Hello everyone! I had my K1-Visa interview here in HK in November 2013. All went well except my birth certificate. I was asked to submit a new one with annotation from the NSO. National Statistics Office in Phils won't do the annotation without a Court Order. As I knew about the issue of my BC, I filed a petition in our local Court to get it corrected a year before we started my K1-Visa. Unfortunately the petition was dismissed in March 2012. I later realized that my lawyer should have filed for a Motion for Reconsideration. He didn't. Which ended the chance to get a Court Order. (I think) I am now in my last option. Last month, March, I hired a US Immigration attorney who is based in Manila. So far I gave everything he needed and now making a draft of my case to submit to HK-USC. As not everyone could relate to the dilemma we are in at the moment, one disappointment after the other, my fiancé and I are trying to explore all possible options. We are now into the idea of him coming to HK and marry me here instead. I heard some couples had marriage ceremony in their Country's US Consulate. Our question is, would that be of help in my application? I really appreciate any help you could extend.

Its okay to apply for a tourist visa however the immigrant intent is already there (because of the i130 filed) so the chance of getting approved is kinda slim.

For spousal visa and other family/employment based petitions, it is the NVC who does the scheduling.

 

Only the K1/K2 visa chasers can do the online/telephone scheduling because their cases don't stay long with NVC.  Once NVC issues their case numbers, the files are sent immediately to the embassy.

The GC won't be processed until your wife enters the US using her immigrant visa.  The GC will be delivered to the US address that you indicated in the ELIS.  You'll get the GC in a month (or longer) after POE.

That's odd.  As the petitioner or beneficiary, you can give (or update) them your email address and contact number.

 

Even if you get your case number, it will still be NVC who'll give you access to CEAC.  A mere log-in will not give you the ability to fill out the forms and pay the fees.  You'll have to wait until it becomes available.

No.  My husband was unemployed too when he filed the i130 for me.  No issues there.

 

However, you'll need a joint sponsor who meets the income requirements for the Affidavit of Support (in the NVC stage) if in case you're still unemployed by then.

If i-130 is filed using maiden name, all forms should be in maiden name. Visa and green card will show maiden name.

If you choose to file i-130 in your married name, your passport and all other forms should show your married name. Visa and GC will show married name.

You will need to re-do the medical and pay another medical fee.  Now, its better to call SLEC to make sure if your wife will undergo another sputum culture or not, because she did sputum on the first medical right?

 

Visa will not be issued unless a valid medical report is submitted to USEM.

I just decided to post my related question on here... I hope someone can enlighten me :)

We have made a mistake with the signing of both G-325a forms by my husband. (please refer to first post)

USCIS has clearly received our I-130 package, with it presently at NBC. Do I wait for an RFE (if they do decide to RFE) or just send already a copy of beneficiary's G-325A form with beneficiary (me) signed off on it?

I believe I mentioned already in another post by you that there is one form for each of you and that you would sign your form and your SO would sign theirs. As some have mentioned, this same error has been overlooked for others in the past so hopefully yours will also be OK!


I really hope so. Haven't found anyone on here share that they got an RFE.



I think my husband (the USC petitioner) signed both of our forms, so I am also hoping for the best.

dont fret yourself this early in the game. i have read on VJ too about people doing that and were ok. Its just that one never knws the mood of tdhe individual who reviews each case. Its just an informational piece of paper to provide bio info for each member( which either person could) but then someone may insist they want each person to take responsibility of their info by signing their personal signature.


Thank you :) I did calm down as I was trying to find stories on here and on the internet about people getting RFEs by sending G-325a forms with both signed by the petitioner... But I haven't found any. Even got an archived memo from USCIS turn up in my search.

So, I will just wait for the NOAs (and the RFE, if it comes) and hope I frontloaded them with enough info to just say "Approved, of course!" ;)

I also tried searching for visajourney members who did that, who might have gotten RFEs, but I haven't found any.

My husband and i just mailed our I-130 petition after a week of completing it.

We both read the I-130 instructions and it never mentioned that the beneficiary will sign off on any forms. That is exactly what we did... Even for my (beneficiary) G-325A form and continuation sheet.

Were we wrong in doing that? If yes, what can we do to remedy it?

I really thought that at the petition stage, everything should be signed off by the US citizen/ the petitioner :-/
