I don't have experience with filing two petitions but I'd think sending them together would be best. You'll save on the postage but more importantly it might help to ensure the petitions are connected from the start. Putting a big clip around each of the separate petitions would work, or two envelopes within the one FedEx package would work too.

QUOTE (Anh map @ Aug 22 2009, 04:28 PM) <{POST_SNAPBACK}>
That is incorrect. They read the entire file prior to the interview. Showing up to the interview with a 9 page letter and expecting it to be read is not likely. Front loading your petition is recommended by fellow VJ'ers and immigration attornies.

If anyone's attorney told them to write a 9 page letter to USCIS then they should be fired.

Sorry, but there's no way an adjudicator is going to read that.

I agree in some cases including a lot of proof is necessary- then serious documentation will help. A 9 page letter explaining why you don't have that will not.

The letter explaining your story would certainly be helpful to map out the relationship for the adjudicator(s).

Unfortunately the adjudicator will most likely not read a 9 page letter. Keep it to under one page. You were able to outline some of your concerns for us here, try using that to give you the basics of what you need to include.

As for his visit here, that would be great opportunity to obtain more proof even if you are mailing the petition right away. Make sure he keeps his boarding pass and include a copy of that. Take a photo of you greeting him at the airport. Send a few recent photos of him with your daughter. Pluck some heartstrings there. Every little bit helps.

I'm guessing from your photos that you are the older one. When the age difference is follows the cultural norm for that country, there will usually be no questions asked. For a woman to be significantly older than her husband, especially when interviewing in a Muslim country, it might get a little trickier. He should be prepared to answer questions about it. Make sure he can describe how important your relationship is to him and whether or not you guys plan on children, etc...

No matter what visa you apply for you should plan on at least 7-12 months for this process. 90 days is the amount of time you have to get married after you've already received the visa and entered the country, not how long the whole thing takes.

But I want to go with the I-130 and not the 129F is NVC gonna ask for all the supporting documents and is this gonna delay my process. what should i do help.

What supporting documents did you not send? USCIS would not have approved you if you had not included at least the minimum required.

Birth certificates usually show the mother's maiden name. Mine had her maiden name listed but my mother has her married name on all her other documents (license, passport, taxes, etc.). I think the names will be different for quite a lot of people and they are aware of that. I wrote next to that document in my cover letter that her name is "Ms. Firstname Xyz (née Zyx)" just in case though.

It should be the joint sponsor + their household + the intending immigrant(s).

If your children are already legally in the US with your husband or US citizens (so therefore not intending immigrants) and you are the only one being sponsored it sounds like the number should be 2: the MIL + you.

IR-1 / CR-1 Spouse Visa Process & ProceduresJames & LingChe NVC Shortcuts
I used the LingChe shortcuts to get an idea of what paperwork we needed to gather- it's good in that sense. Some things are outdated though I guess. An operator will never give you the IIN anymore, nor do you need to create your own barcodes. As soon as NVC receives your file and assigns a case number you should speak to an operator and give them an email address for both you and your spouse. They'll then email you everything you need to know. You can email them the DS-3032 once it's generated, no barcode needed. They'll send you the AOS and IV Fee Bills right after they are generated, so you'll get your IIN that way to pay online. You'll have to physically mail the packages back to them but it still definitely saves you a ton of time.

Sort of correct. The K-3 will go to the country where the marriage took place. The CR-1 will go to the country where the beneficiary lives. Another important thing for them to consider!

QUOTE (Penguin_ie @ Aug 28 2009, 08:18 AM) <{POST_SNAPBACK}>
Doing a K1 with a religious ceremony prior to US entry is technically allowed, but can cause problems because the CO and/ or border agent may decide you are "really" married and deny the visa.

If the foreign spouse's country does not have civil marriages and religious ceremonies are the only option then DO NOT do it. If the marriage is legally recognized in the foreign country then you're legally married according to the US. The officials at the consulate will be well aware of marriage traditions in the country and will not let that slide if you're going for a K-1.

If you're considering marriage in a third country and paying people to be witnesses, how is that different from getting married in the US? Your spouse still wouldn't have her family there...

Who are "they"? Did T-mobile ask you to sue them?

I'm not sure how worth it all this fuss is. If you have a complete picture of your relationship, the phone records shouldn't be necessary. There are plenty of couples who have no phone records (either because they can't afford calls at all or they use phone cards that are untraceable) and they turn out just fine. Maybe you should focus your efforts on gathering as much of the other kinds of evidence as possible...
imaishaFemaleUnited Kingdom2009-07-20 18:14:00
IR-1 / CR-1 Spouse Visa Process & ProceduresQuestion about the packet you send in for IV bill
You do not send in any proof of relationship to NVC. You are only showing the financial details of the petitioner (I-864 + proof) and the biographical information of the beneficiary (DS-230 + passport copy, birth, marriage, police certificates). Have you read the LingChe shortcuts? http://www.visajourn...ut#INTRODUCTION

You'll show your proof of relationship at the interview stage. I'm not sure why you wouldn't be able to obtain your phone records since they're your calls and you payed for them, but if they aren't available you need to think of other ways to document the relationship. Do you have emails, boarding passes, photos, etc.?

