The principal request is that you live in Brazil for at least 6 months, but it's been already 11 years so you should have no problems related to DCF.

You can also write an email to immigrationrio@state.gov and ask whatever you want, they take a few days to answer but they have given me all the answers I needed so far.

DCF means you can file the I-130 in Rio instead of Chicago Lockbox and it generally takes less time than the normal processing time. Good luck!!!

Yes, I did the same, I didn't have joint bank accounts or property, so we sent what we had here, and of course it included many pictures. I printed off the most important ones at the mall close to my house, they were in a normal size (I think it's 15x21 cm), then I got sheets of paper and glued them in the order of the events, I read once that it was important that all the pictures would have dates, but mine didn't and it didn't affect me. So after that I stapled the sheets in the file. And by the way if people that have been sending additional information along with the I-130 such as proofs of a bona fide marriage, and they have been getting approved in USCIS and at the interviews, it doesn't hurt to do so! Yeah I saw just now that India is not into the EP, that's why I said WATCH IF...

Anyways, after one week of your NOA2 date, you can either call them and ask them for the case # and give them her email to be input into their system or she can write them an email (following the samples, she will write her USCIS receipt number, assuming she does not have a case # yet, her full name and her date of birth in the subject line) take a look at this guideline:

So she will receive an automated message from NVC and you can give it a few days and start calling to check if her case was input and she can have a case #, it took me 5 days to get mine after they receive my files from USCIS.

BTW, you need to call NVC after one week of your NOA2 and try to get a case #, after that wait till your spouse receives a DS-3032 through email so she can send an electronic choice of agent through email to NVC. I have been experiencing a bit of delay in my son's case due to an email I sent right after mine and my daughter to them, chosing my husband as our agent, I wasn't supposed to do that to my son because I haven't received his DS-3032 via email yet. So tell her to send the electronic choice of agent just after her DS-3032 is generated in their system.

Just call up NVC and inquire about this. They might have thought that your children are also the children of your husband, in which case it would be an IR-2 visa. But if they're not biologically his, then I believe it should be a CR-2 visa.

I am currently at NVC and when I received the emails from them with the case #s (it's me plus my two kids going throug the I-130), mine was at the CR-1 category, because I haven't been married for over 2 years, but theirs, both of them are on IR-2. I thought they should be on CR-2, right? They are 8 and 5 years old.

Could it be that NVC made a mistake with it? If so, will this delay our approval? :help:

The documents don't need to be translated by a government agency. I did the translations for my husband's documents as I am fluent in Spanish and English and then signed and attached the affirmation statement. As long as the person is competent to translate between the two languages, it is okay. Good luck and congrats and starting the process soon!

If any of your documents are not in English, you will need to include a translation. Anybody can do the translation.
The person doing the translation must sign their name at the bottom of the translation and state the following:
"I certify that I am competent to translate (put foreign language name here) to English, and that this is a complete and correct translation".

Not necessarily, an I-130 can be sent from overseas to a lockbox facility by a USC regardless if the USC is living abraod or visiting their spouse. If the USC spouse was visiting, then their petition would likely not end up in the "fast track" queue for USC spouses who live abroad and DCF is not available.



There is no USCIS field office in Chile so DCF is not an option there.

Yes, you could FILE the I-130. He could try to enter on his tourist visa, and he would have to tell the truth when the costumers ask him "What he plans on doing in America?", he would have to say "Visit my gf or marry my fiancee", like I told you before, they might or might not let him in. IF he enters, you can marry him in America and file the I-130 while he's still there with you, but you won't be able to adjust his status (that would be considered fraud), he will have to watch the date the costumers said his tourist visa would expire, and you both would have to make sure HE WON'T OVERSTAY. That being said, he will have to go back to Chile before his tourist visa expiration date and wait for the process to be complete there, he will have to undergo and medical examination and interview there, and if he gets approved, he will be able to return to America and live with you as a permanent resident.

You only could file the I-130 from Chile if you were living there with him, and I am not sure if DCF is available in Chile. You would have to be living there for the past 6 months at least to DCF your case.

