If that were enough to expedite a case, perhaps a majority of cases would qualify. Unless your beneficiary qualifies as a refugee, I don't see this as significant enough for consideration. If they, do then have them go the refugee route.


Thanks for your note Pushbrk. That's why I haven't requested for an expedite. It has not become a life and death issue yet, just severe hardship. I was just trying my luck since I had the aide on the phone. Can't hurt to try.

Hello dear VJers

I faxed a form request to my congressman last night. I got a call back from his aide and this is what she had to say.

First she told me I filed the wrong petition coz according to her I-129f was for Fiances not Spouses. I explained to her that if you were married the form allows one to substitue Fiance for Spouse.

And she said. "Oh! Is that what you think?" I told her I had NOA1s for both petitions. But she discouraged me from going the I-129f and said if she were in my shoes she would just go I-130. Anyway, I know the difference between both petitions and the ONLY reason I went the I-129f was the thought that I would save on processing time and have my husband waiting here in the US (albeit doing nothing) than waiting back home (also doing nothing).

Apparently she checked somewhere, possibly the USCIS website, and saw that the I-130s for November are the ones Vermont is currently working on and the I-129fs for February. She told me that it looks like my petition would be adjudicated in February-March '09 and said that she cannot make an inquiry until after March '09. That she will keep my form till then. I asked her "what about the I-129fs" and she said that the USCIS will probably not approve those because they are intent on the I-130s and most consulars prefer to approve Greencards as opposed to Visa's.

I asked her if I could qualify for "expedited" processing coz of a situation I have and she said unless someone's health is at risk or someone is dying, it would be denied. I told her it was unfair that the USCIS is not uniform across the board coz California is already approving July filers. She did not have much to say other than she wondered why my petion was not in Missouri ????. wacko.gif Don't know what that was about.

Anyway, I am only glad that politics is occupying most of my time right now (makes the days go faster). Otherwise, March Filers, (MsNoob are you there) it was not a 6 month processing deal, Looks more like a one year processing time. crying.gif

No. All you have to do is make sure that the child is mentioned in the I-129f (of the spouse) and all the other documents like the Affidavit of Support where it asks who else is traveling together with your spouse.

It would be a better idea to do a I-130 for the child alongside theI-129f for the spouse. Previously it made sense to do I-129f when they were getting approved months ahead of the I-130. In that scenario, you would make sure the child is documented on the I-129f and other documents requested. But now it seems that both are being approved at the same time, therefore it is almost useless to petition through I-129f.

From the other end, I spoke with the representative at my Congresswomans office. She tells me that the processing time for the I-129 is Feb 1st. I have to literally beg her to open a web browser and see that the processing date was updated. She then tells me that ... they just updated the date so give them some time! #######!!! Seven months isn't enough time?? She said that they told her that my case was assigned to someone and to call back within a week.

Some of this should make me feel better... but I simply feel deflated at this point. Sorry to vent...

You should find it on her visa. It's the number that begins with "A".


I don't think Visas have alien numbers. She should write "None". If she already had an A# that would mean she had already started the process before. The A# will be issued when USCIS receive the I-130 petition. Watch out for the I-94 number, Port of Entry, Day of Entry.

I hope I bring you good news. Even though its just a touch (since May), I am thrilled. I know I may have to wait for a long time but there is nothing more depressing than thinking that your file is just sitting somewhere in a dusty forgotten box. So, my petition is actually with an adjudicator (is what I hope this means). I wrote to my Congressman who told me they could not do anything till March 09. I wrote 3 weeks ago to my Senator and I did not get a response or an indication that they had even received my request. I left messages, they did not call back. I gave up on the Senator's office and just decided to chill.

I am praying for an approval (or something) by the end of the month.

Are you married already? Did you marry here in Phils? All you need to do is submit the I-130 form without the I-29F. I submitted both and it only delayed my papers.

If you submit the I-130 with the I-29F you will be charged for about $1,000 when you arrive in the US so they can convert it to CR1.

Don't know what other Vjs say.

I was wondering the same thing. I applied both petitions and intend to give priority to the K3/K4 because of my step sons who should be given K4 visas (The kids do not have I-130 petitions yet). Weve been married since March '05 and have shared assets back in the country. He should be able to provide everything they ask for the K3/K4 interview. What would be the reason for denying the K3/K4? Can they just decide to deny it just because they know there would be an I-130 coming along? I am just very paranoid right now. Msnoob has tried calming my fears and I am grateful to her.

If Consulates denied K3 and K4 visas because an I-130 was filed, there would never be any K3 or K4 visas. There's always an I-130 filed but that doesn't mean the Consulate will ever see it. This is a non-issue.

