I think the 2 year window to meet or see each other is for the K1 (fiance). Mine is K3 (spouse). Even though we haven't seen each other there is proof of marital union through communication, affidavits from those who know us and also from financial stuff that we share that tie us together.

Hi VJs. Im new to this forum. After reading some of the topics I realised I should have filed the I-130 and I-129F together. As it happened I followed instructions on travel.state.us.gov website that said that after receiving NOA on the I-130, I would then use the NOA from the I-130 to file the I-129F for my spouse.

I see some of the topics indicate I could have done them together. I guess I should just wait. I am kind of disappointed though that I sent my I-130 on March 10, 2008 and they have not cashed my check yet. But I am giving it the standard 30 days to see what happens. Does anyone know if I should expect to have my spouse from Kenya by fall? We married in 03/15/2005. With me living in the US (citizen) and him living in Kenya, we have not seen each other since 2005. For proof of marriage I included the marriage certificate and affidavits from witnesses mentioned in the marriage certificate as well as a letter from the government appointed village elder. I am worried that they will send me an RFE for photos and I will not have any.

Should I be concerned about not having photos to proof relationship if I sent 2 strong affidavits of marriage acknowledgement.

Proof of Permanent Residence is the Green Card. Make a copy (front and back) and attach to the affidavit of support.

I've seen a list of all the acronyms somewhere on here, but I can't find it now. I thought it was in guides, but I don't see a title that matches. Maybe it is in FAQs. I thought I had downloaded it and put it in my immigration file, but I can't find it there either. Sorry. However, if you keep looking, you'll find it somewhere.

Getting married does not mean the names have to change. Whatever identification your wife is using when you complete the application is what needs to go on the form. It would be easier if you did not assume names will change and actually change the names and have identification to prove it. Also pay attention to the areas in some of these forms that specifically request for (maiden name). Regardless of how many times a woman changes her name when she gets married, her maiden name will always be needed because that never changes. In Puerto Rico (someone told me) women must use their maiden names all their lives (even after they marry). See if its the same in the Phils.

It is true what Emilio Gonzales Says. I applied for Naturalization in July 25, 2007 and my interview and Oath ceremony was done in February 08, 2008. I thought that was pretty fast considering the surge of applications received in June and July.

I applaud the efforts of the USCIS especially in Texas who handled my application.

This is F2B which is not much faster than F4 priority. If and when father becomes a citizen, he can get the petition upgraded to F1 priority which is 6 years waiting for visas.

Any path taken for a 44 year old family member will be a long one but this case has the added problem of no birth certificate showing a daughter or sister relationship to the father or sister in the US. A solution must be found for that before wasting time and money filing a petition.


I agree with Pushbrk. Its going to be hard.........both you and your half-sister share a father who is not on either one of your birth certificates.........I m thinking paternity test first OR DNA to link you and your sister. Before you waste any money filing for your sister, sort out the birth certificates first. The only way I would think how would be to go to your Bureau of Statistics/Office of Registrar of Births and Deaths or whatever they call them there and find a way to properly assign both parents of you and your half-sister on your individual birth certificates. If they have paternity tests there, this may give validation.

I was re-thinking the steps I have made thus far....but what do you think.

Obviously its cheaper to go the CR1 way for the spouse to come as an immigrant. But I want his children here at the same time using his K3 (and the kids K4) so they may all come together with their dad (sooner) rather than waiting to file CR1 for the kids separately and prolonging their journey. I'd rather file for them when they are here and I can space out filing expenses.

If I had opted for just the CR1, would the kids have been able to come with him on the same flight without me having to file separate petitions?

United KingdomWhen Calling The Extortion Hotline

My fiancée is the one in England trying to move here to America. I need to call for her to make the payment for the visa. It says on the site that they need the "applicant's info", but I'm not sure if that's her or me, as up to this point, I've been the "petitioner" and she's been the "beneficiary".

Also, if the info I'm giving is hers and she'll eventually need to prove that she paid for the visa with a receipt, but I'm paying with my card, at what point do I explain that it's my card but her name needs to be on the receipt? I don't want to say the card is hers because it's not, but I don't want to mess it up by not having her name on the receipt.

Finally, is this a fairly easy call? Am I blowing this out of proportion? They just give a very specific amount of time that I'm paying for, so I don't want to ask too many questions and then get charged extra for going over.

Really finally, my cat is meowing like crazy. Would anyone like a grey American longhair? At the very least, he makes an amazing blanket.

NEVER, ever use white-out on any official form. However, you may cross-out with a pen (so they see what you are crossing out) and above or beside, make your correction. AND don't forget to initial the correction.

