IR-1 / CR-1 Spouse Visa Process & Procedures	I-130	I was speaking to someone that went through the I-130 process about 10 years ago. I know a lot has changed since then. I tried to explain this to the person but they insisted that I was not right, so I need to be clear at least in my mind. My fiance and I have been going back and forth with the K-1 versus I-130. So I think we pretty much understand them both. But after this person said something different from what I have ssen so far I decided to ask this question here from those that has already been through the process more reent that 10 years. Here it is:   1. The I-130 is filed in the US correct? Yes.  After marriage, petitioner files i-130 in the US. 2. Once the I-130 petition is filed and approved the interview for my fiance will be done in his own country right? Yes. 3. In this interview because we are married now do we both have to be there for the interview or is it only the beneficiary that must be present for the interview?  It is not mandatory for the petitioner to be there on the interview.  In some high fraud countries, it is better if the petitioner is present during the interview.  You might want to read the Embassy reviews for your wife-to-be's country. 4. Since they go by case number more than name this whole story sounds unbelievable, you might have the same name but you certainly don't have the same case number!   I agree. IR-1 / CR-1 Spouse Visa Process & Procedures	original of marriage certificate	NSO issued documents printed on NSO security paper (birth certificate, marriage certificate, death certificate) are the OFFICIAL documents needed for the NVC and US Embassy stage and even when you're already in the USA, the NSO docs are what you need.   During the USCIS stage (at the initial stage of the petition), they will accept the certified true copy (the one from the Local Civil Registry) of your MC but on the NVC stage you will be asked to submit the NSO issued MC.  Don't send scanned or photocopy of your NSO MC, send the actual NSO MC because they want it as it is printed on security paper.   So if you will get NSO issued documents, make sure you get 2-3 copies so will have extra/back-up copies.	apple21	Female	Philippines	2013-05-29 20:49:00

Bottomline is if you want your husband to get the visa, might as well be there on the interview. If asked about the infidelity at least you as the petitioner can personally vouch that you know about it and you still want the marriage to work. If all else fails, file for divorce and move on. His dad's (petitioner) name was spelled wrong on the immigrant data summary sheet. I called the embassy and they said its quite normal to have typo errors on the data summary sheet. We won't have problems with that. What's important are the details on the immigrant visa itself. If the error is on the visa, we need to bring it back to the embassy. IR-1 / CR-1 Spouse Visa Process & Procedures	can someone please explaine me this because it confuse me	dear all VJ members i have my interview on the 6th may 2013 the co offecier told me that your visa is approved but its going to be under administrative review and they will call me within few weeks as she said so everyweek me and my wife calling them or sennding them emails so yesterday my wife wrote to us embassy in casblanca Morocco.so today they answered her by this email "Thank you for your e-mail. Some visa applications require additional special clearances or administrative processing, which requires some additional time.  When additional special clearances or administrative processing is required, the timing will vary based on individual circumstances of each case. How long will this take when hell get his visa? Cus dey took his passport n comfirm delivery for visa  It depends.  There's no specific timeframe for 221g.  Expect a few days or weeks of delay.  Don't book his flight until he has the visa on-hand. First off I am sorry if this is in the wrong topic, we are in an absolute panic and are both sick right now.....please move to proper area   Situation:   I am a USC and my wife is French,  I arrived 6 weeks ago.    We marry in 2.5 weeks and were planning on applying our I-130 form right after we got the marriage cert in hand and copied and translated into english.   We were planning on staying together and my wife work full time and I do the home duties and help with other things I can help the family with.   The family ALL thought I was allowed to stay IN france until we return to US since I am not working here or anything, just living and waiting.       In putting together our I-130 packet we stumbled accross some visa info then US in France info and found the tourist visa is only 90 days and I'd have to apply in the US and wait for MONTHS in the US.     First off, we are broke....so applying for the i-130 would use every penny we had. Now we are in panic as we find out I will have to go back to the states without my new wife?!?!??!?!         In that case waiting for the long-stay french visa would be worth-less (if it takes months of processing time) and i've been warned the French administration side is a nightmare.      HELP!  are there ANY options that I don't have to leave France and be apart for my new wife for the entire period waiting for her US visa to process????   Help please,  any ideas, tips suggestions.   She is literally sick how her and her family missed this giant piece of extremely important info.   Help.........thank you for reading this.   Did you know of the other fees to be paid?   AOS Fee = $88 Immigrant Visa Fee = $230 Medical Fee = ?? paid directly to the doctor (in Euros) New Immigrant Fee = $165 Plane fare = ??   The entire spouse petition will take approximately 6 - 12 months to complete, did you inform your boss about this?	apple21	Female	Philippines	2013-05-19 20:48:00

But we do include our child's documents when we file like, birth cert, her own g325a form etc.   Yes, the child needs to have his/her own i-130 (no need for g325a), since your petitioner is a US citizen.  Derivative applicants are not allowed in the IR1/CR1 category.   If your petitioner is a Green Card Holder/LPR, then no need to file a separate i-130 for the child as derivatives are allowed in the F2A category.	apple21	Female	Philippines	2013-08-08 20:03:00
