We are happy to get through another step, that the CSC has our IMBRA reply already, and the phrase "the preliminary processing is completed" really made our day... however, we have a later NOA1 date than yours, and it just isnt' good.

Very interesting read.

This has me thinking. A person married in PH can divorce elsewhere. PH law doesn't supercede US law when in the US.

So.... if somehow the PH citizen could find a way to enter the US--and of course this is very difficult to do--then he/she could divorce in the US. Say you got a work visa to the US. That person comes to the US to work. After a while, s/he decides to divorce. S/he would file for divorce in the state court of his or her residence in the US. That would circumvent all the anti-divorce laws of PH.

What do you all think? Is this doable?


No, the marriage contract was made in the Philippines so *if* you could get a divorce in the US,
it would not be recognized in the PI. Divorce is illegal in the PI, annulment is the best that can be hoped for.


Hi, I am the friend that MrsMcknight was speaking of and I've found my sweetheart in PH. GRRRR Since she is married. This was the plan i was hoping to take, have her come as a tourist and get a divorce here. Would it matter if the divorce was not legal in the PI? Are you sure. Suppose after she got here, she decided not to go home as planned from her RT ticket. She got married after her divorce was final. She couldn't work But she wouldn't be in the PI, she would be in the US and that divorce is legal. Now I'm guessing if she ever went home and tried to renter the use that would be a problem.

I'm concerned about her reasons for seeking an annulment, he may have some paranoia going on, causing him to be very controlling and making her life miserable. I guess an attorney there talking to her could come up with something better but that's all I've been able to get out of her. Clearly I need to go see an Immigration attorney. And a good one. My health is not that great and as every-one's sweetheart is, this lady is really precious to me. Anyway, if she's here rather than PI does it matter if it's legal there?

Oh and hello everyone, this is my first post. I married a Scott using the same methods a while back. She came in through Canada, didn't even need a visa or passport but it has been less than 10 years. I believe that's how long that sponsor ship form is? Is that going to make any difference? Do they really enforce that, were if they collect public assistance they'll go after the sponsor to make him pay? Kind of raw subject for m but I need to know.


I'm not a Lawyer and I just dont know to be sure, but I do know that most filipinas have about as good of a chance finding the Holy Grail as they do getting a tourist visa. I would suggest you check with an attorney.
Also what youre asking for basically is information on how to commit visa fraud, No one here will give you this information... Best of Luck

Yes, but I suspect US divorce laws are quite liberal and generous. It's pretty easy to get divorce in the US--same with getting married in the US. There aren't a lot of requirements and you can freely move to whichever state and file for divorce from that state. Sometimes I think it's too generous.



Can that really be done? Can the US or any country for that matter issue a divorce decree for a marriage that was not officiated in that country, not within their jurisprudence? When going through the immigration process "after marriage, after divorce" in the US, will the USCIS/DoS recognize the US Divorce of a Philippine Marriage as legal and binding?

This was discussed by someone in the Manila Interview Thread.. about the annullment of a church marriage, and it really left me thinking.

I was married in the Catholic Church, and that was indicated in the annullment I filed. But when the Decision came out, it was all legal and correct up to the issuance of the Annotated Marriage Contract. I was not told by the court that a separate process was necessary for voidance by the church. And yes, I can get married in Church now.

But this is just my experience.

Hi.

I had to get an annullment before we were able to file the K1. It is very expensive and the process is a real wringer, mine took three years. I saw some members of VJ from the Philippines who got theirs in less than 2 years, and they thought that was a long time already! Mine is a very straightforward case, and easy enough to prove psychological incapacity on the part of my ex (that is one of the more acceptable grounds for annullment).. but the delays were to due to the schedule of hearings... they schedule your hearing on a certain date, then postpones it for anotther 3-6 months because the judge in on personal leave, the fiscal is attending a convention, the judge is on a trip abroad.. and other reasons that make you squirm. Also, it would depend on the work load of the court, and thus will depend on where your friend resides now. Manila and Quezon City courts are swamped, so if she lives in the province, I would think the process will be a lot shorter.

Depending on the ground for annullment, your friend needs to pay for the services of a psychiatrist to be her expert witness, to prove psychologocal incapacity. Cost varies... we paid P15,000 for the psyschiatrist alone. And your friend will go through the process of narrating all that transpired in her relationship with the ex, which can be emotionally trying. Going back to all the details of the relationship during the annullment process and having to go through the cross examination in the hearing even after 17 years of separation left me emotionally tired. This is the only time your friend has to be appear in court by the way. She doesn't have to be there durign the pre-trial confrence, and the hearing where the psychiatrist will testify for her.

