We are both miffed its come this fast! I think postponing is best option though. We expected noa2 in November or December and it came in August. Just felt a little rushed. But I've had the chat with SO and if we can postpone will be fine. His dads not too well undergoing chemo at the moment so we are both a little distracted.

Not ready to move. We should have filed CR1 from beginning and then I wouldn't have the period of waiting for the green card when I get to the US. I don't want to do anything ASAP. I think it's best if we stick to this way now. I just feel miffed that we chose this route expecting it to take months and months and it isn't. There's so many things we wanted to do before moving to the US and its kind of pushed us into a corner.

I've done this once (on a b2), no problems. Bring strong ties to your home country. Where are you from? We filed June 4th and I've pretty much been in the states since apart from one week, so it is possible. It's all down to the border agent On the day. What airport you coming in through? Do you have strong ties that you can prove you will return?

Think she's just asking if she can visit before k1 is issued, not move to the states beforehand.

It has been 2 weeks since our NOA2 and I am headed the states (LAX) next Friday (7th). Have both originals of NOA1 and 2 with me, a return ticket, a letter off my employer (dated July though), and my work ID's. Hopefully I get someone nice at LAX and they let me through!

@skiptex..thanks a lot for your response. Im pretty sure her grandma pays for her own care so that would make income for three of us from march. This clears a lot up for me regards to the financial side of things, obviously i will also look into it myself but it is certainly a good start for getting my mind across things. At the current time i know her financial situation is pretty tight so we will have to work out whats going on and what her plans are for sure all i know is that either of us will do what has to be done for us to be together:)

Some very useful information coming through already, thanks everyone for your input.

The reason she is not divorced yet is that it has been very tricky to track her husband down and get him to sign any papers so alternative routes have had to be taken..she has been actively trying for well over a year now to get the divorce having visited the courts many times even whilst i was over there. She also had a sheriff serve him with the papers. We are hoping that the divorce will be signed off this thursday and i told her to ask the judge about being free to marry so there are no problems from the off.

Another major point has been raised which has been on my mind and that is to do with income so here is the situation...in her house there is herself, 2 daughters aged 15 and 17 (turns 18 in march), 2 sons aged 18 and 21 and she also looks after her gma (she is living in her gma's house whilst taking care of her)she is not getting paid to look after her gma but has been told it is possible and really she should because she does have her hands full. The nurses do visit regularly to help out. So as of March i guess she only has one dependant kid wise. She usually goes in and out of temporary work earning enough to get by but is looking for more fulltime work as there is always somebody in the house to make sure her gma is ok.

Reading the form you gave me i make out that she would need to be earning $18, 387 to meet the 125% poverty line requirement since 2 children are under 18 (up until march) or is the figure based on total household income for all residents whatever the age?..i see this is going to be a tricky one.

is the affidavit of support an absolute requirement in the K1 visa process as i need to be supported before i am able to work legally in the USA?

also do they take into account what i would be currently earning in the UK?

Hi,
just signed up to VJ. I found the site whilst doing some research on the K1 visa and looking for success stories to keep myelf positive about the whole thing..this site looks perfect for this and the many questions i will probably come across along the road.


I am 27 years old and have been together with my gf Sue for two and a half years since we met online on that fateful day. She lives in Kentucky and i have been over there twice staying the full 90 days of the visa waiver. We are so madly in love that it is only something i think we both ever dreamed of..It has got to the point where it is going to be far too hard going over for 3 months and having to come back..time just goes stupidly fast and it becomes increasingly difficult being appart from eachother. Sue is an amazing woman, she is 38 and has 4 great kids with whom i have a great relationship..basically she is still married and has been trying to get a divorce for a good while now but it hasnt been easy with her husband being the way he is. We are hoping that the divorce will be signed off by the judge this thursday(fingers crossed)...

Will the fact that she was still married during the 2 and a half years we have been together have any effect on the visa application and the decission made...do they have a strong view on what on the face of things is adultery really due to the fact she was stil married when we got together even though the relationship with her husband was long over. He himself has moved on and had kids with another woman. I have told her to ask the judge if she will be free to marry as soon as the divorce is signed as one of the major requirements of the application is that you are both free to marry..i am also just really worried at the fact that there is an 11 year age difference between us (not that it really matters when it comes to love if you ask me)and she has 4 kids..we know the love is as true as it can be im just hoping the american government looks through these kind of situations..all i can do is prove and express as much as possible that we love eachother immmensely and thats all that should matter... i think im just looking for some reasurance from maybe people who have applied for the K1 visa with similar circumstances as myself.

