The US Embassy taking the beneficiary's passport is a GOOD thing.

 

Being put in AP is the most stressful part because it can take days, weeks or months before they can finish it.  There's no specific timeframe because its a case-to-case basis.

Its quite common in Pakistan to go into AP.  It means they are doing additional background checks.

Your petitioner did not meet the income requirements that's why your case was put in AP?  Did you try submitting a joint sponsor?  Is your petitioner unemployed?

One of the NVC requirements is submitting a photocopy of the beneficiary's passport bio page along with his other civil documents (birth certificate, marriage certificate, police certificate, divorce decrees if applicable, visa photos).  Can he obtain it anytime soon?

 

The waiver is filed after the embassy has denied his visa.  You'll need an experienced lawyer for that.

If that's the case, the i130 should not be at NVC because he doesn't need a visa anymore.  Those that go thru NVC are for consular processing meaning the beneficiary is outside the US and will be interviewed at a US embassy or consulate.

 

Did you also file i485?

No they gave me my passport i mean i have my passport with me, but they have all my passport and original documents of me and my Fiance

 

The embassy only keeps the passport of the beneficiary (the foreign fiancee).  They will not keep the petitioner's passport.

A lawyer cannot speed up your AP.  You can consult one if you want to.

There's no specific timeline for AP.  What the CO gave you is just an estimate.  It can take much longer.  There's nothing you can do but wait but sure you can email or call them for updates.

There is a chance of approval but determining the chance of approval is hard because they already connected the dots between your tourist visa application and your immigrant visa application.  

 

Normally, a tourist visa denial does not have any bad effect if the denial is based on lack of strong ties to home country but your case is different.  You lied by claiming you have a child.  The consul mentioned that during your IV interview, right?  That's where the AP is coming from.  They are doing additional background checks on you.  The outcome could be approval or denial.

No need for CRBA.  She's a US citizen by birth.

 

I don't see why your child together will cause a red flag.  As long as your relationship is bonafide you'll be fine.

We have been in a relationship now for 6 years. I have read a few posts where the couples that have a child or children together have been denied visa's, not necessarily due to having a child, but it's just been coincidence that the one's I've read about have all been denied.

 

My question is, does us having a four year old together raise red flags? Also, will the length of our relationship pose red flags?

 

Did you already file CRBA for the child?  Does the child have a US birth certificate or US passport?