And yes, it is not always a sure approval after going through all that. Psychological incapacity is not easy to prove. Your friend has to prove that the at the time of marriage, the spouse is not psycholgically fit as a husband, thus the marriage is null and void from the start.

When it is approved and the decision is handed down, comes the part where she will have to file the Decision with both the Local Civl Registrars where the marriage was officiated, and town/city where the Decison was passed to have her records officially changed, and finally back to the Court where she will be issued the Absolute Decree of Nullity of Marriage. Then to the National Statistics Office, for the Annotated Marriage Contract. This is the document the US Government wants.

He has used that passport the last 2 times he went to Manila, but we discovered this only afer the I129F was filed late June. We submitted both his BC and passport in the petiiton package. Apparently, our lawyer missed it (and fyi, we're ready to fire that lawyer grrrrr).

Now we have a 2nd RFE and we're expecting this to be the reason.

Ok, I try again.

My ex's name has a Jr. but the court here in Manila didnt' put it in the title portion of the annullment decree (but this is resolved).

My USC fiance's passport has Jr in it, the US DoS put a Jr in it, but his real name does not include a Jr.
And this is my concern now.

The Jr conundrum!!

So the mystery is solved - there is a Jr. in your husbands name, and so the Jr does belong as part of his name in his passport. Why did you write in your initial post that the Jr should not be there?

Or am I misunderstanding what you've written in one or the other of your posts?

SirLancelot, my fiance is not a 'paper person', and more of a 'number person' I would say, and yes he has the notorious reputation of being lousy at documents. Add to that the lack of time to do this, thus the decision to spend big and hard-earned money on an immigration lawyer. There are other reasons for firing him.. on the whole, he wasn't that diligent, considerig that what we have is a straightforward case, one divorce and one annullment but we have the legal documents, no convictions, no need for waivers, no extra work. Not to put blame on the atty, but that's what he was hired for, to check even t-crosses and i-dots, and prevent RFE's.

I posted here to find answers. This is a very good site indeed, got more help here than I could find in the researches I have done since we started the process, although I must say you have to have a strong tummy for not-so-encouraging remarks and the confidence of a circus elephant. (I don't know why I said that :huh: )

We're thinking a request for name change in the passport would be the most logical way (to take about 6 weeks more or less??). Or maybe there's a quicker way to do it, like a document from the DoS that he is the one and the same person, and that an error was made in the issuance of the passport (albeit inadvertently)???

I'm wondering if somebody here had that same issue with their petition. Your comment/advice will be most helpful.

I think Manila does things differently. They don't send a packet 3. They just scedule your interview and medical then send a packet 4. Packet 4 has all the immagration forms that are needed at the interview. Please, someone correct me if I am wrong here.

i had my medical today...it will take 2 days...first day..physical exam, vital sign, blood and urine test, xray, if u dont have any problem, the next day u will have your immuninization...u have to bring passport...goodluck

Both my fiance and I are single (i.e. never married before). The FAQ from this website (visaJourney) does not list "Certificate of being single" as a required item for K1 petition. However, I read somewhere else online, indicating that at least my fiance needs to get a notorized certificate of being single.

Can someone who has already filed I-129F tell me if this is required? If it is required, do I need it as well? If so, where can I get it? Thanks!

depends on the beneficiary country. in the Philippines, the US Embassy in Manila requires a CENOMAR (Certificate of No Marriage) which can be acquired from the National Statistics Office. From where is your fiancee? would be better if you could add more information to your profile so we can address your questions properly. ;)

hi. we just sent our petition a month ago. I thought all was well and good until my fiance asked me how many passport photos we sent for each of us. I actually do not remember! (I am forgetful sometimes >_<) I asked him why. he said he read cases of denial because they only sent one of each (beneficiary and petitioner). so being the nervous me, I searched the Internet for that and everything I read said one passport photo for the beneficiary and for the petitioner. not contented, I searched the forums of VJ. I came across one thread that asked that. and the answers were kinda confusing. some said two, others said one. so now I am very confused. is it really one photo of each or two? please help! we are now very nervous and worried to be denied because of such a simple and stupid mistake as the number of passport photo to be submitted. I know you all understand how the waiting SUCKS. sad.gif thanks in advance!