However, by not filing I-130s for each child, you've negated their opportunity for CR2 visas and AOS may be delayed if you file the children's AOS concurrently with your own. They'll need I-130's filed with their AOS.

These questions indicate to me the need to return to the guides and learn the process.

YES!!!!!!!!!!!! My fiancee and I met Dec 15 2009 and because he s american and im canadian we to have been seperated alot since we met and we are again.I had to come back to Canada in Dec 2011 and Im not allowed to go back untill April..I was told by our immigration lawyer I have to wait for 90 days because of that..and we are both having a very hard time as well because we love each other and we just wanna be together...Our lawyer had suggested that as soon as Im back we get married then he will file for a K-3 visa and thats exactly what were doing ..we set the date for the 2nd of June 2012...I just hope that my going through customs goes smoothly this is why our lawyer said I had to wait for 90 days just to make sure....God I cant wait to get back and marry him UGH!!!!!


Both of you are lucky in that it's a short distance to Canada, and he, as an American can cross over as many times as he wishes, and cheaply too. I don't know how many people here can say the same. Cost of Airfare alone is a deterrent for multiple visits to see their spouse. You guys can see each other every month if you so wished.

19924/23 = 866.26 applications daily average for the month of august 2011


I have checked out that link many times. It would be good if USCIS also posted the progress so that it doesn't look like they still have 189,249 pending from 12/2009, as it continues to say every single day for years. The only thing that changes on that graph is the new months that they update, but the old ones show little change. My purpose for separating the WACs for 08/29/2011 was mainly to keep a watch of when the once before me start getting processed, then I know mine is close. So every week I will check the WACs before mine and I will probably know the exact date they start processing the NOA-1s of 08/29/2011.

You know how it is....Trying to pass time while waiting for CSC to approve the petition I filed for my minor son. Some of you may think I have way too much time on my hands, but this might help you see what we are up against.

So I received my NOA-1 that indicates that my application was received on 08/29/2011. And since I have my WAC#, I went on the USCIS website where you put your case number and see what your status is. I started back-tracking from my WAC# going back to where all that received notifications on 08/29/2011 begun. It began with WAC1190649850 and ends at WAC1190650754. Mine is in between, obviously. When I filtered and removed all the denials/approvals/return for improper filing, RFEs etc., I discovered that they are exactly 400 applications for I-130 that received NOA-1 on 08/29/2011 that are still in the "Initial Review" Status and waiting for NOA-2.

Just 1 day, 08/29/2011, USCIS sent NOA-1 for I-130 to 400 individual applicants out of approximately 904 receipts. The remainder of appoximately 504 whose receipts fall in between were either approved, denied, returned for improper filling or received RFES.

Just 1 day out of the month of August. All I can say is WOW!.

My theory is that - They lumped all NOA-1 receipts (for the month of August) to be sent at the end of the month (which is surely what I hope the case is) because the alternative of that being their daily receipting activity is too depressing to consider.

To my vj family - Knowing how much they really have to process makes my waiting a little more considerate.

we think I-864 is unconstitutional, it discriminates between rich and poor.

i am a South African citizen, My lawful wife (married 2009 in USA)and our son (born 2010) are American citizens born in USA.
We currently live in USA Seattle , we have filed with uscis but they have not accepted the I-485 because my wife's income is less than 125% of poverty guide line on the required I-864.
We don't have any family or friends who qualify or who are willing to co sign (be a sponsor)the I-864

(we also feel that the requirements of I-864 are a violation of my wife's equality rights as a US citizen because it discriminates between rich and poor.
Also asking some one to sign SURETY is contradictory to our faith as Christians: Prov 6:1, *11:15, 17:18 ... )
Question, what can we do now and who do we talk to.

You said you currently both of you live in Seattle and that her income is too low. If you are here legally, and she applied an IR-1 for you, then you probably should have applied for a work permit at the same time which would have allowed you to work while waiting for the rest of the process. If indeed that was done, get a job so both your incomes can be used.

The only thing I agree with you is that the poverty threshold is a miningless tool. Different levels of income can support or not support a family. It all depends on how people plan to live within their means. Here in Texas, I have seen people support families with the mimimum wage. I have also seen people who make $150,000 a year struggle to support their families.

Otherewise there is nothing unconstitutional about a country wanting to make immigrants take care of their own and not become a public charge. It's their prerogative, even though the tool used is lopsided.

However, If someone earns what the same US government has set as a mimimum wage, therefore a living wage should be enough for immigration. What is discriminatory is that the US sets the minimum wage to be what they consider to be a living wage to its own citizens, yet the same standard is not applied to other would-be citizens. Why is the minimum wage good enough for some but not good enough for others?
