I have been living in the country of Georgia with my husband more than 1 year. I want to go visit my family, and also I want my husband to finally meet them too. I want to go in April to visit my family. It is a good time for me because, I have brothers and 3 of them have birthdays in April, Easter is coming and Mothers day is coming. I want to surprise them all!! :D  Can my husband apply for a tourist visa? or would it effect the Spouse Visa? How long is the tourist visa process?

Hello VJ members,

 

I have been living in Georgia (the country) with husband since April of 2013. It will be 1 year next month. My husband and I have started preparing our documents for the next stage (NVC) when we will receive our NOA2 approval. I have been here on a tourist visa for almost one year, and I applied again for one year last week. I am only on tourist visa until the day Jaba receives his visa and can come home with me. And if everything goes right, and with the correct analysis we have 4-5 months left till we complete everything.  That being said since I am on a tourist visa, do I have to prove U.S. domicile? or does this only apply for USC's who have been away from the U.S. a long time?

We originally submitted our DS-261 on June 24, 2014. And received my IV bill on July 30th and paid for it on August 18th. Two days ago I accidentally deleted my confirmation page on my laptop, so I wanted to download it again. I decided to make a risk and I opened it (today). Now it was resubmitted! Will anything happen? Will my visa processing get delayed? Please help!

They even forwarded the USCIS reps email saying that processing should normally not take priority for 3-4 months more. I got noa1 on Feb20. I hope the senator trick works....

It's been 90 days so far - with no word other than the initial I-797.  So, I called today and spoke with a tier 2 IO who informed me that my case was in the queue at the Dallas Field Office.  I asked if he would expedite our case as my wife is living in a dangerous situation due to her government job, location and the unrest in Southern Thailand.  He agreed that that might warrent an expedite but of course the decision isn't his.  He submitted the request and advised me that someone would get back to me within the week.  I have little hope that our case will be expedited but there is a slim chance.  Maybe we'll be lucky... 

 

 

 

Same boat. My I130 is still at NBC. With no tentative completion schedule timeline. I went to infopass which was uselss the IO barely spoke English. I think if I spoke Spanish I could have gotten somewhere with him but it was just too painful to talk to him.

yes, there will be little to no information at an infopass appointment if your file stayed at nbc.. but very few are kept there, they have sent most 130's from nbc out to local offices which you can only find out about by first calling and speaking with an io


I just called USCIS and they told me that my I-130 filed on Feb 20 is being processed in NBC. There is not an estimation of completion time, nor could they tell me any information about if it was in work flow or even being touched. He also wouldn't answer any questions of any kind about processing times. I asked very directly if it would be transferred to my local field office. He said that there was a small possibility. Do you think my infopass apt. will be a waste of time?

this will be an immigration officer.. generate as many questions as you can in advance, cuz these are the people with the real answers.. as for an expedite, doubtful unless you already started that and meet all the criteria, but they will be able to tell you more about the status and the like. sometimes they will share with you what date they are working on.. when I went, I learned that my case was touched a little over two weeks prior. when I asked does touch mean it went from one shelf to another or touch means it went from the shelf into the workflow, he stated with a smile, yes it is in the workflow.. that was pretty much all I wanted to hear so a few more questions and I left.. two weeks later.. approved (I am sure it had nothing to do with going there though)


Does it matter that my petition is at NBC not cleveland field office?

I would not worry about the time frame USCIS gave you. It all depends on your local field office work load. Where is the city that you live in? This will give you a better idea of how long the wait will be.


I am going to a info. pass appointment this week. I will let ya know if it helps.


I hope it does I just made an appointment...I called USCIS and they told me my I-130 is being processed by NBC and they do not give out an estimated time....

I just made an appointment for next week at the Cleveland Ohio field office to speak with an immigration officer.....How much do you think they can help me? Can they help to expedite things for me? Can they give me advice about what actions to take and answer general immigration questions? The phone people just answer with scripted responses will they just do the same thing?

It's not DCF. DCF is when the USC lives abroad with the beneficiary, and meets the long lists of requirements necessary to be able to file directly with the embassy, usually including legal residency of that country for a minimum of six months. A very small amount of countries are able to do this anymore - Peru, Germany, Italy, to name a few. DCF has a different procedure than the normal I-130 filing, and is much much quicker. From the day they file the I-130 to the day they're issued the visa is usually a matter of weeks.
Filing from abroad is something different - they file all the same paperwork through a lockbox as everyone else, but for some reason when a foreign address is put on the I-130, the approval seems to come faster (somewhere around the two month mark, usually). They do all the same stuff and are required the same documents throughout the whole process. You would've had to move to Hong Kong if you would have wanted that, and even then this "auto-expedite" isn't promised. I filed from abroad (and am still abroad, for that matter) and got no special treatment. I had to wait 197 days for my NOA2.


what about k3 visa. Is it worth while for a feb. I - 130? How long do they take to receive? Could it cut down on our separation time?

