I had my wife go to renew her passport in her Married name in Cebu and the DFA told her she couldn't becuz her passport doesn't expire for a couple more years. They said she had to wait til then. That's in Cebu though, and you know how it is in the PI. If you go somewhere else they might just renew it without telling you that. I wanted to get it in her Married name, cuz we just took a trip to Hong Kong the beginning of March. I used her married name on the tickets, so I just had to make sure we brought our marriage certificate with us. Cebu asked a lot more questions then Manila did, but it was no problem since we had the MC and all our paperwork correct. She had her CFO certificate also.

I know when she renews her passport here in the USA we'll have to go all the way to Chicago. To the Philippine Consulate there.


Wow! DFA Cebu told her that? Shame on them. Some government employees are real idiots.

I have a valid passport under my maiden name, after I got our NSO MC I immediately renewed my passport. The guy at DFA (Aseana-Macapagal) asked why I'm renewing a valid passport, I simply said I changed marital status and I want to use my married name.

I think it'll be easier to do it now that she's still here in the Philippines, if you already have the NSO marriage certificate, for her names to be consistent in all the immigration forms including the visa.

In order to file an IR-1 visa and receive a 10 year green card you and your spouse have to be married for over two years. We are not and I filed a CR-1. We were approved (Yeah!). Since this process has taken so long we will be married for two years BEFORE my wife does her POE. I have heard that if you are married for more then two years BEFORE POE you can have a CR-1 visa converted to an IR-1 visa and get the 10 year green card. I have no idea if this is true. Have any of you heard such a thing? Is it possible? I asked the consular office after our interview and he said that he knew nothing about it and that I should ask USCIS. If this is at all possible I would like to find out more about it. Thanks for all your help!!!


Yes it's true. If at POE you are already married for 2 years or more, you can tell the immigration officer so that they'll issue a 10-yr GC. Tell your wife to bring original copy of your Marriage Certificate as proof.

Im petitioning my husband who is still in Saudi working but ready to go back in Philippines for the time of interview, we are currently in the process of sending our IV bill packet, and I read thru the guidelines here in Vj..one of the requirement for the IV packet is original police certificate from beneficiary. Now whats making me confused is the fact that some says Saudi Police certificate is no longer required for third party nationals who no longer lives in Saudi. So that only applies if the beneficiary on time of the IV packet is no longer in Saudi and for my husband case since his still in Saudi on the time for our NVC stage,he is then required to attained one? I may had answered my own question but I just wanna get some others input on this...thanks in advance


Since your husband is in Saudi now and you are submitting DS-230 while he is still in Saudi, then yes he should obtain and submit the Saudi PC.

Before he leaves Saudi to go back to the Philippines for his medical and interview, I would suggest getting another Saudi PC to be presented at the interview, just in case.

If you are a U.S. citizen, you must demonstrate your status with:

A copy of your certificate of citizenship

You'll probably get an RFE for lacking documents. Either way, your i-130 will not be processed until you submit your Naturalization Certificate.

The beneficiary fills up and signs the DS-230 form. Your wife can mail it together with the other civil documents directly to NVC in the US. There's an NVC address in the barcoded cover sheet. She can send it via FedEx, UPS (2GO), DHL or LBC. After your case has been completed, the NVC will forward her documents to the US Embassy in Manila.

What name did you use on your i-130? You use the same name on your DS-230.

If in all the immigration forms you used your maiden name, passport under maiden name then visa and GC will also be in your maiden name.

No. As long as you have a bonafide relationship/marriage with your future husband (whom I assume is the US citizen), and you're legally free to marry, you'll be fine.

I sent my I864 put the cover sheet inside and i put it on top of the document like what it said.

I recieved a correspondence letter saying:

You should only name your husband, not the 3 kids. He will do that later when he files his own petition for them.


The DS-230 is filled up by the beneficiary, not the petitioner. The husband did the right thing by listing his children and for them to follow at a later date (when he files for them). Listing the children doesn't mean that they are included in the current petition. They don't qualify as derivatives either, as derivatives are NOT allowed in the IR/CR categories.

I wonder about the intentions, and age, of the prospective US citizen fiance. I was wondering if anyone here can tell me anything and everything they know about the CR-1 Visa, such as what are all the required forms, what is an estimate of waiting, an estimate of prices, etc. I am 17 and not married but, it would help if I were told the information AS IF I were 17 and married because that may soon be the case and it would just help me out a lot. Your daughter will get IR2/CR2 visa.  Your husband is eligible to file a petition for her as a STEP-PARENT.  He doesn't have to adopt her for the petition to be approved.

The lawyer is right.  You can get married anytime, it won't affect your upcoming citizenship.  After you get your naturalization certificate, you can file i-130 for your spouse.

 

Your spouse will be under the CR1 category.  He will immigrate within (more or less) a year (given there are no documentation, medical exam and interview issues).

It is the sole responsibility of the petitioner to take care of the beneficiary.  There's no law that automatically puts the same responsibility to the petitioner's parents/relatives/friends.  If they want to help, that's good, but if not then move on to the next relative or friend, if no one wants to be your joint sponsor then find a second or third job.  People who refuse to be a joint sponsor has the right to do so.
