My fiance and I have a 4 year old. We have been in a relationship now for 6 years. I have read a few posts where the couples that have a child or children together have been denied visa's, not necessarily due to having a child, but it's just been coincidence that the one's I've read about have all been denied.

 

My question is, does us having a four year old together raise red flags? Also, will the length of our relationship pose red flags?

 

Did you already file CRBA for the child?  Does the child have a US birth certificate or US passport?

It's upsetting how utterly fast & irresponsible you generalize for Asian women. When in fact, you seem to have only based your logic on the Vietnamese experience.

I can probably pinpoint which parts of your essay does not apply to me or to any other Asian woman for that matter.

You asked for help, but you don't take criticism well. Many well-meaning people, such as myself, have said again and again that your "research" is not research at all. And that what you need to do is see beyond your biases to be able to write this topic well. It's a very good topic, but it requires a lot more responsible research that what I think you are doing.

Also, I know about freedom of speech. And you shouldn't care one bit about when my fiance and I decide to have children.

I'm sorry, dear, but are you just out to prove your own view on the subject matter or have you even tried looking at this without bias and pre-conceptions?

Because for sure... you are not referring to my experience as an Asian woman.

And also... you say how can true affection be formed with just chats and emails? I am quite confused as to why you would think no one can ever gain romantic affection towards another person he/she constantly communicates with and who he/she admires and respects. My experience may not fly for everyone on VJ, but I know for a fact that I am not that type of Asian woman you're implying.

Also, I remember immigration guidelines state that they required meetings in person for the petitioner and the alien. But, I'm sure you already know that.

My life is worse.. the worst, in term of my own earning. I left a job that paid me triple more than I am making here.. and I'm from one of the "POOR" countries you mentioned.

this is a fallacy imo, maybe for the petitioner but not beneficiary. i'm confident most beneficiaries don't "fall in love" in the traditional sense. i mean how could you? you talk to this person once a day, at most 2-3 hours? you see them in person 20-25 days in a good year? sometimes you talk to them for a few months, see them once...and get married. it's not a normal courtship, so kinda hard to fall in love. i see it more as an arranged marriage, and at best the couple will learn to love each other through the years.


Geez. What a hasty generalization. The OP should also make sure not to do that with his/her "research" for the essay.

Ours wasn't courtship, but mine wasn't normal dating either. Sadly, there might be people who do that (get a meal ticket husband, as quoted earlier), but come on now, not everyone who meets a US citizen online and marries them does so for such a fraudulent reason.

Existence of "meal ticket" relationships is the primary reason why us, people who have great, real (but long distance :( ) relationships have a tough time applying for visas.


I feel sorry for the meal ticket husband. I know my wife is in love with me and would live with me in any country. There is no minimum time frame one must meet before it is possible to fall in love. Was your marriage a business transaction "deal" for you?

It is those types of people (that marry to better their standards of living alone and not for love) that create the stereotype that exists today about marrying foreign women. I believe that if those are the true underlying intentions, it is considered fraud.

well, if it is a biased essay, I will be done. I have to do it good and make a stance. If you are an English teacher, you know it well.

My conclusion: "In short, I think that the couples have two countries to choose for their life, so why don't they do that in both for their life and vacations? The USA is not the bad country to live, but it is not the only place to live."

Do you know what the Vietnamese wives do in the USA? We have a group help each other to do business. Looking at what they are doing, I feel proud of them.



IMHO, for your research, better to find social science studies rather than ask for personal experiences in an online forum.

This all stems from my personal experience. I'm Filipino, living in Japan.

Try visiting Phil embassy in Tokyo if they have NBI clearance forms for her to fill in. Better yet, call first. If not, you will have to ask someone from the Philippines to procure an NBI clearance form for her than mail it to her. Fyi, better to use private courier instead of Philpost.

When the form gets to Japan, call nearest Philippine embassy. Find out if they process NBI clearance forms. Have your fiancee go there, bring along ID cards specified in the website, then thumbprinting, payments will be done na. Guess what happens next? You get the processed NBI clearance and have it sent to the reliable friend/relative in Manila. Use courier like Fedex or DHL. EMS can be reliable but better not to risk with Philippine Post. Make sure to include a picture ID with her signature and an authorization letter that the person you're sending it to can file and claim the clearance on your fiancee's behalf. This has fees, by the way, every step of the process.

As for police report with Japan, this is where the huge difference happens. You just check out requirements for police certificate with the prefectural police online, find the station, bring those requirements then apply for a certificate. This is FREE. Your fiancee can claim it after about a week.

I am of the understanding that I can't schedule my own interview. That the NVC does it.

