No, i didn't do the CRBA yet. i didn't want to do 2 things at the same time. i was worried that if i do the CRBA and the K1 visa is in process it might complicate things. our file is already at the Manila Embassy. once the K1 is approved and they are here in the US, i will get her USC here. 

 

regarding the AOS (I-134), when/where is that submitted? sorry, i got confused on the fees...looks like there's no filing fees. thanks  again for your help.

 

The child will be denied the K2 visa because she has claim to US citizenship.  You should file CRBA for her first.

 

If in the event that the CRBA is denied, that's the time you can chase the K2 or IR2.

In the Philippines, when a child is born out of wedlock (as OP's case is), the sole custody goes to the mother. There's no "paperwork" or "proper documentation" for this, the child's birth certificate is enough because it shows that the mother and father are NOT MARRIED at the time of the child's birth. That's why OP was able to immigrate with her daughter (even without consent from the biological father).

But it seems that DOS doesn't recognize this, especially if the father's name is indicated on the BC. Only way to get around it, is to obtain a sole custody document (issued by the proper court, I suppose). But since the father is not cooperating it seems impossible for OP to get anything from him.

A lawyer might be able to do something.

The legitimation part to claim US citizenship is no longer an option.

However, if you have date-stamped proof like letters, emails, pictures and money remittance slips that a father-son relationship was established BEFORE your 21st birthday, then your father can file a petition for you.

* A copy of your child’s birth certificate issued by civil authorities

* If you never married the child’s mother before the child turned 18:

By the way my daughter is under 18 yrs. old

 

 

Your USC husband (as step-dad) can file for your daughter now (if your marriage took place before her 16th birthday).

 

If you file for her now, she will be under the F2A category (Unmarried child below 21 of LPR) with a waiting time of 2 and a half years.  When you become USC (I assume next year 2014), you can upgrade the petition to IR2 (Unmarried child below 21 of US Citizen) so a visa will become immediately available for her.

Hello Fellow Vj Members,

 

 

I apologize if this is in the wrong forum,  anyway i was in the process of getting my 2 minor kids their US passport but due to lack of documents that i did not know i would need ..i  have to delay the process.

 

ANyway  i got naturalized in December of 2012. My  2 kids had an IR2 visa and have been living  here with me since November of 2010.

 

As fas as i know my kids being minors (11 and 15) are automatic citizens once i become citizenthrough Child Citizenship Act.

 

 

 

I read somewhere that kinda confuses me. It says that kids will become automatic ctizens once  the parent becomes naturalized  and  have lived in the US for 5 yrs??

 

 

 

1.IS  this true? do i have to be physically present in the US for 5 yrs?  No.  You can naturalize based on the 3-year residency and marriage rule.

 

2.How can i prove that my kids are eligible to apply for a US passport and that they are citizens too when i become naturalized?  Bring your naturalization certificate and the children's BC and green cards.  The "resident since" date on the GC will show that they were admitted as permanent residents at the same time as you.

 

I have an appoitnment for the kids passport application on  May 14th so i would like to know.

 

 

Any help is greatly appreciated. Thank you very much.

Since you're already a naturalized US citizen, I'm sure you were able to prove that you married your wife in good faith when you filed removal of conditions.

Now, its entirely up to you whether to stay with your wife or pursue your career. I don't think she can have your citizenship revoked just because of your marital misunderstandings.

Sorry.  USC means US Citizen.  CRBA (Consular Report of Birth Abroad) doesn't apply to your case.

I don't know the answers to your inquiries, but, if I were in your shoes I would stay clear of crossing the border (for now).  Wait until you have your K1 visa before going to the US.  Have your fiancee visit you instead.
