I have a friend, teaching in Kurdistan, (Northern Iraq) safe area, and is married over 1 year to a Filipino from CarCar. She obtained a work visa, and bought an airline ticket, and was deenied boarding the plane, because she did not have some kind of form, through an office there in the Philippines, it is something like, OPPA, OOPA.,.., some kind of paperwork, to go with the work visa.
I am trying to help him, as I to am married to a Filipina lady, and he is a dear friend. I know little of what I am asking, I hope my friends here can give me the information so I can pass it on to him, as me and my wife are in the USA.

Today was there 1 year annniversary, and had to spend it apart.,., he is devastated, please help him, I will pass along info. to him on what to do..,.,...,.thanks to all!

Pictures, pictures, pictures, dated, who is in them and where! Make at least two visits, keep boarding passes, not tickets, hotel receipts, food receipts, gifts bought, letters of intent to marry, hand written and signed, AND anything else you pay for visiting him...,and I would plan on 2 visits at least, and maybe one duringg the K-1 visa process, for the interview.

You cannot have too much proof, but 300 pages of chatting IS NOT proof! But, it is a good piece of the process.

We came K-1 through the Philippines, and both of our letters of intent, were hand written on "plain white paper",..,,.

I "do not" know this to be fact, but it seems to me that it was encouraged, by our visa company to write it "handwritten," sign and date, but it was standard 8 and 1/2 X 11 paper,,.,. it worked..,.,. no questions about it.

If he does not meet the income for (3) I would say you have a big problem. If he claimed the nephew for 2012, how can he not claim him for 2013? Is there tax fraud for his 2012 taxes? This may be looked at very closely.,.,you may need a co-sponsor on standby.,.,this tax thing.,.,claiming him one year and then not claiming him.,.,.is a giant "red flag" in my opinion!

Especially, if he does not meet the income requirements1

I feel your pain, as my wife is fron Cebu. I have two divorces, my visa service (in the Phils.) advised for me to go to the court house, and get new "certified" copies of both, with the "red" stamp," and the raised seal. Yes, they were copies, but certified by the probate judge in our county..,.,.,hope this is all it is.

If I was you, I would have what I described, ready to mail back the day I got the "rfe!"

Heed my words, in the county you got your divorce, you can get a "certified" copy with a red stamp on the front pagem and will pass any tests that might me met, along the way, might cost you $2.00.,.,.,I would get two extras, as if you are K-1, you will have to do the AOS.

 

And just for info. to avoid many problems, for Filipinos absolutely, do the "Report of Marriage" ROM, to the Filipino embassy in Wash. D. C,..,as I had to do this, ($25.00) just to get my wife's passport renewed.

We had to go through the Vermont Service Center.,.,and the "V" does not stand for "Very fast" as it was 10 months and 4 days until P.O.E. Alanta, 4-24-2013 and I hope the great people of Vermont does not suffer for the US govt.'s embarassing processing of visa's, as since then, the Texas Service Center has been turned into the next "Vermont".,., it appears, pray your paperwork goes to CSC.

YOU...,.,simply put cannot do what you are asking to do!  You must establish residence in the USA, and be there.

 

If you marry in Turkey, you will have to file I-130 instead of K-1.,.,.,K-1's are running, a few months for approval, I-!30 is quite another story, 12-16 months!

 

I would think you would pay the 340.00 by an approved US source, check money order.,.,etc...,..,and NO you cannot do it online, at least to my knowledge.

 

What you are attempting, 'YOUR" way.,., is pretty much impossible.

I strongly recommend a visa agency to do the K-1 from the Philippines, I had an agency that prepared our K-1 and it was a perfect document!

 

IF, you need some agency from Cebu, or Bohol, or even Manila, I can recommend a very good one, just e mail me.

I knew who my now, wife, was 5 months before we decided it was much more, and we were a "couple" 2 weeks before we filed the K-1 visa, file 6-22-12 and P.O.E. Alanta 4-25-13, and married 6-22-13, and I hope it is forever, she is a wonderful wife!

 

Celebration today as she went from "beginers drivers license".,.,. to obtaining her real deal, regular drivers license license today!  She did a great job on her drivers test before an officer, but she had a great teacher, HER husband, yes, with the right temperament, husbands can teach their wives to drive!

Page 3, all questions are looking for violent offenders, read IT closely, and domestic abuse is one of the things listed. Also, 3 convictions of druken driving, and drug related charges, BUT no-where does it refer to a "white collar" crime even if a feloney, if you do not believe it, read it, closely, again, it is not there!

I had a friend that went through this, and was convicted over 20 years ago of a "white collar" feloney, and he did not mention it but seent two letters fromhis present attorney and the attorney of record 20 years ago, and both advised him to not answer anything concerning this, as "it is not listed" in the application, taking a bribe as a govt. employee, over 20 years ago, IT was not ever mentioned through the K-1 nor the AOS.

But a domestic charge, as it asks, about that in certain words, I would be very careful, IF all is exactly as he says, then I think I would avoid it, but back your void of the questions with documentations.

2-3 months, vs. no job, no income, leaving your parents at a time they "might" need you.,.I could go on and on.,.,.there is so much pressure on TSC, from congressmen, and the average person, something will happen there very soon, I look for many expidited cases, to start happening,.,.,.,.,"hang in there".,.,.you will regret, leaving your K-1 behind!  Think long, and hard, you can do this!

From what YOU say, it is my opinion that you and your fiance' really did not prepare yourselves for this "journey".,.,when filing the K-1 I would hope that you looked at timelines, and how approvals were with TSC, and you are through the roughest part, the first 5 months, (my wife and I was 10 months and 4 days, Noa1 till POE Atlanta) and if you do as you are talking about doing, well, yes, you will be together soooner, but the visa situation will be much, much longer than waiting a few more months on the K-1.

 

I KNOW it is hard, been there, done that, but hang in there, you say how you need to be in the USA, and it was your orginal plan, try to grind it out, as YOU are through the rough part, in a month or two, things will really start moving, and when it does, you will be very busy, getting through NVC, medical, interview.,.,.,..,You can do this K-1, hang in there!

Good, Luck, you are going to need it, regretfully, but this would be  a truely miracle, by not having the "together time".,.,.positive proof., I am a short timer here, but I have not seen an approval, without, evidence of the "required meeting".,.,..,and the other requirement, "you are free to marry".,.,.,that is the two requirements for a K-1.
