Hi Vjers! My husband got approved last April 18 on his interview. We are still waiting for the visa to arrive at home. My question is, when is the right time to pay the $165 fee? :) Thank you and God Bless!


Pay it as soon as he receives the visa and visa packet. You, the petitioner will pay for it online. Instructions are included in the packet. It must be settled BEFORE hubby flies to the US.

International terminal fee at NAIA is 550 pesos. Travel tax is 1,620 pesos (check if travel tax is already included in his air fare, if not it should be paid at the airport).

If petition for the spouse (her parent) happens after 2.5 years and she turns 21, she'll probably be moved to another category which is the F2B category (Unmarried Son/Daughter Over 21 of Lawful Permanent Residents). Waiting time for F2B Philippines is 10-11 YEARS and she must remain unmarried during the entire process until she receives her green card. Marriage of the Son/Daughter will void F2A and F2B categories.

They cannot immigrate at the same time because "dependents" are not allowed in the IR categories.

Your parents can immigrate quickly (less than a year) but not your siblings. If you petition for your siblings, it will take 24 YEARS before they can immigrate.

Penguin's advice is correct. Petition for one parent, while the other one stays behind to take care of the kids. Once parent receives green card, he/she can file i-130 for spouse. The kids become the "dependents" of that petition. They will all immigrate in 2 and a half YEARS.

Don't pursue the medical and interview anymore. That will stop the process. But if you change your mind later, you'll probably have to re-file everything again and pay a new fee.

Yes, bring original CEMAR. Get a new one from NSO. You need to fill out the application for CENOMAR but since you're already married, they will give you the CEMAR (Advisory on Marriages).

Get a new NBI clearance too.

These docs are to be submitted to NVC together with your DS-230 form.

The medical normally takes 2 days. Everything including the vaccines are already covered in the medical fee.

The embassy doesn't really care if you were AWOL with your most recent job, unless that employer filed a criminal case against you.  Otherwise, as long as you have a clean NBI clearance, you'll be fine.

Just returned from Cebu on Apr 5, we didn't think that my asawa needed to pay the travel tax when we were heading off to the security check point after receiving boarding passes at check-in and was detained at the passport check desk. We were diverted back to the Travel Tax counter to obtain the travel tax waiver, which cost 200 php. We were in Phils for 3 weeks. Can't recall if this happened in Manila back in 2010.

The other half (personal copy) is okay and will be accepted during her interview as long as its valid (not expired).  NBI clearance is valid within 1 YEAR of issuance.

There is a cutting line in the middle of the certificate. One is for the applicant's copy and the other is the copy you hand-out during the interview. Make sure it still attached. The embassy will be the one who'll detach it. smile.png

 

No they don't.  Most people submit the other half during the NVC process and the "personal copy" they bring with them on the interview.  As long as the NBI clearance is still VALID (not expired), no issues there.  My husband handed over a "detached" NBI clearance to the embassy pre-screener and had no problems with it.

That copy, she can keep.  Tell her to get another one from the Local Civil Registry.  The next copy she'll get will have a stamp that says "Certified True Xerox Copy of the Original" and it will have the stamped seal of the LCR.  The REGISTRY NO. part (the one on top of your wife's name) should not be blank.  There should be a YEAR and some numbers there.

Before, anyone can get a cedula without presenting any kind of ID card.

Nowadays (at least here in Las Pinas City), you need to present a valid ID before they will issue a cedula.

If both of your fiancee's parents are without birth certificates, maybe the parents' next of kin can act as her guardian who can sign the parental advice form. An uncle or aunt maybe? Of course they should have a valid ID as well. They should all together go to the LCR in case the LCR officer asks why the parent cannot sign the form.

I don't know if others have done this. This is just my suggestion.

If your parents are already USC, they can file i-130 for their married daughter.  She will be under the F3 category (Married Sons and Daughters of U.S. Citizens).  Waiting time is 21 YEARS.

 

If you file i-130 for your sister, she will be under the F4 category (Brothers and Sisters of Adult U.S. Citizens).  Waiting time is 24 YEARS.

Just to clear things a little bit. You don't "petition" for someone to get a tourist visa. The term "petition" is most commonly heard from people who have filed for their family members to immigrate and live permanently in the US, not for "just visiting" purposes.

If your sister intends to VISIT the US, she must apply for a tourist visa known as the B2 visa. She must qualify based on her own merits. The "invitation letter" from your mother means nothing to the consul officer. She will need to provide STRONG TIES to the Philippines by showing that she has a stable and high earning job, a business, properties under her name (car, land, house, condo, stocks/bonds) and her own money/bank savings.

This may not be an issue at all, since she is 25 she may not need the parental advice.  The wording of this rule states "between" 21-25 rather than "from" 21-25. And we know that 21 requires consent rather than advice, so "between" can be taken literally.

 

Yeah but just to be 100% sure that she won't encounter problems with CFO, have the document with her.

 

Once she's in the Philippines, she should bring the notarized parental advice form to DFA to have it authenticated before presenting it to CFO.

My fiancee lives in Bangkok now but will be returning to Manila after we get the NOA2 to complete the process and interview there.

She's 25 so she will need the parental advice form completed. It won't be a problem for her mother to fill it out and sign it.

But, her parents also live in Bangkok, they won't be in the Philippines when she is back there.

My question is, will my fiancee be able to have the document notarized with a COPY of her mother's ID rather than the original?  Obviously, she won't be able to take her mom's original ID from Thailand to the Philippines, as her mom needs to keep it!

That's a good point and yes we did ammend her passport to her married name 18 years ago. We had to go to the CFO then too and my wife remembers the certificat she got there. Unfortunatley we don't have it anymore or the passport with the maiden name that would of had the sticker. My wife will go there on Monday to talk to them about it.

We talked to the Philippine Consulate in Hong Kong. They said if you report your marriage today you can get the Report of Marriage the next day.

Go to Hongkong and do the Report of Marriage thingy, then fly directly to the US. HK airport officials won't be looking for your CFO sticker.

You can have your NSO marriage certificate mailed to you by a relative if and when it's already available at NSO.
