I'm Filipino, but I'm filing from Japan cause this is where we currently live. Since I just filled on DS260 last September, I will give you the best answers I know... Which is based on my experience here on VJ and with talking to people... hope this helps...

We are filing out the DS260 and have a few questions we need answered. I sent this email to IV manila and NVC also to get some clarification. Does anybody on this web site really know the answer? I have searched this site for several hours and there is a lot of educated guesses but does anybody have the correct answers? 
 
 
We want to get the DS260 filled out to get our interview appointment and to get our medical scheduled but don't want to fill out the online DS260  wrong.
 
1. Does it make a difference on log in if you log in as the principal applicant or petitioner? --- I don't know if it makes a difference. But, just to be careful... DS260 is supposed to be filled in by the principal applicant. Since it's the IV application of the few months back, only now it's all online. 2. On the personal information page we are we don't know what name to use maiden or married?? On her passport it list the maiden name but we are in process of changing that to the married name. We have an appointment with NSO and DFA and the passport will be changed to the married name before our interview. What name should we use in filling out the DS260? --- use her current name in her passport. They won't follow another name that isn't on her passport. Believe me I've tried. And from what I've read on here, if she gets her passport in her married name before the visa interview, she can have the visa written with that on it... Since her visa name (if approved) will be based on her passport.
 
3.The beneficiary passport will expire in one month we will have a new passport in the married name before our visa interview will it be acceptable to fill out the DS 260 with a passport that will expire soon? --- read above.
 
4. On the medical vaccinations record issue. We don't have all the records of hers vaccinations nor do we know what she will need until after medical (because she is Pregnant this might be different) Before we have our visa interview we will have the medical examination and vaccinations completed. What do we put for the answer to this question about vaccination records? --- what was the exact question? I forget. Just be truthful. If she doesn't have the vaccines yet, then she doesn't have the vaccines. The medical exam will make sure she gets the vaccines she can get prior to the interview anyway.

If you do the DCF way for filing the CR-1/IR-1, it will be over really fast. Not sure about time but it definitely won't be a year. Look up Direct Consular Filing on Guides (topmost bar)

I asked the same question a year ago. My husband and I live overseas together, but I thought about coming with him to the US on one of his work-related trips. After reading stuff on here, I decided not to do it.

Why? I felt like it will be just a waste of our money on the visa fee. Even if we both live overseas, the consular officer can still think you are trying to jump the line, trying to move to the US so you can adjust status there instead of waiting it out for the immigrant visa.

Better solution would be for your husband to come visit you. Every 3 or 4 months will be good :)

Depending on how long your going to stay, NSO Marriage Certificate will take time to acquire. That may be one thing she’ll need mail.


Regular registering process of NSO marriage certificates take 6 MONTHS.

It would be better if after the marriage ceremony you personally take the marriage certificate to your Local Civil Registry. That's what I did.

Don't forget to request for an ADVANCE ENDORSEMENT of your marriage certificate so you won't have to wait 6 months to get it.

I got mine 1 and a half months after we got married then I just sent it to my hubby via USPS. (Heard some people got theirs way earlier, depending on the persons handling the document.)

CRBA is an entirely different process than your wife's CR1 petition.

Your baby will not be issued a visa unless claim for US citizenship is resolved.

Your wife can still do her interview in December, if she wants to. But you also have to consider the validity of her medical exam (which is only 6 months). If CRBA is not done by the time your wife's medical expires, then your wife has to do the medical exam all over again (and pay another fee).

Yes, you can begin the process even if she doesn't have a passport yet.


Regarding the NSO MC, your wife should have applied for ADVANCE ENDORSEMENT to expedite the processing. I got our NSO MC 2 months after we got married (refer to my signature).

I used NSO MC to change my Driver's License and Passport to my married name.

I'm under F2A category (spouse of LPR), to show bonafide and on-going marriage, we will show the following evidences:

- Money remittance slips (my hubby sends me money once a month)
- Our photos thru the years and wedding photos
- Skype logs, Skype screenshots, Emails, Whatsapp messages

Having a joint bank account or owning properties jointly is not mandatory because it's obvious that we are living separately.

My I-130 package is due to be reviewed for NOA2/RFE within the next week or two, and I believe I may have made a mistake.

I filled out 2 form G325A's, one with my information, and one with my wife's. I signed both of them with my name. Is this going to be a problem, or should I have my wife (in the Philippines) mail me a G325A with her signature on it?