It's not necessary to put things in a binder. There shouldn't be that much stuff and they're just going to take it out and stick it in their own folders. Simply make a cover letter explaining what you're including, make sure you have the NVC barcoded cover page on top and write your case number on every page. That will be more than sufficient. Then you can mail it however you'd like (though some sort of recorded method is preferred, i.e. USPS priority/express mail, FedEx, UPS).

Edit: I see you do have emails, photos, etc. Great. Keep collecting stuff like that. Any cards? Photos with family members are also great. Any gifts you've sent each other?

-your husband has to send it to NVC, and he has to give you an exact copies of what was filled by him and his cousin for your interview.

NVC will forward all of your packages to the embassy before the interview, but it is always good for the beneficiary to have an exact copy of everything, just in case.

Yep nothing to worry about, as long as the cosponsor meets the requirement.

If your hubby's income on line 7 is 0 then there should be no W-2. If you're worried about not having one even though he doesn't need it you can always apply for the transcripts. Then you only need that one piece of paper. Might be good to have for the co-sponsor too. If not I think his dad's income would be reported on a form 1099-R rather than a W-2, so you'd need that plus his 1040.

Don't wait on mailing the DS-3032. You need them to process that ASAP so they'll generate your IV fee bill and last time I checked they were taking two weeks to process choice of agent e-mails. Best to mail it right now and not wait for the AOS package.

IR-1 / CR-1 Spouse Visa Process & ProceduresDuplication of Paperwork Seems Needless
To begin with, the entire process is for the IR/CR-1. Do not think of the I-130 as something separate. The petition is the first step in the process to get a CR-1 visa.

Have you read about the next steps? Begin with these: http://www.visajourn...he_NVC_ShortCut and http://www.visajourn..._live_in_the_US

I'm not sure what you think is duplicated- seems like you are worried about having to provide proof of the relationship. Everything that you sent to USCIS with your petition will be forwarded to NVC and then on to the embassy, so don't bother with duplicating those photos and affidavits. You should be able to provide more proof at the interview though- people usually provide more photos/chat logs/emails/phone bills then. You're not duplicating anything. You're just providing them with all the proof you can so they'll have little reason to doubt your relationship. You'd have to do that for any visa you apply for so you haven't made the wrong choice.

Oh and also, from here: http://www.usembassy...i130filing.html

"The USCIS London Field Office has jurisdiction for adjudicating I-130 and I-360 petitions from U.S. citizens who have permission to reside AND who do principally reside in the United Kingdom."

So I think you have to have been residing, not just able to reside.

If you're living in Gibraltar why not do DCF from Spain? You don't have to go through the embassy of anyone's home country. The embassy in the country where you have residence should work. I'm basing this on a couple of K1s I know who are Indian and Pakistani citizens in the UK and go through the London Embassy (because that's the country they reside in).

Is there a way to get them to email the interview letter rather than snail mail it?

It's because the mail system is horrible in India and its even worse where my wife is living they are soo nosy there they'll steal the mail and read it, then talk about it weeks later. I'd rather not have nosy people who have nothing better to do screw up my wife's interview..

If you give NVC an email address for you and your spouse they will e-mail both of you a copy of the letter. You won't receive hard copies of anything.

If you enter on a CR-1 visa you will get a stamp, an I-551. That acts as your temporary green card for 1 year. That stamp is valid for travel and work purposes. So yes, you can travel right away. You must be careful to not be out of the country for so long that you lose resident status though.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat forms can I be getting ready?
Hmm... It sounds like this is actually DCF, so they wouldn't be dealing with NVC at all- they'll bring the I-864 to the interview. There's some information on DCF in the wiki and on the London embassy website. Check here: http://www.visajourn...-130_Processing and here: http://london.usemba.../ivprocess.html

You can visit your GP and make sure you're up to date with all your shots and make sure you have original copies of all the required documents (birth, marriage, divorce, police certificates).

Also, there are pretty clear instructions for the I-864 in the form. When doing DCF, petitioners almost always use a joint sponsor or assets as their current job (or even a job offer in the US) doesn't count. The embassy will only consider income that will continue after your move. The petitioner still needs to fill out the I-864 and provide their tax returns, but the joint sponsor will have to do that as well as provide proof of income or assets. Keep in mind that when you do not live in the same household as the joint sponsor the incomes are not combined, so the joint sponsor alone will need to make enough to meet 125% of the poverty line for their entire household + the immigrant. Reread very carefully the instructions here: http://www.uscis.gov.../form/I-864.pdf. They should give you a good idea of what you'll need to prepare.
