The fee for the petition is $355, due at the time of filing. That does not include the visa fee.

The visa fee is $131, due at, or just before the interview.

Do not contact the embassy. They will be reluctant to give you any information or the code and you will end up wasting your money.

Just call DOS- the Department of State. The embassies all fall under their jurisdiction. When an embassy updates your file, DOS can see it.

If an immigrant visa is available to the applicant then a K-3 interview cannot be scheduled.

Each embassy interprets that in its own way. Some embassies will schedule a K-3 interview and be open to the possibility of switching it to a CR-1 on that day. Others will not schedule A K-3 interview if a CR-1 is already scheduled since that's the ultimate goal and they don't want to waste their time scheduling an unnecessary appointment.

So that's what the question here is. It's not that it's invalid, it just may not happen at all if the embassy is aware of the CR-1.

Who at the embassy told you that there was an 18 month wait? And what exactly were they referring to? Are they saying the wait for an interview is that long? I'm almost certain it's not. Are they saying that's how long it will take to complete the rest of the processing? Because the embassy has basically nothing to do with it. You're with NVC for the rest of it, they just accept your file for the interview.

Because you filed an I-129f, your I-130 lost its place in line. It was pulled out when they received the I-129f and both of them went to the back of the case load. That being said, if the two petitions are not approved at the same time and you get an I-130 approval first, your I-129f cannot be approved.

here's a little breakdown that has been posted around here before:

K-3:
I-130: $355
I-129F: NONE
Consulate: $131
Adjustment Of Status: $1010
($1496)

CR-1
I-130: $355
NVC I-864: $70
NVC Visa fee: $400
($825)

so that works out to a difference of $671. not chump change if you ask me.

you also have the option of filing the 129f if you want to since it's free, and then deciding later on, once they're approved, which route you'd like to go. lately they've been approving both at the same time, so you can choose whether to just take a quicker interview for the K-3 which gets sent immediately to the embassy from NVC or take the time to go through the processing at NVC for the CR-1. there are also lots of shortcuts here to get through NVC quickly if it does become time sensitive for you.
you can also try to let the K-3 run its course, take that interview date and if the I-130 gets out of NVC fast enough the embassy may issue the CR-1 at that time. that's what we mean by "flipping" the interview, and it's what i'm going to try to do in london.

a lot of the reason i wish i hadn't filed the 129f is that people who filed only an I-130 around the same time i did wound up getting transferred to CSC, which was and still is moving lightyears ahead of VSC. it's all a game of chance though. not sure if they're still doing transfers. seems like they're not doing much of anything at all.

if the K-3 is right for you then by all means go for it.
also, have you considered whether or not he'll be working when he arrives? with the K-3 you'll have to apply for an EAD which is free when filed with the AOS but takes at least three months to process so it'd be some time before he could work, whereas with the CR-1 he could work basically right away.

If you're sure you want to go the K-3 route then yes, now is the time to send in the 129f, with a photcopy of that NOA1, to the service center listed on the NOA1.

Are you positive that the K-3 is right for you though? The immigrant visas (CR/IR-1) are taking about the same( if not less) amount of time and benefits include getting a greencard upon entry (no adjustment of status later) and paying less in fees.

Just something to consider. I regret ever filing my 129f as it's slowed me down and we're just going to ignore it if it ever gets approved anyway.

We didn't have any children so I'm not positive but the form does say, "Complete one copy of this form for yourself and each member of your family, regardless of age, who will immigrate with you," so I think yes, you should prepare one for each child. Maybe someone else will have some better ideas. Sorry!

They can't put it back on the shelf. The people who answer the telephone are no closer to your case than you are when you check your case status online. There is no way they can affect or delay the outcome of your case.

I also doubt that they log calls. Most likely a previous operator put in a service request for you or flagged the file and the operator saw that and knew that you had called recently. Or in your frustration you may have let on that you've been calling frequently.

Do not try and withdraw your I-129f. By time someone opens that letter and deals with it you'll probably have your approval. You can choose which route to go but not until you are out of USCIS. Then you'll just ignore the correspondence for the K-3 and only deal with NVC.

And it's possible that it is still with an adjudicator. The first time I was told that it was on someone's desk was about four weeks before my approval. In between I had many operators who told me some crazy things, including that it was still sitting in the mail room. Don't freak out. The misinformation line is called that for a reason you know!

I was in the same position, made more than enough but had only been working for around 9 months. I used my mother as a co-sponsor just in case. It won't affect you negatively so I think it'd be wise to prepare the paperwork just in case.

Because you're doing a K-1 you won't have to submit it before the interview like I did. You should come prepared with both sponsors, only hand over your fiance's paperwork and if the officer seems skeptical you can then offer the co-sponsor's. I think it's better to have everything ready just in case than to go home disappointed on the off chance they want a co-sponsor and ask you to mail it to them before they will issue a visa.

Actually you have to have been married to and living with the US citizen spouse for those three years.

Many K-3 and CR-1 applicants have trouble using the 90 days early bit because yes they were married, but they were living apart. Because you adjusted from an H-1b you have probably been living with your spouse for the full three years so it won't affect you, but it's an important distinction to make for anyone else who reads this thread. For example, shakysgirl, you might want to look into it further...

Hi everyone. I was getting a little bit worried since it's been nearly 30 days now and we haven't received a biometrics letter, so I pulled out the NOA-1 to double check all the info on it. That's when I noticed two different application numbers. The top of the form lists one (and according to the website that application was last update with the sending of the NOA-1), and the second is on the bottom left corner of the page, where it lists the USCIS office address. That application number, according the website, had a biometrics notice mailed out on April 24th (which obviously we have not received). Is it normal to have two different NBC numbers on your NOA-1?

I was in a similar situation with Boston... applied in April and still no biometrics notice in August. It took 4 service requests, a conversation with a tier 2 officer who also said we would just have to wait, and finally a letter to one of my Senators. I'm not positive that's what did it but about two weeks after contacting Elizabeth Warren we had a biometrics notice and then within a couple of days of the biometrics appt, an interview date.

 

I'd recommend calling USCIS earlier in the day whenever possible and documenting every conversation you have. If you're putting in service requests regarding your service requests, you're probably not going to get anywhere though. And if you decide to go the Senator route, Elizabeth Warren's website makes it very easy to send everything they need without making another phone call.

Yes it wasn't really an RFE but one of those yellow notices that says you should bring additional documents to your interview. In our case, yes for 16 I thought better safe than sorry and disclosed a speeding ticket for which he received a $160 fine. He's just going to bring his copy of the citation and the receipt from payment.

Wow, I can't believe it took so long! Do you have any idea what may have triggered the delay, other than institutional incompetency? Looking at the table, I assumed you were long done with the process and simply didn't update your status. I hope your case goes smoothly and swiftly from now on.

I'm going to be calling USCIS on Monday, the 90th day since I was put in line for interview. Not holding my breath.


Otta- I'm sorry to hear about your delays! I have no idea what caused ours but once I contacted our senator the ball got rolling very quickly. Not one but two Bio dates, an RFE (traffic citation), placed in line and finally interview letter mailed all in just a couple of weeks. I hope things start to look up for you soon!
