their were some boxes that we had to write in by hand as for some reason it would not let us type it in, & so far we have no problems.

IR-1 / CR-1 Spouse Visa Process & ProceduresCertified or Notarized Copies?

That's not what I was saying, your first post that I was replying to implied that a spousal visa applicant hand carries original documents to the interview and that is not correct when the NVC is involved in document intake. Original documents are sent to the NVC in that instance.

Ok point taken but the same thing was said by another member that originals were needed at NVC & the embassy, also in the guides it states that originals are needed at the interview.

IR-1 / CR-1 Spouse Visa Process & ProceduresCertified or Notarized Copies?

That member may be saying that and typically, it would be correct.  However, in real life, you're going to want to optin for electronic processing through the NVC stage, (not available everywhere but now available for London) so will be scanning and emailing the original or original certified copies of documents, then having the beneficiary carry all originals to the interview.

A certified copy is one issued and certified by the government agency holding the original.  What WILL be original is the Police Report.

With rare exceptions, like China, there is no notarization of any document, during the immigrant visa process.

Thank you for putting it that way  :)  which is far better than just saying someone is wrong with no explanation, also I think that they need to update the "Guides" as the info is a bit misleading at times. once again thanks :)

IR-1 / CR-1 Spouse Visa Process & ProceduresCertified or Notarized Copies?

The way your posts reads, the applicant would be hand carrying their documents to the interview which is not the case when the NVC is in the mix.

So you are saying that NO original documents are needed at the interview

IR-1 / CR-1 Spouse Visa Process & ProceduresCertified or Notarized Copies?

This part is incorrect, for a spousal visa case, originals are submitted to the NVC.

How is this incorrect???

IR-1 / CR-1 Spouse Visa Process & ProceduresCertified or Notarized Copies?

On the VJ guide to applying for the IR-1/CR-1 it says "A copy of your marriage certificate", "Copy of the full Birth certificate", and so on.  My question is:

Do these copies need to be notarized copies, certified copies, or just plain xerox copies?

Many thanks

Hi just normal photo copy's as the originals will be taken to the interview

IR-1 / CR-1 Spouse Visa Process & ProceduresJoint Sponsor Requirements

My husband and I recently got our I-130 approved. We are both living in Sweden at the moment but I am an American citizen who has been here for 2 years. For the 2 years I've been here I was trying to find a job without much success. Luckily my husband is able to support the both of us and all is fine. I did go to school to learn Swedish for a while and then we decided that it would be best to move back to the USA and we filed for the spouse visa around the end of April of this year.

Since I have been in Sweden for the past two years without a job, I don't have any income at all. As for being a sponsor for my spouse, I will not meet the requirements. Therefore, my relative said she will be willing to be our joint sponsor. As for my aunt, she is an American citizen and lived in the US for the past 15 years. I would like to ask if anyone knows what specifically we would need to send to NVC? There are 3 things that I've researched that they will need:

1. Her past 3 year's tax records

2. Her bank statements

3. Proof of her citizenship

4. Filled out I-864

I just have the following questions:

1. For her bank statement, can we just send a copy of her most recent bank statement?  If so, is there a certain amount of savings she needs to have in her bank? I mean, are they looking for a minimum amount?

2. As for proof of her citizenship, can I ask her to make a photocopy of her American Passport? Or would I need her to send me a copy of her citizenship approval?

Thanks for your help

Hi, I don't know about your 1st question but with regards to the 2nd, you can send a copy or ether passport or naturalization papers. I personally sent a copy of my wife's passport & naturalization papers just on the safe side.

Good luck with your journey.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp With Family Name On Forms

So if she hasn't done this yet we need to use her maiden name on the forms? Or to make it easier we should wait till she gets her new SS card? Or can we use the married name as we have the marraige licence?

Hi,

I would suggest that to make things more stream line to get all her documents changed into her new name before you file, but you can file everything with her maiden name as it's not compulsory for a woman to take the man's name.

The marriage certificate is the prof the you two are married, as far as I know if she wants to use your name on official paperwork then she will have to get everything sorted prior to you filing.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp With Family Name On Forms

Hello vj

I appreciate im probably not the first person to ask this but I have been reading several differant things as I have been looking into this issue.

My wife is confused about which name to use on the i-130 and G-325 form I know that she has to state her maiden name on the I-130 but not on the G-325. On our marraige cert it does not state her new name but she did sign it with her new surname. She had not yet changed her passport drivers licence and so on with the state. So which name should we use her maiden name or my name any advice would be appreciated

Many thanks Jamie

Hi Jamie,

The marriage certificate is your wife's prof that she can legally use your name, the first thing she needs to do is go to her local SS office & get a new SS card in her new name then when she has that get her passport changed then go to the DMV & sort out the driving licence, after that the bank, her works, credit cards & anything else.

IR-1 / CR-1 Spouse Visa Process & ProceduresHelp-Married a US citizen while visiting

Hi Ian,

Thank-you so much for your information and encouragement.  I work with the government and have had no criminal issues.  At POE I told them I was visiting Vegas for vacation and they didn't ask anything further.  I have Nexus so I don't tend to have a lot of questions asked at POE. So I will begin the paperwork, from the link in the post I am assuming the CR-1 Process is the one we should be applying for.

Hi, The process and forms are straight forward, we did it all with out the help of a lawyer. The guide you need to follow is the one that Darnell posted as you will be doing what is called an AOS, Adjustment of Status as you are married to a USC and now living here in the US with you other half.

K-1 Fiance(e) Visa Process & ProceduresNOA2 ARRIVED! but when should I replace my damaged passport - K1 VISA
Hi
You can always book an appointment at a passport customer service centre & you should get it there & then or wihin a week according to gov.uk web site, it will cost a lot more but if you need it quickly it will be the only way, as having a damaged passport could lead to problems.
