The JOINT SPONSOR will also fill out an i864.

I know this topic has been addressed elsewhere, but I'm having a hard time finding solid information.

 

 

My fiance (the beneficiary) has recently moved apartments. We are still waiting for our NOA2.

 

Should I call USCIS now and change his address with them, or should we wait for NOA2, and if so, who do I contact and when?

The NOA2 will be mailed to the US address of the petitioner.

 

The beneficiary can update change of address at NVC or the Embassy.

She can still attend her interview as scheduled, but expect delay on visa issuance until she submits the new passport.

If we were you, we would get the new passport (remember your old one is still valid until issue of new passport).

 

When you apply for a new passport, DFA will punch holes on your existing passport making it invalid.  The US Embassy will not accept a passport with holes but given the situation, they will most likely issue a 221g for the new passport.

 

To babydoll6218:  Apply for a new passport, attend your interview and explain why you have an invalid passport, expect a 221g then send the new passport ASAP.  You can also re-schedule.  Its up to you.  Good luck.

I believe you can get that done prior. Keep in mind there are vaccines that are needed every few months. Like the flu needs to be yearly. Hmmm maybe that's just it. Just make sure records are brought during the medical for the visa.

That's what i'm planning to do since i pretty much have all my vaccines done.

Our relationship prior to getting married was a long distance one. We were in two different countries, mainly communicating through emails and skype, and meeting each other halfway in different Asian countries. Before we got married, we have been in 5 countries together but have never shared the same mailing address. We had a ton of airline itineraries, hotel receipts and visa stamps to show we were in the same country together.

But, if you were the USCIS personnel looking over these files, wouldn't it confuse you? I helped my husband make the EOR letter so that it can assist the person looking over our petition package. Ours was inspired by this draft letter which I got off visajourney, too. I think this was Darnell's:

On Dec 29th, 2006, I went to China for a month, spending time with her and her family (see Reference 4,5,6,7 and 8). We had an engagement party on Jan 17th, 2007 (See Reference 9). We travelled to Chengdu to visit her mother's family, from Jan 19 to Jan 27 (see Reference 10).

I returned to Texas on Jan 29th, and returned to China on March 11th, 2007, staying with my wife for 4 months (see Reference 10). We travelled together around Wuhan, two trips to Chengdu, a trip to BeiJing (see Reference 11, 12, 13 and 14).

So, the idea is you can use the letter as a guide to make the USCIS people understand what all those paperwork you sent in are for. Can you call and ask them if it is possible for you to respond to the RFE through an email? Snce you have already sent in the needed paperwork, you just want to send in this letter to make them understand everything else.

If they say yes to sending an email response to the RFE, best to scan all the paperwork (train logs, tickets, hotel receipts etc) and include it with your email.

We got the 2nd RFE requiring three things:

1. Signed statement of how we met, in detail and under what circumstances -- We just put "we met on ICQ" initially, now they want an elaboration.

2. Alien fiancee's divorce decree -- we attached my Annullment Decree in the original submission, yet they asked again. Oh well. So we are sending it again, and also a copy of the Annotated Marriage Contract. This is the requirement of the US Embassy in Manila, might as well furnish USCIS a copy.

3. Birth Certificates of all fiancee's children -- Of my three children, only my youngest, my daughter, is eligible for K2, and we already atached her birth certificate in the initial submission (per lawyer's instructions). Now they are asking for the birth certificates of my two sons who are above 21 and not elegible for K2 anyhow. The lawyer said we need not submit the boys' birth certificates, as it seems like a mistake by USCIS. So we decided to send the birth certificates anyways.

The USCIS website said they sent 2nd RFE on 16 September, we just got it today.

Oh, and while waiting our heads off wondering what that 2nd RFE would be for, we were kind of convinced it was for the discrepancy in the name of my fiance (the USC), considering the importance of name checks. The Passport Office made a mistake in putting a "Jr" on his passport, which shouldn't be. As it turned out, we werent' RFE'd for that.

The "paper work" took me, less then 20 minutes to fill out the DS 2029 Consular Report of Birth Abroad (CRBA) and the DS 11 Application for US Passport they are only single page forms. Going over the CRBA checklist for supporting documentation 5 minutes. Gathering documents less then 1 hour. The time waiting and interview at USEM was about two hours, "weeks or months of paper work" rubbish I did the whole process in less then a day.


It will take time to acquire a copy the baby's NSO birth certificate because from the hospital it will be first turned over to the Local Civil Registry of the municipality where the baby is born then passed on to the National Statistics Office Head Office at Quezon City.

The Embassy process may have been quick but gathering ALL the CRBA requirements will take time.

If she gets pregnant and gives birth here in the Philippines, it will cost additional weeks or months of paper work for you, since you would have to file CRBA for the baby in order for the child to claim US citizenship and a US passport.

In my opinion, you can do the filing for yourselves but (if possible) postpone the baby until she's already in the US.

is she thinking about the old address that she used on the passport application form? if yes, she doesn't need to go to DFA and change it. it's only for record/delivery purpose and have no impact on the passport itself.
