What if i go to the Interview for K3 and dont travel?? I know there is an expiry on the K3 and would it affect my CR1 application?

I don't think so. The K3 expires in 2 years. If you don't activate it, there shouldn't be a problem because it is finally up to you. And if you activate it, there shouldn't be a problem either; otherwise other people couldn't go back for their CR1-interviews after entering on K3.

Your CR1-application will be continue to be processed regardless of your decision. However, if you decide to continue with CR1 you can't change your mind later that easily, meaning it will be more difficult if not impossible to adjust status in the US should you enter on K3 and decide to stay.

Almost certain. IR-1 visa holders are lawful permanent residents, which have a ten-year green card. I read around some and I didn't find any different information.

That is up to you. It doesn't really make a difference if you still go for the K3 or not. Processing the petition at the NVC can still take 2-3 months and then you'll have to wait another few weeks for the interview. So if you can wait that long, you could cancel the K3-interview.

If you go for the K3-interview, however, you can travel to the US and wait for your CR-1 to reach London and you go to the interview there rather than filing for AOS. Doing so will most likely be quicker than waiting for EAD and green card. There are a few people on here who did just that.

If you're married for two years why didn't you get an IR-1 visa?

But to be less skeptical, you can still enter the US on your visa, and you probably should in order to save your marriage if at all possible. Whether you can stay doesn't really matter at this point, because your wife is the reason you planned the move, so if she is not willing to mend the relationship then there's not much you can do.

If you have a CR-1, you will be granted conditional residency for two years, after which time you need to file for removal of conditions which will be difficult if you're not married anymore at that time. If you're on an IR-1, you shouldn't have any problems staying in the US given that you will receive a GC after arrival. I don't know if there's anything your wife can do to cancel you visa, but other than informing USCIS that your relationship has been terminated there's not much she could do, and even then it would be questionable if that would change anything unless she claimed fraudulent reasons.

The first thing you want to do is send your wife a copy of the DS-3032. You can find it in the NVC-section of this forum by searching for "James' shortcuts" or by going to NVC-timesavers (it's post #5). You need to make sure that your case number is on the DS-3032. It's probably easiest if you become the agent because it means that the NVC will contact you for the fees and forms.

To China, you can take the DS-230 (also to be found under the link above), which you wife needs to fill out; if you take it back with you, it will speed things up. You, as the petitioner, will need to fill out the I-864 (affidavit of support).

Other than that, there's not much to do for the NVC. It might be a good idea though to help your wife collect the evidence necessary for the interview (photos, phone bills, and whatever else can be used to support your relationship).

The question range from simple to more complex. Your wife should be prepared to answer question concerning you and your source of income, your family (names, jobs, and the like), how you to met, when and why you decided to get married and so on. Your wife should also take evidence of your relationship to the interview; anything that shows that you've spent time together (like wedding photos and other pictures), and anything that indicates that you are currently communicating (letters, emails, phone bills, etc). If available, you can also bring anything that shows that other people (family, friends) know of and acknowledge your relationship.

In short, your wife needs to be prepared to convice the consular officer that your marriage is genuine.

hey once i generate a barcode, can i just make 19 copies of it? and cut it out and glue it wherever necesary? or will each page need a different size?
i will need a barcode pasted onto:

To answer your other questions:
You don't need 19 copies of the bar code, but 1. Every form requires a different size. Please make sure to read the instructions in James' shortcuts(under #5) carefully before continuing; you need to understand the order of documents sent to the NVC. Also take a look at the NVC-flowchart, which will give you an overview of the two different tracks at the NVC.
1. DS-3032 does not need a cover letter.
2. Yes, but different size.
3. Ditto.
4. No. But you need to write the case number on every page.
5. Get started on the I-864 after finishing the AOS-fee bill. It will take the most time of all forms. You can assemble the DS-230 package after sending in the IV-fee bill.

Yup, they do. They get more picky later on, though. If you're planning to use James' shortcuts try option B or C, just to get used to making your own barcodes. If you have Acrobat Professional (assuming DS-3032 is a pdf), you can also paste the barcode from the program. It needs some resizing but it looks great.

They don't tell you unless you specifically ask. We only found out that the I-864 for ok when we got an RFE for the missing DS-230 (which they hadn't mailed to us yet).

You should hear fairly quickly if things are not ok, though.

I think my husband used ACCO fasteners for copies of the return because he had over 60 pages worth of paper work. So far, NVC has not complained.

ditto - I believe I even read on one of the USCIS pages to not staple anything but I could be wrong

USCIS doesn't like staples, but the NVC actually includes stapling guidelines. Maybe that's why they're so much more efficient... :P

Hi,

Our case was completed at NVC on Feb 6th and we're still waiting to hear about an interview. I understand that NVC assigns the interview dates for Montreal, but I have heard some people make mention of a "checklist" that we need to send to the consulate there. Where/when do we get this checklist, and will they assign an interview date before or after we send it it?

The checklist is part of package 3 for K1 and K3. Since you are applying for CR1/IR1, you will only receive the interview letter aka package 4. There is a list of documents that you need to bring to the interview in the package, but it is not really a checklist.

I have no idea how long it takes to schedule an interview in Montreal, but unless it takes more than 90 days, I would go ahead and request the police report as soon as your case is complete at the NVC. At that point, you can also do the medical. In most places, it takes a while to get an appointment with one of the embassy-approved physicans, but you should have enough time to get the results before your interview.

It is, however, possible in many locations to the medical on the same day as the interview on a walk-in basis. To find out if that is possible in Montreal, take a look at the embassy section on this site. It is also possible to go to the interview without the police report, but your husband will not receive his visa until all the documents are at the embassy. So, based on your time frame, wait for case completion , and then go ahead and schedule the medical and request the police report.

you should get some teething tablets for Zaid. I'm not sure about where u are but where I live they sell these all natural teething tablets that I used for my kids and I swear they made my life soooo much more bearable when they were teething. You should be able to get them in the grocery store and any pharmacy.......I'll try to remember what they are called. Hyland's teething tablets...........they totally work!

Yes I saw that on the news...........the child is considered a canadian resident since they were in canadian airspace. We've been extremely busy at my work this past week.......everyone trying to have their babies to get that tax deduction......lol.
Sorry to hear ur not feeling well. My husband has that same cold right now and he sounds awful. I hate it when he's sick! Drink lots of hot tea & vicks does wonders for ur nose......