Thank you all for your responses, links and help so far..We have been talking this through with each other and i have just found out that her gma is going to sign the house over to her.. is that enough as an asset for the sponsorship?..anyway hopefully we will be getting the petition sent off soon. need to get everything sorted for that first:)

yea I think I need to feel the fear and do it anyway.. This visa is the best option I have I am pretty sure of that any other I have looked at just doesn't seem to be an option including work visas and such. If it gets refused I will just have to try another route. I will not give up.. i can't give up.. It isn't an option.. Just trying to be the best prepared I can be, and thanks.

a success story based on similar circumstances would give me hope but I feel our case is a little extraordinary and difficult. its really frustrating because iI know we can get setup no problem but proving that to the usg based on our circumstances could be extremely difficult and iI just feel they would have plenty of ground to refuse the visa

even for the cr1 we need the affidavit of support.. so is it really much different than the fiance visa?.. iI know wewould get by for 3-6 months without me working till iI get my residency so to do all that just to be able to work straight awayisn't really important or very viable cos I know we can manage till we can get me the green light to work

the main focus is the easiest and most likely way of me being able to stay over there so we can be together

Thanks for the cr1 spouse visa information I will have a good look into this now.. any option is open to me.. We do want to get married and we love each other so much but anything that gets me there and we can be together is the most important thing right now..i would even look into getting a work visa and I have done this many times but iI have not got a clue what companies offer such visas and a lot of it seems for professionals only.. I'm so lost with all this. And iI appreciate the advice

well here's the other thing..her and her kids live with her gma so she doesn't even have her own house..We always got by when iI was over ther.. as long as we have food and a roof over our heads we can always get by.. She doesn't have to pay rent or anything like that as her gma has that all sorted.. i would obviously have to go over there with money and that was a useful thing to know about how much it costs for the change of status.. i am in work myself at the moment but on part time at around 30 hours per week it is temp and the contract is up at the end of October but iI will be moving sraight into another job at the end of it.. This is why it has me really worried.. The circumstances are far from perfect and they are going to know this and it is going to give them a doubt as to whether this can work whereas we know it isn't a problem at all.

there is another problem because iI read somewhere about the us citizen fiance being on benefits or food stamps and stuff like that can really go against the application even when a secure co sponsor is involved.. She does do temporary work every year but she is in and out of that stuff.. It's not her fault though she also has her gma to look after.. She is pretty much her carer.

hi, I have been with my girlfriend for three years and we are looking into getting a fiance visa. I would happily go through the process myself if i felt i wasn't going to bump into any problems. my main concern is that we probably don't meet the requirements for the affidavit of support.. We are both normal people but neither of us has enough money coming in to meet the requirements for this section of the visa.. i know that it wouldn't be a problem to go over there without this stupid money requirement and be able to stay with my gf and get everything sorted and get into work.. i have been over there twice for 3 months on the visa waiver and we have been fine both times and iI have stayed for the full duration..Do you guys think that a lawyer would help us to get through that step? can we get through it ourselves? thanks.. I'm also just really worried about getting refused

Hey everyone, I am really pleased for those who got an interview in London hope ur intervews go great and u are reunited with ur loved ones very soon. :yes:
BUT i just wantto say LONDON EMBASSY SUCK!!! :help: GOD sake our CR1 case has been there at the embassy for 5 weeks well just over. Case was completed on the 4th August people here have HAD THERE case completed after ours and been scheduled an interview date already whilst we are still in LIMBO. called the DOS they said everything looks good but we have not been scheduled a date yet.
Called the london embassy they have suddenly changed what they say - normally they wod say that the CR1 interview will take approx 8 to 12 weeks to schedule. now when i ask them they tell me they cant say and EVERYCASE IS DIFFERENT!!! what the heck does that mean how is our case so different. everything has qualified nothing is missing. onlything i can think of is my ethnicity. I was born in England lived here all my life my parents are Asian? I DONT UNDERSTAND why its taking so long they give us no idea when it will be scheduled I dont know what to do Im so depressed. HELP!!!! ANY IDEAS :(

Our CR1 interview in London was on Wed my hubby came from US to be with me.
Everything went ok, they asked my hubby afew questions abt his job and support.
I was soooooo nervous. they n ver asked us for any evidence of our relationship - we had taken a huge folder but i guess because he was there with me that was enough.
i got my passport and documents yesterday I am flying out in 2 weeks. I am soooooo happy.
such a relief its all over. i wish everyone who is going through the process all the best.

Do you have that document? (proof of the surname change)



Yeah, I have a photocopy of this document.

But am I then obliged to send in my birth certificate as well? I only have the short form one, which apparently can lead to an RFE.

I am a UK Citizen and the beneficiary of an I-129F petition.

At age 7 my name surname was changed to that of my mums new husband/stepdad. I am now 22.

I have declared this on the G325A form.

As the beneficiary do i need to submit the legal name change form? If i do, do I need to provide my birth certificate as well?

I only have my short form birth certificate, and I heard RFE can occur if this is all that is submitted.

There are so many conflicting opinions..

but does anyone have a definitive answer for me... What should i include in the pack?
