Just my opinion, certainly not positive about this, but I think...

You are a citizen. They're not interested in you returning because you are free to enter at any time. You don't need to declare yourself. The question about a spouse entering the U.S. only matters in cases where the petitioner was another type of relative, say a naturalized child petitioning for both parents.

The only time I think it would make a difference in these sorts of cases would be DCF- showing that the petitioner intends to restablish domicile. But even then, I don't think they'd read too much into that with all the other evidence they'd require on that front.

I don't think it hurts to put the petitioner's name there but I really don't think it's necessary.

You're most likely not screwed. VJ's advice is not the end all be all. It's probably safest to send 4 copies, but with only one page posted to the USCIS website, I'm sure you're not the only one who submitted only one copy. Consider even the worst case scenario- they'll just want you to submit three more and that RFE wouldn't cost you more than a couple of days. Don't freak out now!

If there is no date on the photos (which there shouldn't be) and his appearance hasn't changed, they should be fine. We took a whole bunch of photos at the beginning of the process and used them many months down the line and they accepted them all without incident.

It's whichever passport she'll be presenting at the embassy, so most likely yes, her Chinese passport. It is easiest if she assumes the name during the visa process and prior to POE, but not impossible to change later.

It's usually easiest to do before she arrives, and before the interview so that she can change the name in her passport and receive a green card and social security card in her married name. If she changes her name after she arrives she'll have to pay for a new green card and apply for a name change with social security and most likely a new passport...

Will your father be submitting an I-864 or an I-864A?

If it's an I-864, the number would be 3 (assuming you are not claimed as a dependent on his returns).

If it's an I-864A, your incomes and unfortunately your household sizes are combined. Your household is 3 (you, your spouse and your child) + 1 for your father = 4.

For some reason the I-864A does not ask for the household size of the household member filling it out so I don't think your father's wife will be counted.

You will have to file an I-864, even though you are not working. You as the petitioner will always be the primary sponsor.
You can have 1 other person act as a joint sponsor- either your mother or your father will do, but not both. One of them will have to meet the requirements individually to be of help.

CR-1 all the way, especially with London. They take so darn long to schedule interviews these days that you basically lose no time (provided of course you're prepared for NVC). With NVC you'll most likely have an interview the month after you get a case complete. I pursued both paths and the CR-1 wound up being quicker! If you haven't gotten the I-129f approved yet though it won't be approved. Once you've got an approved I-130 petition the I-129f is moot. They're doing you a favor really.

And the medical is valid for 1 year. Did you do it with Knightsbridge? I was under the impression that they wouldn't schedule an appointment without a case number as if they forward the results to the embassy without that number it'd just get tossed.

I always say no. The false RFE wouldn't cause you to lose any time. As soon as they get to your IV package they'll register it in the computer. It's not like they're sitting around waiting for a response to an RFE that they didn't actually generate.

I think you actually end up saving time. Because they take so long inputting the choice of agent form and generating the DS-230, I believe it's safer to have them working on your AOS in the meantime. If you get an RFE on the AOS you could potentially have that in hand and returned to them before they even see your choice of agent.

No. I filed separately this year when my husband did not have an SSN or ITIN. I just left that blank. My federal return went through without a problem. My state sent me a letter saying ,"You left your spouse's SSN blank, please tell us what it is." I just wrote a letter back explaining the situation. Had my refund two weeks later. You cannot e-file without it, but you can definitely send in paper returns.

It's not a risky situation, it's just most likely an impossible situation unfortunately.

A false RFE for most people is when NVC completes the processing of the affidavit of support but has not yet opened up your IV package. Because of the two different tracks at NVC (AOS is one, DS-3032 + IV package make up the other) the timing can be a bit funny. For many people it takes NVC so long to 1) accept the choice of agent and generate the DS-230 (up to 2 weeks it looks like these days) and then 2) enter the IV package, that their computer automatically generates an RFE for the missing IV package, even if they've got it already. It just means they haven't logged it into their computer yet. Don't panic. You can speak to an operator who will usually confirm that they "received a package on" such and such date. Then just give it a day or two and they'll register it.

getting married in california would definitely be easier- your lawyer is right. i (USC) got married in the UK and had to apply for a fiancee visa at the UK embassy here in new york (sure i got it the same day i applied but i payed dearly for that service) and then after being in england for 10 days i think we had to go down and give notice and then two weeks later we had to go back and pick up more papers and then go to another office to be married. it was a whole hullabaloo since i wasn't planning on staying there or anything.

check that website for info. each county may have different rules about whether you'll receive your license immediately after applying but your fiancee will NOT need a visa. he should just come over on the VWP as he's just coming for a holiday and going back.

as for your situation when you go back to england, that might be a different story. if you've got leave to remain currently then that won't change i don't think. plus should you decide to come over here eventually then depending on how long you've been in the UK you may be able to go for direct consular filing which is speedier than other routes.

The number I dialled directed me to an automated message with no option to speak to someone live (had the same problem trying to get through to someone at USCIS) and none of their automated messages answered my questions. My fiancee and I are trying really hard to avoid paying expensive fees to hire a lawyer to sort out our paperwork. We think with a little help, we can do it ourselves. I know immigration laws in both countries are quite strict so we want to be careful. We would also like to start some of the paperwork now so when we get to California this summer, we don't have to end up waiting around for months to get everything processed.

if you're just getting married in california and then moving to his country, you don't need the k-1 at all. he can just enter on the visa waiver program (if applicable) or a visitor visa and leave after that.

the k-1 is only for if you plan on adjusting status after marriage so that he will be a permanent resident of the u.s.

you must marry within 90 days of her entry though, which is June 11th unfortunately.