Incorrect, the K3 officially remains on the books even though it is practically nonexistent in practice. USCIS will accept an I-129F that is filed to start the K3 process and pull the I-130 that was filed from its place in the queue and place it with the just filed I-129F. The petitions will be adjudicated by USCIS and if they are both approved, they will be sent to the NVC. It is the NVC that administratively closes the I-129F for K3 if they have an approved I-130 on station at the time they receive the I-129F. There is that rare occasion where an I-129F will arrive at the NVC ahead of the I-130, a scenario that results in the K3 process continuing.

With all of that being said, I will restate what I said earlier and that is to forget the K3 because it's practically unobtainable and it would cost time as a result of USCIS tying the I-130 and I-129F together.


Ok, yes you are right, my mistake! I tried to say the K3 is not a way she could chose, but ended up involving USCIS name. If she files a I-130 and right after files the I-129F, she will get both NOA1 and NOA2, which indicates it's still being processed. But the K3 was a way of getting spouses to America faster because until some time ago, the CR/IR visas took a long time. Currently the time for approval is close the same for both, so the K3 gets turned out to the CR/IR route, making it pointless to consider the K3 possibility.

First, once you start your visa journey, there’s no way how to make sure he’ll be with you by April 2013. We have an estimated timeframe but all cases are different. So what you could do is get some statistics of timelines from Chile with both K1 and CR1/IR1 visas and have an idea of the processing times. K3 is not being processed anymore in USCIS.
Related to the prices, immigrant visa fees will be reduced soon, I’m almost sure that by September they will be valid already. If you apply for a spousal visa and he gets approved, he’ll be able to work in America as soon as you receive his SSN and GC through mail in the address provided, but there’s a waiting for fiancée visas, you need to marry within 90 days of his entry and then apply again for AOS “Adjustment of Status”.
You can file a CR1/IR1 visa for him while he already has a tourist visa, it shouldn’t be a problem, but then related to visiting America while waiting for it to be approved varies a lot, some people are able to enter America, some might get denied, it’s up to the costumers to decide if he can enter the country or not, but what I can tell you for sure is “He has to tell the truth at POE (port of entry), always”, if he is caught lying, that will completely mess up with all your plans of a lifetime together. But I hope someone that has had this experience already can share with you this subject!
If he gets approved for a CR1/IR1 visa, he will be able to travel and visit his family in Chile, even if he’s a conditional resident, not sure about the K1…I would think that probably just after he adjust status, but again I hope the fiancée visa people give you their input about it.
And yes, your parents can be his co-sponsor! I hope you figure out everything you need, this journey is not easy, I have been waiting for my spousal visa and it hurts deeply to have to be apart from my husband for such a long time! Good luck! BTW, she can fill out her DS3032, sign, mail it to you, and you MAIL that to NVC. She can also mail that herself, the most important is that NVC receives it! The electronic choice of agent is easier though.

You can email NVC but it has a big chance to be rejected because she has to chose an agent, so untill NVC accepts her choice, your emails won't be of much use. I just wanted to make it clear!!!

Hi! I understand you don't wanna be far from your husband, it's very difficult, everybody goes through the same situation here, but there's no shortcut, you will have to file I-130 petition for him and it pertains to the spousal visa CR-1/IR-1. It has been taking 8-10 months lately for the whole process to be completed, you can look at the Morrocan timelines to have a closer idea of the time you have ahead of you.

You have to send the originals in the native language as well as the translations. That's the way it works. You'll get them back at the interview.

EXACTLY!!! Send the originals followed with a translation, anyone can do the translation, it doesn't need to be "sworn"

Just make sure the person translating will state the following:

"I certify that I am competent to translate (foreign language) to English and that this is a complete and correct translation."

Put the name of the person doing the translation and have him/her sign it.