I'm also not comfortable sending in the police clearance and having to wait for them to process it for 10-20 days. My husband and I only have around 45 days before he has to move to the US (with me in tow, hopefully).

But the police clearly told me I can only give it to the consulate. Are you sure it was mailed to the NVC? Sealed envelope and all?

I already have a Japan police clearance. And I know I need it and have already gotten it.

In a sealed envelope. Which the police specifically stated for me not to unseal and to give (sealed) to the consul during my interview. So, that is why I asked what I asked.

Did you mail your sealed envelope with the clearance to the NVC?

I'm Filipino, curently based in Japan with my husband, a USC military member. We are here on SOFA status (aka regular Japan immigration laws don't apply to us). We're here because the military sent him here and we're not alien residents of Japan.

So, I'm applying for a CR-1 visa. We've already submitted our AOS and IV packages. Then, we got this email...

In some cases, however, the police will issue the appropriate police certificate, provided that the illegal alien submits to deportation proceedings and agrees to leave Japan by a date specified by Japanese Immigration.
U.S. Forces, Japan (USFJ): Criminal records of the Japanese and USFJ police are not cross-indexed. Therefore, a crime that occurred in one jurisdiction may not be reported to the police of the other jurisdiction. USFJ applicants, (civilian employees or military personnel, and family members), who are physically present in Japan under the Status of Forces Agreement, (SOFA) must show the results of a check of both Japanese and USFJ criminal records. This type of USFJ police certificate will explicitly state that Japanese as well as USFJ criminal records were both checked and give the results. Processing time: Approximately two months.

So, this was obviously something they copy-pasted off the State Department website cause I read those, word per word, from that site.

I fall under Applicant personally present in Japan and US Forces, Japan. I've gotten what I needed from Security Forces of my husband's base. They had it sealed and instructed me not to open it and was for opening by the consul during my interview. I got clearance from the Japan Prefectural Police. It was also sealed and they specifically instructed me not to open it. Only the consul during my interview can.

So, i believe this email request from NVC was a gross negligence on their part to create an email that was specific to my application. In my paperwork, i clearly stated I live in Japan, with my husband and we are not Japan alien residents.

Has anyone experienced this before? I am tempted to just ignore it and request for an expedite instead. (We have compelling reasons but are choosing not to do it yet because of the government shutdown's effects on the military) In that way, they will just send our paperwork to the consulate and then we won't have to deal wifh NVC anymore. (They've made a huge mistake with my application months prior)

Please guide me.

Hi Glen Charles, a baby can be delivered 2 weeks advance and 2 weeks delay from the expected date of delivery. Your wife can have the baby before the interview or better else after the interview. It rarely happens that a baby is born exactly the day he is expected to come, so i guess you don't have to worry about her giving birth during the interview. Oh by the way, where does your wife lives? It might be uncomfortable for her to travel to the embassy with a big tummy and to think that she is almost due?

Not sure when to contact my Senator on this, so I'd like to know how many others have yet to receive their IMBRA RFE.

My fiance has not received anything by mail from the USCIS. Our lawyer just scanned his copy of the NOA1 and sent it to us. And before that, the Receipt Number at the back of the check doesn't get accepted in the Case Status Online System. which drove me nutty. Yup, USCIS administrative failings. of which there are many.

And no IMBRA RFE... yet. We sent a request for information thru the lawyer, and a case update last August 2nd reflected that they got that request. Now we wait what they will do then.

oh, I know the new form already includes the IMBRA questions, but our lawyer did ask my fiance if he received an RFE in the mail... and I've seen some cases here wherein they used the new form and got RFE's anyways, after a month of getting NOA1.. so if that is true, we should be getting that RFE within a week.. maybe.. hopefully..

I guess I'm just getting too anxious to get that RFE step out of the way...but seeing how many have been waiting for longer periods of time humbles me.

Anyhow, I think my case belongs to a new thread then...

so after the follow up interview which is coming up in a few days, the dna test has been completed and processed. the window appointment the embassy calls it, what happens? they get approved possibley and then have to wait one to three weeks for visa to come in mail???? why do they want the passport, is the visa not just a stamp in the passport? is the visa given to the children upon approval during this "window apt" coming up in a few days? i read on the internet they don't hand the visa out at the embassy. Is that true? They have to come in the mail several weeks after approval???? somebody tell me please. would like some hope the children will be here by christmas. their apt is in a few days. follow up from their interview early october where they gave us a blue sheet and asked for dna at the last minute. just trying to figure out how this last part works.

Its not a simple "stamp". It takes time for the embassy to print and affix it in your passport that's why you will have to wait before you can receive your passport back.
