AP is essentially checking that you are not a terrorist nor have links to terrorism. It was instituted after 9/11, and you can thank the PATRIOT Act for introducing it.

Thanks for your prayers!!!  I see here that some couples go for weeks and even months in AP with no recourse, no way to get information or status from the embassy...it's like waiting for the NOA2 again :-)

When were you interviewed? I was interviewed yesterday and was approved and now my status says Administrative Processing too. I guess most cases undergo this process ;-) Be positive!

 

It's been in AP for 2 weeks now.  i had to fly back home yesterday and get back to work...couldn't wait any longer.  was hoping to be able to fly back together and be with her through the POE process.

How much more vetting could they possibly need to do?  The USCIS and State Dept. now know more about me and Michelle than our own mothers.  First, the long wait for NOA2 (including an RFE), then the 8-month DOT saga, then we both show up for the interview ("you're approved"), but NOW they have us in the AP holding pattern.  For what?  What more could they possibly need to know about us?  It has been 14 months since we sent in our I-129.  Do I sound frustrated?

I hope this helps a little. There is an AP and there is an AP. They are two different cases depends on it's content. You are put on AP after the interview if your case needs further review , you may have one missing doc or they really need further review ( CEAC shows AP your case requires furhter review. ) and there is AP which showez your case is undergoing necessary AP ( If I am not mistaken this AP showed when they will issue you a visa soon )
 

 

Our AP says:

 

Your case is under administrative processing. Please see the letter you received at your interview for more information. If you are required to submit additional documents, please submit them to the U.S. Embassy via any branch of 2GO courier service (Attn: Immigrant Visa Unit) together with a copy of the letter.

If further information/review is needed, you will be notified once we have completed our review of your case.

Consular officers need to be reasonably satisfied that all issues have been addressed before a final determination is made regarding visa issuance.

The time required to process a visa application to conclusion varies by case and depends on its complexity, along with the number and intricacy of other cases awaiting review.

Do not finalize travel plans, purchase plane tickets, dispose of property, or cease employment until a visa is delivered to you. We are unable to commit to issuing a visa on a certain date.

Can we cut out the euphemisms here? I've never been to Asia and thus an unfamiliar with "bar girls" but what I assume you are saying is that you paid a prostitute to have sex with her and then decided that you wanted to bring her to the United States. What you should know, if that is the case, is that once she has to file for adjustment of status, she will have to answer the following questions:

Also keep in mind that she will have to, on multiple occasions, declare ALL of her recent employment. Maybe you could try to put "bar girl" down, but it seems to me that the honest answer is "prostitute."

Keep in mind that all of these forms are sworn statements signed under penalty of perjury.

I see too much judgement being cast on the OP's fiance, and none of us knows her. Girls enter prostitution for many reasons. But the primary reason is MONEY, and almost always, the girl is not the main beneficiary of that revenue. Bar girls in SE Asia are no exception. BUT to assume that everyone who enters the sex trade is bad person with no moral fortitude is not fair and completely naive. Greed does not drive these girls, desperation does. I was so saddened by the abject poverty in which many people live in the Philippines. When a girl sees her family starving, with no hope that things will change, and living in conditions that we wouldn't even wish for our family pet, imagine the power of conscience that would drive her to sacrifice her dignity and leave home for that lifestyle. I certainly will not judge a girl who makes that sacrifice, despite everything she was taught to be "right" in a religious upbringing.

I feel badly for the OP and his fiance. The message they are getting here leaves them in a "damned if you do, damned if you don't" scenario. If they tell the truth, she will be denied. If they lie, the truth will come out and she will be denied and banned. Not much hope for their future, is there?

Seems to be a wise choice and the one I'm leaning towards... Does anyone have a recommendation for a certified translator online? If my fiance does it, It will take three days to do then 10 days to get to me... apparently scanning would not be an option...

Search for the American Translators Association online. Lots of ATA Certified translators there. Simplified Chinese shouldn't run you more than 5 or 6 cents per word.

You stopped at the status prompt. When it ask to enter receipt number and tells you the most recent status. It will than ask you more you press 3 for problems with your case.
When the operator comes online (this may be a long hold) ask for a tier 2 operator to find out if anything. The orginal oiperator is just that someone answering the phone and will just parrot words. So ask for tier 2.
Because VSC is so slow you probably will not get anything. they are at 6 to 8 months and what times you get on VJ doesn't mean nothing to them.

