I personally feel that your marital problems "from day one" and "on and off" separations are definite indications that your marriage will not last. When you entered my country under a fiancée or spousal visa, you made a sworn statement that you were entering into the United States (and your relationship) in good faith, yada, yada.

I have to respectfully say that an honorable individual in your position would return to his home country and not attempt to deceive the DHS for the sole purpose of staying in the U.S. There are already way too many immigrants coming in to the United States that do not live up to the conditions of their agreement/visa and every one that files anything (AOS, lifting of conditions, goes to interviews, or whatever) slows the progress of the honest people that are truly in love with their fiancée, husband, or wife and are in OUR country for all the right reasons... those people deserve to be here.

my thoughts to you is this.. file for divorce (or annulment) and go back to your home country, if someday you are as blessed as I have been to find a kind, understanding, loving, and beautiful wife and she happens to live in the U.S. then enter for all the right reasons.

Hi, I am at least a few days off your receipt date. It was received May 28, 2009 and OMG! blink.gif i just logged on my portfolio and it says the last update they have is August 27, 2009. LOL! i got excited over that, although im not really sure what that means. lol. My fiance received the NOA1 last week of June. I have hopes that we will get the NOA2 by September.

when do you leave to meet her and when is the interview? i suggest you send it to her overnight so she can double check and see if you missed ANYTHING ( i personally am nothing but thorough) as two heads are better than one. so if and when she HOPEFULLY receives it before you come in the phils to meet her, and you missed anything at all, then you can bring those additional stuff when you come visit. wink.gif gluck smile.gif

AND OH-- put those western union receipts in your back pocket and not with all the files she will present. i heard that here in the phils, most consuls kinda raises eyebrows when they find out that money is kinda involved. so unless asked for, thats when you present it smile.gif i am going to do the same and has searched VJ for info about this laughing.gif gluck gluck !!

And hey.. I have a question... I just registered at the USCIS Status Search (where you log in and check for status of the application) a few days ago, which i found out about here at VJ (many thanks, this site rocks rose.gif

It said:

When I checked it the other night, it said the LAST UPDATE is dated June 6, 2009. But when I logged in today, the LAST UPDATED date changed to AUGUST 27, 2009.

My fiance called the Immigration call center on August 27, 2009. Does the "Last Updated" date impact anything at all with the waiting time we have for the NOA2? I mean, does it mean that they are already on our case and it is actually processing?

i just called the USEM here in manila ( Manila Embassy (Immigrant Visa Unit) | 011-632-301-2000 ext 5184 or dial 0)

the representative told me that they dont send the packet three anymore. they only send a letter, one page, informing they already received the approval notice.

they got my approval information electronically last sept 8, 2009 and i was told to call at least a week from today to schedule my interview. i will call then and will update you guys smile.gif

If the last updated date changes but the status of the case does not it's called a "touch". What it means is that, for whatever reason, someone at the USCIS service center handled your case folder. Many people also report that their cases have been updated with no corresponding change in the online status. One frequent poster on this site likes to remind us that his case still shows "pending" on the USCIS website, even though his visa was approved, his fiance has come to the US and they have married, and her son has followed to join, and all of this happened many months ago. This means you shouldn't hold your breath waiting for things to happen with the online status. You could receive a notice in the mail without seeing any changes in the online status. Since you did see a touch, I think there's a pretty good chance you'll see a status change soon.

I just got an email stating the RFE , but I will not know what they are looking for until they send me the hard copy which lists the details. I am quite shocked that I got one because I think I nailed every thing they were looking for. So, from what I am seeing an RFE is not that bad you usually get approved within 2 weeks or so. If you have not recieved the email yet, I am sure you will be getting the hardcopy of your approval shortly. Just hang in there I am quite certain it was your approval. My status changed on Aug 27th as well, and than I got my RFE udate.



thanks. i wonder if we will get an RFE . i suppose if they do, we have some more to supply them.. the first time he visited me was November 2008 and he came back just a couple of weeks ago cause we freaking miss each other so much LOL! (and now i mis him again, he went back to US Aug23 after 10days of stay here) cant wait to talk to my fiance again to tell him about this. he is getting upset over the fact that no one on the call center thing can give us any answer on what's up with the paperworks! had i not been researching online, we will still be in the dark on whats going on.

I forgot to mention in my original post I firmly believe the NOA2 approval was a DIRECT RESULT of my Congressman's inquiry with the USCIS. Although I can't prove I would not have received the approval within the same time frame even without the inquiry it seems more than coincidental that within 1 day of the inquiry our approval was granted. To all you nay-sayers out there - at least in my case the Congressman's assistance paid off. May the rest of this process go smoothly and quickly for each of you.

you know, i see a lot of good advice here. so i dont know why you just decided on flying over and getting married in a month or so.

and like what i said before, which i see a lot of people saying the same -- DONT. JUMP. THE. GUN. make at least a couple or so trips to him. gather a lot of evidences: pictures, receipts, emails, snail mails, bday cards and such. if you jump the gun the consuls will just show that you are being stubborn about this (which i can understand why) and is just REALLY after the visa.

BUT if you take it slowly but surely, it will show the sincerity of your relationship. patience is a virtue and all of us here on VJ know this: this kind of relationship (that we all have) needs A LOT of patience. being calm and patient about this will show your sincerity and willingness to wait to be together for good --- that also shows your security and confidence on how both of you feel for each other. if you REALLY love each other so much, then it's worth waiting for, right? just as the old song goes.. "you cant hurry love" happy.gif

the disapproval of the family is something every couple-- whether long distance like ours or same nationality--- has to overcome. there are people who are just lucky to be instantly accepted by the family. but that is another BIG factor that can be seen as a redflag in your case. if you take it nice and slow, spend more time together as much as you can and gather LOTS of pictures together -- two of you and with his family. no, it cannot be just a few! again, if you really love him, then you will do something to make his family accept you. and if he really loves you, then he will fight for you. right?

the course of action you are planning to take (despite tons of wise advice given to you) isn't THAT smart. i agree with what was said "this is not a case for the weak." be strong ally. and be smart. i pray that you will make the right decision. good luck luv.gif

Returned petitions are a common occurrence in Middle East/North Africa countries and many there will be able to give you more specific guidance.


i think i missed one information i should have asked: when does your petition expire? but if the expiration for the petition is soon, then you will have to get a waiver for extension of the petition which will add up to the processing time.

i am not sure if the waiver had to be applied if you are going to ask for reconsideration. i'll get back to you on that.


after you get married, you can file for a spousal visa which is K3 instead of K1, which has the same 5month processing time.. here is the general guide for K3:

i would say though: RELAX. BREATHE. dont jump the gun by flying over to him and get married at once. it is case to case basis so do more research on what's the next best step to do.