Yeah I've seen that, they filed from overseas (DCF?). Somehow, they get preferential treatment :angry: ... I don't know how that works. Had I known, maybe I would have filed my I-130 at US Consulate in Hong Kong if I could.



I sent mine to Chicago lock box....AIT in Taiwan does not accept I-130's to my knowledge ( I thought everyone files through a lock box)....Why are you thinking they got preferential treatment?

I filed (I-130) at end of Feb (got NOA-1 in less than a week later) and do not expect NOA-2 until August or September. :blush:


A couple of people on here already show they have NOA2 and filed at the end of Feb. as well....Hopefully we get it quicker then that! Sept....(omg misery)

Nebraska Service Centre is one of the slowest beside Vermont and National Benefit Centre.  California and Texas work amazing, they are approving people from another countries too, i meant not only Pillipines.

For my case passed 3 month since NOA1, i hope after 1 month i will get NOA2 which is avarage for Georgian's.

I haven't received NOA1 Mail just I received email, i wrote to Nebraska and olso to Chocago Lock Box but no one responded, if someone experienced about it please write me how to get some info.



I wish Nebraska starts approving cases from different countries.

      I am from Georgia, Europe.  My wife is USA citizen from TX. We received first notisfication at Octomber 29, almost 2 months ago. We are waiting our approval, i read much about it and for nebraska from noe1 till noe2 waiting time is 3 month and 2 week. For my case passed 2 month so i am not nervous. I noticed nebraska reviewd and approved gyt from octomber so it is good sign that they will soon start full approval of octomber and fortunatelly i wont be last between you guys smile.png
     Just my question is, if someone contacted to Nebraska and got some usefull info about your cases!?

The AOS costs $88 (per case) and the IV is $230 (per person). They have to be paid with a US banking account on the payment portal (site linked in first post). Question: 1. As i know only petitioner or Agent (appointed with DS-261) can pay AOS and IV bills right ? Is anybody who can pay more ?

                 2. Here is said bill must be paid with a US banking account, so it means petitioner must have US located bank's account (debit/credit card )? If it is such and petitioner doesn't have USA located Bank account what can we do ?

My wife came in Europe, Georgia, Tbilisi in April 13 of 2013 and after 3 month we got married, since her arrival we live together. Despite of short period must she (My petitioner) prove US domicile? (I have heard at another forums that if it is 1-2 year you don't need to prove domicile,  but i am expecting confirmation form you anyways) Thanks

Is the joint sponsor providing an I-864 ot I-864a. If they are combining income with the petitioner using an I-864a (not recommended) you must use some method to show they are in the same house and they are related.

If the joint sponsor is providing an I-864 then you do not need to do this as a joint sponsor does not need to be a family member.

Hello guys, i am Jaba from Europe Georgia, Tbilisi. My wife is Vivian from TX, USA. Obviously i am beneficial, we are PD 21 October 2013 filers. Based on statistics provided by spreadsheets we will get our approval (NOA2) at the end of the current month or at the beginning of the April.

 

Why i got here ?

 

Because of approval is soon and i am not ready for NVC procedures i decided to start researching information and making papers ready to meet NVC procedures and not lose time after. i am sure all of you did on your certain time. BC of you already are on NVC procedures i believed you would know everything much more than people from October filers who are waiting approvals by USCIS like me.

 

Huge thanks to Saylin who does a lot for all of us and without her VJ would be less effective and clear.

 

I read almost all link provided at the beginning of the forum and a lot information caused confusion in my brain smile.png So i am here with hope you guys will help me for my NVC procedures, bc of i am from Georgia i think Georgian beneficial can provide more accurate information for me. All respond is appreciated !

What i know well it is:

 

1. When NVC will receive my case after 1 week i need to call and provide My wife's (petitioners) and mine (beneficiary's) Email dresses to them. Also ask for NVC case # and IIN (invoice identification number).

 

2. When i have Case # and IIN i can enter in system and make DS-261 (choice of agent in my case agent will be my mother-in-law who has US mail address and i will get fast mails without losing mails and delays as i experienced with NOA1 hard copy). 

 

3. DS-261 is already submitted electronically i must check if bills are made if yes pay both or separately depending how fast they will appear.

 

4. i got bar code cover sheets so now i need to start work which i don't know certainly (Making AOS and IV packages and express mail).

 

 

 

Guys please confirm if way i see process till 4 is right and help me to figure out about below issues.

 

 

Please guys someone give me actual check list of AOS package which you guys sent and works i am worried about not send  package with missed papers or not proper bc all my knowledge is based on much forums and less official instructions which i barely collected and still confuses me.  (for i-864 purposes i want you to know that my wife lives with me in Georgia since April 2013 and therefore we need joint sponsor who is going to be my father-in-law, so i want guys you to put joint sponsor requirements at checklist too. and also i am not sure which form my father-in-law must fill, i-864 or i-864a, my wife and i are going to live with my brother-in-laws and father-in-law after arriving in USA)

 

Also please give me IV Package checklist. I want to make ds-230 not electronic one (ds-260)