Yes. My step kids were 9 years and 12 years old and they had to go to the interview. I think everyone regardless of age (even toddlers) have to go to the interview, not necessarily to be interviewed themselves, but for visual comparison (photo, etc.,). The CO asked my step kids if they knew me (the petitioning USC) among a few other harmless questions. They also asked trick questions about the primary beneficiary (I guess for the kids safety) to make sure he is their father.

Our package left NVC on April 15, 2011, and Ben's interview was on May 26, 2011. But, we scheduled the interview ourselves using their new system. Your case may be different since you are petitioning your son, and your interview may be scheduled by the NVC (I know they schedule the CR-1's). I would call the NVC and ask them. They should be able to give you an idea. The wait could possibly be a couple of months, maybe more, but I am just guessing. When we scheduled our interview, the times available were Monday through Friday (it didn't specify that only certain times of the month were available) but again, I believe the choices are different depending upon which type of visa you are applying for. You select the visa type before you are permitted to see the interview schedule. If it's scheduled by the NVC, then obviously this is a moot point. I hope this helps a little.


I'm planning to request an expedite once NVC is complete based on the need for my son to take summer classes before his last year of high-school begins in August 2012. I hope that will be a good enough reason. I don't want him to start his last year of high-school not knowing what level he is academically and the summer school will give a good idea on if he will need extra tutoring before and during high-school.

I have never filed for a son; I imagine some parts of the process are similar, however I would pay the fee ASAP and schedule your interview well in advance because fiance visa interviews tend to be more available than other types and other types can entail long waits. The fees may be different for that type of visa as well; for the fiance visa we had to pay via phone or bank in Kenya, and it was a separate fee than the initial filing fee.

This website: http://usvisa-info.c...E/selfservice/p should be able to let you know if you have to pay another fee (were you given a fee receipt number? You'll need that to schedule your interview on that site.) I would register on that site and then you should be able to see if any additional fees apply. I hope you don't have any more!


I just called NVC and they confirmed that since I have already paid the Visa fees to NVC here in the US, that I will not be required to submit any other fees at the US Embassy.

The NVC should mail your documents to the Nairobi Consulate (this takes a few days). Once you have word they've mailed it, wait a few days and then call the consulate to confirm they've received it. At that point, you can schedule your interview as soon as all your documents (police clearance, birth certificate, etc.) are in your possession and you've prepared the forms in the "Packet 3" available on the Visa website. After you have paid the fee, you schedule the interview through the other website http://usvisa-info.c...country_welcome). You can schedule your medical via email or phone for around the same time as the interview, but you'll want to do it enough days beforehand that the medical offices have time to deliver your medical records to the consulate BEFORE your interview.

Since I am filing for my 16 year old son (my natural born son), is the process the same? The NVC asked for the police certificate and ORIGINAL birth certificate which they have received. Also, I paid the IV fees $404 directly to NVC through their online payment portal. Are there STILL other payments to be made at the US Embassy Nairobi? I was thinking that the Medical is the only thing remaining.

I want to post some information on this Nairobi thread just incase someone comes along with the same situation.

The NVC requires everyone over 16 to give police certificates when sending the IV packet. Well the CID in Kenya told my aunt that they could not issue a police certificate "certificate of good conduct" to my 16 year old son who I petitioned for because.........well...........he is not 18 years old yet, Duh!! He does not have a national ID and therefore not in any database. Why does the NVC ask for this in the first place for minors?

Anyways, I called the NVC and told them that my country is not able to issue police certificate for my 16 year old son, for the reasons cited above. The operator told me to hold on so she can do some research. She came back and told me to attach a letter indicating why the police certificate was un-available.

Hopefully this information will help someone else here on VJ in the future.

My husband (and my two step-sons) completed their interviews today. He said that he was given a blue slip with a line across it and at the end of it was Date February 6th which he was told was when he could come back for Visas. The Embassy also kept all three passports.

I thought the PINK Slip was the usual indication that the interview was passed and that Blue meant, additional information needed.

Am I freaking out for nothing? Please let me know.

Then there is a fee to pay at the Embassy on the day of the interview, i cant remember how much that is. I think it is around the 130 dollar mark, but dont quote me on that.

Doesn't save much but it saves the mailing time from NVC to the spouse.

* Have the beneficiary (now the applicant) fill out the DS-230 and send it to the USC if they are to be the agent....this can be done at any time before the DS-230 is generated at NVC. Once it is generated it will be sent to the agent, the signed copy with the cover sheet (that the agent will receive) which has the barcode can then be mailed to NVC.

* Have the beneficiary (now the applicant) forward any documents, photocopies etc that may be required to be submitted with the DS-230 to you ahead of time. Check out the Department of State website HERE
and select the Instructions for Visa Immigrant Applicant appropriate for the country of your spouse.

* Complete the I-864 which is also available in the above link for download. When NVC generates this form it comes to you with a barcode cover sheet which you will then need to return along with your completed I-864 form.