The directions weren't very clear on the forms...


The wife should sign her own g-325a. That's what I did. Your wife should mail it to you via 2GO (UPS), FedEx or LBC.

Since you already used your married surname on your i-130, it is best that you change all your ID and passport into your married name as well.

Prior to getting married, I also have a valid passport and ID cards on my maiden name. Since I want to use my hubby's surname, I changed name in ALL my ID cards including my passport.

On the line that has, Applicant's last address outside the United States of more than 1 year. My wife is still in Indonesia at the same address she has lived since 1972. It will be the same information as the line above this except the line above has present at the end. I do not know what to put in the date space. Should I put todays date or put the word present? On my form, I put March 1979 (I only live in one address my whole life) and the other date space I left it blank. Since on the previous question I put the same address with dates March 1979 - PRESENT.

The date space doesn't accept letters when you type it in because the PDF file only accepts numbers. I suppose if you want to put PRESENT, you would have to handwrite it.

Ohhh I hope I didn't mess up mine. :bonk:

Hi,

My husband's interview is scheduled for December 31st of this year. Our first child is due on the 23rd of December. With the high number of first born babies who arrive a week after their due date, I'm very nervous that I will be having the baby on the day of his interview.

I've contacted the consulate, told them the situation and requested to reschedule. They've responded saying that they cannot reschedule the interview.

So the question: If I do end up having the baby on the day of his interview and we cancel at that time, what happens? Has anyone had to miss their interview? Does this jeopardize the entire application or does your interview just potentially get rescheduled for a much later date?

Your husband can go on with his interview as scheduled. You don't have to be there with him if you can't.

Hello, I am currently in the Philippines and will be getting married in 2 weeks. I will be using the spouse visa to bring my wife over to the US. We both want to start a family right away and are trying right now. I have a couple of questions.

What would the citizenship status of my child be if he/she were born in the phils? American? Filipino or dual? The child can claim US citizenship from you. You have to file CRBA for the child in order for the child to be recognized as a US citizen and be issued a US passport. If my wife were to become pregnant right away can I still file the spouse visa or would I have to wait until after she gives birth? You can file CR1 petition right away as long as you already have a certified copy of your Marriage Certificate.

Would she be allowed to emigrate to the US if she were pregnant? It depends. YES, if her pregnancy is not considered "high risk" or NO, if her doctor or the airline company will not allow her to travel.

A us citizen petitioned for spouse, spouse birth certificate only has mother's middle name and last name NOT the father's name. Father was never in spouse's life, spouse has no knowledge of father's whereabouts. Will NVC accept the birth certificate without the father's name? Will that be an issue, or does it not matter since it's not the parents petitioning for the spouse?

I didn't know she needs an NSO marriage certificate. Do we need that even if we have a "Certificate of Marriage" from the "Office of the Civil Registrar General" provided by the court where we did our civil marriage?


Our more experienced VJ members confirmed that you can submit the Local Civil Registrar (LCR) copy of your marriage certificate during the USCIS stage.

However, during the NVC stage, you will be required to submit your original NSO marriage certificate.

Normally, it takes 6 MONTHS before you can get an NSO marriage certificate. I applied for ADVANCE ENDORSEMENT of our marriage certificate at our Local Civil Registrar (LCR) that's why I was able to get it 2 months after our wedding date.

If your NSO MC is already available, either you did advance endorsement or 6 months have already passed since your wedding, then you can get a copy within 3 days when you order it online or via telephone.

My husband had an 8-month old personal copy of his NBI clearance during his F2B interview and didn't have any problems with it.

However, if you don't feel confident having an old NBI clearance, you can always get a new one. :thumbs:

They did. It was the consul who wants another copy with the original signature of the petitioner. My cousin only has a photocopy so she got a 221g.

It's best to make copies of everything you send to USCIS/NVC.

Make a copy of i-864, sign it and keep it as your personal file. You can send it to your spouse for her to bring at the interview.

My cousin who was interviewed this morning was given 221g because her i-864 was only a photocopy. The consul wanted an i-864 with the original signature of her petitioner.

Hello, my question is do I still have to file a separate I-130 for my spouses son when I file for my spouse?
The reason for this question is my wife will come to the U.S. first, then after we get settled and find work for her,
then we will get her son here. I don't make enough money according to the poverty guidelines to support both her and her son if they both come at the same time.
Any help with my question would be greatly appreciated!!
