K-1 Fiance(e) Visa Process & Procedureswhen can we marry?
QUOTE (ghomnet @ May 17 2009, 08:02 PM) <{POST_SNAPBACK}>
My fiance come to USA on the 13 of March, her visa says it is good till Aug 18, 2009, but on a card stapled on the other side of the page it says the (I 94) say June 11 2009. We Met on June 12, 2008 we wanted to get married on that date. Would that be a problem?

the visa says August because she had 6 months to enter the country.
you must marry within 90 days of her entry though, which is June 11th unfortunately.
what about just getting married at the courthouse on the 11th to satisfy the paperwork side of things and then having a celebration on the 12th?

QUOTE (Deryck and Miho @ May 19 2009, 12:13 PM) <{POST_SNAPBACK}>
Hi,

Regarding the G325A and Fiance Intent letter, is it acceptable for my fiance to sign her name like she does in Japan, using Kanji? Or is she supposed to sign using roman letters now?

Regards,
Deryck

your signature is your signature and should always be the same. if she usually uses Kanji, then she should do that on the forms. do make use of the box below that where it asks for the name in roman letters.

If your case just got to the consulate today then you've probably got a bit of time before your interview. Maybe it'd be worthwhile to get the letter corrected, just in case.

K-1 Fiance(e) Visa Process & ProceduresTricky situation....
you certainly can get married while she's just here visiting. she just has to go back to canada while the visa is processing. visits will still be ok while you're waiting. the laws for this are made by the states so what you'll need (marriage licenses, etc.) will depend on where you live.

what's sometimes not ok is when someone gets married while here as a visitor and then overstays and applies to adjust status. if she comes with that intention then it's visa fraud. if she comes not with that intention (though it seems like you're already considering it so this is moot) then she can stay and adjust status as long as you can convince immigration that it was completely unintentional and just happened.

K-1 Fiance(e) Visa Process & ProceduresJUst curious about timelines
It's not an indication of longer times to come. It's just that other members who applied before you have joined/ updated their timelines. They've already been in the queue, Igor's List just didn't account for them yet.

As for my experience (we weren't a K-1), I watched us go up and down and get quite far down (or is it up?) on the list while still not hearing from USCIS. We spent a month outside of processing times before hearing anything though.

Igor's List is a nice guide but of course you can't rely on it. USCIS can do whatever they feel like, whenever they feel like it.

K-1 Fiance(e) Visa Process & ProceduresExpedited processing
If your fiance is going to be studying in the U.S. why didn't he/she apply for a student visa? They are less expensive, processed faster and still give you the option of adjusting status should you get married eventually.

Am I misunderstanding something here?

K-1 Fiance(e) Visa Process & ProceduresPlease help, from UK, would like a k1 visa, b2 temporarily?
No one can tell you that there would be "no problem" entering the US. It is always a gamble, all of the time, even with all of the proof in the world. People have been denied a visit on the VWP even on just their first visit, so leaving such a short time between visits is not helping your case, as everyone else has already said. There are never any guarantees. We like to say that if the immigration officer woke up on the wrong side of the bed you could be denied entry. You seem pretty intent on taking this trip. If you want to try, go for it. You might end up with a great vacation... but you might also just be throwing £490 down the drain.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhen can I schedule the Medical Exam?
QUOTE (Shakeeb Mustafa @ Jun 28 2009, 10:28 AM) <{POST_SNAPBACK}>
Guys,

The NVC has input the DS-230 into the system and the CASE should be complete within the coming weeks. I'm headed to India next week to be with my wife. Is it possible to schedule the medical exam while I'm there, before the CASE is officially completed?

Shakeeb

Unless there is a country specific reason why you shouldn't, I think you'll be fine. We scheduled out medical at least 2 weeks before our case was complete. The doctor in London was fine with that- they only needed our case number. The results should be valid for one year so as long as you're expecting the interview within a year I think it's fine. Perhaps someone who has done it in India will know of a reason this won't work.

After your case is complete and the interview has been assigned, NVC will send you a link to this page: http://travel.state....ng_for_med_exam

There you can find all the information you'll need about the medical exam, including the list of doctors you can see. For New Delhi at least it looks like they don't require the interview letter and you pick up the results and bring them to the interview with you. I'm not sure if that's the embassy you're dealing with but you can find everything you need on that website.

Can anyone answer my question regarding the border crossing?

I've can't find anything to back it up but I think I remember reading somewhere that you WILL have to use the visa when you enter.

Do you have any particular reason for not wanting to use it? If anything I would think it'd be a good thing. By time you officially move in September you'll already have a social security number so it'll be easier to get a job/apartment/ bank accounts etc. and you'll already be three months closer to removing conditions.

And once you have your case number you can call NVC and give them the email addresses of the petitioner and the beneficiary. They'll then email everything to you. I didn't receive a single piece of paper from them in the mail. Much safer if you're unsure of the mail system.

