IR-1 / CR-1 Spouse Visa Process & ProceduresDecision before interview

please can someone answer this question for me.

i went for interview last year march and i was denied because i never presented enough evidence. The case was later reaffirmed and i was called for  my second interview last month.but on the day of my interview the lady CO took my package and after she went through, she called three other CO to go through and after that i saw them nodding their heads looks like they where confused.
finally my number  was called with no much questions and at the end she kept my passport and gave me two sheet containing CONTACT SHEET and 221g form on A P.
i noticed my case has been decided before my interview.and my police and medical report expires ending of February.

my questions,

Does it mean cases are decided before interview on whom to APPROVE,DENY AND put under A P?
Does embassy allows medical and police report to expire in other to ask for another one before issuing a visa?  The embassy does not purposely let the medical or PC expire.  They do expire because of the long period it takes to finish the AP as there's no specific timeframe for it.  They will surely ask for a new medical or PC before they will issue the visa BUT there are also circumstances wherein they ask for a new medical/PC while the AP is not yet over.  The AP can continue even if you submit a new medical or PC.

thank you all vj friends

IR-1 / CR-1 Spouse Visa Process & ProceduresNo joint bank account okay at I-130 stage?

It won't be an issue.

We didn't have a joint bank account when my husband filed the i130 up until we finished the visa process.

I brought money remittance slips (hubby sends me a monthly allowance) during my embassy interview but the consul didn't ask for it.

For the IV package, the beneficiary must submit:

-  original NSO birth certificate

-  original NSO marriage certificate

-  original Foreign Police Clearance (if you lived/worked outside of the Philippines for 12 months or more, you will need PC from that foreign country)

-  photocopy of passport bio page

-  3pcs visa photos

Please refer to the IV instructions at the CEAC site for complete list.

IR-1 / CR-1 Spouse Visa Process & ProceduresOriginal Doc or Certified Copy?

do we need to submitted original documents for AOS package or photo copy .. as it said that a beneficiary will bring the original copy during the interview?

For submission to NVC of the Affidavit of Support, the petitioner and joint sponsor (if any) must submit i864/i864a with their original signature/s.  Photocopies of ITR and W2 is acceptable.

For the interview, its best to bring a copy of the AOS package.  Also a copy of the 2013 ITR and W2 (if you submitted the 2012 tax stuff to NVC).

IR-1 / CR-1 Spouse Visa Process & ProceduresUsing Irish vs British citizenship to immigrate to US

Hmmm, the embassy interview is the last step of the process, I wouldn't worry much about getting the interview schedule, but you can check the regional forums to get a benchmark of the scheduling difference between Dublin and London.

The initial stage at USCIS is probably the most stressful as it can take 5-6 months (or even more) to get your i-130 approved.  But there are some lucky ones that get approved quickly.

The second stage at the National Visa Center can also take a month or so depending on the completeness of your financial and civil documents.

Just be prepared that it can take more or less a year before you can immigrate to the US.

Good luck.

IR-1 / CR-1 Spouse Visa Process & ProceduresUsing Irish vs British citizenship to immigrate to US

Your USC spouse will have to file i-130 (CR1) after your Irish wedding.  You will enter the US via CR1 visa which will automatically give you a 2 year conditional resident status and you can start working immediately.  A US job offer will not speed up the CR1 process, sorry.

Your citizenship has no bearing on the petition as spouses of US citizens are processed (generally) on the same pace.  You will have to put both citizenship on the forms though.

The K3 is obsolete.  You'll be fine with the CR1 route.

Your mom was ill advised.  Late registration is only for those who NEVER had a BC in the first place.

Good luck.

Yes my petitioner is a US citizen

I don't have any intention to enter the US with the intend to stay I only visit and return back to canada .

My only concern is that my petitioner submit i130 petition for me and he only list my daughter under the section C " information about your relative .

He also enclosed 420 which is one fee.
Is this correct , or should submit one for me and a one for my daughter and fees for both ????

He should submit a separate i130 for your child (his step daughter) and a separate $420 cheque for it.

It should be:

i130 and $420 cheque for you

i130 and $420 cheque for daughter

Is your petitioner a US citizen?

As Canadians, you can travel to the US visa-free for tourism/temporary purposes only.  If you enter the US with intent to immigrate/adjust status using VWP, that's considered fraud.

IR-1 / CR-1 Spouse Visa Process & ProceduresObtain police certificate
I stayed in Japan for almost 3 months back in 2002 but I didn't include that in the forms because it wasn't considered as actually residing there because I was on a tourist visa and just visiting.

The pre-screener at the US Embassy asked me if I worked or travelled in a foreign country and I just said yes and mention that I visited HK, Macau and Japan. She asked if I stayed there for 6 months or more and I just said no because I went there as a tourist. She made a note about it but didn't ask me to submit a police clearance. I just submitted the one from NBI.

You don't need to get an Australian police clearance. Just the NBI clearance.

What the other poster meant is, some countries don't issue police clearances for persons who no longer reside in their country, for example in Saudi Arabia.

If she lived abroad for a short time (less than 12 months), no need to get PC from that country.

If she lives nowhere else but the Philippines, regardless of how many times she moved/changed address as long as its within the Philippines, the NBI clearance is enough.

If she lived/worked abroad (outside the Philippines) for 12 months or more, she needs to obtain police clearance from that foreign country.

If she lived/worked in the Philippines her whole life, she only needs the NBI Clearance (the green one, for travel abroad).
