Removing Conditions on Residency General DiscussionEnough evidence, hopefully?!

You need a lot more than that or your are begging for an RFE. Here's what I submitted.

http://www.visajourn...etter-evidence/

Well we sent it out so whatever else they want I guess I'm going to have to pull out of my ####. We are both in our early 20's and have nothing to our name. I think you all think it's so easy to just provide them with all of this information. It's hard to get started in life when I am disabled and my husband has never even had a steady job. I'm glad for all of you but when it came down to what we tried to send it was frustrating.

We are sending out my husbands stuff tomorrow for Removing Conditions. This is the following that we have:

Tax transcripts for this year
Photos
Greeting Card for our second wedding anniversary
Bank statements checking and savings

unfortunately that is all we have. I know it doesn't seem like much but it's hard when we dont have anything. Opinions?

US Embassy and Consulate DiscussionChina: P2 to Interview averages 6 months

Here is combined data from VJ and a Chinese site,

http://001family.001.../interviews.asp

I combined them into one spreadsheet. While 4 1/2 months is possible, 6 months seems more likely. And with the longer delay (CSC to NVC) and the upcoming holidays, I fear it could stretch out a bit.

US Embassy and Consulate DiscussionI-134 Question
QUOTE (Anh map @ Mar 18 2009, 09:17 AM) <{POST_SNAPBACK}>
You need to submit the most recently filed return. As long as that shows income equal or above the 125% figure you are ok. I-134 is just for the K1/K3 process. It "dies" at AOS.

For the AOS you will complete the I-864. Same income requirements. A more binding obligation for the sponsor.

Thanks for the reply. Which of my many "incomes" is the one the evaluate? My company gross? My company net profit? My personal draw from the company? My taxable income? I write off as many of my living expenses as I can, so this becomes important to know. Any advice from the experts?

Thanks!

US Embassy and Consulate DiscussionI-134 Question
Hi All,

I'm wondering how best to complete the I-134. I'm self-employed and I can choose between this year and last year's tax return as I haven't filed this year yet.

Last year I had a higher personal income, but less gross income. This year I have much lower personal income, but 50% higher gross revenues. Which will best suit the I-134 form?

Personal income was lower this year as I did a better job of sheltering my income in business expenses.

Thanks much

Darren

Quick questions:

1. Is your wife already in the US on an F-1 visa? If so, is the visa still valid?

Yes, she is currently in the US on a valid F-1 Visa.
The visa expires in December

K-3 Spouse Visa Process & ProceduresMarrying F1 Student Paperwork
Hi All,
My Wife and I got married on October 2nd, and are sitting down to file all the paperwork.

So far we have the I-130, the I-485, and the I-765 (employment)

We got most things filled out but there were a few things we were unsure about.

First was the Alien Registration Number, is that the number from her entry form stapled in her passport (I think its the I-94)?

Second, is the Alien Receipt Number the same thing?

Third is the name change. She has not changed her name yet anywhere, but is this something that she should do before she files the paperwork.

Things she would need to change in the US would be: SS Card (for a student employee), State ID, Banks, etc.

She has her F1 and her Visa in her old last name, would that need to be changed now before the paperwork? and if so, i believe that she would have to leave the country, which I understand could cause more issues. (let alone its over $1000 for a plane ticket)

There is paperwork that she can change her name on her visa once it is approved, and this seems like it would probably be the best option, but if anyone has any more insight, that would be very helpful.

Forth is when filling out the I-765 (employment form) and Question 16 asks for the Eligibility, the would it be considered an F1 student? or what should I choose?

Also, when submitting the I-130 and the I-485 concurrently would we send it in the same package? or in seperate packages to the same location?

National Visa Center (Dept of State)Are we done with the NVC?
No. Unless you're considering pursuing IR-1 after approval of your petition (I-130). Then your wife would have to travel back to her home country to get another visa. The NVC will contact you when they receive your I-130. Send out the enclosed DS-3032 and make sure to indicate that you don't want to proceed. Otherwise, you'll end up facing a delay because the approved I-130 will not be send back to USCIS.

