Original NSO documents (like CENOMAR, Birth Cert, Marriage Cert, Death Cert) don't need to be authenticated (red ribbon).  USCIS, NVC and US Embassy Manila will accept them as they are because they are already printed in NSO security paper (SECPA).

Have the BC corrected first (at the Local Civil Registry, where her birth was recorded).  After she gets the annotated NSO BC then she can proceed with renewing her passport into her married name.  She would need to present the NSO marriage certificate to do the name change.

Actually, before, bringing the old/expired NBI clearance can actually help speed up the "renewal" process.

 

But now, things have changed, there's no more "renewal", each time you get an NBI clearance, it will be considered a new application, which will be subjected to a verification process.  Once your name got a "hit", every time you get a clearance that "hit" will come up, making it impossible to get the clearance right away.

 

The process sucks, but no way around it.

For all of your Philippine addresses, you will only need an NBI clearance.

In most cases, if all the documents requested by the consul during the interview are handed over and of course all questions are answered accurately, then approval will be given outright.

 

If additional documents are required, she will be given a 221g form.  If subject for administrative review, 221g will also be given.  Prompt submission of additional documents is a must as visa will not be issued unless you comply with whatever paperwork they want.

Actually, there's really no "guardianship papers" in the Philippines.  Usually, the grandparents or the uncles/aunts sort of automatically becomes the "guardian" when their grandkids/nephews/nieces become orphans.

 

Whoever is looking after and taking care of them is their guardian.

Do the "ceremony" after the k1 visa has been issued and on-hand, to be at the safe side.

 

Do not sign any papers in relation to that "ceremony".  Keep in mind that "ceremony" is only for show and NOT LEGALLY binding in any way, whatsoever. Make that clear to the parents and everyone who will show up.

Thanks for you suggestion, it gives light to my situation. I still don't have my passport, because I don't know what POB should I use. 

 

When you apply for a passport, DFA will follow the POB written on your NSO BC.

 

You should get a passport ASAP to avoid delay in the NVC stage.

When it's time to submit the DS-230 form, include a letter of explanation regarding the discrepancy on the Place of Birth.  You will submit your original NSO birth certificate as proof together with other civil documents like CENOMAR, NBI clearance, photocopy of passport bio page etc..

 

On your passport, what place of birth is written?  POB on your NSO BC should match POB on your passport.

I am currently processing my documentation for my US VISA.  When I tried to get my Birth Certificate from the NSO it says that I was born in Manila.  In my US VISA Application it was stated there that I was born in Ormoc City.  How will this affect my VISA applciation and how can I correct this one.

     The problem.  My wife thought she had the annulement, we did the paperwork, and got a married by a judge in the philippines.  We filed the paper work, and thought we were good.  We now started to get the visa ball rolling.  She went to the CFO and got a certificate from Cebu, but they questioned her divorce.  She went to NSO in Davao to get a new passport and name change on passport, and they said it shows she now has 2 husbands and the annulement never happened, and how did she remarry.  She went to city hall and found out they didn't send the paper work before to manila, and are saying there are now new rules.

 

     They are now saying once again she needs to get her exhusband, who is japanese and has no interest in helping us, to sign a paper, and also get the paper work from city hall in japan again.  Which according to our informantion requires the exhusband to help her get and he won't.

 

     1.  She has a cfo certificate with her married name to me on it, not her married name to her exhusband and her current passport.  She can't get the stamp with that from what I understand.  (thought about trying the fiance visa)

 

Does anybody have any solutions.  The keep saying the only hope is having her exhusband sign the new paper and get the divorce paper work again in cityhall.  I don't know what the new rules are, but can she try to use the family code or whatever it is called.  I was reading if she has a child by another man(me) there is grounds for annulement.  Is that feasible.  Can she just do the visa in another country at an Embassy there.  Or is there any way to just sneak her out of the philippines with the fiance visa and just have her fly here from another country(Hong Kong).

 

If the annulment "never happened" it means your marriage is invalid.  She won't be granted a spouse visa (IR/CR) if she can't present the proper annulment papers to USCIS, NVC and the US Embassy Manila.  CFO is not the only bump along your road.

US tourist visa holders are not required to attend PDOS.  It is only for immigrant visa and K1/K2 holders.

All intending immigrants to the USA (including K1/K2) are required to register and attend the Pre-Departure Orientation Seminar (PDOS) at the Commission on Filipinos Overseas (CFO).  There is a reminder included in the visa packet.

 

CFO will put a sticker on your mom's passport as proof that she is registered at CFO.  If your mom is 60 years old and above, she's exempted from attending the seminar but she is required to register in order to get the sticker.  If she's below 60 years old, she's required to register and attend the seminar, unless she's incapacitated or mentally challenged.

Flat-out denied? or were they asked to submit additional documents?

 

If I were you, I would concentrate on my own case and do the preparation for bonafide relationship ahead of time so I wouldn't cram before the actual interview day.

 

Each case is different.  The consul will assess your case based on the evidences that you submitted and the circumstances of your relationship.

 

Stop listening to the "rumors", IMO.

Hello. I already obtained 1 copy of NBI clearance, do I still need to obtain a Police Clearance from our municipality? How many months is the validity of PC? Spousal petition has just been approved the other day, I'm wondering to obtain it next week.


Police Clearance is only needed if you worked or lived in a foreign country for 12 months or more. You will need PC from that foreign country.

If you never lived/worked outside the Philippines, you will only need to submit the GREEN NBI Clearance.

That's not a simple typo error that can be brushed off.  Make sure your fiancee fixes it before she leaves for the US.  She cannot claim "her" child on K2 if she's not listed as the mother on the BC.
