Im posting for my co-worker who met a filipina whose husband died 5 yrs ago, hence she is a widow. She has NSO issued death certificate. She also has NSO copy of their marriage certificate. Therein lies the problem. On the marriage certificate it shows the man's year of birth as 1946. But on the death certificate it shows 1956. Will the US embassy require both marriage and death certificate, and since the man's year of birth are not the same what issues/problems will be encountered down the line. I really don't have any definitive answer to this dilemma. Thanks for any input.


She can have the date on the DC corrected at the Local Civil Registrar where it was issued.

my child is illegitimate and no father on her BC, but she bears my middle name and surname..
question: Does the DFA only follows the details on the birth certificate even though it has the mother's middle name? Yes, they will follow the name on the NSO birth certificate. What if they dont and should be no middle name? An illegitimate child can bear his/her mother's middle and last names. It is also acceptable if the illegitimate child doesn't have a middle name but only his/her mother's last name. Both situations are acceptable and recognized by DFA. What should i do? Im so bothered.. Anybody help..

DFA will put whatever is the child's name on his/her NSO BC on to his/her passport.

It's very common for illegitimate children to bear their mother's names. They can have the mother's middle name and surname OR they can have only their mother's surname, no middle name.

Yeah you can stay forever if dual citizen. US citizens who are former Filipino citizens get Balikbayan visa anyway that is good for a year. So about the only reason to be a dual citizen,if your moving there to live, or if you want to buy real property, or work there. You can enter the country on a US passport, or Filipino passport don't make any difference, just need to show that you are a Filipino citizen went you enter, and stay as long as you want too! No visa needed.

The child is also a Philippines citizen by virtue of being your child, even though the child was born in the U.S. You can get her a Philippines passport as well. She is a DUAL citizen. I know this for a fact.

PDOS takes only a few hours to complete. She can check the available schedules on the link. I doubt immigration will let her leave the Philippines without the CFO sticker on her passport. It's a requisite for all Filipino immigrants (not just fiancees or spouses of foreigners).

My husband arrived March 2, 2012 (Friday) and we immediately proceeded to the Local Civil Registry (LCR) to apply for marriage license. We planned for a church wedding, so before his arrival, I already have original copies of our NSO birth certificates, CENOMAR, baptismal and confirmation certificates.

March 15, 2012 we received our marriage license. We did the required seminar in between March 2 and March 15. Your marriage license won't be released if you don't attend the seminar. For civil weddings, you only have to attend a one-day seminar.

We were married March 21. Since we want to immediately register our MC, we personally took it to the LCR on March 23. We applied for ADVANCE ENDORSEMENT so we won't have to wait 6 months to get the NSO copy of our MC. According to our more experienced members, you can submit the LCR copy of your MC to USCIS when filing i-130.

My hubby went back to the US on March 25.

May 14 we received our NSO MC. Sent it via UPS to my hubby so he can file my i-130.

My husband was here for 24 days and we were able to comply with all the wedding requirements (without red tape!). :thumbs:

There's no need to make an appointment at St Luke's. They are on a first come, first served basis.

Tell your husband to make an INFOPASS appointment with USCIS. He should bring original NSO copies of your marriage certificate and your birth certificate. Also a photocopy of your passport as proof of your correct date of birth.

Yes we only pay for the LBC courier fee. It varies depending on your LCR's location.

If she was instructed to do so, then your wife should be able to get a copy right away, provided that NSO already recorded the child's birth.

Ask her if she filed for Advance Endorsement, if she did, then you have no worries.

When a child is born at a hospital, after the mother/parent fills up the BC and the attending physician signs it, the hospital staff forwards the BC to the LCR of their area/municipality/city. The LCR stamps the BC and then forwards it to the NSO. The time between the LCR forwards it to NSO and NSO recording the birth takes 6 MONTHS. That's why I said that it will normally take 6 months before you can get your child's NSO BC.

Now, is there a way to speed up the process because you don't want to wait 6 months? Yes, you should file ADVANCE ENDORSEMENT of the child's BC at the LCR. That's what I did with my marriage certificate. I got my NSO MC in 2 months instead of the usual 6 months.

