Wow, I can't believe it took so long! Do you have any idea what may have triggered the delay, other than institutional incompetency? Looking at the table, I assumed you were long done with the process and simply didn't update your status. I hope your case goes smoothly and swiftly from now on.

I'm going to be calling USCIS on Monday, the 90th day since I was put in line for interview. Not holding my breath.


Otta- I'm sorry to hear about your delays! I have no idea what caused ours but once I contacted our senator the ball got rolling very quickly. Not one but two Bio dates, an RFE (traffic citation), placed in line and finally interview letter mailed all in just a couple of weeks. I hope things start to look up for you soon!

I did my Oath this morning. I am a USC now!! I also went to the passport agency to apply for passport as I am treating myself a trip to Brazil this Friday. Thank you for all the helps VJ folks.

Hey Y'all,
 
So I'm still awaiting my Biometrics letter to be sent out.  Yesterday was 30-days from my NOA date and my case status is still the same: "Initial Review."  I called USCIS this past Friday (5/17) and the nice customer service woman said that my status should update by the 30th-day, which again was yesterday.  I'm not sure if I need to worry as of yet but I hear that the Los Angeles office is notorious for delays due to the rather large applicant volume.
 
I think I will call USCIS again this Friday if my case status is not updated by then!




If you've already passed the 30 day mark they should have offered to initiate a service request immediately. Give them a call again and request it. We're in the same boat and were just promised some type of response within 14 days so here's hoping!

It only worked for me if I changed the $ to *


I called and they confirmed that the $ number is a payment confirmation # and replacing it with a * gives you someone else's information.

As for our case, the most recent notes he could find were as of May 9th and that it's still just pending scheduling for biometrics.

Accidentally posted this in the May forum a little bit ago:

Hi everyone. I was getting a little bit worried since it's been nearly 30 days now and we haven't received a biometrics letter, so I pulled out the NOA-1 to double check all the info on it. That's when I noticed two different application numbers. The top of the form lists one (and according to the website that application was last update with the sending of the NOA-1), and the second is on the bottom left corner of the page, where it lists the USCIS office address. That application number, according the website, had a biometrics notice mailed out on April 24th (which obviously we have not received). Is it normal to have two different NBC numbers on your NOA-1?

hrm... i thought cr1 was a single entry visa- meaning once you go in, that's it you're a permanent resident. you can still go back to canada as long as you're not breaking the out of the country for too long rules. i think if you're going to be gone more than 1 year you'll need a reentry permit? i think that's it. not positive though. and you'll have to think about the time away if you're going to be applying to remove conditions or for citizenship, which have limits on that.

I think it's not as simple as just applying for a new visa if you leave. You've overstayed so long I think you are likely to end up with a ten year ban. That means applying for a waiver which is another long and costly process...

Yes it is Aisha! I'm not very creative with usernames...

And yes I thought we were good to go as well but you must meet all other requirements except the continuous residence requirement to apply early... which means you must be married to and living with the US citizen spouse for the 3 years immediately prior to applying. For us at least that didn't begin until POE :(

I go back and forth with it but I've found some posts that mention couples being denied (like: http://www.visajourn...-90-days-early/) so I think we're just going to wait the full 3 years.

I have just received an email from USCIS stating that they mailed the new card today. Good timing before I send my citizenship package.


Hi Princess In Love. Congrats on the card! I, like you, went the CR-1 route. I thought that we couldn't send in our citizenship applications during the early 90 day window like K-1s do. I thought that since you must be married to and living with your spouse for 3 years, CR-1 folks have to wait until the actual 3rd anniversary of their POE. Am I missing something?

seems so far away in the heat of the summer. (i live in vermont where summer and winter are VASTLY different weather-wise!)


oh yes i learned better than to get my hopes up with the VT service center the first time around...

the idea of january ever coming is pretty hard to imagine here in boston as well, but i'm looking forward to complaining about the snow again rather than the humidity!

There are two different paths with the NVC paperwork. AOS is one and the DS3032 & IV package together make up another. Check out this flowchart: http://www.visajourn...wchart_v1-2.pdf

The DS3032 and AOS fee bill are generated first. A while later, once the DS3032 has been accepted, they'll generate the IV fee bill.

Remember you can't send things in right away after the bill has been payed. You'll have to wait a few days for the status online to be updated to show that it's paid and print out the cover letter from the website.

As for who mails what, they don't care. Usually the petitioner mails everything just because it's quicker and more reliable to have everything mailed within the U.S. I don't think you'll have too much of a problem with mail coming from Canada actually getting there and doing so in a timely fashion, which is a huge problem in countries with more questionable mail services.