Otherwise, it's USCIS all the way (except for EAD, I think)

Good luck!

National Visa Center (Dept of State)NVC loses documents

*hugs* you are almost there. What if you give them a call again and ask about sending in the birth certificate...see what they say. In general NVC seems to be pretty spot on compared to the service centers 'misinformation'...despite this ####up

I know. I was quite impressed with the NVC until two days ago. It turns out that they sent 2 RFE's on the same day, both asking for the same information. My husband called them about it, and they said we just needed to return one of them. So he will now just mail the second RFE with the copy of the birth certificate and hopefully that will rectify the problem they're having. Keep your fingers crossed...

National Visa Center (Dept of State)NVC loses documents

shute.....that sucks. I'd be hopping mad too. Not exactly sure that there is much you can do but wait on the document search. Perhaps someone else has an experience with same and can advise. One could possibly send in the so called missing documents with a cover letter explaining what has happened and that would be that but then again it could mess up their good records system //sarcasm

Thanks, Lorelle(?). I've thought about sending them another copy of the birth certificate but I'm afraid that will screw things up even more. I just so don't want to deal with this whole #### anymore...

National Visa Center (Dept of State)NVC loses documents
About a month ago, we got an RFE because the NVC was missing the DS-230 and the birth certificate of our co-sponsor. My husband send both on January 30 and the NVC claims to have received the checklist on Feb 7.

However, my husband called them yesterday, and now they say they didn't receive the checklist letter or rather that the the birth certificate was still missing because we didn't send in the checklist. When my husband asked the if they had received the DS-230, they said yes, but they didn't seem to be aware that the DS-230 was sent with the checklist (we were instructed to do so) and so according to them the checklist is missing which is why they didn't contact us. The woman at the NVC said she would now put in a request for document search and it would take 2-4 weeks to be processed.

I'm extremely angry and upset by this negligence of the NVC especially since they told us the last time we called that they had received everything. Is there anything we can do to speed things up?

National Visa Center (Dept of State)Federal tax info release authorization form
You can find the form here. The exact link is in the section entitled I-864. You will need to chance the information to fit your case.

As to who needs to file it, anyone applying for a CR1/IR1-visa. It's part of the I-864-package that you receive after paying the Affidavit-of-support Fee-Bill.

Hope this helps and good luck.

National Visa Center (Dept of State)I-864 Form
Just wait a few more days. The NVC is sometimes a little chaotic, so don't worry about it. This just means you'll be done more quickly if you're lucky.

If you don't get the I-864 2 weeks after they mailed it, give them a ring. Or you can self-generate using James' Shortcuts...

National Visa Center (Dept of State)Husband robbed!

Can we just down load the I-864 forms, make the corrections , provide the tax transcripts asked for and send it back without the RFE checklist letter and correspondence. We do have the barcode sheet . It was not in the bag. Delayed again!!!

Thanks,

Mermaid.

Sorry to hear that happened. You can certainly print out the I-864, make the necessary corrections and get everything else together, but you can't send it in without the checklist letter. However, you might want to check James' shortcuts and see if there's an explanation on how to do RFE-letters. Alternatively, you can of course send in the amended form with an attached letter explaining the situation. Make sure to include your case number visibly on every page though.

When you're husband calls on Monday, he should ask what the quickest thing to do would be.

Good luck.

The NVC is weird when it comes to items sent without the necessary cover sheet; they claimed not have gotten a BC from us because they had sent out two RFE's with the same checklist and only looked at half the documents we returned. Just wait for the RFE; it's unlikely they will match your passport copy to your file.

National Visa Center (Dept of State)Update: RFE before DS-230
I posted in the old forum that we had received an RFE before receiving our DS-230. Well, it turns out they had reviewed our I-864 and were ready to move to the last document even though they hadn't generated it yet.

The RFE contains the DS-230 as well as a request for a birth certificate for our co-sponsor. Otherwise, the I-864 seems to be ok. It also states that we need to send back all documents requested using the cover sheet of the RFE which is truly awesome because the DS-230 is still not generated and this allows us to save more time.