Okay so this is what happened :


We had all our documents sent in and accepted on Monday. On Tuesday morning I woke up to an email from NVC with a checklist. Inside it said to send our civil documents (which I had done already) and this about our I-864


The NVC has received the information you have submitted in reference to
the Affidavit of Support. Please be advised that the Affidavit of Support
information you have provided does not appear to meet the minimum
income requirement according to the current poverty guidelines to sponsor
the intending immigrant(s) for this petition. The consular officer will make
a decision regarding this requirement at the time of your interview. In
order to avoid delays, you may wish to submit an additional Affidavit of
Support (Form I-864) for a/another Joint Sponsor to the National Visa
Center to assist in sponsoring the intending immigrants. To view the
current poverty guidelines, visit

If you decide to use a Joint Sponsor to assist in sponsoring the intending

As I said in an earlier post, my husband does make more than 125% of the poverty guidelines for 2 people by about $1000. Knowing this was low we sent in bank statements amounting to about 15k. So I was confused as to why this was the case and emailed them back. No response yesterday or this morning so I called them today and the operator told me that our case was complete. So what does this mean for our situation? Do we need to get a joint sponsor and just bring that paperwork to the interview? Or can we bring proof of other assets ie. vehicles & a motorcycle along with current bank statements that will show more in our savings. We're trying to get my husband's dad to co sponsor but he is really reluctant due to the legal obligations so we would really like to try and do this ourselves if possible. Is this possible?

Is it normal to pass through NVC without meeting the minimum guidelines?

BTW, just to give you the complete answer, when you receive your interview date, in the end of the letter they will tell you what documents they got and what you need to bring to your interview. So there you will know what you need to provide! :)

I have a question about the I-130. I am from the US and my wife is from Vietnam. I submitted the application in Aug. 2011 and it was received by Sept. 1, 2011.

My status has been on initial review the whole time until March 22, 2012 I got 2 email with the DS-1200. In that email was a pdf file with an invoice asking me to pay the AOS fee of $88. and it had a DS-3032 form in the pdf. My wife is in Vietnam. I forwarded the email to her and had to sign the DS-3032 form and send it to the address stated in the pdf. I also paid the fee of $88 already. It's been about 2 1/2 weeks since my wife mailed the form to the NVC. My status is still showing initial review.

How long does it usually take for the status to update? Also was my wife sending the form ok or was I suppose to send it? Can someone also tell me what is the next step in this process?

First of all, the I-130 is the beggining of the process, it's the first petition you have to file to start the spousal visa process. According to what you are saying, in USCIS website your status is still in "Initial Review", but you have received email from NVC with the AOS packet...

Ok, if that checks, you were approved in the USCIS, but they haven't updated their website yet. If you submitted an application for e-notification along with the I-130, you should have received emails and text messages in the phone you listed in the form with notification that your petition had been approved. If not, you only will receive a hardcopy in your mail with that notification. I suggest you to find out about that and fill in your timeline here, it will be easier for everybody to understand what's happening to you.

Now related to your other question, it's totally fine if your wife mailed them the DS-3032, most important is that NVC receives it. When they receive and accept it, the agent she has chosen in the form will receive the IV bill and you both will have to work in her IV packet, it basicly has the DS-230 parts I and II but both of you will have to provide more documents to be mailed along with the DS-230.

Keep in mind that according to what you said above, you are currently at the NVC stage, even if USCIS haven't updated your status in their website yet! I would find out about your second notification with approval from USCIS though, we call it here NOA2.

It's possible to go for a visit if you have a tourist visa, but you cannot just stay and adjust status based on marriage there because it will be considered visa fraud (entering on a tourist visa with the intend to stay). You can marry there while visiting, but you will have to come back to Canada and wait for the whole processing. You can't overstay your tourist visa, otherwise it will mess up with your plans!

CR1/IR1 visas will allow you to work as soon as you receive your SSC and conditional GC at the address provided (around two weeks), with K1 visas you will be able to work just after adjusting status "AOS"

I am just trying to get my head around the children of the my fiance who is in the process of her K-1 application. She has 3 children (16, 11, and 8). We will get the 16 year old her own passport which, when granted, her visa will be attached to. Should we also get the other under 16 year olds passports? Or do they travel with their birth certificates and use their K-2 visas for entry into the USA with their mother?

Do I fill out forms d230 for each one? I assume yes.
Do I fill out forms 156 for each one and include picture to it?

I do have two children, they are 8 and 5 years old, they are going through the process with me (they are my husband's stepchildren) and yes, they have passports! Their visa will be attached to their own passports, I even had to send to the NVC a copy of their passport's biographic data page. Each one will need a form too!

Now related to the form 156 I can't really tell you...sorry, my process is the CR-1, but I would think that yes they will need one for each of them too!