IR-1 / CR-1 Spouse Visa Process & ProceduresWhat are the time difference between USCIS and NVC
Wow that's a lot to ask at once! Let's see:

QUOTE (KDOR @ Jun 28 2009, 06:09 PM) <{POST_SNAPBACK}>
On the USCIS website the processing times for various visa categories was tabulated and for instance the I-129 and I-130 where either stipulated or confirmed to be 5months. My question does the 5months applies to USCIS alone to recieving a case and approving or the 5months also includes the NVC services (meaning taking uscis and nvc process the case for 5months or what?).
Only USCIS.
What is the date of the USCIS Fiscal Year for 2009(FY2009).
I'm pretty sure they go by the calendar year. Not positive though
Are visas number automatically available to spouse of US citizen?
Yes.
When your case is recieved and pending what should or can you do if it has not been touched for weeks on the USCIS website?
Nothing. Being touched on the website means nothing. Many have been approved and their case status was never updated. Do not do anything until you are outside of processing times.
What could be classify as a potential age difference between a US citizen and his/her spouse (the beneficiary), is there a age limitation?
There is no age limitation. This usually only comes up at the interview stage. It comes down to what is considered culturally acceptable, for example if the consular officer has reason to suspect the marriage is a sham they may consider a much older woman marrying a very young man from an African country suspicious.
What is the implication of a first-in-visit marriage and a short courtship which preceeded into marriage and the possible decision of a visa interviewer in such a case? How long can a marriage couple lived together in the foreign spouse country before the interview date at a US consulate or Embassy in other to establish a evidence of bona fide relationship?
You don't necessarily have to have a long history of living together to prove a bonafide relationship. You should be able to provide many different types of proof. Photographs, emails, phone calls, visits all give a more complete picture.
Does the spouse been pregnant makes am Entry clearance official to grant a visa?
No. There have in fact been times in some countries where the child needed to have a DNA test to prove that the US citizen is the parent. Pregnancy is not considered a proof of a bona fide relationship and USCIS will not consider it a reason to expedite. Some people have gotten more consideration from NVC and the embassy but again it's not guaranteed. Please do not consider having a child to make the visa situation easier.
Can the petitioner be present at the interview in the foreign spouse country when he/she goes for interview.
That depends on the embassy. Someone going through your embassy will be able to help you better with this.
Hope to hear from you all soon and hey remember the best response/reply attracts a great reward of more love in your love life and a goodwill wishes on your case too... MWAHHHHHHHH!!!!!!!!!!!!!!!!

"Hi I just wanted to see if my Affidavit of Support has been reviewed yet" or "I want to make sure my IV package has been entered into the system" or "Has my case been completed yet" and so on. They're usually very honest with you and not rude or annoyed that you're asking the way USCIS was.

BUT there is no key at the bottom that says what C means. Does it just mean to bring the letter along to the interview?

Don't worry about it everyone's says that. I think yes, it just refers to the appointment letter itself.

I never sent a hard copy in the mail, When I called and asked NVC they said that if you email it then you dont need to mail the hard copy as well.

You don't need to, but if you want to get things moving more quickly then better to send it every way you can, no? It took them forever to generate my DS-3032, and forever to reply to the e-mail. About a week after my hardcopy was accepted I got an email response to my first email saying they'd already accepted the hardcopy and had an agent on record. I think they were especially backed up because it was a holiday weekend, which this weekend will be as well.

They will talk to either the petitioner or the beneficiary. When you call you'll have to confirm both of your names and dates of birth (and the case number of course).

As soon as you have your case number, call and speak to an operator and give them both of your email addresses. They will then email you everything rather than send a hard copy. This will save you weeks.

And yes you probably should make your husband the agent, assuming he'll be the one paying the fees.

It's really weird but we never called NVC to give them our case number. They must have gotten it from the cover sheet of our packet, because one day out of the blue they emailed us choice of agent form and invoice number...

I think you misunderstood what I meant. NVC knows your USCIS case number- you don't need to inform them of that. The only reason you would call and give it to them is when you want to use it to find out what your new NVC case number is right after it's been assigned.

Question for you....

For our I 130, we had to submit the petitioner's divorce decree. I, the beneficiary, haven't been divorced. So, in the filing for the NVC stuff, does he have to send it with the I 864 stuff? It doesn't say anything about it. But for my package as the beneficiary, it says to submit any documents for a divorce which I have had. So... in this stage of the game, do they need HIS divorce decree?

Thanks so much.
LGG

I don't think it's necessary, but I'm not sure since that didn't apply to us. The NVC stage is primarily confirming who you are and your husband's financials. It was needed at the USCIS stage to make sure that your marriage was valid, so that's already been proven. Make sure you have a copy to bring to the interview just in case though.

Again, not positive though so maybe someone else will be able to chime in.

thank you . what about if you have lawyer ?

If you have a lawyer you will not receive a request for a DS-3032. The lawyer will automatically be appointed the agent. Your first step then will be paying the IV and AOS fee bills which should be generated at the same time.

He already has a social security number and driver's license? So he's been in the states already? You shouldn't have any problems at all then. Here's info on the laws in Kansas and what you'll need to get the marriage license: http://www.kscourts....ts/2marrnfo.htm

As for what you need to go to the UK with him, I'm afraid we won't be of much help as this site is for people coming to the U.S. Try these boards: http://talk.uk-yankee.com/ for info on how to do it the other way round.

Based on my research I came to the conclusion it is a mistake to leave any field blank. In the case of g-325a alien registration number, I put "N/A" for myself because I am a US Citizen and will never have one. For my wife, I put "None" as she does not currently have one, but will some day. There are a lot of people with a lot of opinions about when to use N/A versus None. You should use the one that makes sense to you after you research it. But I wouldn't recommend leaving the (or any) field blank.
