there are a few things you (or your husband) need for the interview besides the medical which, as germangel pointed out, you can do on a walk-in basis in Frankfurt. The consulate will inform the doctor's office that you might come by, and, unless you live close to one of the other places mentioned in the embassy-section, I would do the medical the same day. It takes 2-3 days for them to forward the results to the consulate but given the turn-over time of 5-14 days to process your visa, the delay doesn't matter.
You will also need a police report (Polizeiliches Fuehrungszeugnis) and it take a few weeks to get that. I would say to go ahead and request it at the town hall or the Ordnungsamt as soon as your case is complete. You can hand it in later, but that will delay the visa if not there in time.
As to booking flights, I've had fairly good experiences with booking flights two weeks ahead of time as prices seem to drop again at that point (even in the summer). So, if you book a flight after going to the interview you should be fine and you will know that you're not spending money on a flight you can't be on.
Btw, given your timeline in combination with germangel's, I think you can assume to interview at some point in August, which would mean that your flight could be in off-season again.

Thanks for the great advice. :) I spoke to my husband about the police report, he said he had to get one before from his city (Pforzheim) for his job and he was able to get it right away. Is that the same type of police report? (His last job was as a security guard.)

Should be the same, but they have centralized the issuance. That's why you have to wait now...

Pharmacist, that happens when you're faster than the NVC. We had the same thing happening a few months back and it turns out that they send out an RFE when your I-864 has been accepted but you haven't submitted the DS-230.

My advice at this point is wait for the letter they send out last week, and return the DS-230 with the checklist. Even if the other letter were generated by now, sending in the DS-230 without the checklist would mess things up because they need it to complete your case.

Sorry that you have to go through this, but you're almost there and hurricane season is still a few week off. Good luck...

Not to break any bubbles, but if you're doing CR/IR1, neither USCIS nor congresspeople are eager to investigate unless 180 days have passed (personal experience). I've no clue how long the wait for I-130s is these days, but I'd hope for you that you'll here from them before that time. Good luck.

Hello guys
this is my first time to post here ..It has been very helpful getting into this website and reading about other's experinces ..I thought I am the only one is suffering in this world since I miss my hubby alot and i am tired of the visa process thing and i wished if my husband wasn't and American ..
today early morning we have got an email from USCIS telling us that our case was approved of the I-130 and they sent us NO2 that's is amazing because today is my birthday what a nice thing to hear in my birthday but I am lost we are going through the visa process with no lawyer and I really don't know what is next I would like to know what is next and what ever i may read here I still feel lost I really don't know what we should do ?? Please tell me I need your help and support I am always worried because this visa thing ..i am afraid of anything wrong to happen and afarid it may take long I justwanna be with my husband and my soulmate ..
It's really hard to live away from the one you love most ..

I'm back, and because I had to wait in pouring rain for the embassy to be opened for 20 minutes, I have a cold, so I'll make this short.

The interview went ok. During the document-check the assistant complained that I didn't bring an original of my J1-waiver, but the CO didn't seem to mind. He first toook my finger prints.
He asked:
-whether my husband had been/lived in Germany before?
-how we met?
-where we got married and if I liked Wilmington, NC?
-what I was doing in the US when I met my husband?
Then, I had to take an oath that everything on the DS-230, part 2 was correct. After that we went over the I-864, and he asked some more questions:
-what my husband's job was and why he didn't make enough money?
-the name of my husband's mother and her job (she's our co-sponsor)?
-the name of my husband's father and his job and why my mother-in-law included him on the form even though he wasn't necessary?
That was it. No other questions, no proof of relationship. Then he told me that it would take them two weeks to send me the visa after receiving the medical results and the police certificate. I'm somewhat confused because I don't know if I got the visa or not, but that's what they seem to be telling everyone I talk to at the doctor's office.
My police certificate was in the mail today and I'm express mailing it tomorrow. I'll let you know when I find out what the outcome of the interview was.

Hey guys,

my husband interview is on Tuesday and I am soooo nervous. I am thinking about everything and wondering if I sent everything that was required. I thought about the AOS (mainly because I didn't send a copy with the items). I was wondering do I need to sent another AOS or will NVS send the original with the file? Do I need to run out now and fedex a copy?

I called my consulate about the AOS yesterday because they listed it as one of the things I had to bring. They said if my husband send it to the NVC then that would suffice. I'd assume that's the way it's handled everywhere, but if you want to be sure contact the consulate and see if they need another copy.

I got my interview date: March 31, 2006.

I'm shocked because it is so soon, and I'm unsure how I'm supposed to get everything together that they want.

I'm calling tomorrow to see if there is a chance to send them any missing documents after the interview.

They want an original copy of the I-864. Is that normal? We've submitted originals to the NVC and there's no way my husband can mail that to me again within 6 days given that it takes at least 10 days to get new copies of the tax transcripts. Any ideas?

Btw, called NVC and my case is in Frankfurt or someway close to it. They claim they mailed it on March 7; checking DHL revealed however that a letter was transferred to Frankfurt between 3/3 and 3/6. Nothing mailed past that, so I'm hoping that's my package. So hoping for an April interview (wait time is 4-6 weeks).

Sorry to hear that, but it not unusual for service centers to change speed randomly. I would, however, not call that a backlog. CSC is still way behind VSC and even if you wait 3-4 months for approval you're better of than those who go through CSC.

As to 30-60 days approval time, that seems a fairly low estimate for I-130s given that USCIS estimates 999 days (which is of course even more fictive). Good luck and I do hope you hear something positive from VSC soon.

Well, that's good. F1 visa means there are no conditions connected to the visa. So, you can marry her in the US and adjust status afterwards (I-130 + I-485). As long as her visa is valid, your future wife can leave and enter the country. Once you've filed for adjustment of status your then-wife will need Advance Parole to leave until she receives her green card.

Because your fiance has only been in the US for 6 months, there is still a slight chance that USCIS will assume she had immigration intent when applying for the student visa, so be prepared to answer questions regarding that in the interview and to produce evidence supporting her status as a student in addition to materials in support of your relationship. Since you do now plan to marry, your wife cannot extend her visa; she can however continue to study because this does not affect her student status as long as she stays in the US.

Your wife can continue working towards her degree and, if she has the permission in connection with the F1, to work on campus. While the visa in the passport will be deemed invalid while filing for adjustment, the I-90 (which is the USCIS-form documenting her status as a student) will continue to be valid until the adjustment has been processed and approved/denied.

If you prefer to marry abroad, you need to petition USCIS (I-130) so that she can reenter the country. This process, however, takes a while; you can get her back into the US more quickly if you also file for K3, but then you'll end up having to adjust her status again. K3 is normally quicker then waiting for I-130, but that is not guaranteed and it also takes a few months.

In short, marrying in the US will save you having to deal with an indeterminate-length separation; you would just have to adjust status afterwards. The alternative would be to marry abroad and petition for her return. To find out more about the immigration process check out the guides-section on the site (you can skip the K1-part since it does not apply).

Again, how to proceed depends on the type of visa she holds currently. There's more than one student visa category and the differences between both are significant. Hence my question.

There is a slight chance that she will be unable to adjust status, and once she's married, she will also not be able to get another student visa (marriage to a US-citizen counts as immigration intent) which would mean she cannot travel at all anymore.

The other important question would be how long she has been here on her student visa and if she received the visa before getting engaged?