We know that the VJ timeline is only based on other VJ members'. But we are so excited to get this approval behind us, that we are a little impatient :whistle: Especially in light of the fact the Igor's list shows that about 75% of CSC June filers (including some that filed after us) have a decision...and CSC is now approving July filers.

I know all the VSC filers are rolling their eyes at this topic. You couples stuck at Vermont are real troopers and we wish you the best!!!!!

Hi VJ'ers. We are now past the date range that VJ estimates for our I129F processing time. At the bottom of our Timeline page on VJ, it says "If this date range has passed or your application is past due per USCIS processing times then you should consider calling the USCIS to inquire on your petition." But we are not sure about which number to call. I tried calling the number on the NOA1 letter, but all I get there is a recorded status that is exactly the same message as our USCIS account status on the web.

Can anyone here recommend a different number to call?
Has anyone actually gotten through to a live person before?
Ideas on how to navigate through the voice prompts to get to a live rep?
Will the USCIS rep will even be able to give out any information beyond the standard "our processing time target is 5 months" anyway?

We are getting prepared for our interview in about 3 weeks. For proof of an ongoing relationship, we have thousands of lines of Skype messages (over 100,000 messages back and forth)...and that is AFTER we have scrubbed the "private" stuff out. Obviously, this is too much to print out. What have you all done to condense your chat logs into a user-friendly version of your proof of relationship? Would love to hear your ideas.

Prove, prove, proof, what you write in your letters means nothing, I can write a letter with your name on it. Somehow you did not prove to them you meet in person. Did you write on your I-129 Line 18 how you meet. They pay the most attention to the form you fill in, and not some letter you wrote.


Turns out you were wrong about that. The proof was in our original petition. Our response to the RFE contained nothing more than a 1.5 page "letter" of the milestones of our relationship with a one or two sentence description of each milestone. One week later, the NOA2 came. The letter was precisely what they were looking for.

But yeah, bummer, the only thing I can think in your case, is that almost all of your evidence is somewhat circumstantial, in that only your pictures would have anything with your fiance on there, if that makes sense. Meaning, a boarding pass, passport stamps, receipts for travel all prove that you were in the country, but only the picture prove that you met. And if your pictures looked suspect for some reason maybe? Like printed on just regular paper, I know it's a trivial point, but presentation does count for this silly game with play with them.

We were lucky that by the time we submitted, we had taken two trips together to Hong Kong and Sinagpore, so had plane tickets, boarding passes, ferry tickets, with both of our names, and seats sitting next to each other, etc.


It would have been great if we had traveled together within the Philippines. Then we would have had more hard evidence. But we decided to spend money fixing her place up, rather than a week in Boracay. I included pictures of me with her family, eating out, chilling in front of her house drinking Red Horse with her mom and dad... We really had a great time just hanging out with the whole clan and bonding with everyone. Well, let's see if my response was sufficient :-)

Just an update...

We got the RFE in the mail on Saturday. And thanks to all your advice, I was able to submit the response today (Monday). I included:

* A timeline with key dates in our relationship
* A color screen shot of each of our profile pages in Filipino Cupid
* A little write-up about each of our important dates. (All in all it was about 1.5 pages)
* Many more photographs than I had in the original petition (41 pics now, only 19 in the original) grouped by day and a short description

I also resent the following stuff from the original petition just in case they were "misplaced" by USCIS
* Resent copy of the flight itinerary/receipt
* Resent copy of the boarding passes
* Resent copy of passport with entry and exit stamps
* Resent copy of receipts from our activities while I was there

SO......Let's see if that passes muster. Hope so! Wish us luck :-)

Thanks VJ friends for all your great advice. I know now what we need to do for this RFE. Our story is a wonderful story to tell. So I have no problem explaining how we found each other and how we came to meet in Manila. I didn't tell that story in the Petition because I thought that stuff was for the embassy interview for proof of an ongoing, loving relationship.

Anyway, I will write it up and send it along to the CSC tomorrow. And we will keep you posted on the outcome.

