Did the beneficiary worked/lived in a foreign country (outside the Philippines) for 12 months or more?  If yes, police clearance is needed from that foreign country PLUS the NBI clearance.

 

If she only lived/worked in the Philippines her whole life, she only needs to submit an NBI Clearance to NVC.  A fresh one preferably.  Green for travel abroad.

How do you know you were approved yet without your NOA2 because that is your approval notice.

We were approved by the USCIS Nov.4th and the NVC received our file on Nov.8th and it was entered

in to there system on Nov.26. Im not sure how long the NVC part takes we are just starting it ourselves.

 

When your USCIS case status says Post Decision Activity - "On xxx, we mailed you a notice that we have approved this i130?", that means an approval.

 

Jane - It could take 8 weeks (that's the standard timeframe NVC operators will tell you) before NVC can issue a case number.  Most of the times, its less than 8 weeks.

Your eldest does not qualify for CR2. You will have to file for him yourself. He will be under the F2A category (unmarried child of LPR). Waiting time could be more or less a year depending on the movement of the visa bulletin.

Are the kids also your husband's biological children? Or are they his step-kids?

If stepkids and you married before their 18th birthdays, your husband can file i130 for them. They will be CR2.

In the meantime, you can delay your case for up to a year in the NVC stage while you're waiting for your kids' i130 approvals.

No.  A separate i-130 must be filed for her.  If your husband married you before your daughter's 18th birthday, he can file i-130 for her as a step-dad.  Otherwise, you will have to file for her once you gain your LPR status.

Seriously haven't they gotten enough money out of us already that is totally crazy.  Thanks I was totally unaware of that expense.  He will need that paid before he  can come over or before they will send the greencard?

 

The USCIS instructions say you have to pay it before he flies to the US.

 

But some pay for it after POE.  No issues that I've heard of.

 

It must be paid first, otherwise they won't print the card.

I am not sure what that is we filed IR1/CR-1 so all fees were paid upfront I never heard of an immigrant fee.

 

Its a new fee implemented Feb 1, 2013.  Its for the production of the actual green card.  If you don't pay it, no GC will arrive.  It applies to all immigrant visa holders.

For the SS card, no need to go to the SS office.  It may arrive at your address in 2 weeks or so after POE.  Delivery times vary depending on your state/area.  My husband got his a month after POE (Los Angeles area).

It depends on the circumstances of when the child is due and if the visa is already issued.

 

If you don't meet the residency requirements of CRBA, no US passport for the baby, hence you will have to file a separate i-130 for the child.

The NBI Clearance has a top and bottom portion. The bottom portion is the "personal copy". I'm submitting the top portion to NVC in support of the DS/260. My question is, will my wife only need the bottom portion (the personal copy) for the interview at the embassy in Manila? Or does she need to get another NBI clearance so that she will have the top portion for the interview?

 

Yes, she will bring the "personal copy" to the interview but rarely that the consul asks for it as long as the NBI clearance she submitted to NVC is less than a year old at the time of the interview.

 

NBI clearance is only valid for one year.

G-325A of the beneficiary which me. Do i need to sign the G-325A. I have been reading topics about this here but no definite answer found. So if you have experiences or any answer verified to the USCIS pls do help us.


I made this mistake in our petition. We live together. I interpreted info on the USCIS guide that he (my USC husband) should sign both G-325A forms. And that's what we did. I was so afraid to get an RFE.

We didn't get an RFE and our petition was approved 47 days from NOA1. There can only be two reasons... Either the mistake is not that significant or that we provided more than enough evidence of our relationship and of my identity. You can take the risk, but if it is possible for you to fill in a form, sign it and express or overnight mail it to your spouse, I suggest you do so. :)

I'm Filipino, but I'm filing from Japan cause this is where we currently live. Since I just filled on DS260 last September, I will give you the best answers I know... Which is based on my experience here on VJ and with talking to people... hope this helps...

We are filing out the DS260 and have a few questions we need answered. I sent this email to IV manila and NVC also to get some clarification. Does anybody on this web site really know the answer? I have searched this site for several hours and there is a lot of educated guesses but does anybody have the correct answers? 
 
 
We want to get the DS260 filled out to get our interview appointment and to get our medical scheduled but don't want to fill out the online DS260  wrong.
 
1. Does it make a difference on log in if you log in as the principal applicant or petitioner? --- I don't know if it makes a difference. But, just to be careful... DS260 is supposed to be filled in by the principal applicant. Since it's the IV application of the few months back, only now it's all online. 2. On the personal information page we are we don't know what name to use maiden or married?? On her passport it list the maiden name but we are in process of changing that to the married name. We have an appointment with NSO and DFA and the passport will be changed to the married name before our interview. What name should we use in filling out the DS260? --- use her current name in her passport. They won't follow another name that isn't on her passport. Believe me I've tried. And from what I've read on here, if she gets her passport in her married name before the visa interview, she can have the visa written with that on it... Since her visa name (if approved) will be based on her passport.
 
3.The beneficiary passport will expire in one month we will have a new passport in the married name before our visa interview will it be acceptable to fill out the DS 260 with a passport that will expire soon? --- read above.
 
4. On the medical vaccinations record issue. We don't have all the records of hers vaccinations nor do we know what she will need until after medical (because she is Pregnant this might be different) Before we have our visa interview we will have the medical examination and vaccinations completed. What do we put for the answer to this question about vaccination records? --- what was the exact question? I forget. Just be truthful. If she doesn't have the vaccines yet, then she doesn't have the vaccines. The medical exam will make sure she gets the vaccines she can get prior to the interview anyway.