There are many documents that need to be sent in with the DS-230.

* BARCODED Cover Sheet (to be printed from web when your status is PAID online for IV bill)

* You OWN cover sheet listing what documents are in the package, so they're easy for the reviewer to locate

* Completed DS-230 part I & II and ONLY part I signed by beneficiary (with 2 passport appropriate photographs)

* Photocopy of the beneficiary's passport biographic data page.

* Original/certified copy of beneficiary?s birth certificate.

* Original/certified copy of beneficiary?s and petitioner?s marriage certificate.

* Original police certificates of the beneficiary.

* Original/certified copy of military record, if applicable.

* Original/certified copy of divorce decree, death certificate, etc. of previous marriage, if applicable.

The AVR would update for an RFE, but probably not until a day or so later. You could call and ask the operator if you're really concerned but I'd wait a few more days. Seems like it's taking them 2 weeks to actually look at the file after they've received it so it's likely the operator won't have any news for you yet.

They do update it but sometimes it can take a day or two for it to update. A better way to find out is to try and log in to the payment page. When you get an error message it means your case is almost complete. Then call NVC and ask if it's completed yet. Should be a day or two.

Our case complete came two weeks after they had received everything (1 day after the sign in error). Two days after that the interview was assigned and four days after that it was sent to the embassy.

It most likely won't take 90 days. I haven't read of any case that has taken that long. Most likely it will be 2-3 weeks. You haven't even gotten to the 2 week mark yet- don't panic. Unfortunately there isn't much you can do in terms of expediting it so long as it's still sitting at the service center, but perhaps you can find out from NVC how to move things along once it arrives, i.e. avoid possible AP and request a quick interview date if deployment is imminent.

Well it's been more than 10-15 days so definitely call back and say, "You've been telling me that for x number of days now, may I please speak to a supervisor?" And if they say no, hang up, call later and try again.

I was also told that my case was with a supervisor and within five days my case was complete. The operator had no idea why my case was with a supervisor- she ackowledged that it wasn't standard practice but didn't have any other ideas. Nothing was wrong, I guess they just wanted to review it or something.

Of course a case could also go to a supervisor when something is wrong. When did they first tell you that that was what was happening with it?

Hooray! NVC will e-mail you an interview letter... not sure what the wait time is for your embassy though. They say they only schedule during the second week of every month but many people have gotten them at other times (I got mine the third week). You can't try the DHL trick until your appointment has been scheduled- NVC will hang on to the package until then.

The interview letter will contain a link to this site: http://travel.state..../info_3731.html so you can start reading up and make sure you're ready for the medical, etc.

I also got the double false RFE, June 9th and June 11th. I never received the emailed checklist though- I only knew what was going on from the AVR and speaking to the operators.

If the operator confirmed that they received the IV package then you're probably safe.
6 days after I got the second false RFE my case was complete.

You might try calling again 1) to double check that they have the IV package recorded in their system and 2) to express to them that you spent 13 months at USCIS. I'd guess that you've only got a few more days, maybe a week left at NVC but I've read that they are sometimes sympathetic toward people who had a rough time with USCIS and push it through a little faster.

Yep that's a false RFE, nothing to worry about. Do pay attention to the AVR for the next week and make sure that the date they say the checklist was generated doesn't change to a more current one. That would indicate that an actual RFE has been issued.

Though I actually got 2 false RFEs so it could mean nothing at all. Just check with the operator if that does happen.

But for now you're safe!

Oh dear. So sorry- what a terrible wait! I'm not sure what recourse there is for you but you might try posting this in the Sub-Saharan regional discussions. It's possible that the long wait really is totally normal unfortunately. The timeline on VJ says 302 days, which is the longest (after Iran) but I'm sure it's not really that long.

I have a feeling the problem is not about needing an apostille- that seems like a lot to ask and in general NVC will accept a document with any sort of stamp or seal from the issuing agency. It was just a guess so you shouldn't worry too much about trying to get that. Definitely try again to speak to a supervisor- for an issue like that the operator will almost definitely transfer you. If not, hang up and try again. That will most likely clear everything up. Hope it doesn't set you back for too long. Good luck!

Did you have it translated?
Call again and speak to a supervisor who can actually look at the case.
If that fails unfortunately it would probably be faster to just send them a new copy than to fight them over it.
You might try asking if they would accept an emailed or faxed copy of it and bring the new original to the interview, not sure if they'd let that fly but I think others have faxed RFE responses.

Oh also, was the "certification" by the city hall an apostille? I think for things like photocopies of international documents the apostille is the only universally recognized proof of certification. That might have been the problem.

Just some ideas of what the problem could be, not positive about any of them really.