Just thought I'd post this update since several of you have received a similar request.

K-3 Spouse Visa Process & ProceduresSeeking for advice- EAD card
I would call your local USCIS-office or if necessary the national number and ask them. While you're right that your switching your status, you will officially remain in you current status until your interview. That is also the reason why people adjusting status from student visas continue to be subject to SEVIS-fees.

Good luck!

K-3 Spouse Visa Process & ProceduresAffidavit of support
I would start getting it ready as soon as your husband has filed taxes for 2005.

Consulates will insist on including the return of the most recent calendar year after April 1. Because it is highly unlikely that your case will have been processed before that, you will need to include the 2005 return.

I read somewhere on the USCIS-website, that they are now accepting an affidavit of support for only the recent tax year. Check on the and see if it applies to you. If it doesn't make sure that your husband has his last three tax returns and W2s. If for some reason, he doesn't have them he can order transcripts from the IRS and get replacement W2s from his employer. He will also need a letter from his employer, but I would wait on that and the notarization until you know that your petition has been approved.
FischkoepfinFemaleGermany2006-01-30 07:26:00
K-3 Spouse Visa Process & ProceduresLetter to Consular
Ditto. The letter is way too long and goes into too much detail. If you feel the need to proof your relationship, send some pictures and proof of communication between you and your husband (phone bills). If you think a letter is necessary think of it as an introductory letter.

Something like this:

Dear Sir or Madam (chances are that fits better than consular),

I am sorry that I am unable to be present at my husband's interview. I have enclosed supporting evidence proving the authenticity of our marriage.
Thank you for your time.
Sincerely,

Signature

If you absolutely feel the need to say anything else, keep it to less than one page. Also, if you for whatever reason think it's important to keep the contents of the letter from your husband, sign it on the back after gluing it shut.

Good luck.

P.S.: To everyone, why would you need a letter for a K3-interview. I thought only K1 needed to provide proof of relationship???
FischkoepfinFemaleGermany2006-01-29 10:00:00
K-3 Spouse Visa Process & ProceduresI-864

First, You actually need to submit your 2005-tax return if your petition goes through the NVC and to the embassy after April 15.

Is this documented somewhere as my interview will more then likely be before this date and all that I have been reading on various sites has led us to believe we can submit 2005

Not sure if it is possible, but I've read on the DOS-website that they will not require it before that date. I'm worried about that and hope my interview is before April 15 because I have been filing our taxes forever now, and I don't want to burden my husband with it.

I've read though that the most important thing is your current income because it is more an indicator of your sponsor's ability to support you than previous tax years.

USCIS has actually changed the rules for the I-864 so that only the last year is required, but I'm not sure if this applies to the consulates who seem to be doing their own thing anyway.

Sorry to spread confusion...
FischkoepfinFemaleGermany2006-01-31 08:45:00
K-3 Spouse Visa Process & ProceduresI-864
First, :time: .

Then, the answer to you question depends on where you are in the process. You actually need to submit your 2005-tax return if your petition goes through the NVC and to the embassy after April 15. If the consulate in Thailand accepts the 2005-return before that depends on the Consular officer (CO) interviewing you. That said, the CO will also determine whether you need a co-sponsor or not. While most of the time, the last tax year would be most relevant in this decision, this is not always the case.

Looking for a co-sponsor probably won't hurt, even if you don't need one in the end.

K-3 Spouse Visa Process & ProceduresToo Long?
I wouldn't worry about it yet. If the embassy mailed off your petition to TSC on or around January 30, the chances are that it has only arrived at TSC recently. It takes TSC a few weeks to enter the petition into their system and process the payment. They also used to forward all I-130s from US citizens from TSC to CSC, which tacks on another few weeks. Still, you'll hear from them soon...

Good luck!

Do the medical in Germany. It's only €125 and you can do it on the same day as the interview...

No idea if they would accept Danish medical in Frankfurt. Give them a call at their normal number (check consulate info). They're open from 2-4; they're really slow in picking up the phone, so be prepared to let it ring for a while.
