hello,
you should apply for a tourist visa first and not overstay it.After u return to your country apply for a K1 because you cannot enter US while K1 is in process.


I thought you could still enter the US on a VWP while your K1 is going through, if you have proof of returning home

I've been reading about the Letter of Intent that the forgein fiance needs to fill out and the USC for the I-129F application.

But when I look at the "guides" I dont see anywhere that you need to send a Letter of Intent with the I-129F package.
So do I need to send that or not?

Hi Everyone,

We are expecting our NOA2 late June or early July. I am considering traveling on a tourist visa to spend some time with my fiance in the US while I wait for the US Consulate office in Sydney to contact me. Is this a possibility? Has anyone had experience with this or know of a thread about this? Thank you so much for any help.

I was in the same situation as you. I went to visit my fiancee in the states while on my NOA2, i took a letter from my employer. mortgage statement and a few more things showing my ties to the UK, got to the POE in Chicago. They didn't ask for anything, just waved me through after the usual stuff and said " Have a nice stay". You should be fine

Hi All,
Well just got back from Chicago, spent 6 great days with my fiancee.
Had no problems at O'Hare Airport, even though i had a letter from my employer, morgage statements etc, as suggested on here. The POE guard just asked the same as always and said " Have a great stay" and waived me through. HAPPY DAYS !!!!

Yes, you can, but it is upto the immigration officer at POE as to whether you will be allowed into the US.

Take evidence with you that you have intent to return to the UK - a letter from your employer is good to start with, recent mortgage statement, return plane ticket and anything else that ties you to the UK. Also a copy of the NOA2 & Embassy packet 3 letter to show you are applying for a K1, shows you're not trying to hide anything.

Hi,
I am a Canadian citizen and my American fiance is about the file form I-129F. Once we have filed this form, am I able to enter the United States to visit my fiance? We have a 2 weeks trip to California planned. When I called the US Customs and Border Protection Office I received mixed information. The first lady I talked to said it was extremely difficult and if I am denied access to the United States then I may not be able to apply for a K1 visa. When I called and spoke with the customs officers at the bridge and tunnel in Detroit, they both said it wouldn't be a problem as long as I can provide sufficient proof that I have ties in Canada. I am currently a Master's student in Canada so it would be no problem for me to provide proof of enrollment at the University. Has anyone else had experience crossing the border while your K1 visa is pending?

I was halfway through my K-1 Visa when i went to the States to see my fiancee in Chicago. i took all sorts of ties to the UK after being advised on here to do so. There were no problems at all they didn't ask anything different than normal, only said " Have a great vacation" and that was it.

Hi there - thanks in advance for your help.

I've read the general requirements for the I-864 both on this site and on the U.S. official site, but I'm still feeling confused/worried about "domicile" and am hoping some people could respond with their experiences or offer advice. Our main objective is to not be forced into living apart while I establish domicile in the U.S.

I have lived abroad as a TEFL teacher for the past few years, but now my English husband and I are settled in England and starting the visa process for the U.S.

The whole time I've been abroad, I've completed tax returns (using my parents' address in Michigan, though some income was earned in California thru a summer job there), maintained a U.S. bank account (address in Michigan), maintained U.S. credit cards (Michigan address), and have a current California driving license. I have also started a distance learning degree from a U.S. university based in California.

Is this enough to satisfy the domicile requirement, in your opinion? Will the California/Michigan difference matter?

My father runs his own business and could also offer me a potential job, but I wouldn't likely take him up on it upon settling in the U.S. Would the job offer help our case or would it sound suspicious in some way?

I'd appreciate any feedback.

I see that you have a similar situation as me and were allowed to do it in London - maybe they just made a judgment call. The criteria doesn't seem very clear!

update: We have had our DCF visa application returned because the UK is not my primary residence (since I only arrived in September 2006). So it seems that DCF is not necessarily available to anyone who has limited leave to remain...

It's true! I have just spoken with someone on the Visa hotline about doing DCF through the London field office. He said that the rules have changed in the past month and now anyone who has permission to live and work in the UK (including if they've lived here for under six months) is eligible!! spread the word! :thumbs:

Thanks for your response - I am living here with a Visa and can stay for up to two years but am not a resident as of now so cannot use DCF.

I didn't realise about the Vermont service centre processing the K3 - I'll make sure to give a careful read to the info.

In the meantime, can anyone else see anything wrong with using my US address despite residing the UK?

Hi everyone!
I am the USC living in the UK for six months with my British husband and we are just starting the process.

My questions:

Is it OK to use my parents' address in Michigan as my official address on all forms? Or would that be considered suspect, as I actually reside abroad?

If I do use the MI address, is that the state I should file with? The last state I lived in was California, but I'm not sure if that matters to the officials. Does anyone have advice?

I am in the very fortunate position that having retired I have been able to make a number of long visits to my intended over the last couple of years. However, the last time I went (May this year) I was pulled over and given a hard time by immigration (in Philadelphia) Essentially, the view was that I was abusing the Visa Waiver Programmer and that I should get a tourist visa.

Looking to return for Thanksgiving and Christmas (had hoped to be in the US for good by that time!!!) I took the advice and have an appointment to obtain same. Still with me?

(I think) my problem is showing I have strong social and financial links to the UK? House went to my ex. Am staying with my dad until the process is complete. Have cash savings and regular pension income. Am also a type 1 diabetic (unlikely to become an illegal!). If you were in my position what would you take? All ideas welcome!!!!

Hi.

I have just been filling in the DS156 form (using the one from the London Embassy site) when I got to point 29- Additional Visits to the US. I began to fill this in when the field suddenly decided it would take no more entries. I worked for a UK Software business and made numerous trips to the US.

Is it OK (on this "automated form") to have a supplemental sheet where I can list all the visit dates or should I limit my list to say the last 10 years?

Based on a very non scientific survey of Christmas cards received, the problem would seem to be post out of the London area.

I have everything I need to return for Packet 3 (all downloaded from the London Embassy web site). Could I just mail them in anyway? If do, does anyone have the address?

:dance: Until 2005 I worked for a UK software company and made many short trips to customers in Western Europe. I know which countries I visited but cannot be specific about which year. Can I list the countries involved and make some general statement about the year I visited them e.g

"During the period 1998 to 2005 I made business trips to Denmark, France, Holland, Luxenbourg, Spain and Ireland"

:help: Hi there. I was happily(?) putting all my forms together when I found an electronic version of DS156 is now available (it automatically adds the barcode). I (of course) have completed the standard PDF version. Will London ask me to submit (print) the electronic version?

As an aside, on the standard PDF version (box 22), it insists I put a date value in. I don't have a specific date. Should I just leave it blank?

Following is real life experience.

The problem with the VWP is that there seems to be no hard and fast rules as to how many times you can enter on it in a year. Some years ago a colleague in the company I worked for was pulled over and advised to get a Business VISA as he was making a lot of trips (non longer than 2 weeks). All trip were business trips.

I went over in July 06 for 9 weeks (straight through), November 06 for 11 weeks (straight through) and May 07 for 9 weeks (pulled over!). Told I was living in the US. Convinced them that was not the case (I took early retirement. Visits were easy for me. NO questions on my life in the UK). Then told I was abusing the VWP and that although they would let me in this time I should get a VISA if I planned to come again.

We are in the K1 process now but I would still like to go again but will not try! Is there a flag against me? I have no idea. The thought of being turned around though is not very appealing!
