Good day to you all,

My Question is in regards to some threads I've come across now that I'm focusing on the interview at the Manila Embassy.

I have read here and there that the USE in Manila will require documents to undergo a document verification at the NSO and that it's wise to have this done or paid for prior to going to the interview? Can someone with recent experience involving a case from the Philippines enlighten me on this?

You can get a certified true copy of your Marriage Certificate at the Local Civil Registry. That copy you can send in together with your i-130.

Did you apply for Advance Endorsement of your MC? If you did, you will get the NSO copy (printed in NSO Security Paper) within 1-3 months. I got ours in 2 months.

If you didn't apply for AE, you'll get the NSO MC after 6 months.

If wife is changing her last name on her passport, she needs to have the NSO MC because that's a requirement at the DFA.

Just get a copy of your NSO marriage certificate. That's the official document that will be accepted at the NVC stage up to the Embassy interview. No need to get it certified as it is already issued by NSO and printed in their security paper.

HI Hank. She has not lived outside of the Philippines. I ask because I've seen other VJ members have got RFE's because they didn't send in a police clearance along with their NBI. So you're saying she only needs the NBI to send in with the ds230?


She would only need to submit an NBI clearance (the GREEN one) with her DS-230 along with the other required civil documents.

I'll make an example.

Name on birth certificate (maiden name):

First Name: Maria Anna
Middle Name: Reyes
Last Name: Santos

Husband's First Name: John
Husband's Last Name: Smith

If you want to use your married name on the NBI clearance, your name on the NBI clearance will appear as:
SANTOS de SMITH, MARIA ANNA y REYES

Full maiden name + husband's last name will BOTH appear on the clearance.

AKA will be needed if there were corrections on your name (corrections were made on your BC) and if you used your ex-husband's surname (from previous marriages).

If you want your NBI with married name: your full maiden name + husband's last name will appear on your NBI clearance so no need to get a separate one with AKA. You will see a "DE" and "Y" on the clearance.

I changed my passport too right after I got our NSO marriage certificate. Before I went to DFA, I also got a new NBI clearance with my married name and it looks just like yours, with the "DE" and "Y".

The 550 pesos is TERMINAL FEE. It's paid per person.

TRAVEL TAX is 1,650 pesos per person too. Some airlines include the travel tax to their air fares so check with them so you don't have to pay twice.

Our children were 5, 6, and 7 when they immigrated last 2011. No major issues whatsoever. Of course their first 2 weeks in school were the adjustment period, they were a little bit shy and apprehensive but after that everything went smoothly.

Just after a couple of months they were already speaking "slang" English. :rofl: I can't keep up myself.

Don't worry, children adapt faster than (us) adults just as long as you encourage and understand them. They'll adjust in their own pace. :thumbs:

A little background though. Our children went to private schools here in the Philippines so they have above-average English language skills but at home (and everywhere else) we speak fully in Tagalog. I never encouraged them to be "English speaking" because I know they will immigrate at a very young age so they'll adapt English easily and most specially I don't want them to "forget" our native language.

Philippines6 month wait for marriage certificate?
Normal processing for newly married couples to get their NSO marriage certificate is 6 MONTHS. That's how long it will take NSO head office to put your marriage in their archives. Same with newly filed birth certificates.

The copy from the Local Civil Registry is different because that is not printed on NSO security paper. The MC printed on NSO security paper (SECPA) is the official marriage certificate and the one used in the NVC stage, embassy interview and even at the DFA (for married women wanting to use their married name).

I was able to get our NSO MC fast because I applied for ADVANCE ENDORSEMENT at the Local Civil Registry (LCR) when we submitted our marriage certificate immediately after getting married. Instead of waiting 6 MONTHS, we got the NSO MC in 2 MONTHS. Refer to my signature.

I don't see an issue. She already completed the seminar. Once lady receives her visa (it is attached inside her passport), she can go back to CFO and get the sticker.