Can you still apply for Advance Endorsement now? Tell your wife to speak directly with an LCR officer if they can do something to speed up the NSO BC since you need it for CRBA.

The "online" thing you're referring to is the ordering of the NSO BC, right? If a person's BC is already registered at NSO and an NSO copy is already available, it will only take a few days to get/order a copy. This is helpful if, for example, you will get a copy of your child's BC 6 months AFTER the baby was born.

My wife lives in the Philippines, i live in America, recently her cr1 visa was approved:) they said all of her papers were good and they took her passport, early next month my wife and my 2 month old daughter will have a certificate of birth abroad appointment. My wife has all the documents needed for that appointment but im fairly sure she needs her passport for our daughters appointment but as i said b4 they took it. Also our daughter was already scheduled for a certificate of birth abroad appointment b4 but she was to young to have the NSO birth certificate she needed, she only had the one issued by the LCR(i believe thats the correct abbreviation. So they told her to make a new appointment and to come back when our baby is 3 months old and has received the NSO birth certificate. She was also planning to get her cfo stamp on her trip to manila for our daughter, how can she get that with no passport. So i have some questions. P.S. She lives at the bottom of the Philippines and i sent her to manila for the interview and i will send her back again for our daughters appointment. Also she has already attended the seminar and just needs to get the registering stamp in her passport.

1. How long does will it take for my wife to get her visa/passport by mail(she lives at the bottom of the Philippines)?
Personally, I would give it 10-15 working days.

2.What if shes back in manila for our daughters appointment when her passport arrives at her house, will they give it to her brother that lives there?
Before she leaves for Manila, she should write an authorization letter for her brother and leave a photocopy of her valid ID. The brother should have a valid ID too.

3. How can she get her CFO stamp without her passport?(she has already attended the seminar and just needs to get the registering stamp in her passport)?
When she receives her passport with visa, she should return to CFO to get the stamp.

4. The 2nd my daughter turns 3 months old can she get her NSO birth certificate that day or is it going to take like a week or something?
Did you apply for ADVANCE ENDORSEMENT of her NSO BC? If not, the normal processing of NSO BC takes 6 MONTHS. Check with your LCR if something can be made to speed things up.

5. Lastly, me and my wife were already married when she got pregnant with our daughter and we have all the required documentation asked for in regards to the certificate of birth abroad appointment, plus she now has been approved for her CR1 visa, will it be a problem if she goes alone to that appointment alone because i cannot leave work right now to attend said appointment with her?

I did have the interview for my wife and my son and the interview went well. The interview was both good and bad. The good part was that my wife's Visa's been approved. My son's Visa was also "approved" pending submission of a couple of documents, both of which are very time consuming to obtain. But at least, the Visa for my son was not "denied", and I am optimistic that I would be able to obtain the necessary paper works within the six months allocated for my wife's visa to be travel-completed.

I don't see the need for any letter if the parent, in your case it's only your fiancee, is the one who will receive her child's passport with visa.

If another person will receive the passport, your fiancee will have to make an authorization letter for that person with attached photocopy of your fiancee's valid ID and that person must present his/her own valid ID too.

That is just the approval time at USCIS. Time for them to approve your i-130 form, NOT THE VISA.

The entire process for (F2B) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents for Philippines will take 10 YEARS.

The entire process for (F1) Unmarried Sons and Daughters (21 years of age or older) of U.S. Citizens for Philippines will take 15 YEARS.

Entire process means time from filing the petition up to visa issuance.

Daughter should maintain her unmarried/single status for the entire duration of the petition, if not, she will be transferred to another category with a much longer waiting period.

If you married in the Philippines, file for ANNULMENT of Marriage.

If you married in the US and you filed a Consular Report of Marriage Contracted Abroad at the Philippine Consulate, file for DIVORCE. I'm not sure if filing for annulment should also be done since there's no divorce in the Philippines. (Someone kindly correct me here).

Not sure if this applies to us cause I surely won't be having my PE in Manila. Hmm... But it's good to know a new passport with the married name is easily accepted.