All the above do not save as much time as Jame's Shortcuts but they do save time.


IMPORTANT
Familiarise yourself with the NVC Flowchart so you know the order in which forms will be generated and what is sent to the USC (petitioner) and your spouse (beneficiary/applicant) to be completed.

press 1 for information about your immigrant visa
It will then ask you if you know your CIS receipt number.....press 1
(Once you have a case number you can use this.....press 2)
You then follow the instructions to key in your number.
If will then tell you if NVC has received the petition, and assigned a number.

This automated service is available 24/7.
Once you have your case number you can call them at any time to hear any updates on your case, using either the NVC case number or your CIS (NOA) receipt number.

Choice of Agent
Many members are having success in emailing the NVC to choose their agent in place of sending in the DS-3032. They usually send a confirmation email within a couple of days. If not you will need to call to confirm that it has been accepted. Below is an example email posted by AMarina.

As soon as you know (from the answering service or talking with an operator at the NVC) that the Choice of Agent form has been sent out, the beneficiary can EMAIL their choice of agent to NVC. Apparently, there is a rule that if you cannot locate your form (due to bad mail service in your country), you are entitled to appoint your agent by e-mail. We did it on a second day after the form was mailed, and received a response from NVC two days later that they accepted choice of agent (by the way, we still have not received that letter from them yet, lol).


Here is a sample of my correspondence with them:

Dear Sir or Madam,

Your inquiry has been received at the National Visa Center (NVC).

The NVC has updated the petitioner's address. Please continue to notify the NVC of any change of address or change in personal situation, which may affect the beneficiary's entitlement to a visa.

We have received the Agent of Choice selection.? The Immigrant Visa Application (DS 230) processing fee bill will be sent to the petitioner.? The fee must be paid according to the instructions before that form will be sent. Please allow two to four weeks for the petitioner to receive this fee bill.

EXP 07 NOV 2008A <---- this should be about one day before the NVC tells you it left.

Below in the "shipment pick up date range" put the day NVC told you it left as start and finish.

You may need to play with these dates a bit but that is what normally works.

I've been browsing the USEM site. Its my second home. Unless I'm cross-eyed, It mentions forms being available at the Embassy, not at the Doctor's office. Sarit Center is One Way and the USEM is in the Opposite Direction. He will call the doctor and see if the forms are also available at the doc's or he can just download from the link you provided.

The USEM indicates that the Medical Forms DS-2053 are available at the Embassy. Does anyone have a copy I can use instead? I could not find this at the State.US website.

If you had followed my advice earlier to join the March NVC thread, you would know of this problem already :P

Starting yesterday it seemed, whenever one dialed into the AVR, it would be re-directed to an operator. And then, today, as soon as you called in, it went directly to an operator. They're trying to fix this issue, it seems. I highly doubt they'll completely eliminate the AVR.


Sorry, I don't have that much time on my hands, no offense to anyone else who does. In any case, there are other people who call the NVC who are not March filers.

I called NVC yesterday evening and was surprised when the line was immediately picked up by a live person.

This morning when I called, a live person picked up again. She told me that from now on the NVC line will be picked up by a live person. Has anyone else experienced this?

I called NVC several times this week and you can actually reach an operator without going through automated messages. Operator said automated messages were disabled. For this reason, we cannot use James' shortcut for IR1/CR1 visa. What do you think?


I was told the same thing. No more Automated Service from now on. Some members here seem to think it is a temporary thing, but I've called more than 4 times and told 4 different times that from now on it's live customer service. I am wondering if they will continue to give case numbers over the phone.

You can join a March 2012 NVC filers thread if you can look it up on the search field. I haven't joined coz there are way too many pages to read through and keep up with. Don't have the time, but periodically visit the main NVC forums.

The NVC will send you the IV & AOS fee. After paying the fees, you download the DS-230 & I-864. After to send in those form and the supporting documents, then the case goes to the US Embassy.


Here is what I don't understand. My minor child (16 years old) will be asked to fill out a Choice of Agent?

Got my NOA-2 for my natural born son on March 2nd. :dance: So I guess the next step is at the NVC. I have checked all the guides, and forgive me if I missed something. Do I understand correctly (since it hasn't been mentioned anywhere) that only spouses use the DS-forms (choice of agent, etc). Will my case be transferred to the Consulate directly or are there other things to be done in between? Someone responded to me in another forum (six months ago) that from CSC the file is sent to NVC, NVC will issue Visa Number and send a packet to Consulate. I am just trying to anticipate what I should be preparing to do next.

I am a little confused. If she is your ex, why would you claim her as a dependent and on what form are you listing her as a dependent? And what has her citizenship got to do with anything? And no, the privacy act does not allow you to get information on your ex from USCIS.