She will need to bring in the following marked in red:

Requirements for Registration:

Original and photocopy of Passport;
Original and photocopy of visa
Original and photocopy of Immigrant Data Summary for US-bound emigrants
(except for K visa holders);
Original and photocopy of Confirmation of Permanent Residence for Canada-bound emigrants;
Original and photocopy of Certification of Eligibility for Japan-bound emigrants;
Original CFO guidance and counseling certificate;
Duly completed emigrant registration form; and
Payment of the authorized registration fee.

I see no value in bringing receipts to the interview... doesn't prove a genuine relationship. Scammers collect money from "suckers" all the time.

Pictures together, chat log, emails, call logs that is better. And of course, his fiancée knowing him well.


It might not matter on K1 but it has bearing on spousal petitions like IR/CR and F2A.

It is evidence used for showing "co-mingling of financial resources" provided that the names of the petitioner (sender) and beneficiary (receiver) are both reflected on the remittance slips/receipts.

Joan and I were talking about her leaving her full time job. Her English is good and she speaks a little Japanese. We will live in Waikiki, Hawaii so there is a good opportunity for her to get a better job if she knew more of these languages in addition to her native Tagalog. We were thinking that it would be beneficial if she picked up a part time job (or even no job) and spent her time studying the languages. I mentioned this to a co-worker who wondered if there would be a concern or problem at the interview if Joan was not employed or employed full time. Does anyone have any thoughts on this?


Beneficiary's (Joan) work status or employment history doesn't matter to the consul. If she never worked in her life, it's okay too.

What matters is the petitioner's (you) current employment status because you're the one who's going to financially support Joan.

You don't have to buy land for her.

For evidence of bonafide marriage, you can present these:

- NSO marriage certificate
- Wedding photos
- Pictures of the petitioner and beneficiary together: on different places/occasions, with family and friends
- Remittance slips/receipts showing the petitioner's (sender) and beneficiary's (receiver) names
- Birth certificates of children of the petitioner AND the beneficiary (if applicable)
- Email, Skype, Facebook, Viber, WhatsApp, BBM, iMessage, SMS printouts
- Skype video call screenshots are also useful
- Skype video call logs
- Letters, greeting cards

Just spoke with my girl,

She is at the records office getting latest NSO Birth Certs, and applying for the kids passports with these new docs. Then she will send me the oldest boys new NOS BC with the name change. I can then change this with USCIS according to my call this morning to USCIS.

Better to have this cleared up now.


Yes, the quicker you get the boys' annotated NSO BC, the better. Send it ASAP to USCIS.

I keep asking how this can happen without her signature but she states in local Zamboanga office they WILL accept the name change request from a Father that is noted on the Birth certificate even though he is not the custodial parent. So different than in the USA.. So Different!!

After I spoke with USCIS It seems this will not be an issue but I still wonder how this is possible in Phil? I will tell her your advice now.

Looking deep into RA 9255, it seems the FATHER can execute the name change, even without mom's consent.

Rule 3. Who may file

Under these rules, the father, mother, child if of age, or the guardian, may file the public document or Affidavit to Use the Surname of the Father (AUSF) in order for the child to use the surname of the father.

The fact that the children are illegitimate makes mom the sole custodian. So even if the name change is successful, mom can still bring them to the US.

Mother should immediately go to the LCR, track and verify the documents. The LCR keeps a copy of the Affidavit that dad executed, if he really executed such. She can stop the process by saying that dad falsified her signature and she did not consent the name change. If the documents were already forwarded to NSO, then she can directly go there.

Pay it as soon as he receives the visa and visa packet. You, the petitioner will pay for it online. Instructions are included in the packet. It must be settled BEFORE hubby flies to the US.

International terminal fee at NAIA is 550 pesos. Travel tax is 1,620 pesos (check if travel tax is already included in his air fare, if not it should be paid at the airport).