Maybe I am oversimplifying, but what exactly did you write in box 18? You said "here is the letter that I included...." The contents of the letter should have been placed in box 18. I know it sounds really basic, but they don't have time to go searching for things. If it is not specified in box 18 they will treat your petition as if there is no proof attached.
Just a thought.

For Box 18, I used the verbiage that is recommended on VJ in the example forms. Here is what I wrote verbatim:

See Suppliment "I-129F Suppliment: Part B, Question 18: Has your fiance(e) met and seen you within the two-year period immediately preceding the filing of this petition."

Then I attached a page which contained the verbiage from my original post immediately after the I-129F form.

OP, if you're going to write a 2 page letter explaining how you met(the circumstances), I'd probably suggest making a timeline as well. It'll serve as an overview with the important highlights.
Were you introduced through a friend, family member, met online searching, or randomly met online. Did you arrange to meet in person and know each other before you arrived in her home country, or randomly visited her home country and then met in person.

They want to know how you met to establish a relationship, not for proof of meeting within the past two years. Alot of people miss this, as it is a two part question.


Yeah I think you are right about that. What I read on the Petition form is that if we DIDN'T meet within the last 2 years, then I would need to describe how the relationship was established. However since we met face to face this year, I didn't think that extra description was necessary.

This advice should definitely be part of the I129F checklist on the VJ wiki page.

I am thinking about writing a 2-pager on our whole story. I think it falls more into the category of "proof of ongoing relationship", which we don't need to present until the embassy interview, but better to send that to be sure that they understand the "circumstances" of how we established our relationship. Also, we have hundreds of photos. Maybe I will send a couple dozen of those that I didn't include before.

All of this along with what I submitted with the initial I129F is probably overkill. But I honestly don't understand how we got RFE'd for this in the first place

Sounds a LOT like our RFE the we got just last month. I responded and we got our NOA-2 less than one week after the response. Here is the thread that we posted on VJ:

The long and short is, along with about 40 pics of us together (I only had 19 pics in our original I-129F petition), I also included about 1.5 pages of our history together which was a simple list of our relationship milestones with a 2-sentence blurb for each milestone. ^^^ I agree with emailing a request to the Embassy. However, you should have requested that your approved I-129F, Petition for Alien Fiancé(e) be revalidated (extended), not "a visa approval notice."

Normally, St. Lukes will notify the Embassy that a person is undergoing TB treatment and the Embassy will routinely revalidate the petition. However, a phone call to the Embassy is a good idea too. If it were me, I would email the Embassy. Either way, the Embassy will revalidate the petition for another four months. The Embassy will continue to revalidate a petition for up to one year.


Thanks Tahoma for sharing your thoughts. I will email them, Michelle will call them, then when I am there later this month, I will stop by the embassy and confirm.

Hi pigmonk. St. Lukes called her on December 7th, about 4 weeks after her sputum test. I was visiting in Manila when Michelle got the news. She is already one month into the treatment :-)

Hi everyone,

Well we got the dreaded news that Michelle's culture came back positive. Even though she does not have active TB, they discovered bacteria in her culture (probably contracted/inhaled it during OJT from nursing school). In any case, she has already started the 6-month meds treatment...every day at St. Lukes, Manila. So sad that we need to wait another 6 months to start our lives together but happy that she will be completely bacteria free!

My question for the VJ family is:

What do we need to do to extend the NOA 2 approval which expires next month, well before she completes the treatment? Does St. Lukes communicate to the Embassy, or is it up to us to apply for an extension.

You have to prove ongoing relationship at the consulate stage, not the initial petition. The initial petition requires a letter of intent and proof of meeting within the last 2 years. That's it.

You can front-load the petition with other information about ongoing relationship, but USCIS will not look at it, they'll just send it over to the consulate.


This is not necessarily true. My petition included all kinds of evidence that we met in person, but we still got RFE'd because I didn't explain how we established our relationship. It is a tricky nuance, but check out the topic I posted a few months ago.

In the end, my response to the RFE contained nothing more than a 1.5 page summary of the milestones of our relationship with a one or two sentence description of each milestone (before AND after we met in person). One week later, the NOA2 came.

That's because Michelle tested positive for TB bacteria in her lungs, so we are on the 6-month meds plan before she is cleared to travel.
